Farrell and Seldin Misrepresentation?

I was working with debt settlement company. One of the debts they were handling was turned over to Farrell and Seldin. My settelement company was negotiating for 2 years with them and now they claim to be representing Discover - they have an affadavit on the loan and the amount from DB Services - who supposedly is an affiliate of Discover that keeps the records. THey also say they will have a phone witness from OHIO - but they don't state who this witness represents. It is not clear to me if they are really authorized by Discover to sue me or if they are working for a collection agency that has bought the loan. I go to pre trial in September - if anyone has any advice that would be great.

Has anyone dealt with an attorney named David Anderson at Ferrell and Seldin? Has his behavior been unusual?

One thing you could do is ask them to show you proof that you owe the debt. Usually they bought the debt in a package with other debts and they don't have your original paperwork. If they don't have the original paperwork, they can't prove that you owe the debt. A printout of what you allegedly owe is not proof of the debt and they won't be able to win. But if you do not show up in Court in September, they can ask the judge to enter a default judgment against you for the total amount they are suing you for and they judge will do it if you are not there to defend yourself.

Farrell and Seldin Credit Collection Bad Information

I went through a nightmare with this vicious collection company for a mere $244. They went through court proceedings and obtained a judgement against me for the $244. I promptly paid Farrell and Seldin immediately, my balance was zero and they confirmed this in writing. It is now 8 years later and the judgement has still not been updated in Centennial CO courts. I have sent numerous letters to the courts and Farrell and Seldin. The courts always point me back to Farrell and Seldin, they claim that the courts must be notified by Farrell and Seldin to update the Judgement.

I have literally begged for them to update the status of this judgement and they will not help me...

Thanks for posting. Many people are fighting them even now. Curious to know more about your case. Contacted the FTC, AG's office and plan to fight here in NM, others are fighting in Co. If you can ad or update anything please do.

Farrell and Seldin Claiming they are in house counsel for Credit Card Companies

This company needs to be shut down. They submit frivolous lawsuits and they also submit frivolous notice of appeals. Their lawyers claim to be in house counsel for what ever credit card company they have bought old debt from. They also do not understand collection laws. I want someone to investigate this company to see if they have a debt collection business license to operate in New Mexico

The only thing to do is fight them at arbiration level and beat them at their own game. When I confronted Kenneth Oh about claiming he was in house counsel for Chase bank, he was very bewildered. I told him to prove it and he couldn't... This and many other reasons is why I won arbiration. But now they are tryin to reopen the case and take the same information they lost with back with the court system. I delivered answers to the court to enforce the judgement.
They may be licencse attorneys but are they licenced to do business as a debt collector? Also remember they must has a contract between the original creditor and thier business in order to pursue this action.

Thank you for checking. I know they claim they have a license but it is only to practice law: which doesn't cover the debt collection portion of what their company does. I am trying to put together a packet to submit to the NM General Attorney and I hope anyone else who has encountered this company does the same. They really are unethical and need to be shut down.

Farrell and Seldin are a bunch of idiots. Everyone needs fo file complaints with the State Bar of New Mexico ( www.nmbar.org ) and the State Bar of Colorado ( www.cobar.org ).
They need to have their law license suspended and/or revoked.

Well, Farrell & Seldin filed with the court 5 days after receiving my debt validation letter as well as sending a Notice of Settlement Offer letter the same day. I wrote out a 3 page answer for the court. Two of those pages are violations of the CARD act of 09 and FDCP act on various counts. It's worth the $92 bucks to file with the court. Those s-o-b's have violated the law on so many levels and I will fight them in court. Does anyone have any advice before I submit my answer?

Sorry, I have been reading so much to defend myself, I am really skimming. You did consult with an atty. I have gathered tons of info on their misdeeds. Be happy to forward it on. I have complained to the FTC and will posting complaints to the CO and NM AG's offices. I need a scanner/copier big time.

Hi,
I am a guest and just got served a summons from Farrell & Seldin. This is my first time hearing of the company. A week prior (after 2 whole years of no correspondence) received a statement from Capital One. I find it odd that I would recieve a statement 2 years later, then all of a sudden get a summons. The court does not have a case #. I requested a written validation and sent the letter to Cap1 and Farrell & Seldin c/o Ian Ballard. Cap1 charged off my debt and the statement and summons are saying two different amounts. I plan on going to court and will file my answer later today. I will not meet with Ian and will make him go to court if that's what Farrell wants. I had tried to settle with Cap1 and my attorney told me to disregard since they weren't working with me. I only owe $274 on a $300 limit and would be happy to pay that amount. Cap1 refused and say I now owe $895 and Farrell states I owe $795. I sent my DV certified and will expect an answer. Reading these really helps a lot!

I was helping a friend who had a charge off from Sam's Club, he wrote to GE Money Bank to inquire about the debt since he was applying for a job and needed proof that he was making payment arraignments. He got 2 letters in the mail today. One from GE Money out of El Paso dated June 20 with the acct # and amount due. Another from Farrell & Seldin dated June 22, acct number, same amount due, saying they represent the above referenced creditor. Please tell me what F&S is up to! Is this useful information? Something is truly fishy. Calling the AG Monday!

Hi Alice44,

I will certainly let you know what I find out, though I'm wondering if the request for clarification that I sent off to Adrian Martinez has been kicked over to a lawyer's office or the AG's office to get some legal advice on the matter due to the time that has passed. The more I read the case law regarding debt collectors and debt collection attorneys, the more I'm convinced that the letters that they have sent out are, in fact, a violation of state law. If I don't get a response soon, I'm going to send out a complaint to both the CO and the NM AG's offices as well as both state's bar associations. This complaint will include far more than just the violation of that one state law, however, and it will be backed up with plenty of evidence. Every indication is that these guys are ### who rely on a high volume of default judgments where the defendant does not respond to make their money. They don't care about due diligence, they just care about being lawyers who know how to file a very large number of lawsuits.

Questions to anyone here:
1. Does anyone know if there is a time limit on being served after a complaint is filed with the court?
2. Has F&S ever failed to properly serve and gone ahead to get a default judgment when the person has not been served.

That other person would most likely have been me. The statute specifically states that there exceptions to those who need to be licensed, but it is somewhat vague as to whether or not Farrell and Seldin must be licensed. I'm leaning towards that they do need to be licensed for all of the standard debt collector letters that they send out, especially the ones that say "Your case has not been reviewed by an attorney, " but I am not a lawyer nor am I intricately familiar with case the case law regarding when an attorney-at-law is legally considered to be acting as an attorney in the state of NM. If I find that I am correct, I will file a formal complaint both in NM and in CO.

Farrell & Seldin are not licensed in NM as Debt Collectors. But may not have to be.
I called the NM Regulation and Licensing Department yesterday. Marie phoned me back this morning. There are no records indicating that Farrell & Seldin is licensed in NM as a Debt Collector. In my message I mentioned Farrell, Seldin, Oh, and Tallman specifically.
She said that she believed that according to the Fair Dept Act Section 61-18A-2 and 6, F&S would be exempt from being licensed in NM as debt collectors.
All the letters they have sent include these statements: “please be advised that this firm represents the above creditor” and, “This communication is from a debt collector.”
Marie also said that someone else had called today asking if they were licensed in NM.
I have included the web site and phone numbers of the Department. She also advised me that Adrian Martinez is acting director at this time and it might help to contact him for clarification.

Farrell and Seldin Lawsuit

Been paying agreed terms of Citibank account. One month behind due to medical bills. Sent in payment and it was returned/rejected by Farrell & Seldin.

[protected]@gmail.com, can you post a response again as to what you did with Farrell & Seldin or what can be done if they contact you? I've been paying them $150/month for a Citibank debt. They too petitioned me to go to court before I agreeded to their terms. What can I do now? I missed one month and they sent a letter saying I was in default. I sent a payment anyway and today, they sent it back to me saying they can't accept the money order? what are my options trying to get a payoff? I've tried that with them too to no avail? Now I'm afraid they will garnish wages?
