Ms. Peden,
Please be advised that I am sending you this message regarding a disgusting complaint you filed here on this site that includes my name. Here is the post:

Lewis Victor and Mike Martoe have called me a number of times to harrass me. They threated to sexually abuse me, to come to my home and other harmful things. I was also never paid for the work that I did when I worked for them. They claim I never worked there even though they sent me packages and emailed me new hire papers. I have the phone records to prove they did call. They need to be put out of business and go to jail for making threats.
Now, I can only speak for myself. I, Mike Martoe, did not ever have a conversation with you, unless you were hired by our Firm. In which case, I would have only spoken to you briefly to confirm start dates, contact information, etc. I have NEVER personally spoke to you in the manner you describe in your complaint. You lied. You have embarrassed me, personally, and my family that bears the same name.
I have secured legal council in both Palm Beach County, Florida and Knox County, Tennessee. I have also written a letter to Tennessee's Attorney General & Reporter, Robert E. Cooper, Jr. I plan to sue you, personally, for maximum punitive damages allowed by the law and defamation of character, among other lawsuits I plan to bring upon you unless you tell the TRUTH. I plan to follow this matter through to the fullest extent of the law. I have unlimited resources to do so and will not stop until you tell the truth. You know I never spoke to you, especially in the DISGUSTING & REPREHENSIBLE manner you casually described in your complaint. Yes, I am furious. And you would be, too.
However, if you choose to amend your complaint and tell the truth, I will cease all legal proceedings towards you. Please take this matter seriously, as you have made a very serious error in judgment and that carries with it serious consequences. I will give you a short amount of time to remember your thoughts that provoked you to use my name in the above complaint and correct or delete my name from your post. Otherwise, the Knox County Sheriff's office will visit you and your family to serve you papers. Again, understand this: I HAVE THE LAW ON MY SIDE AND I WILL NEVER EVER STOP UNTIL YOU TELL THE TRUTH AND ELIMINATE MY NAME FROM YOUR COMPLAINT. I have a wife and children and what you did was wrong, unfair, unlawful and punishable by the law. I pray, for you, that you do what is right.

I spoke with you a few different times regarding Luis making those remarks to me. You then said you had never heard of me, had no information on me, which is clearly untrue since you have my cell phone number. You said that I was a liar and I was never involved with your company. I have clients that I can speak with that I called from their office to ask prices to you personally for. You are the liar. We both spoke with a detective of the Knox County Police Dept because I have phone records proving it. The detective simply said that he would advise both of us to have no further contact with one another of which I have had ZERO contact with you since that message. I have all the phone records needed to prove that you and members of your office have called me as well as witnesses and a 911 tape to prove I was harrassed. I am not taking this claim down as it is truthful.
As I have told you before, I am NOT SCARED of you and your company's tactics to try to scare will not work. I have the means to sue you just as you claim you have the means to sue me. Basically it is money fighting money. I said in the last phone conversations with you and with the detective I WANT NOTHING TO DO WITH MIKE, LUIS, OR THIS COMPANY. I DEMAND TO BE LEFT ALONE!
Turn about is fair play. I can in turn sue you as you have called me a liar. I have not lied nor do I gain anything from telling my story to warn others against your company. I do not make threats or speak poorly of people that are not a fault. You and your company and some of it's employees have participated in bad business behavior when you allow an employee to speak to another employee in that manner. Then you try to lie and say you know nothing about it. I do not want your prayers as you are the one that really needs them. I feel sorry for your family if they live with someone who can treat people in this manner or allow their employees to treat people in this manner. I have witnesses to corroborate that I have been truthful from day 1. I have phone records from where I can show that I had calls from your company and a 911 call that I reported the incident when it happened. Do Not Contact Me Again. I say to you again I want nothing to do with this company or you ever again.
If you want to waste everyone's time to sue then I will be happy to prove that I did not slander your name. I have evidence to prove it. I have not even thought about this riduclous company since this was written, clearly if I were out to defame your character I would have gone to great lengths to do so. That was not my intention, I just wanted to warn other people how this company treated people. |

My words are not meant to threaten or scare you in any way. Here is the lie I am referring to in your complaint:

2.) "They need to be put out of business and go to jail for making threats."
These are lies. I, MIKE MARTOE, NEVER SPOKE WORDS TO YOU THAT YOU CLAIM IN YOUR COMPLAINT. MY VOICE NEVER UTTERED THAT KIND OF SMUT INTO YOUR EAR. THAT IS A LIE. THAT IS SLANDER. THAT IS DEFAMATION OF CHARACTER.
In addition, you make direct reference to my family in your rather cavalier response to my rebuttal. I ask you never ever make reference to my family in any way - EVER. I have not done so to you, nor will I.
Have your attorneys look at what you and I have posted here. I will be happy to have my legal team speak to your people any time. I have a signed petition with almost 140 signatures on it speaking on behalf of my character and my job responsibilities here. If someone here spoke to you in the manner you claim, they deserve to be reprimanded by their superiors - not me. I am in charge of sales. I oversee the producers who are out in the field selling consistently. You were not one of them. So we never spoke. And, if we did, I am not surprised I did not remember you. You never officially 'started' with the company. You never sold any advertising. Why? That is your business. You also requested I not contact you via phone, which I will respect.
REMEMBER, THE TRUTH IS ON MY SIDE. I, MIKE MARTOE, NEVER EVER THREATENED OR SPOKE TO YOU IN THE MANNER YOU CLAIM IN YOUR COMPLAINT. THIS WILL NEVER EVER GO AWAY UNTIL YOU TELL THE TRUTH ABOUT THAT PARTICULAR ITEM. I WILL GO TO WHATEVER LENGTHS THE LAW PROVIDES TO SEE JUSTICE IS SERVED HERE. You have slandered my family's name, committed defamation of character and are responsible to me for punitive damages allowed by the law. (by the way, an attorney is over my shoulder as I write this).
Please tell the truth and this will all go away.

Here is an excerpt from an email I received from Ms. Peden and I think this proves my point that she did in fact lie, meaning I never spoke to her in the manner she described in her original complaint. Since she will not take accountability for her own wrongdoing, I will accept this as an apology:
To Whom It May Concern:
I worked for this company only a few weeks but when they did not pay me for the work that I did I chose not to continue my employment.. At that time I was called and harassed by Victor Lewis my supervisor at the time. He asked for materials to be sent back along with the people I met. I explained to him that I had given him the list of people and I had no other materials except for the folder. At this time he proceeded to cuss me and then threatened to "stick his dick in my mouth" if I did not give him what he wanted. I asked if he was threatening to rape me at which time he replied "I will do whatever it takes to get my money's worth out of you. I know where you live and I will come to your house." I hung up on him and called 911 to report the crime here in Knoxville, TN. I also called the office and asked to speak with Victor's manager and was given Mike Martoe. He claimed he had never heard of me before...
Apology accepted. Next time get your facts and names correct. Thank you.
