I shamefully admit, I'm ripped-off by the GoWin Sotware Company.
I purchased some software from them which should enable you to consult a database with soccer statics, league tables, results etc. That's a nice concept if you're into soccer.
Only the bloody software doesn't work. I made some screen recordings which prove that and posted them here.
I should have known perhaps, because none of the links to "Terms of Use" or "Privacy Policy" were accessible. And they really didn't give any real support. One e-mail with the advice to reinstall the program or reinstall Windows.
Also the "License Agreement" which shows when installing their software is in breach with EU COUNCIL DIRECTIVE 93/13/EEC of 5 April 1993 art.3 point 1. "A contractual term which has not been individually negotiated shall be regarded as unfair if, contrary to the requirement of good faith, it causes a significant imbalance in the parties' rights and obligations arising under the contract, to the detriment of the consumer." Since, interpreted, their license agreement states that they have no obligations in terms of support or what so ever and you as customer have no rights.
They have been holding me off. At one point they even requested a copy of a photo ID and a copy of a recent utility bill of me. I still don't know why.
If it were 1 January 2009, I could easily file a lawsuit in my own country against them for a small claim. Because then the EU directives to ease the way for small cross-border claims come in effect. For now I think I'll have to sue them in the UK, I guess, since their headquarter is stationed over there.
It comes down to the point that I feel victim of a daytime robbery and the culprits are getting away with it. Their lute? £ 169.38. Quiet a setback just before the holiday season...
