We hired Dani Schreiber d/b/a Spa Rite to clean our hot tub on a monthly basis. After a few months of doing so, he recommended that we replace the cover on our hot tub because it was beginning to leak. We prepaid for the new cover and installation, which was a total of $815. Obviously, we shouldn’t have prepaid, but we thought we could trust him because he had been working with us for a few months with no problems. We were also often at work when we came for the service so it was just easier to prepay rather than having to make sure and leave a check on the day he completed the installation. Anyway, he never delivered the cover. We began to call him regularly and leave increasingly aggravated voice mails. He refused to return our calls. We then sent two demand letters via certified mail. Once he received the second letter threatening a lawsuit, he finally called, said he had spent our money and promised to repay it within the week. We reluctantly
agreed but never received the money. He has not answered or returned any of our phone calls since then.
