Santander Consumer USA Unfairly over charged

Charges that are unfairly added to my payments with holding my payment a day or 2 after I'd make a payment on time so that they could add interest fees on top of the car loan that some how is almost the price of the car loan the total cost almost doubled I never missed a payment and when I signed the paperwork for the car at Frank Kent I was told that Santander would send me the copy's of the paperwork in mail tryed for a year to get the paperwork from both frank Kent and Santander they would say its on its way then never got anything no information about the car was ever given to me about 4 days after I bought the car I had went to the dealership and ask to speak to who I bought the car from and I was told he no longer worked there and that they can not help me because they wasn't the person who sold me the car that I'd have to call Santander so I did many times without any luck so I pulled up my credit report in order to find out information about my car loan and found out that they was charging me 17.8 interest when I bought the car the salesman sold it to me with a 7 percent interest at a monthly payment of 532 a month for 74 months the car was brand new I'm the first owner after the down payment I owed 22, 000 and payment 534 a month for a year and they only applyed 1100 towards paying off the car all the rest was being applied to the extra 10 percent interest that was added to the 7 my credit score has suffered from the with holding my payments a day late and I was told if I turned the car back I'd never be able to buy new car after having a big hit to my credit so now instead of a 22, 000 74 month pay off I'm lefted with a endless nightmare and a 48, 000 pay off . Can you please help me expose them for the criminals they are. I'm young this was my first big Purchase and I was screwed over by a misleading sales man that disappeared with all paperwork on my car and a left me with a company like Santander with out any info to bleed me blind .

Santander Consumer USA Car loan overcharged amounts through telephone payments/bank account

In October of 2018 I purchased a 2019 Hyndai Accent from the Hyndai Dealership in Las Vegas, NV
I traded my Mercedes Benz Truck and was given $1,000.00 towards the down payment which should have been applied to the purchase of the accent then there was supposed to be rebates on the accent so the car should have been sold to me at a lower amount instead the way the numbers we're implemented in the contract the balance came to $20,000.00 and I was given 45 days to make the first payment I didn't receive a coupon booklet, a telephone call, or a letter informing me of where to send my payments to it dawned on me one day that 45 days had pasted by so I called Darelle the finance manager and I asked him for a telephone number to the company that financed my car he gave me the number to Santander, Consumer USA I called and spoke with one of their customer service representatives I gave them my first and last name and the last 4 digits of my sociol security number the customer service representative stated that I was almost 1 month past due on my car payment the payment is $531.00 so walking into the loan Santander wanted a double payment I replied no mam this isn't my fault that Santander had the wrong address/information she stated that she would make a note of it but still wanted the payments I paid the first payment I recall in January then after the payments we're made I continued to run at least 30-60 days behind Santander charged me astronomical late fees I made several payments through my debit cards over the phone payments and through my America First Bank Account. On my experian credit it states that my balance is $19,463.00 dollars and I've paid $10,000.00 plus my balance hasn't went down only about $600.00 of my hard earned money has been applied to the loan. Santander has caused me major headaces calling me over excessively, sending letters in the mail of wrong balances due, and placing wrong amounts of balances due in there automated system. I sent Santander, Consumer USA 24 pages of my credit card and bank statements and we came up with a resolution I begin to pay them the money they said I owed I also had a death in my family but I still continued to pay them for about 3 weeks straight everytime I made a payment of $288.00 once a week starting from the end of February 2020 I called Santander to discuss the balance due to make sure we we're on the same page as far as the balance due we confirmed that the amount was the same and that my account was being closer to becoming current so I felt I didn't need to call Santander repetively because we we're on the same page I called them about 1 week and a half ago and they told me that even after I made a $300.00 payment I would still owe around $1,007.00 I said no I dont my balance is only $643.00 and it shouldn't be this amount according to all of the money i've given you. I requested an account ledger months ago that shows how much i've given Santander and the Company failed to send it by email or the US postal mail. I asked them once again to send it by mail only I don't trust the company in the way they do business!. I desperately need someone to help me this isn't a good company they take from the poor to middle class people and stress them out with phone calls and threats in regards to money owed and repossessing the vehicle. I'm requesting all of my money back and more for all of the headaches, pain, and suffering santander has caused me also it states on my experian credit that my account is deliquent everytime I try to apply for a small credit card such as wal-mart I keep getting denied. Please someone in the legal field please call me right away at [protected]?.

Hi Ms. Daniels.

I can appreciate what you're suggesting. Your accounting doesn't agree with theirs. You have a right to request a review of your account and even that someone walk you through their accounting to show how your current balance is arrived. Be aware, though, that accounting for your repayment of the loan is what they do. It's very possible, if not likely, that their accounting is accurate and yours may not be.

My concern starts right from the beginning in being late on that first payment. If you've simply told them that you're only going to make a single payment and not the second payment that was due at the time, it would have placed your account in arrears and kept that way for the entire time you've been paying on the loan. This allows them to legally charge late payments and possibly more interest. It's also probable that there is a clause within your lending contract that they are able to add on collection fees if they have to turn it over to a collection agency for payment.

So that is all the negative parts to address. Your number isn't even listed on here. You're not likely to get a call from an attorney out of the blue. You're going to have to contact an attorney proactively by finding one that deals in that type of law in your area. With that said, I think you'd find doing so is not going to likely benefit you. Attorneys - especially the good ones - generally don't work for free. They generally will require a retainer for them to take your case and start looking over the accounting and so-forth for you. Most retainers start at $1500 on the cheap side. If you're only speaking of a few hundred in difference, I'd suggest doing something a little differently...

Get someone you trust that is also good with number to help you. Contact their offices and set an appointment to go over these numbers and ask your friend to review them with you. Assuming their accounting is correct, you'll feel a little more comfortable, hopefully. And then you can start the task of working to rebuild your credit.

Hope this helps. Let us know what happens.

Santander Consumer USA auto loan interest payment ripoff

I purchased a car with Santander in 2013. I just received notice from my credit monitoring that I had paid 40% of my car off this Jan in 2020. I have paid $36, 000 on this car since 2013 on a $24, 000 car with $13, 000 more to go by maturity date in August 2020. Wow is all I can say. Yes when I got the loan I didn't have the best credit but now I do so not coming up with the money to pay off is not an option. Any class action lawsuit I'm on board!

Santander Consumer USA car loan

My husband and I bought a car may 2013. We borrowed 26, 000 loan has matured and we still owe almost 16, 000. It should be illegal for this company to be in business. I understand my credit was poor and I was going to pay a higher interest rate. It was never explained to me that this was a sub prime loan or what that meant. Please help me and all the other victims of this company.

Santander Consumer USA car loan

I began business late sept 2016. Since then the car was repocessed 2 times. First time due miscommunication via dealership. Called in october of 2018 for a deferment due to being laid off and was denied. Needless to say I was offended employment last week and car was taken. I was denied the ability to retrieve my vehicle after being told that I had to wait for a manager approval to get the car. I have one year left in the loan without an option to get the car back

I purchased a mini van with Santander. I was so upside down in the loan that when I lost my job I could not afford the balance and the car was repossessed. My interest rate was 19%. I had to file bankruptcy to clear my credit in order to move on.

Interesting how noone knows about the settlement and the States Attorneys have mailed Settlement Checks dated June 4, 2021 only to void August 3rd, 2021. Most were not sent out on the June 4th date due to Covid shut downs, staff shortage, and of course USPS shortage. So, we do not get the money in time, but the Government keeps that money? We have no guidance from Santander or any State officials about how loans are to be forgiven, the protocol, whom to speak with. THere are so many unethical issues in all of this and you would think it would be an easy website with already answered questions!

How can I participate in the class action lawsuit against Santander. I brought my car in Aug 2013. Was in an accident in 2014 and was unable to pay for the damages. They totaled the car but still want me to pay 8k left on my car. Do I qualify for the lawsuit?

Car was stolen. Told them that wherever they found the car I wasnt notified that it was found therefore the car was repossessed without notification. I was mislead over the phone to finding my car. Car was repossessed unfairly now it's on my credit reports. I'm disputing as much as possible to get it removed from all of my credit reports. Contacted them recently about car to see if they would remove it from my reports.

Santander Consumer USA loans

To whom this may concern,
I Valeria Randle, am making a complaint against this loan company. My husband Eric Randle, is a Florida State officer. My husband has been out of work due to a back injury. My husband is a public servant and a protector. My husband has gotten behind on his car note due to his back injury. He has made contact with this company's customer service associates. The associates that he has talked with concerning his situation has fail to make note in the computer according to Mario . Mario is a manager and was very rude to my husband and myself. We were attempting to talk to a supervisor in hope to find out how we can get my husband's work car back. This company wants to keep my husband's ar for less than 2, 000. I tried to explaint to Mario that The money has become available and we ar able to pay the car note up. He was nasty and talked to me like I was trash. I found that very offensive for any bussiness. He didn't and wouldn't let us speak to anyone higher than him.I would think this company would try to resolve the issue by letting my husband work out some type of plan to get his car back. After all the car has some issues but we were in the process of having the car fix.
My husband also have all his documentation from the doctors that he's out of work on medical leave.
I may be emailed back at [protected]@gmail.com

Santander Consumer USA auto loan, interest fees, no movement on principal, fees for no reason.

I purchased a car in 2013. It was a used 2006 Toyota Corolla for 10k. For 4 years i made payments of over 9800 on that loan with Santander and it on took 1900 off the principal. It should be illegal the way they take people's money. They are stating that I still owe 7663. Can someone please explain how?! This company should be shut down. I am one complaint out of millions and they are being sued left and right. I really need help breaking free from these vultures.

Santander Consumer USA auto loan.

I purchased and had a car financed by Santander. These people are horrible. I mad payments mainly on time. They tripled our financing charges. Added late payments when there was none . Marked we had missed payments when we did not I had wired the money and had proof. They gave me 45 days to pay off the car. I was tryin to do so they came way before the 45 days. Repossessed the vehicle sold it at auction for 3k and are trying to sue me for the remaining 11k on the vehicle. So now I have no car, they are trying to sue me and have ruined my credit. I need some help please. I have always paid off every car I have ever had financed but even with making your payments on time the balance never went down. It's disheartening and I see so many complaints they should seriously have to close their company what they are doing to hard working people just is not right.

Santander Consumer USA I got repossessed after 4 months said santander representing

I had a 2013 Ford Explorer and I paid 5, 000 Down with a trade in and 468 per month. The first year the truck was fine after that I stay having problems left and right with this truck. No good warranty so everything out of pocket and not one thing was a easy fix for my first truck ever financing. When getting the truck there was 88, 000 miles on it from the first owner and I feel that truck was way pass due on maintenance before I receive it. My second vehicle in my lifetime and the problem was one after another getting higher a higher. Every other month there was a problem with this truck and I contacted them letting them know the problems and setting up date to pay my loan. After awhile going back and forth with them about it I wanna to throw in the towel and be done with I never did. There was times I asked to push some months behind cause the problems and money amount was outrageous. The Santander Operators never really care how they talk to you when it come to the loans till they harass you calling every day all day. Which made ask the to not call me on a every day base and it was not like I was not working to better myself with fixing on a car and paying my monthly note. Now that the truck is gone that is messed up how my credit score is extremely low for a truck that was never in a good conditions. That was the whole point of getting a newer vehicle and getting a better credit score. At the time of getting this truck it was only 10, 000 dollars cash and when Financing it became 16, 000 truck with over 2, 000 plus of problems to keep it fix. I really needed help with this situation if so can some give me a call at [protected]

Santander Consumer USA auto loan

Purchased a 2014 Nissan Versace Note in 2014 through Michael Jordan Nissan in Durham NC. Lost my job in August 2016. Had car for 2 years and wasn't late in paying. Called and explained situation to them stating that payment would be late. Stated ok and when I received the statement noticed that my balance was never going down after 2 years. Tried refinancing through my credit union and couldn't because the amount due was too much for the period of time that I had the car. Called back concerning a fixed rate and was told; not possible. So I called back to tell them I wanted to turn the car back in where could I do it? Was told that I couldn't turn it back in. They would have to come and pick the car up and it will be sold and they will send me a balance owed. They picked the car up and I never got a statement for the balance due. Representatives there are very unprofessional and rude. Never wanting to work with you and speaking to you like you are not a human. Never once did they explain that this was an interest only loan and it would increase my loan payment. This was found out in 2018 due to my researching because as of today this is on my credit report and they keep revolving it and the amount due is going higher. Also was paying for GAP insurance which I found out never existed. I found out on Nov 20 2018 that Santander violated the Consumer Financial Protection Act of 2010. They failed to properly disclose the impact on consumers of obtaining a loan by not clearly and prominently disclosing that the additional interest accrued during the extension period would be paid before any payments to principal when consumers resumed making payments. I would like to have this removed from my credit report because under the terms of the consent order, Santander must among other provisions, provide approximately $9.29 millions to restitution to certain consumers who purchased the additional on product. The consent order is at https://files.consumerfinance.gov/f/docu

Santander Consumer USA auto loan

Santander is reaging the delinquency date on a charge off on my account causing my credit to continuously drop by several points. The account was charged off on 08/2014 and had been reporting as a charge off each month since then. I was in the middle of a mortgage and they changed the charged off date to 10/19 and now my credit is showing a new delinquency. My credit score dropped by over 30 points and now I am being denied my mortgage. I need assistance And to fight them for these inaccuracies. The credit bureaus will not update the correct info either.

Santander Consumer USA Auto loan

I co-signed as I was told for my daughter turns out my name is on the loan first. She has been making payments since 2014 and her her principal hasn't hardly budged. They have made harassing phone calls and have discussed my personal finances with her fiancé which is illegal. How can I join the class action lawsuit? 5 years of payments on a used car and principal hasn't budged this has to be more then the percentage were were told at the dealership. I don't understand how Santander is even still in business! It's disgusting how they treat their customers!

In 2016 we got a car loan at Car Depot Kansas City MO. The day was late when we got to the car dealership. We was pointed to one vehicle, a 2012 Dodge Caravan, 15,000.00 that the car dealership could make work for us. Again, the hour was late. We needed a vehicle so we went ahead and bought this one. While inside, the car dealership was getting ready to close. We was rushed into the office to sign papers. We did not READ all the paperwork, but was told rather fast what it all meant. We did not respond to the GAP. We did get the warranty. Jump to 2017, November. A deer hit our van and our insurance company totaled the van. They sent us a check for $8900.00 which TOTALED the van. We had to sign the check and send to Santander Consumer USA. Within the next few months, we was without a car, Santander sent us a bill for the remainder of the car loan. Over $8900.00 Now mind you we had made monthly payments ALL ON TIME of $500.00 which came to over $7000.00. I called them and they said we have to pay for the remainder of the contract. I said NO. By them signing the check from our insurance company that was FOR ALL the car loan. They refused to accept this. They placed on our credit report that we owed over 8,000, Which there WAS NO vehicle, thus no car loan. NO title, thus no car loan. We kept sending letters with rather rude remarks. I contacted the Attorney General in Missouri because we thought the AG would join with the other 34 to make Santander Consumer USA stop their abuse to people who had poor credit and like us senior citizens. Today I am still trying to get this resolved. Santander Consumer USA has WROTE off the amount, which I finally made Experian put on our credit report we had made payments, there was no title no van, thus no car loan, and that Santander Consumer USA received an insurance check WHICH they accepted being full payment. I am filing now with the Federal Government stating this company, Santander Consumer USA is unethical with business practices. The car loan is void. NO CAR/TITLE NO LOAN.

Was it legal to repossess my vehicle during and after the 34 state attorney general law suit was filed against Santander ? I struggled to pay the ridiculous note while being employed. Tried several times to get Santander to work with me but the just refused to do so. I went to another state to look for employment which was difficult for a person my age. While in that state still looking for employment I awoke one morning in 2019 to find my veh had been repossessed without notification or warning bu Santander. How is this right ? Why is Santander allowed to treat people this way after already treating them to such unfair practices ?

Car loan does not say percentage of what I signed on contract. Was pointed out what car was being sold for. Took facevale when asked to initial and sign. I am paying on a 7 year loan which I was told can't even make extra payments. A car that's a 2015 Mazda thought I was paying with tax 17000. And I am actually paying 35000. Dollars So. Unethical to be taken advantage of credit score was low too still gave me loan now I'm in bankruptcy chapter 13. Will have to pay car full amount too tried calling Loan said can't change anything if they would help me and reduce interest.

Santander Consumer USA auto loan and bad malpractice

Santander Consumer USA, has been harassing myself and my wife all hours of the day. Charged off my account and continued to expect me to pay them with a charge off. I could not even trade the vehicle in if I wanted to I want to get from under Santander so badly. They do not care about their customers life events. They repossessed my vehicle back in 2017 and had the company take the truck to Florida. The company ensured me that they would bring the vehicle back to me and that was not the case I had to pay 500.00 dollars to get myself back down to Florida during the mandatory evacuation to get my vehicle and drive up to North Carolina. Santander's mission statement does not depict the company. I have personally told them that they have a bad business practice. I can not even speak to the office of the president any longer.
