I was looking for a 2 bed flat to rent in March 2013 for myself and my family (my wife and six month old baby). In the month of March I paid £3350.00 to R-Reed estate agent (also called as Rosetta Reed estate agent) based out of Forest Gate E7 0EP for renting a 2 bed flat in Ilford. I paid the agent Horace Moseley (who is also the owner of this agency) 6 weeks deposit (£1800.00) and 1 month rent in advance (£1200.00) for moving into the flat on 01/04/2013. I also paid him letting fees in full (£350.00). At the last moment when I was to collect keys and contract papers from him on 28/03/2013, he calls me and says that the flat is no longer available immediately as the tenants who are staying in the flat requires more time to vacate. Also, he said that the owner of the flat require more rent now (£1250.00 per calendar month) than what has been agreed (£1200.00). He offered me to refund me my full amount if I am no longer happy with this new deal. I asked for a refund and am still running behind him to get my hard earned money back. It was a big pain and harassment for me and my family to find an alternative place to stay at such short notice.
After making several phone calls, text messages and following up with multiple times, he did a bank transfer of £1500.00 on 02/04/2013 into my account even after promising to do a transfer of £3350.00 which he failed to keep your promise. After further multiple phone calls, text and follow ups, he then gave me a post-dated cheque of remaining amount of £1850.00. On submitting the cheque in my bank, the cheque was rejected by the bank and it had bounced on 17/04/2013.
On informing him again about the cheque being bounced, he started avoiding my phone calls and also started mentioning several stories again as before. On personally meeting him on 19/04/2013, he mentioned that he is now running short of funds and he agreed to pay me the balance of £1850.00 in maximum of 2 to 3 weekly instalment starting from 26/04/2013. He promised to pay me the money through online bank transfer for which I provided him my bank details too. I accepted his payment assurance for another one more time and waited for the 1st instalment to reach my bank account by 26/04/2013. Unfortunately, he failed again on his commitment and he did not transfer any money to my account.
On trying to contact him on the evening of 26/04/2013, he avoided my phone call and later sends me a text message confirming that the money will be in my bank by Monday 29/04/2013. This again resulted to be one of his multiple lies that he has been saying so far and he has not transferred any money to my account yet. Most of the time he will not pick up the phone, voicemail will be full, will say I am driving, I am with my son, I am with my family, I am out of London and so on.. Now I have no option left than to drag him to court to get my money back. Being the only earning member in my family, I am now going through severe struggle in my life as I had to pay another deposit for the alternative flat where I am staying currently. Please help if you can. I will be highly obliged if you can help me in getting my money back. I can provide you all relevant proofs if required.

Resolved

The company did not do anything to return my money. I applied for a third party debt order after receiving the county court judgement in my favor. The money was taken out of the bank account of the company by the bank and then paid to me by the bank on the order of court. Thanks to God for helping me get back my hard earned money from this cheat.

Hi, I have the same thing since last year. We've tried different ways to get money back. I think we should go there together and call the police..

Hi mate,
I have exactly the same problem with Horace Moseley.
I paid to this man 4000 pound on 24th of march and I receive the same story...
The collection keys day the house wasn't ready and the price has been changed.
From that day he send me back 1500 and I still calling him every day.
I have claim already my money to the courts and I will do whatever I need to get my money back.
I got everything, receipts, his text, email, a bounced check...

I was visiting his office in several occasions and even the people working in his office told me about take him to courts.
