Mirabella Motors Unethical Business Practice

This company did a buy here pay here/in house financing. I recently retired and needed a few months until my retirement funds came through. I put $4000 down and a $1000 in a repair immediately. I had 4 payments due then a balloon. The contract had a due date with a 10 day grace period. I called them 2 days before it was due and verified the mailing address and due to my SS check arrival date, I mailed the payment 1 day late. On the 5th day, they claimed they had not recieved it and repossessed the car. They then demanded I pay the full amount owed within 10 days or they would resell the car, even though I offered to pay the 4 payments to give them reassurance. They assumed that due to my age and restrictions of funds I would not be able to redeem the car and they would be able to resell and make more money. I tried to call and talk to the owner and he refused to take my calls. I went to the dealsership the next day and to their surprise paid them the full amount owed, plus a $895 repo fee even though they were only charged $350...and the owner claimed he didn't want the car to resell but couldn't say why he wasn't willing to take the 4 payments/ BEWARE anyone looking to do in house financing here, as they will not honor the 10 day grace period and will try to take the car back and resell it. I have talked to an attorney and apparently this happens quite often with this type of a financing situation, stating that most buy here pay here's sell their cars 2-4 times each! We are pursing legal action for breech of contract.

Buy here pay here places or even lots who do case by case in house financing take a risk selling cars to people with bad credit, therefore business practices are going to be a bit different than at a dealer that uses conventional financing options. Though of course it isn't always the case, they don't know that you didn't decide to put the down payment on the car, drive off in it and keep it. It does happen, among other things. I used to work at a corporate owned buy here pay here lot. We had locks on the ignition in the event the customer missed a payment. If a new code isn't entered weekly, the car won't start at all, and yes one day late and you couldn't drive your car. There was no grace period at all.

They have to be ready to repo it if you miss a payment and don't make arrangements, of course. If you have that much money to spend anyway the best thing to do is buy a used car outright, and work on your credit so that you don't have to deal with shady loan practices in the future.

Thankfully the educated consumer realizes someone doing "in house fnancing" is someone who can't get conventional financing with a bank due to an extended history of not paying bills on time or at all! Customer was over 2 weeks behind on first payment and ignored about 100 of our phone calls. They did finally call back not until after we repo'd the car. We rarely do in-house financing & we do not want to take anyone's car however we are very upfront if you do NOT pay on time & you do NOT communicate with us, we will repo your car. This was about 4 years ago & I'm still waiting for the payment to show up in the mail that was mailed 1 day late... customer got the car back. Communicate and we are reasonable people.

They provided in house financing. We paid $4000 down. The contract provided a 10 day grace period. The first payment was due, they were called 2 days prior to verify the mailing address, the payment was mailed 1 day late due to waiting for my SS check. On the 5th day late, they claimed the payment had not been received and repossessed the car. They demanded full payment of the car plus a repossession fee more than double what they paid the company to take the car in 10 days or they would resell.

Upon our calling numerous times through out the day and leaving messages asking a call back to discuss, offering to pay 4 monthly payments in cash to prove we were not trying to run out, we had $5000 in this car. Between the DP and a repair, we were still in our 10 day grace period and Noone would call back to discuss. They made an assumption we would not be able to come up with $8000 and thought they had this car back and could resell to make more money. This is a violation of their contract, unfair and unethical business practices and I believe they were trying to take advantage of someone they thought were unable to redeem the vehicle due to recently retiring and being on a limited income.
