GM Financial Unethical behavior/possible fraud

To Whom it may concern:

On March 05. 2021 GM Financial sent a tow truck to repossess my 2013 Dodge Avenger due to lack of payments. I did go over my contract and my car was due to be paid off in October 2020, and due to the world pandemic going on at that time, I had lost my job, my phone, I had no computer, and I was severely depressed and riddled with anxiety. I made an ACI payment of $500 in November 2020. It was then that I lost my job. After waiting 90 days I was able to close out my 401k. I got my phone turned back on. My intention was to put $1000 onto my GM Financial account on March 08, 2021. After speaking to the agent, he reminded me that just because my phone was turned off, doesn't mean I couldn't get the number out of my phone and use a friends phone to call sooner, as you have been calling me. I certainly apologize for not thinking of that, when I was in a lot of stress wondering how I was going to pay my rent, lights, buy groceries, and still be able to get my depression and high blood pressure medications. I then asked if I could make $1000 payment over the phone to prevent it from being towed and continue to make payments, but I was denied that request. Furthermore, I asked the agent for the name of the impoundment station so that I could call and find out what the cost was to get my car out, as I needed to know the total amount of money I needed when asking my kids to borrow money, or god forbid, I couldn't get the money and I needed to clean my car out. Your agent was kind enough to tell me the total amount that I needed to pay. I contemplated paying just a few dollars to see if I was able to still make payments via my phone, so I tried it, but didn't make a payment. I was just experimenting to see if it would go through. Likewise, I called your agent back and asked him why I was able to do that if my account was indeed written off. He said it must be a glitch in the system and I shouldn't be able to. I told the agent that after paying for my car for 6 years, I wasn't about to let it go for $2, 529.75. After speaking with my kids, we all agreed that we were going to do whatever it takes to get my car back. On Tuesday, March 09, 2021, I made an ACI payment of 1330.00. Now, it this was the wrong way to go about paying on my account, this would have been the right time for GM Financial to contact me and tell me the actual procedure that I needed to take. On March 10, 2021, I made another payment of $1300.00, again, no one called me, so I assumed that all was good. On Friday, March 12, 2021, I paid the remaining $425.00 for a total amount of $3, 054.75, to include $2, 529.75 plus the $525.00 impoundment fee. I called GM Financial that morning when to get my car released. The agent that I spoke to asked if anyone told me the process to get my car released, and I said no, just that I needed to pay $3054.75, but no details on how to do it. The recording I listened to indicated that my account was open, so I paid in payments, by phone. Apparently, this wasn't the correct way, and that I was at fault for not asking. She said that because I never asked how to pay it that must have meant that I had no intention of retrieving my car. "I told the agent that after paying for my car for 6 years, I wasn't about to let it go for $2, 529.75." This was in the conversation with the first agent I spoke to. AND, again, GM Financial was fully aware of each payment I was making. If there was an issue, I should have been made aware. The second agent then suggested that I could cancel my payments and do it another way, but again, never told me how that "way," was. I refused. The total amount was paid. I don't believe it should matter how it was paid. And I asked her if there was now a zero balance on the write-off, and she agreed that there was and that I had paid that balance. BUT she still couldn't release my car for up to 14 days until those payments posted because there was a chance that my payments could bounce. After I hung up the phone with her, I called my bank. I was reassured that this is NOT HOW DEBIT PAYMENTS WORK! Once they are made that money is gone. My banker compared it to using a debit card for groceries. The money is taken out of your account at once.
I was fully expecting my car to be released over the weekend and arranged for someone to bring me to get it since the impound lot if over an hour away from my house, but that opportunity has passed. Without my car I now cannot go to work or attend my nursing classes, both of which I am holding GM Financial responsible for, and if you truly intend on waiting the 14 days, I will lose my job and will have to drop out of school - you see, my intent was to become and RN and better myself and get out of my financial ruin. To resolve this issue, I want GM Financial to BRING my car to me. I feel that you never thought that I would pay this off. I feel that GM's tactic was to perhaps confuse me in some way so that while I paid all those payments to you for years, that you would be to keep my car and auction it off? Luckily, I have been keeping contact with the owner of Alexander Recovery in Fairfield, Maine, who is holding my car, and he has been the kindest, understanding man. As he said, this is a very difficult time for me, and he just wants to shed some empathy. However, the time has passed for me to get someone to bring me up there because GM Financial would not release my car on 03/12/21 or 03/13/21.
In closing, I want GM Financial to BRING my car to me, just as you took it, and in the same condition as it left my driveway. I also wish for an apology letter in the confusion that you have caused with the miscommunication.
I have enclosed copies of my payments that were made to GM Financial.

GM Financial Billing

When I first leased my car in June 2020, I went through the most stress trying to contact them to receive an account number to pay my bill. I could never get a hold of someone and the website cannot be used without an account number. After 2 months of this problem My credit was affected and dropped 100 points. I finally got a hold of someone 2 months and a day from my lease date. They mentioned my home address and phone number were not incorrect in the system. So because of someone else's error my credit has dropped for the first time in 10yrs.
Fast forward to Jan. 2021. Because of the holidays I couldn't remember if I scheduled a payment for Jan. 1, 2021 so I went into the app to make a payment on the second and the app accepted the payment. On Jan. 4th I see 2 withdrawals from my bank account for January. Again it takes me a long time to reach customer service to solve this problem. A week to be extant. When I get a hold of someone they tell me it takes up to 48hrs for a refund request approval than it is mailed out (snail mail). I refused this service and asked the customer service rep to cancel the refund check being mailed to my home. I also told him I would do a stop payment on ONE of the 2 payments. The rep told me I can do that as there is no Other way to refund money. I couldn't wait another week or more for this refund. It should have been refunded the same way it was charged. Via a debit card online.
Now my account states it 14 days late when I only stopped 1 of 2 charges on my account. I have no received a refund check from GM so I should be still credited for the 2nd payment I made and my account should be current not 14 days late and counting. Again I'm stuck waiting on the phone or on a chat for a response to this problem

GM Financial I am complaining about a recent reposition

I have made numerous phone contacts with GM explaining my employment problems and made every attempt to catch up on my car loan.
During the early morning of 11/19 my car was repossessed while I was asleep and only 1 1/2 payments behind. The car was towed to Tampa, FL which is one and a half hours away from my residence. My wallet was in the car with insurance information and drivers license. I spoke to numerous people at Customer Service to no avail. I asked why the car could not have been towed within my city limits (Sarasota, FL) but was told that I was not entitled to obtain "internal GM policy information" I have made every attempt to work with GM regarding my employment problems (COVID) and was able to bring my account as current as possible (1 1/2 payment behind). I now owe a $500.00 towing fee and late charges and the outstanding balance on my account totaling $1337.19. During the worst employment crisis and national pandemic I thought a large national company would work better with their customers. This has been a nightmare requiring assistance from my 70 mother who recently lost my dad 6 weeks ago. I would appreciate any reimbursement possible

GM Financial Credit reporting

During these tough times with the pandemic, gm financial is reporting my lease payoff as late to credit bureau with memo of pandemic related..
This is happening to others also.. I cant believe they are reporting like this in these difficult times..
I will and my friends and family will never lease a vehicle from gm again.. I will also place this issue out in social media..
There is absolutely no reason for gm financial to report like this

GM Financial Unethical behavior

To Whom It May Concern,
My Name is Jocelyne Province, I am writing this letter as one of my formal complaint from a disturbing visit to one of your dealership AutoNation Chevrolet in North Richland Hills, Texas on April 4th, 2020. My visit at the dealership was very disturbing base on the information I provided by the finance manager and the salesman. I was contacted by the salesman Reuben Thompson on April 1st, 2020 claiming that he had received a request from me looking for a vehicle. To be clear, as I told him from the conversation, I did not make such request and he must have gotten my information from the last time I purchased my vehicle in 2018. He told me at that time that the dealership was looking for 2018 vehicles like mines and returns you guys had some great rebates on the 2020 Malibu, I advised Mr. Thompson at that moment that I have negative equity for my vehicle, and I went further to explain to him of the situation as of why because I had trade in the Chevy Silverado which I had purchased from AutoNation for my fiancé in 2017. I traded the truck in after he passed away shortly after in 2018, Mr. Thompson pretend like he understood, and I also express some of the concerned I had from the time I purchased my current vehicle the 2018 Chevy Malibu. I even told him I did not trust anyone at the dealership because of what happened in 2018, he asked me to give him a chance and come in by the dealership and he will work with me. I arrived at the dealership on Saturday April 4th to see Mr. Thompson, for one I don't think he remember the conversation I had with him the Wednesday prior, because as soon as I arrived, he handed me paperwork to complete. Which one piece of the documents to complete to pull my credit. I told him I will not be complete any documents to pull my credit until I know exactly what was going on. After he pick a couple vehicles for me to check, I saw the one I was somewhat interested in than I asked him to see numbers before I signed anything. After he showed me the numbers for the new vehicle with my trade, he showed me a total of 40K with some change, I cannot remember the exact number. I immediately told him I will not agree with that number because by that time I trade my vehicle in I will have a much high negative equity. This is where my visit become so disturbing. Mr. Thompson stated another for him to check what more he can do for me they will need to pull my credit because he had told me my 2018 Malibu only worth $9k. At that time, I agreed and signed the document he wanted me to sign with the agreement they will not blast my credit out there and only pull it through GM financial since I already have my current vehicle through GM. Mr. Thompson took my information back to the finance department were shortly after the finance manager Wade came out to speak to me about my options. When he came out of the office, he then tried to explain to me my options to get the vehicle finance, some of the options were for me to put 5K down payment, get an 84 months payment term. I declined those option, he then began to mumble something about a bank kickback, and if I pick that option my finance request will not go thru GM Financial as I requested; which I had no idea what he meant after the finance guy left Reuben than asked me if I didn't want to do the bank kick back. I asked Reuben to further explain the terminology of a bank kickback for me to understand. Mr. Thompson than began to explain to me that a bank kickback is like a tradeoff where I will be financing the 2020 vehicle if they can find a bank that will allow them to finance me the new vehicle and after that I will need to give the 2018 Malibu back to the current bank. I also again asked his finance manager to explain to me the meaning, he than tells me that once the finance go through for the new vehicle, I will need to call GM Financial and explain to them that I could not afford the vehicle anymore due to everything that is going on in the world to come pick up the vehicle. It did not take long for me to realize that the dealership was trying to ruin my life by having me to do a voluntary repossession with GM Financial just to make a quick sale. The finance manager (wade) than began to explain to me how my credit should not be that important if I'm not trying to purchase a home anytime soon and that a repossession will only stay in my credit for a couple years and if I want to purchase a vehicle again I can do so in another six months. I find it very disturbing for anyone in the banking industry to make that type of suggestion about my credit. I also felt insulted and very disrespected for him to suggest that my credit does not matter, if I had gone to the dealership with a 300 credit score they would of would of look at me as if I am less than a person. No, I do not have an 800-credit score, but I am proud of the score that I have and was able to purchase my home not too long ago. Furthermore, it is very odd to me that he will make such suggestion knowing that the vehicle he is suggesting I do a voluntary repossession belong To GM Financial. That alone make me questions the dealership integrity. They also were very proud to tell me how they have done this all the time and they had done two deal like that earlier that day. Well! My reason for writing this complaint today is too make sure that this type of fraudulent activity is fully investigated by your company. I also do not want anyone else to endure such pain by any of your dealership. Because I truly believe that that if your dealership tried this type of activity with me, brag about how many times they've done. I know for sure they will try again. After all of this, I have written a letter of complaint to the general manager Patrick Morison and as well spoken to him about the incident that had happened. According, to the conversation I had with Mr. Morrison, I simply do not believe that anything will be done. Which is the reason why I am fully prepared to take his matter further if I do not receive results from anyone investigations, my steps include but not limited to reporting this issue to AutoNation Corporates office, news outlets media, social media, legal representative, etc... I also have my witness who I contacted while at the dealership whom Mr. Thompson had spoken too on my cell phone and provided him the same information. My goals are to protect the people that this type of fraudulent happened too in the past and to protect future customers so this will never happen to anyone else. I felt insulted by them telling me hat I did not need my credit. Who are they to make such suggestion? How would they know that I do not need my credit? Why would anyone in that position make that type of suggestion? How many innocent people have they done this too? I have so many questions that left unanswered. GM Financial Disposition fee

I leased a 2015 gm sierra and made timely payments for 39 months. I turned it in oct. It was 1500 miles under and in good condition. I just got a letter saying I own $524.70 because I did`t lease another vehicle. I`m a 75 year old vet on a fixed income and I can`t afford this bill. Please help. GM Financial Two chevy equinoxes

I have leased two Chevy equinoxes and set up the auto payments on both of them. I was reviewing the credit score and found that 120 punts down sand upon reviewing the report there was one late payment with a late payment due amount of $6000 plus whereas that supposed to be under $200. Upon contacting GM financial, I was told that the system automatically cancelled as one of the auto pay setup amount was $10 less than the due amount. It seems there was an issue with auto pay as the autopay always by default selects the first option of ‘pay the next due amount' which should pick the monthly payment. If at all that's an issue, I should get notified first via email or postal mail. The agent tells me that I got notified via email and asked me to check junk folder, but he was not able to tell me when did they send. I clearly see that he lied about it, as he wants to close the call and denied connecting to the supervisor. I am going to call again today and see. More over, the autopay worked for 4 payments already before cancelling. I never had late payment in the last 18 years of my credit history and this screwed up my score. Issue that exists in their system, which is so ridiculous.

GM Financial Lease return.

I had a 36 months lease with GM for 12000 miles a year. Returned it with 2 months left and at 33300 miles. Since my lease wasn't up yet, the vehicle wasn't inspected until 2 months later.
To my surprise, I received a bill from GM for 655.75 for 4 tires for excessive use. What is excessive when it comes to tires? You would think a set of non performance tires should last longer then 33300 miles. Yes, I've rotated them every 6000 miles. The tires wasn't bald when vehicle was returned. I contacted GM for a payment plan, they refuse to let me make 100 a month til paid in full. I've contacted them thru email and no response. I have been a loyal GM customer all my life.

GM Financial Title delivery

I sent my lease pay off via Fed Ex overnight as well as emailing all requested paperwork (odometer statement, etc.) on June 26, 2019. I received a formal letter dated June 28, 2019 stating that my lease account was paid in full. I was told I would receive title in 10 to 15 business days from the pay off date by the customer service rep on June 26.

Having not received the title, I called customer service on July 22, 2019. I was told the title should have been mailed on July 18 but had not been sent yet. Lakesha said she was sending an email to her TL (assume that is team leader) and that I should call back in two days for an update on the status of my title.

I did as instructed and spoke to Jessica on July 24. I explained what had transpired so far and she informed me that the pay off should have automatically initiated the title being processed but somehow this had not happened. She told me to expect my title 15-20 business days from July 24 and that it could not be expedited.

I am appalled at the complete and total lack of professionalism and concern for a good customer who did everything by the book. I would expect at the very least for this company to take responsibility for THEIR MISTAKE and expedite getting this title to me ASAP!

GM Financial Lease

I went to purchase a new Suburban yesterday and the dealer ran my credit. It was destroyed. From a 760 to a 515. Because of GM Financial Reckless attack against the American tax payers.

For several years GM Financial has sent us mail and emails on our Chevy. We turned in the car at lease end in March of 2019. We never received any communication, no mail, no phone call and zero emails regarding any additional charges due.

Rather than contacting us as they had in the past for years (I would have arranged payment timely) GM Financial chose to place a serious delinquency in litigation on all my credit reports. Irreparable damage for years to come.

GM Financial course of action has not only trashed my credit but they have lost me, my children and my children grand children and are going to be loosing tens of thousands of more customers as I shall continue to voice how they are conducting business with the American consumers that bailed them out. To add to their self infliction I will be persueing a large sum of punitive damages. I don't even care if I loose in court. I will create a massive mountain of litigation so they will have to spend hundreds of thousands of dollars with their legal teams. Costing me nothing but time and my mutilated credit report.

GM Financial Disposition fees

I leased a 2017 Equinox for 2 years. When I turned it in, the miles were 15k below and in excellent condition. My new job offered me a car so I didn't renew my lease. A month after turning in my lease, I received a bill for $417, disposition fees. I called GM Financial, I would have to discuss this with the dealership that leased me the vehicle. I called the dealership, they told me it was GM Financial that would have to make the decision. This isn't right. My family won't be leaving from GM anymore!

GM Financial Damage claim check

I endorsed the damage repair check from my insurance to gm financial. I had my car repaired and sent in all documentation of said repairs, including preliminary estimate, final bill, before and after pictures. I was able to have repairs done professionally but cheaper however gm financial refuses to release the remaining funds to me. They have illegally applied the remaining to the principle loan even after full knowledge of my intentions to have the remaining funds mailed to me. They avoided telling me this was their policy until the repairs had been made. They have ignored every Message left for a supervisor to call me

GM Financial Disposition fee / lease end

I leased my 2016 GMC Terrain for the last 36months. I just received a bill for 624.30.
$495 is a deposition fee, so i lease thru you and payment my rental fee each month and now at the end of the lease i have to in essence pay you to get rid of "your" vehicle at auction... i knew ii owed on my mileage and was expecting the bill of $77/75 but deposition fee and official fee/taxes Imposed... i paid taxes every month on this lease. I have lease vehicles for the past 12years. I will not lease thru you unless this is resolved. I have never ever paid this fee in these years of leasing. What a rip off BEWARE PEOPLE I dont even know how this is legal doubling taxing and what is the fee for month for anyway?

GM Financial Lease close out cost

On April 10, 2019 I received a GM Financial Lease close out letter for account [protected] requesting a final payment of $3, 890.97.

I am disputing the final cost. Specifically, $948.00 which I found out from a GM representative by the name of Rafael (Code 035) who told me that it was for new tires. I asked to speak to a manager, and I was passed to a Raul Alvarez's voice mail. I was attempting to come to some resolution. At this time, I have never heard from this GM financial representative. I take this is another example of the type of customer service being provided. The explanation for the charge was not in the letter. I am prepared to pay the remaining balance of $2, 942.97 but not for tires that GM or someone elected to replace. I have pictures of the tires which I took at the dealership. These tires would have passed North Carolina automobile inspection.
I have been a GM financial customer on several occasions owning several GM cars. I returned this car to the Sir Walter Chevrolet dealership in Raleigh NC and purchased another vehicle from this GM dealer. I was told, my pay out would be approximate $2, 833.00 based on their on-site assessment, which included an assessment of my car. In conclusion, my dispute is based on a decision made after I turned in the car to replace the tires even though the tires would pass North Carolina inspection. I have elected to not dispute the $495.00 disposition fee however nowhere in any of my lease documents did it mention an "disposition" fee.

GM Financial Hidden/non disclosed disposition fee

I have leased GM cars for years and never pd this fee. This time because I didn't get another lease, just turned my Acadia in at end of lease. With thousands less miles than we were allowed and a clean no damage car(per AutiVin) inspection. I called GMAC to see if there was anything else I needed to do or if there was anything due and was told no! Than a little over a month after turn in came this bill for 524.70. I had never heard of this fee and it wasn't explained during our financing. That would've been a red flag. Called and ask about this fee and the gentle stated you should've read every line of your contract. I trusted the finance manager that went over it with us at time of delivery. He never said a word. We are GM family and won't make that mistake again!

GM Financial gmc vehicle lease

I was surprised to be charged a $495.00 disposition fee which appears to be a fee charged if you don't immediately lease another GMC and $41.04 for official fees and government taxes.

Since this is the first time I have ever been charged these fees when I ended a lease; I wanted to check my lease for the section that had that charge in it Of course for some unknown reason, I was missing the contract page that had the disposition fee information.

The way I have to look at this fee is that it is a fee that I payed because I did not lease a GM vehicle. To get the maximum value out of my disposition fee; I will never purchase or lease a GM vehicle again.

GM Financial gm financial

Hello,

I want my car returned from repossession.

On February 15, 2019 my 2013 Ford Escape was repossessed by G.M Financial. A black unmarked tow truck with no identifying numbers displayed on the truck arrived at 7:45 a.m. on Friday, February 15, 2019. The driver demanded I hand over my key.

I called GM Financial immediately and they claimed I didn't pay my December or January bill. My December bill was paid and I have proof from my bank on this matter. The customer service later claimed my December payment was returned as insufficient funds which is also not true. I did miss January's payment due to a brief financial difficulty. When I went online to catch up on my bill in February, my account was locked and I wasn't allowed to pay.

I had received a payment modification for the month of December and January. The payment made in December was for a reduced amount of around $168.00. I was also charged a $10.00 fee for the service of a two month modification of my monthly amount. I knew the next two months were to be financially challenging for me as my two daughter's were moving home from 1500 miles away. In good faith I notified G.M. prior to the upcoming struggle.

I'm a teacher with a good salary and a single mom with four college age kids.

I'm able to pay and want my car returned from repossession without having to pay all the fees associated with the repossession. I can pay the balance on what is owed from the past two months.

GM Financial Fraudulent disposition fee

The dealer sat me down with the sales agreement in front of me, went over everything line by line, asked me to sign it and I did. He did not mention anything about a $395 disposition fee included in the agreement. I feel this was fraudulent and I should not be subjected to paying it. I wrote DMV a letter and forwarded it to the dealer and GMFinancial to get the matter resolved without success. My lease ends in 2 months. The account # is [protected]. The dealer is Blasius Chevy, Waterbury CT, dealer # 98877.

Finally got to talk to GMF last week. Agent was congenial. I was told that the disposition fee is only for those who do not live up to the lease and return the vehicle early. I was told that I would not be subjected to the disposition fee even though I don’t plan to lease or buy another GM vehicle at the end of the lease, especially because my car will have only 14k miles of a 20k mile lease. I have my hopes on GMF living up to this promise.

Tried to call GMF and a 5 min wait turned out to a greater than 15 min wait. Went on line and used the APP to submit my complaint but was timed out before I could submit it. Tried to call and was faced with a wait of greater than 15 min again. All I wanted to ask GMF is to forgive the fee so they don’t end up losing another $2500 by forcing me to lease another car with this fee. We both end up winners.

I don’t know why GMFinancial is so adamant at forcing me to lease another car with this disposition fee. They lost $2500 on my 2014 lease and will lose another $2500 or more on my 2017 lease. Another lease would only cause GM to lose another $2500.

I asked GMFinancial to approve my returning the car early in exchange for the disposition fee and they declined. I am surprised they allowed other leasers to do this. The car had only 12K miles and now has only 13K for a 20k mile lease. GMFinancial is difficult to deal with and unyielding to me. I was hoping they would see my post and contact my with a solution to this problem. Not so yet.

GM Financial Unethical behavior

In July of 2018, my car was repossed from GM Financial. I was never given any legal notice or correspondence in the mail. I got the car back. In September of 2018, I received notice from the GAP insurance carrier that GM Financial cancelled the coverage and received the money back. I was never ever notified that they cancelled my GAP coverage. I called and complained and they tried to lie and say they did not have the premium from it which was $276.28. None of my statements have indicated where are the money went after I paid them for the reposession. I do believed they pocketed some of it. None of the statements indicate the repo fees nor the GAP money they stole. I asked for the GAP coverage to be reinstated as I have the car but they will not do it. They have been very rude and nasty. How is it even legal to cancel GAP coverage insurance and never notify anyone and then steal the money because GM is greedy and wants more than they are entitled too. No customer should be driving around a car with no GAP coverage ever.

I would like my GAP coverage reinstated, an official breakdown of how the money was applied after my car was repossed and I got it back, and an apology for the way I was talked to and how dirty and illegal it was to go behind my back and cancel my insurance that I am paying for without my knowledge or consent.

The GAP company has the check number and the date for when GM lies again and says they did not do it.

Absolutely horrible way to do business. Wonder how many laws this breaks? And I am sure because I filed a complaint my car will be repossed again because this all started when I complained on a GM survey about how you treat people.

GM Financial Lease vehicle

I have leased a 2018 Cadillac ATS. I was told the car is a Executive Demo car, but it is still qualify as a New Car Lease! Upon delivery of the Car, after I drove it home, I have not drive it since we still have two months to go on our old leased vehicle! My wife and son has drove the car and told me that the car was driven with someone smoking in the CAR! Also, the side mirror is shaken and vibrating while I drove the car! I brought the car back to Brogan Cadillac Dealership in Wayne, NJ. They told me that the car has been bomb for smoke, but the smoke has been contaminated to the car AC system. Whenever you started the car, the smoke smell is still there through the AC system! The side mirror has been in back order for more than 2 weeks. My service adviser from Brogan is very good and understanding! That car should not been lease as a new car with the smoke conditions! Even their loaner all stated as NON-Smoke car! How can they lie to customer that they car can be leased as a new car! This is the first time we lease a car or lease a Demo Car! But all has to be like new car condition, not with a smoke smell that some one definitely smoke a box of cigarette in there! This is an Executive Demo! Please let me know what GM will do with this issue!
