It is appreciated that- Aisha L. Ben Hassine - posted her age (18) on her complaint, as this somewhat explains the childish, unprofessional and malicious nature of her remarks. Furthermore, not only she shows a very immature behavior, but also a despicable attitude in an obvious effort to slander our company and reputation, as a result of our decision to terminate our brief contractual agreement.
Miss Ben Hassine was employed as a sales executive for about two weeks, after undergoing two days of training.
On her fourth day as a sales executive, she misplaced her laptop and made a very offensive scene in the office. The entire staff stopped working in efforts to help her relocate her laptop. She even accused one of our team members by name, with no reasonable justification whatsoever. Finally, she ended up relocating the laptop on the very same desk she had been sitting at, right where she left it under some magazines and papers. It is unfortunate she was unable to take the initiative to look thoroughly for her misplaced item before disrupting the entire office in order to find something that was directly in front of her, which in turn caused others to feel accused and uncomfortable. This situation and the way she handled it was totally unacceptable, raised a big red flag, and was fully documented with several witnesses.
The very following day, while the manager was away from the office, she approached our receptionist and voiced her complaints in a completely inappropriate manner, using language that is not suitable for a professional working environment. This situation was witnessed by all four people in the office at the time, and has been fully documented as well. All of these people approached our management to let us know what this lady had done, and to indicate their discomfort with her attitude. At this point, we had no choice but to dismiss her, as she has proven to be completely unfit to be part of a professional working environment.
It is unfortunate that out of her dissatisfaction from being terminated from a very promising sales position, she is going totally out of her way to take revenge from what was the result of her own unprofessional and immature behavior. We don't feel she deserves the time invested in responding to such allegations, but we have decided to respond to protect the reputation of our company. Additionally, our attorney has contacted Miss Ben Hassine to inform her of the legal situation she may be facing if she persists in her slandering efforts. Finally, we have signed documents from employees and independent contractors on file in our office regarding Ms. Ben Hassine.
This is FLAIR's response to her complaint:
1- First of all, she was hired under the exact same terms and conditions as every other account executive in our company, which is under a generous and more than fair commission structure, ranging from 15% to 25%, PLUS weekly bonuses and a gas expense allowance program. The gas expense allowance is granted when reaching a minimum sales quota that ensures us that the individual is really using his/her gas money to serve our company, not other interests. Everybody finds our allowance program more than fair, as most companies would not offer a program that covers for gas, food and cell phone, as we do ($200/wk X 4.2 weeks per month = $840.00 per month).
2- She only brought one single sales agreement into the company, which to this day has not been paid for. Of course she cannot get paid a commission on an unpaid transaction. Any sales executive with a minimum understanding of sales processes would agree to that. Obviously this wasn't her case, although she was very clearly explained this point during her training, just like everyone else was.
3- Her claim that she is required to travel around Colorado is absolutely false, since we focus our sales efforts on the Denver Metro area only. Presentations outside of Denver have never been performed by ANY of our account executives. We are of course open to do presentations away from the Denver area, but it has not been the case yet.
4- Miss Ben Hassine did only two presentations on behalf of FLAIR, and in BOTH cases she rode in Mr. Gondra's vehicle as part of her training, so she spent $0 in gasoline. It is amazing the way she describes this point with so many details in her lying, such as driving "all over Colorado" out of her own gas.
5- She was never SENT anywhere whatsoever, yet she claims that "as an 18 year old girl, I was sent around to meet with old men who at times made passes on me". She only went -accompanied by Mr. Gondra-, to appointments she personally scheduled. Furthermore, there had been complaints against the appropriateness of her clothing by employees, complaining it was not suitable for a professional work environment. The one isolated incident that occurred regarding inappropriate gestures from a client in which he contacted this lady on a personal level over the weekend was brought to Mr. Gondra’s attention, from which he immediately asked her to stop any communications with this gentleman, and he offered to deal with him from that point forward. If there had been any other inappropriate advances made to her, it was not brought to our attention and thus we cannot be held responsible.
6- No one in our sales force is required to be in the office at 8:00 am or to leave at 5:00 pm, as she claims. This is also untrue. We have a clear understanding of labor laws and the difference between a salary employee and an independent contractor. Our account executives are welcome to use our office space to make phone calls, setup appointments, send emails and faxes, and do any office work. We encourage them to take advantage of the fact that we have all the tools they may need to do their job efficiently. However, they are not required to work any specific number of hours or days. We currently have sales executives that may come into the office for a few hours per day, or that may not come into the office at all on certain days.
7- She claims to having been sexually objectified, which is nothing short of preposterous and extraordinarily untrue. Mr. Gondra always shows a great deal of respect for his employees, account executives, clients and vendors, both women and men. He always emphasizes the importance of enjoying a great work environment, where everyone feels welcome and respected. FLAIR is a very professional, peaceful, respectful and fun place to work, and anyone visiting our office agrees to that.
Lastly, we regret this situation of having to defend our company and Mr. Gondra against such accusations from this individual, which were highly falsified and untrue.
