Eastern Savings Bank loan modification denial

I know it's been a while but I'm trying to find out if there are any class action suits that are currently active. I dealt with Eastern in 2010. I had a home equity loan with them. I was forced to medically retire from the U S Govt. and had to take a substantial pay decrease. I went to Eastern to modify my loan. They refused and offered no solutions. They foreclosed on my house and lost it. Eastern was extremely uncooperative and in fact, mean and accusatory during this entire process. They gave me 7 days to get out. Needless to say. I had to leave the majority of belongings. They refused to allow me to go in after I was evicted and all my stuff was hauled away to the landful. I didn't learn until a couple years after that this is Eastern's usual treatment to people in that are in catastrophic financial status.

Eastern Savings Bank they are trying to take our church

Eastern Savings Bank refused to modify our loan. After repeated requests they wouldn't budge. The rate remained at 12%. We paid money to a law group that was supposed to be helping and found out they never answered the judgements against us so ESB foreclosed and sold the building . We are still fighting them...trying to save our church. My mother bought the building for 228, 000 back in 2005. They sold the building for 500, 000+dollars. We are still having our services there pending court date. According to ESB my mother owes them 425, 000 not to mention they allowed her to purchase the building with credit cards. They are really evil.

Eastern Savings Bank mortgage

Eeastern savings bank are a bunch of thugs.
I was foreclosed in 2014 out of my home of 40 years.
Their phone is answered by a message that says, we are a debt collector any information obtained will be for that purpose, your call may be recorded.
I was not in debt when I made my first phone call.
Their was no truth in lending in my file with my signature, because I was not made aware of its importance
I have multiple sclerosis and dealing with the persons whose names I have, I believe were false names. I spoke with many of their mean, relentlessly mean-spirited staff. Terry brown I was told was the person in charge. I spoke to her. She was rude and barely let me state my questions. I repeatedly begged to save my home. My family went through hell. They put forced insurance on my home that I could not afford. The closing attorneys were kriss & feuerstein, manhattan new york.
My home is located @ 261 friends lane, westbury, new york 11590.
The process took over 9 years. During that time I was paying in attempt to save my home.
Initially after we took the loan our payment was $2, 600. I received a phone call after I made my first payment saying my payment had been calculated wrong and the next payment would be $3, 300. Later it went to $3, 600. As we began going broke we struggled to get payments in on time.
However, we continued to pay.
I went to the county clerks office in nassau county, new york, because looking at my file at the cletks office I saw their was a notarized paper. There was no notary so I checked. The signature is a forgery.
I was supposed to get cash out at closing. The title company came up with debts I did not owe and held our cash out. I do not remember the amount but it was over $ 20, 000. I later received a check for what they said was left in around $1, 600.
We made payments early and we were penalized. 1or 2 days early.
When I looked up new york pre-payment penalties, by nys law was 1 year.
At closing I refused to sign because it stated 3 years pre-payment penalty. They then came back with a one year pre-payment for us to sign. Looking at the file the 3 year pre-payment penalty was in the file and not the agreed and signed by me 1 year pre-payment penalty.
I became so fatigued by the constant non stop day by day unknown that I relapsed with multiple sclerosis. After they took my home and all of my belongings I had to leave my job as a supervisor of passports for the town of hempstead under the department of state. We were an acceptance facility. I found myself after years of doing this work I could not recall many things necessary for me to properly get my days work done. I had to go out on disability. I needed two more years to retire at an amount I could only receive if I made the 20 year threshold. I made around $74, 000. Had I been able to continue my salary today would be around $96, 000. Also, there is no retirement age requirement so I could have stayed another 10 years or more.
My retirement account was cut in half due to having to borrow to pay legal fees in an attempt to keep my home. Also, my defferrd compensation was ckeard out in order to survive and have food, medical bills, utilities, car and insurance plus all other expenses.
My home when they started foreclosure was a beautiful home. The needed repairs could not be done. Which caused mildew to take over our living space despite our best attempts to clorox it to death.
I later found out (yet I do not know for sure) that a new neighbor assisted a local fire chief to buy my home.
My homes value at the time this all started was $495, 000.
I have done the best I could here to explain but due to multiple sclerosis I suffer from cognizant memory problems.
I am 68 years old on july 1. I worked my life for my home, my husband is turning 70 and the stress has caused him memory problems as well. Not saying we do not remember but we have to take time to remember.
I cannot leave out that my two sons that were supposed to go to college, were unable to because when we were evicted we had zero dollars left. All of our savings. Loans from my sister in law in the amount of $10, 000., again to pay lawyers who threw us under the bus. We had three attorneys during this horror!

I too am a victim of ESB's unethical practices. I initially did a Home Equity Loan on my house through ESB. I was employed as a senior level law enforcement agent. At the time of the initial loan, I was making more than enough money to make my payments. About 3 years into the loan, I became ill and was forced to retire on permanent disability. I took a substantial cut in pay that made my loan payment impossible to pay. I contacted ESB to request a loan modification. After Several weeks of negotiations, i was offered a refinance. At this point, I was behind on my payments. They agreed to refinance my loan at 16% interest. The reduction of my monthly payment Was reduced by only $28 a month. At this point I was already 3 months late and was going into foreclosure. I had no choice but to accept the offer. I only did this to buy some time. I might add that this was my family home that I grew up in. We had owned the house for close to 50 years.

I was forced to file for bankruptcy so I could at least stay in the home until I find a way to keep the house.

For 3 months I tried to get ESB to show some compassion and do a modification. They refused. I was unable to find another lender that would refinance. Since ESB had reported my late payments and the foreclosure, no other lender would approve me.

Subsequently, i ended up losing my home. I was given 6 days to vacate the home. The stress and sense of loss was too the point that I suffered a heart attack and mild stroke.

From some research, I learned that this was the norm for ESB. There were countless complaints against them.

I truly don't see how they are still doing this with all the complaints against them.

I will say that ESB's refusal to refinance or modify the loan has pretty much ruined my life.

I have fought this bank since 2005, when they set me up to steal my home with a high interest refinance. They succeeded in taking my home of 20 years. My 12 year old son, I and our pets have been homeless since April 30th, 2016. There is a comoany in Washington DC that writes the laws that banks have to follow. The woman I spoke to said there is no statute of limitations on predatory lending and the more oeople that submit their information to them together with the same complaint against ESB, the more likely we are to win. They have recovered over 11 million dollars for people that have been ruined by predatory lenders. Let's do this! I need to set up my computer and get connected to as many of you that have been victimized by ESB as possible and we will all send all our evidence in together! I have copies of all my documents and my motions and appeals! Who's with me?

Eastern Savings Bank Double payment

2006 my husband and I needed to re finance a condo to pay for his mom's funeral...by a friend suggested Easterns. Well they started us off with a super high interest rates 22% with a 1% reduction each yr we keep the payments on time. We were desperate ! The condo was in his moms name ..I was the only one working with strong credit so Easterns made me a co-signer. Need less to say my marriage ended so I did a deed in lieu I just wanted out! Easterns sends their rep and gives me relocation money .fine I should be done NOPE! The place is sold 2 times for what I paid...and eastern sued me for the FULL BALANCE OF THE LOAN, with fees, lawyer cost, penalties, interest total 210, 641.00 OMG! Here's the kicker its been 7 yrs... Now they are garnishing my wages they said I'm soley responsible for the total cause I signed for the mortgage. They never went after my ex just me even though both names was on the original loan? Now I have a new home Easterns wants to put a lean on my property if I don't pay them I'm gonna have to ruin my life and credit again BANKRUPTCY HERE I COME. HELP ME PLS

Eastern Savings Bank Trying to steal

We have been dealing with Eastern Savings since 2006. Our original mortgage was for $50, 000. After making payments for 9 years ($500.00 per month, some $50, 000 later we now owe $61, 000). We have asked numerous times for a mortgage modification - our interest rate is 12.99%. we make payments they sit on them for a few weeks then return them. They have now put us into foreclosure, forcing us into chapter 13 bankruptcy. We have a lot of equity in our property and it is our belief that they want the property, instead of working with us. We are living on a fixed income (social security), and we feel everything we have worked for our entire lives they are trying to steal away. They have strung us along since May, telling us they were working to modify our mortgage. Have numerous phone calls we were told in July they would not lower the interest rate and we would need to pay $5000 cash, make payments for 12 months and then we would basically start all over again paying on this mortgage..

Eastern Savings Bank Predatory lending

We had a mortgage with this company and fell behind due to medical reasons They would not work with us in any way just wanted to forclose. When we did get a buyer we tried to negotiate the service fees and late fees but they would not work with us in any way. We closed in 2010 but we still are being haunted by their negative feedback to the credit bureau, even though we paid out over $10, 000.00 extra in fines on our loan.

Eastern Savings Bank Fraudulent/Predatory Lending

This company has taken my dwnpmt of $126K at closing 2007 with one fixed interst rate ( other discrepancies found on T&L) over the course of years till present it has changed at leat 3-4 times (ILLEGAL). I only owe $76K with $66K in equity they refuse to work with me to keep home, now recvd forclosure papers ystdy 8/30 for amount owed. I was n CHP13 for help (I saw 3 difft int. rates) payments escalated to over 54% of my income, as instructed by Judge Mitchell get her some help todate (no resolve). I had difficult times, burgulary, unforseen medical expenses from military active duty, sought assistance from 2 area ofcs (HUD counseling agencies) these people are so dogmatic. They refused the modification, only offrd forebearance pay $500 mthly put house on market 3-4 months, I did not agree. What am I to do, where am I to go, disabled when signed the loan, no change, dtr that resides with me disabled also, two teenage drndtr also. All my monies gone ESB don't care. Now they are being looked at by fair housing, how can ESB take advantage when you are already down, why not work with me when you have all of my money. Some of their representatives are rude Dawn Stover for one, she even was rude with the HUD Counselor. What are we to do about these people?

This Bank should be shut down forever. How do they get away with this unlawful practice? Its now wonder
the housing market crashed. Eastern Saving Bank played a big role in this and they must be punished. Where is the government and all the politicians when you need them! They only come out when the need your vote. Shame on all the judges that allow forclossure to take place when clearly Eastern Saving Bank has the predatory lending practice and not even the JUDGES have simpathy they are monsters just like ESB

That is a good question. What can we do? I really wish we could do something. I am having the same problem, but not in forclosure. ESB interest rate is extremely 2 high and they won't even think about reducing it. I have also tried to get them to do away with the interest only mortgage of which I DIDN'T want, but they are so hard to deal with. I Pray everyday that I will hear about a classaction lawsuit against ESB. We reall need to do some thing. Eastern Savings Bank Predatory Lending

Hey All,
When I went to court last Monday and told the Judge in charge of my Injunction that I was filing a Motion for an Order Seeking Recusal of the trial judge due to her bias, unfairness and incompetence in foreclosure matters, he seemed surprised. He said that in six years of this Judge being on the bench, nobody had ever accused her of Incompetence, and I replied that when I told her (this Judge) the bank, Eastern Savings Bank, had been being investigated by The Federal Office Of Thrift Supervision in 2008 for their Predatory and Unlawful Lending Practices, and received a Cease and Desist Order and 2 Civil Money Penalties from this Office in 2009 and 2010, so I didn’t have the information needed in 2008 to go after them for the TILA, RESPA, HOEPA, REGULATION Z, and UNCONSCIONABLE LOAN VIOLATIONS, and the Violation of the CT CLEAN HANDS DOCTRINE, her response was “I don’t care if the bank was investigated”. And that’s what is wrong with the system, too many Judges just don’t care, because it’s not being done to THEM or someone THEY care about. We (the homeowners) are just a bunch of lowlife ### that don’t want to pay our bills! And now the Judges in CT REFUSE to grant a 60 day moratorium on foreclosures, so they can go through the paperwork, like they SHOULD, and find the fraudulent documents that were filed, it again goes to show that THEY DON’T CARE, NOT THEIR PROBLEM! WE NEED TO MARCH ON WASHINGTON AND DEMAND JUSTICE BE DONE FOR US! WE did not CREATE this FRAUD, yet WE are the ones paying the price by losing our homes! AND THE BANKS KEEP GETTING RICHER WITH THEIR BAILOUTS, AND THE JUDGES KEEP LOOKING THE OTHER WAY ! WHAT FRAUD?! IF EVERY HOMEOWNER that is in foreclosure, due to what they SINCERELY BELIEVE to be FRAUD done to them by their Lender, got TOGETHER on a SPECIFIC DAY and MARCHED ON WASHINGTON, DEMANDING JUSTICE, SOMETHING WOULD HAVE TO BE DONE! WE CAN NOT CONTINUE TO SIT COMPLACENTLY WHILE THESE FRAUDS CONTINUE TO BE PERPETRATED AGAINST US, TAKING AWAY OUR HOMES AND THROWING US AND OUR FAMILIES INTO THE STREETS!

Anyone in foreclosure with eastern savings bank, who believes themselves to be victims of predatory lending, is urged to contact the federal trade commission at [protected], and give them your complaint asap, also contact eyewitness news investigative team at 1-877-tip-news, and tell them your story. Contact the office of thrift supervision at [protected], and tell them your complaint, and contact your states attorney general. Finally contact the fbi mortgage foreclosure fraud unit at [protected], and tell them your complaint. The more people that have been victimized by eastern that complain to these entities, the better our chances of beating them. Don't wait, do it asap.

well once again EBS has screwed us . Pulling this house out of foreclosure, sucking everything up, , now we are UNABLE to refinance.. due to late payment history...? WTH? Everything should be caught up, no where does it say that--- only negative... EBS does NO do refy. but no one else will touch it due to the history. We are hard working people and cant get a break. Pisses me off!.. we r at 10% now with no chance of lowering it, current rate is 4-5 %.

I have done everything people have suggested- A.G in MN is working with me- but its not to my advantage. In so tired of fighting a loosing battle and being so stressed all the time. Just got a letter from the BBB in Maryland-they are closing this issue because we can not reach a aggrement.NO DAH! I'm not sure I even want another house! Our credit is shot, My husband has 10=12 years left before he wants to retire. If we di want another house I will make sure I investigate mortgage co that's offering us financing. with EBS- we did not have a choice it just happened @ 13% interest I didn't even know how much they were charging. I hat to be persistent with the issue- then I was told I did not DESURVE a lower rate! Who the hell do they think they are treating a person like that? I think that is what makes me the maddest out of the whole issue! The other fact is there is nothing I can do.. EBS is predatory lender.

Eastern Savings Bank predatory mortgages

If you are a victim of eastern savings bank in foreclosure, call and write to your states Attorney General, as well as call the Office of Thrift Supervision who regulates them and oversees them, to file a complaint with them. Their number is [protected]. They will give you a web site to go to, to submit your complaint. Also go to your states court web site and type in eastern savings bank in the party's name and hit search; you will probably come up with a list of people in your state who are also victims of eastern and are in foreclosure with them. I found over 100 in ct and Benito found over 100 in New York. We all need to band together and file a class action or multi-state co-plaintiff lawsuit against them as soon as possible, to put these criminals out of business and in jail where they belong. A Correction. Eastern Savings Banks corporate headquarters are in Hunt Valley, MD. The message below lists their address as 97 Winding Lane, East Hartford, Ct. That is incorrect, that is my home address. I'm sorry, I'm just a little tired!

I agree! I'm tired of being treated in that manner. NO ONE should be told they "don't deserve" a better interest rate- or a better way of life! Everyone has their up and downs, but we need to band together. I'm NOT the underdog,

I have been fighting since 2008 also. I made com[plaints to Minnesota Attorney General, Better Business bureau, both in Minnesota and Maryland. They will eventual take our home- but I will not go down as the under dog any more.

Greetings to the world of foreclosure fraud and defensive actions. I am Walter Springer, and am a victim as many others. I am in court at the moment and have raised claims to the legal sufficiency of proof of claim. My claims are supported by out of court Admin. Proced. Act proceeding in which Eastern failed to verify the debt. and thereby defaulted. Notwithstanding, Eastern had the Green Law Group Call me under false pretense of ushering modification previously denied. Needless to say, this attorney law group would hold de at bay while Eastern filed complaint. I was fortunate to have intervened with application for extension to file answer just days before summary judgment was expected to be granted in my abstencia. Of course Eastern denied knowledge of this incidental happening. Most inportantly, the hearing court order production of the doc's and Eastern Still has not produced such. Their arrotney will try to evade this matter during discoveries, but the court order them to produce and their attotney committed his client with representation that they had it at the office. If they had is at the office they would have pfoduced it, unless it was adulterated. That spells trouble, and possible recoupment of funds for unauthorized securitized activities. To all, be aware of agreements rendered by this bank. The agreements often surrender rights to challenge validity of the holder in due course. I was unsuspecting, but have enough evidence to show intrinsic fraud as a definitive defense to this agreement. Their representations were underlined with intent to stop demonstration of the Invention: Sham Pleadings. Challenge the legal sufficiency of the action and make them show valid proof of claim. They may well be in a servicing possession and not have collateralized the loan with the FSB. [protected]: May, 2012. I am interest in all phases of class actions aganst this predator.

ESB is a predatory lender and how rotten they are. Please post any information on any class action law suits since I know several people who want to get on that list. Call and make your complaint to the

Eastern Savings Bank predatory lending practices

Eastern savings bank set me up to steal my home. They used only 2 years of Social Security Survivors Benefits as income, when to use as income, it has to be gauranteed for at least 5 years.
You who wrote, they are cold, heartless filth and deserve to be prosecuted as the criminals they are. I have been fighting them for over 2 years, in foreclosure.
I urge anyone in foreclosure with eastern savings bank, who believes themselves to be victims of predatory lending, to write to your states attorney general for an investigation. The State Banking Commission did me no good, as eastern wrote a really convincing letter, and they dropped the investigation.

If we all band together, as someone else wrote, we can file a class action lawsuit against them with the help of our respective attorneys general.

You should also file a complaint against ESB with The Office of Thrift Supervision [protected] or go to their website www.ots.gov to file a complaint. The more complaints the better, let OTS know that you did not have the money to pay when they gave you the loan. They have a cease and desist against them as well as other legal suits from OTS, including one where the VP signed loan papers illegally. Complain now.

Eastern Savings Bank Predatory Lending

Eastern Savings Bank appears on many complaint boards because they are a hard money lender that has shown they are unwilling to modify mortgages. They appear to deal only with people who have some equity. The word is they don't budge and people are concerned that some of their tactics should be scrutinized by the Thrift Supervision Board, they already havea cease and desist order against them with respect to commercial lending practices. Consumer alert - Eastern Savings Bank in Hunt Valley Maryland is a Predatory lender. We are hoping to gather enough victims of this company to initiate a class action lawsuit. This company has been preying on the vulnerable for far too long. They routinely charge interest rates above 12 and 13% They also are involved in creating prepayment penalties that may violate many state statutes.

With the current state of the economy and the thousands of Americans facing foreclosure this company stands out as one of the worst. They appear to not agree to modify loans they refuse to work with homeowners and have been known to treat them with disrespect and a cold calculating manner. They appear to be going after the properties rather than working with homeowners in an effort for them to stay in their homes.

If you are a victim - let us know - state your case here and provide info to join in the pending class action lawsuit. We are looking at something similar to the class action suit filed against Countrywide. Eastern Savings certainly appears far worse than CW.

The federal government should be made aware of this federally insured bank and the tactics they utilize to take people homes! People need to take a stand against banks that refuse to modify loans and at least give people a chance!

Refined out of foreclosure in2005. First rate was below 11 percent, at closing was 11.9, had no choice at this point or lose home. They knew I couldn't afford the 2000 plus a month payment. Problems began in 2006 which caused me to ask for help, was told to apply for forbearance, but required full payment plus more, problem continued 2007 into 2008, asked for help and a restructure, was denied, asked for loan modification was denied, now was thousands of dollars behind with fees, was no way to pay and caught up, foreclosure loomed, they stated pay full amount was the only way to save home, home was taken in 2009 and sold at auction. I know they did me wrong and felt that it was me against a very large bank. I want to join the class action suite.

I was not told about all the changes in my loan until I got to the title company and found out that my interest is 12.99%. It has now been 2 yrs and I am facing foreclosure. I was returned 2 payments before I was told about my account being sent to the lawyers 2 months prior. They will not help me now. I was given this percent and payment with them knowing it was more than I could afford.

Eastern Savings Bank misrepresented the details of my loan. When I got to closing, their Representative breezed through the documents. The loan carried a higher interest rate. When I tried to re-finance the loan later to get away from this company, they had built in a fee of almost 100, 000.00 if I tried to re-finance within the first year. This fee was incremental over the first 5 years of the loan. Misrepresentation at best and fraud at the least.

We have been threw just about everything- complained to as many people as possible, trade commission, better business everything led to a dead end. We hired a lawyer and are now fighting . hubby has to cash in his retirement to stay here in this house of 14 years. THAT sucks! We are @ 10 % now, been with EBS for 7 years! Nothing has changed. Trying to get credit in a better pace, but in the mean time, its a waiting game. Our lawyer is trying to get EBS to lower interest, we will see in yr we will be able to refinance but we have to stay with EBS due to credit issues. we have been threw sever modifications... all in their favor, but I was tired of fighting. I was almost ready o let it go and I thought-- If im going down--- EBS will go down with me. I have been working with Minnesota Attorney Generals office, filled complaint, I suggest to do the same with your State Attorneys General. The more complaints the better. Alo file complaint with Maryland BBB and Your state BBB. They suck I know! We paid to have the Sherriff sale stopped, we had this lawyer way before this issue. And they are fighting for us. this is the leverage we need. I know lawyers are not cheep by no reason, but I think this is our last resort besides filing chapter7( I think its a repayment plan, )but then we would have to stay with EBS for a LONG time. Don't want that! The trade commission I also complained to- the list goes on and on! Trade commission stated that they are under their ligation, and they are complying? with who> not all the poor people who are with them, GEZZZEEE! we did I get a pre paid credit card to help. So far so good. But we are still in that limbo stage and I hate it! there was a law suit going on back in 2009, naturally- that's all done. I have not herd if anything else is going on, but if I doI will post here! Keep strong.. WOW still cant believe that they can walk all over the average family and get away with it!

I am just hurting that there is nothing that can be done about ESB predatory lending practice. They do not want to help anyone stay in their home. Why cant anything be done about the way they treat consumers/customers. They offered me a 1% decrease in interest rate when tried to get a modification from them. My interest rate is 10% which is 6 time more than what the average interest is on mortgages. This was only going to be for 6 months! then go back to the 10% interest. When can this classaction get started. It should have been going long ago and put a stop to the way ESB is practicing. Are they above the law? SOMEBODY PLEASE GO AFTER THIS BANK AND HELP ALL OF US GET A RELIEF AND KEEP OUR HOME!

well. another dead in my quest. A, G letter was the SAME as every other complaint word for word, kinda funny, ebs has no BALLS to even write a different letter...lol! I did! The question still remains- what the hell happened to all the "extra" money we paid since 07? This issue might be a blessing . The stress levels are going down. I know I did everything within my power to save this house. We were just getting above drowning and were planning to re model, witch it needs badly, but I guess its not my problem any more.! I have been looking @house rentals and they look better than my house! Will be living IN a house=not FOR the house. I hate to leave, im depressed about that no drought. add another chapter to our life's. I still pissed off @ EBS and will always be. But how many people have they screwed with? lost their homes, their life. I will stillest here just to keep u p with things and if there is anything new, a law suit would be great.

I cant belive the crap we are going threw! Can you rent some place? I know being one limited income is hard. Right now. we are going to have a good Christmas and take every day, one @ a time. We are getting all those things we could not afford before, now. wOW ITS SOOO NICE TO HAVE NEW COOK WEAR!There must be something you can do! It pisses me of Hoe a co. can do that! Getting EBS exposed will be a hard thing to do. I contacted the Office of the controller r that regulates what EBS does, and according to them, they are with in their operating standards.. What standards? BBB states that we cant reach a agreement so that done. I don't get it... I figure what goes around-comes around. Might take some time, but they will fall. And we will be thee laughing @ them
I wish you the best.. You would think that with all the complaints- they would be looking into it well tryto take tings easy. think of this as a new chapter to your life, that what we are doing.

Things are not going good. It is so frustrating when I drive by our home everyday knowing that our mortgage was paid in full 5x and we are sleeping on an air mattress in my dads office. We are not the typical case that went thru hard times and stopped making payments. We had a perfect payment history and we continued to make payments when we had to vacate our home due to Toxic Mold. We have proof that we were never sent a NOD because we weren't in default, no Notice of Sale was sent nor was the sale published in the newspaper. The illegal sale was bought by bank atty with an invalid credit bid. We also have Mold Reports that show we had the highest level ever seen in a residence, pictures & proof of the visible mold and how they tried to paint over it and flip the house. I got the building inspector involved and they could not get permits and sold the home for cash without disclosing the mold. They got paid for a home that was stolen from us an no money was ever involved. So involved but when I look at our son who suffers from PTSD, and no much more to know that these weasels are responsible for my son returning from his 2nd tour fighting for our Country to find out the only home he ever lived in was stolen and we were homeless. 2013 is a new year and I will get this story exposed and all the government officials that have been presented with facts and chose to look the other way. There is nobody that has a complete paper trail in chronological order like I do. There is nothing I don't have. Unfortunately our Lawyer was a wolf wearing sheeps clothing. All the work was done for him and I know every date & payment etc on the top of my head. Unfortunately I am disabled and have Multiple Sclerosis & Trigeminal Neuralgia which are progressing because of the stress. I will not give up until justice is done and the Judge is removed from the bench! Keep in touch.

Eastern Savings Bank mortgage loan

Eastern savings bank fsb is the worst preditory lending bank my interest rate is 11.5% i tried to get my mortgage modified they would not do it i also hired a company to get mortgage modified still wouldn't do it and they bully one of the workers of that company now i am in forclosesure not knowing the mortgage i have is a equity driven mortgage, this mortgage was given to me solely because of the equity in my property if there is any way all persons eastern savings bank fsb has given a mortgage and refuse to work with you please e-mail me and maybe we can all band together for a glass action lawsuit and possibly get these mortgages reduce or remove. On november 24th 2008 the federal reserves put a lien on all eastern saving bank assets the loan amount from the federal reserves was 11 million dollars, this makes all mortgages have been assigned and now eastern saving bank is considered a servicer at this point.

I lived at this particular address 32 years. In 2008 I took out a home loan with ESB seeking 5k to pay my medical bills under the threat of a collection agency. That agency was Walpoff and Abramson. This collection agency recommended that I do a refinance to get the money or have my wages garnished. So per their recommendation I sought out a refinance, not specifically with ESB but with this mortgage company. The admin assistant was very helpful terms were discussed, goals established constant communication. Well here comes a rep of ESB at the 11th hour. The day not designated to be the signing day but the last day Walpoff and Abramson gave me to have a deal. The came almost 7pm on a Friday and nothing was what I thought we discussed. My back the way I saw it was jelled with the wall. Under the terms they knew this was almost impossible for me to make out even reasonably. So I started contacting the Md Hope numbers that was set up by the state of Md to help homeowners prevent foreclosure. They were absolutely, heartbreakingly useless because they said ESB was a private lender. In less than a year it was all gone and no one could help. Now they are suing me for 30k additional dollars after they sold my house which was in very good repair in a nice neighborhood.

go proposed sale of February 13the 2013 and there is NOTHING we can do about it contracted lawyer suggested in post...- they wont even consider us because we do not live in Maryland What a pile of xxxx. It makes me sooo angry! That they can sleep @ night! But I guess that when your getting paid "under the table" I would look the other way also. PLEASE if any one has EBS for a mortgage DUMP THEM ASAP! DONT BE A NOTHER PERSON THAT LOOSES!

the more I dog the more I find on EBS. We had a modification- wow- just throw everything on the back of he loan, sounds great- don't lower interest of 13, OMG! IM not sure what's going on here in Minnesota I just know we are loosing the house of 14 years.. I see that in 07 there was problems that when they took over the loan, Should of looked back then, but now I'm smarter.

Call The Office of Thrift Supervision and complain immediately [protected] or go to their website ots.gov and file a complaint and then file one with your state's attorney general office and file a complaint. The more complaints OTS receives, the sooner something will be done. Don't wait and don't let what happen to you happen to someone else.

An excellent law firm in Illinois that has done battle with Eastern Savings Bank is Edelman, Combs, Latturner and Goodwin LLC: Give them a call! One of the top rated and highly respected firms in Chicago. They also specialize in class action! Tara Goodwin is top notch and Dan Edelman is an expert at HOEPA violations. Dan has published a pamphlet that is very helpful to Illinois residents.

They have done the same thing to me. I also asked for a loan modification and was turned down flat. They went into court for the foreclosure and lied. They had filed a deed of trust in my state for my mortgage with a third name my mothers on the deed of trust at no time was she every on my loan. There response to that was so what we can still foreclose. They lied in court and got the foreclosure. At the sale they purchased the home. They are now trying to evict me without following the laws for eviction in our state. Here are some statutes that may apply to those facing action with Eastern Savings Bank - Illinois is similar to other states. Pay close attention to the common law fraud and common law breach of fiduciary duty: This bank should be investigated for this on a multi-state basis and should be handled by individual State Attorney Generals!
Chicago Municipal Code regarding predatory lending: it stipulates certain sanctions for banks or savings and loan associations that are found to be predatory lenders, such as no award of contract with the city, no designation as a city depository.
Illinois Consumer Fraud and Deceptive Business Practices Act, 815 ILCS 505/1, et seq.: this is an Illinois state law that prohibits commercial deceptive and unfair business practice. Where a conduct is within the definition of Uniform Deceptive Trade Practice Act, it is unlawful whether any person has in fact been misled, deceived or damaged thereby.
Illinois Department of Financial Institutions and Office of Banks and Real Estaterelevant administrative rule: this page covers a wide range of issues that are relevant to lending practice in Illinois, such as disclosure of material information, regulation of brokers and predatory lendings.
Illinois Interest Act, 815 ILCS 205/0.01 et seq.: this act puts a cap on the maximum percentage per annum a lender can charge. The application of this Act to loans secured by first liens has been preempted by federal law, but is still applicable to loan secured by junior liens.
Common law fraud: unlike ICFA, common law fraud requires proof of reliance. In Illinois, you must show: (1) a false statement of material fact; (2) the party making the statement knew or believed it to be true; (3) the party to whom the statement was made had a right to rely on the statement; (4) the party to whom the statement was made did rely on the statement; (5) the statement was made for the purpose of inducing the other party to act; and (6) the reliance by the person to whom the statement was made led to that person's injury. In foreclosure cases, borrowers usually bring a third-party claim against the one who they deal with directly (the contractor, broker, or loan officer). Siegel v. Levy Organization Development Co., 153 Ill. 2d 534, 542 43, 180 Ill. Dec. 300, 607 N.E.2d 194 (1992).
Common law breach of fiduciary duty: the specific elements are: (1) a fiduciary duty was created; (2) the fiduciary duty was breached; and (3) the breach proximately caused the injury of which the plaintiff complains. Martin v. Heinold Commodities, Inc., 163 Ill. 2d 33, 53, 205 Ill. Dec. 443, 643 N.E.2d 734 (1994).
Common law breach of contract: the parties to a contract have a duty to honor their obligations thereunder, and they also have an implied duty of good faith and fair dealing. Saunders v. Michigan Avenue National Bank, 278 Ill. App. 3d 307, 315, 662 N.E.2d 602 (1st Dist. 1996).

If you are facing foreclosure with Eastern Savings Bank you should contact an Attorney at the onset, have them review your closing documents. The loan docs will most likely have TILA, RESPA and HOEPA violations. They may also reveal abuse of fiduciary responsibility on the part of Eastern Savings preparing loans in the Subprime market. This could lead to consumer fraud and the potential for a criminal investigation. Here's why, preparing a loan for a subprime D borrower is a tricky situation to begin with. This is now biting Eastern in the rear. They gave out loans which appear to be train wrecks, that is, loans given to borrowers that only had equity, they used creative financing and hybrid loans that appear to laden with all kinds of statutory federal and state violations. They utilized tactics like no-income verification, outlandish appraisals, brokers that are now out of business etc..A lawyer can take one look at your docs and see that this bank preyed upon victims and was a major player in the subprime mess that is affecting thousands of Americans. Not to mention that this bank also has a Federal Cease and Desist order placed against it for among other things "not adhering to the Truth in Lending act". This bank is also on numerous bank failure watch lists. Complain to Federal Thrift Supervision Board and your local attorney General. Don't let them take your house, fight back against this nefarious bank!

Eastern Savings Bank Fraudulent practices

Eastern Savings Bank fsb is a predatory lender who charged me over 13% on a home loan. I made these draconian payments until I had a health problem .They drew up a forbearance agreement after I threatened them with bankruptcy .. I did that because they would not talk with me to try to work things out.

Instead of helping me they added an additional payment of $100, 000 per year. I kept up with this until I transferred jobs and had to wait for some checks to get to me. But I never missed a mortgage payment during that time In August of 07 I was given until the end of the month to come up with $50, 000. Not only did I do it I also offered 2 months more in advance. The VP said No We've decided we want your house.

I have fought them for along time because I believe this is fraud. They are unresponsive to me, lawyers and mitigation companies. There is so much more that must be uncovered about this bank.

this also happen to me, they had my house as a two family which is not, so i was not able to refinance when i need to, i also need to know how to sue please let me know Sharon.pettwayre@gmail.com

I am in missouri and I am in the same situation with my ESB mortgage. I am going to the state to look at the predatory lending laws. I have been informed by an attorney that my pre=payment penalty is not legagl in missouri. Here is my email address m16baker@hotmail.com.

I am looking for people to join a lawsuit against Eastern Savings Bank...we have two so far and need three more to start an action...do not think there is any cost involved at this time but want to get a list of people who might be interested. let me know.

Eastern Savings Bank appears on many complaint boards because they are a hard money lender that has shown they are unwilling to modify mortgages. They appear to deal only with people who have some equity. The word is they don't budge and people are concerned that some of their tactics should be scrutinized by the Thrift Supervision Board, they already havea cease and desist order against them with respect to commercial lending practices. Consumer alert - Eastern Savings Bank in Hunt Valley Maryland is a Predatory lender. We are hoping to gather enough victims of this company to initiate a class action lawsuit. This company has been preying on the vulnerable for far too long. They routinely charge interest rates above 12 and 13% They also are involved in creating prepayment penalties that may violate many state statutes.

With the current state of the economy and the thousands of Americans facing foreclosure this company stands out as one of the worst. They appear to not agree to modify loans they refuse to work with homeowners and have been known to treat them with disrespect and a cold calculating manner. They appear to be going after the properties rather than working with homeowners in an effort for them to stay in their homes.

If you are a victim - let us know - state your case here and provide info to join in the pending class action lawsuit. We are looking at something similar to the class action suit filed against Countrywide. Eastern Savings certainly appears far worse than CW.

The federal government should be made aware of this federally insured bank and the tactics they utilize to take people homes! People need to take a stand against banks that refuse to modify loans and at least give people a chance!

I AM ALSO IN A SIMILAR SITUATION AND IT IS VERY STRESSFUL. I HAVE NEVER BEEN LATE FOR FOUR YEARS UNTIL RECENTLY...HEALTH CONCERNS AND REDUCTION IN FINANCES. THEY KEEP ADDING ON FEES AFTER FEES...IT SEEMS AS IF I WILL NEVER BE ABLE TO CATCHUP. I AM TOTALLY DISAPPOINTED WITH THEIR PRACTICES AND NOT WILLING TO COMPROMISE AND USE ANY MEANS OF MODIFICATION EVEN IF IT IS TEMPORARY...I FEEL HELPLESS AND CONSIDERING THERE IS SO MUCH DISCUSSION ON STIMULUS PACKAGES ETC...WHERE DO YOU GO FOR HELP?

Eastern Savings Bank Awful bank

My house was scheduled for foreclosure sale today. This was the sixth date set by the bank. I tried everything our government recommended. I asked for modifications and restructure I even called HOPE CRISIS what a bunch of bull. Busch administration did not tell the banks to work with people. Eastern Savings Bank will not cooperate at all. I filed a chapter 13 restructure and the bank asked for a relief of stay due to "position be jeopardized due to declining market". I voluntarily dismissed my chapter and having been awaiting the sale. I am ready to walk and now need to figure out when I will be evicted and how much time. I really need to know how I can get them to pay for my move. The bailout must have worked for some because there were 19 foreclosures scheduled at the same time as mine and all of them except mine were rescheduled or canceled at the request of the beneficiary (the bank) go figure my luck!

This bank did the same to me my rate was 13.99 When I became disabled and had to retire I contacted them to modify and was told we do no modifications at all.
They have now foreclosed on my home and added more then 67, 000 in fee to what I owe. I aslso had a prepayment penaltyl so I could not refi the loan either. They are heartless and need to be closed

Eastern Savings Bank now thankfully has a Cease and desist order placed against hit...by the grace of god hopefully if people stick together and fight this bank...maybe we can help shut them down! contact the FTC and file a complaint against them today! and don't forget to also file complaints with your local State Attorney Generals ! Take Eastern Savings Bank Down!

Eastern Bank stole my son's childhood savings.
I cannot believe that a bank can start charging an account $3.00 a month for not having a minimum balance. Then continue to charge it until the account is $0.00 balance. I opened this savings account for my son when he was little. We had forgotten about it until the bank sent us a letter saying they were going to turn the account over to the State Tresurer as abandoned property. This letter was sent on August 7th 2009. My son went to the bank to try to close the account but the teller would not let him stating that it was an underage account and only a parent could close it. When I went to the bank to find out about this they said that because when my son became an adult he did not meet the minimum $ amount requirement for the savings account and that is when the fees started. The whopping 62.00 account was closed on June 30, 2009. Then why did you send us the letter 2 months later? The banking supervisor suggested that maybe it was a mistake. How can a bank take the savings of a child and be OK with it. I will never use this bank again and I am going to tell everyone I can that they are nothing but a rip off.

I too am dealing with (attempting, but they won't deal) Eastern Savings Bank. When it comes to restructuring the loan, and adding the delinquent payments to end of loan...they say, "We are not that kind of bank", "With all the bail-outs and through course of business, we at Eastern Savings, get no money from the federal government." This quote came straight from Linda Cashman's mouth. She holds title of Vice President. Whether it is VP of the entire bank or just the mortgage dept. I do not know yet.

I have a novel idea, for getting ESB (Eastern Savings Bank) attention. If somehow, all of us that have a mortgage with ESB were to band together and boycott...JUST STOP PAYING ANY KIND OF MONEY TO ESB! DON'T SPEND IT..SAVE IT UNTIL THE MATTER IS SETTLED.

Think about it. It may do nothing at all, and throw us all out on the streets, but if enough people, just stop paying, I'm sure it will get somebody's attention. The trick will be to get all of us that are in default, onto the same page...and don't budge until ESB AGREES, to restructure FOR ALL OF US...NOT JUST A COUPLE OF US. This may sound crazy, but what else have we got to lose? My house is on it's way to foreclosure. I am ready to walk. Feel free to add to the idea...putting our heads together, we may find a solution.

Subject: Eastern Savings Bank

To whom this may concern,
Eastern Savings Bank is our mortgage holder. Due to unfortunate set of circumstances medical and lost of income that cause us to become delinquent on our mortgage May 2008. We call Eastern Savings Bank
to try to work out a modification since Our loan interest is 13.49% and
the payment is $4600.00 per month. We took this loan out in April of 2007,
and payed this loan for a full 11months on time. We tryed to make it to the
12th month to refinance the loan to a lower rate and mortgage payment. We call ESB and tryed to work out a modification. They told me they can do a Forbearance for $ 5700.00 per month. We defaulted in July 2008. We tryed
everything PHFA, HEMAP, USMAC, HERO LOAN, HOPE for HOMEOWNERS, and many more with no help.

We do not want to lose our home. We just want to modify it and start
again. My complaint is ESB is not trying to help us the consumer. This is
home and have no were elese to go. We had different agencies call and they
will not work with us. A loan officer told me to contact you to see
if you could assist us having the bank to help us modify this loan. I hope you can help us.

I am going through the same issue with Eastern Savings! I paid apply2save to contact eastern savings to get the modification and they declined any form of helping us. We have 3 children we have written letters, called etc and Eastern Savings employees are so cold and mean hearted. We were just served papers and not sure how much longer we have. I am trying to figure out other options as we want to keep our home but a 12% rate come on... why not modify the loan and tack the back payments on the end of it? or extend it to a 40 year mortgage? I am not asking for a favor like cash out or totally waive my past payments I am asking for a break. any ideas? I will for sure come back and share mine.

this must be the worst bank ever, I am in a nightmare mortgage with them, I've asked for a mortgage modification, and a restructure I was turned down on both attempts, I went to my state for mortgage assistance, they were willing to assist but Eastern refused to adjust the arrears, they had almost $4000.00 0f additional tax escrows included, even though they agreed to charging me for incorrect taxes, according to the escrow department they could not adjust the figure until the mortgage was brought current, I tried to get them to see that those taxes were driving the figure higher, and making it impossible to pay the arrears but they would not cooperate, I was told. "too bad, you need to sell your house" . I don't know how they could get away with this, its criminal and I don't know where to turn, The representative that is handling my mortgage is the rudest person I've ever encountered, the counselor from my county housing department tried to reason with her, she gave this professional mortgage counselor no respect, I tried to warn her ahead of time, but she said, "the lenders usually work better with them" one conversation with the Eastern pit bull, she said to me "I've never had that happen in all my 20 years" I don't know maybe its me, but isn't it better to have people modify and pay than to have a bunch of foreclosed properties. I'd like to know how others are getting there mortgages modified, restructured and/or refinanced. I have a brand new baby and trying to keep a roof over our heads
