Re: 2006 Chevy Silverado GAP Policy # 1061278
On March 31, 2009 we were notified by Service Lloyds Insurance Companies that they were not honoring our GAP insurance that Cowboy Kia of Conroe selected for us in October 2007 for our 2006 Chevy we purchased from you. Their reason for declining the claim is because they do not cover commercial vehicles.
There are companies that do have GAP insurance for commercial vehicles, which is what they should have selected for our policy.
The salesman, Alex Booker, and the finance manager, sold the vehicle and processed the documents, with knowledge this vehicle was for commercial use. We arrived at the dealership in a commercial vehicle, told Mr. Booker the vehicle we wanted to purchase was for commercial use, he sold us the vehicle as commercial, the finance manager processed the documents knowing its commercial purpose. However, he did not include a GAP policy from an insurance company that covers commercial vehicles. The finance manager later requested a document from our insurance agent to be forward to Citifinancial to show the vehicle was not a commercial vehicle so that the vehicle could be financed.
Can we hold Cowboy Kia of Conroe solely responsible for the balance of the payoff of the vehicle which is approximately $9200.00.
