Yamaha - 2012 yamaha raider

On october 10, 2012 I purchased a 2012 yamaha raider, vin #javp27e0ca014683 from velocity powersports located at 151 gateway drive, ladson, sc 29456 along with $4, 000 in after market accessories. On the date of purchase I drove the bike home.
•october 11, 2012 I took the bike back to order the after market accessories and informed them that the motorcycle was backfiring and shouldn’t be. They said we can look at it when we are start installing all the parts.
•december 3, 2012 velocity picked up the motorcycle from my residence to take to the shop. The mechanic told me when we install all of the parts it should fix the backfiring issue. So the mechanic installed the parts and got finished on december 11, 2012. I picked the bike up and the bike started backfiring and stalling.
•december 13, 2012 I called to let them know the motorcycle was still backfiring and stalling. I brought it back to their shop. The mechanic worked on my bike for four days because he was needing a tapping tool. The mechanic said he got it all fixed up.
•december 19, 2012 I picked bike up and on the way home it was backfiring and stalling out. I called when I finally arrived home. The next day the mechanic came to my house with his son and lap top and worked on my bike. He worked on it steadily for 1.5 hours. When he was done he indicated that the bike “should be good now, have tons of power as he had everything wide opened”. After he left my house I took the bike for a ride to the store. The motorcycle was burning extremely rich pouring black smoke out of the exhaust pipes.
•december 19, 2012 I contacted velocity powersports in regard to this and the service manager, chad said I will call you back as we are just backed up. I never received a returned call.
•december 20, 2012 I called and spoke to chad again. He informed me that the mechanic who had been working on my motorcycle was no longer in their employment. He was let go. Chad indicated that he would speak to jeff about it as he is a better mechanic. I said okay. I wait three days and never received a phone call.
•december 24, 2012 I spoke with service and they said to wait until after the holidays as everyone is off.
•january 3, 2013 I called and the delivery driver was out of town and I couldn’t ride it in as it was shutting off on me and was unsafe.
•january 4, 2013 I called and the driver was out sick.
•january 5, 2013 I called and he said he would get it tomorrow and he will call you before coming. He picked it up at 10:30 am and the driver said why is it pumping out smoke. 5 days went by and I heard nothing so I called back on
•january 12, 2013 I contacted velocity and they indicated they cleaned the plus and its ready to go.
•january 14, 2013 they brought the bike back to me in the cold rain. I was not able to test the bike at the time he brought this to my residence as it was raining.
•when I did test the bike it still wasn’t right.
•january 19, 2013 (or thereabout) I called chad and he wanted to argue and said “i’m throwing my hands up. I don’t know what to do. How long do you let it warm up before driving it?” I said 5 minutes but it sounds like a shot gun when I first start it up. They picked up the bike and again and tested it for three days. Due to the weather I was unable to ride the bike until later in the month.
•january 29, 2013 I called velocity and they said they didn’t see anything wrong with it. I got it back and rode it with my wife and it was backfiring and cutting out. The motorcycle would only go 25 mph at its fastest. We felt unsafe and I drove it up to the dealership and asked if they could fix the bike or put it back like the “fired” mechanic had it so I could get it home. Chad said yes for $95.00 an hour.
•february 28, 2013 I called and said the fuel gage is now not working and this is a warranty item can you fix it. The service department said maybe next week.
•march 5, 2013 I contacted the dealership again and asked for the bike to be picked up so the fuel gage could be repaired and the bike worked on as it would drive okay and then go to bad in no time at all. I felt it was to scary to chance. The service department indicated the driver was out of town could I call back tomorrow.
•march 6, 2013 driver was backed up on deliveries. He would have the driver call me. A week later still no call back.
•march 21, 2013 I called charleston powersports and took it to them. They said to take it to the dealership where I purchased the motorcycle. They indicated they weren’t allowed to touch it unless it was a factory warranty.
•march 25, 2013 I called myrtle beach powersports and they said they couldn’t as they were instructed not to touch it.
I then took my motorcycle to velocity powersports and asked them to try and sell it. They said they would and left it behind their building for a week. They didn’t show the motorcycle at all. I sent a friend who was interested in purchasing the bike and they would only show him a new yamaha raider.
One of the purchased after market accessories for the bike was cobra sweeping pipes. Installation was done by velocity powersports. The mechanic stripped the o2 censor and told me he had to re-tap it. After removing the pipes on august 10, 2013 I discovered he welded the hole shut. The mechanic drilled a new hole in the pipes and made the hole bigger than necessary.in an effort to fix the error some form of tape was used to fill the hole so the o2 sensor could be pushed in and not screwed onto the factory torque specifications. The tape kept he 02 sensor from grounding.
At this time I also discovered that the right foot peg for driver was missing a bolt. Attached are pictures of the pipes and foot pegs.
In good faith I have contacted velocity on numerous occasions in an effort to get my motorcycle repair with their assistance. I feel as if I have come to an impasse and that now I must ask for yamaha to assist me with my concerns and issues that I am having.
I have tried to contact yamaha on several occasions, left messages and had to hold for over 45 minutes and have not been successful in receiving a return phone call or response in regard to my issues. I sure woul d like to get this matter resolved.
