Wells Fargo fraud charges to a closed account

On 11/2008 i closed my account with a banker Vic Jenkins at the above location, Vic told me "your account is closed". Then cut up my visa debit card there in front of me and my father. Exaclty two weeks later 11/19/2008 wells fargo hits my "closed account" with a "monthy service fee" of eight dollars. On 11/24/2008 my "closed account" was again charged, this time by Blockbuster video for sixtyfour dollars. 11/26/2008 my "closed account" is refunded sixtythree dollars from Blockbuster video. Meanwhile my "closed Account" has accumulated negative fiftyone dollars in charges from Wells Fargo when again on 12/3/2008 my "closed account" recieved a eight dollar charge from Xbox Live. My "closed account" with Wells Fargo is currently - $104.00. When i recieved all this information i told them i would give them ten dollars and that the rest of the nintyfive or so dollars was all charges from them on a an account that they told me was CLOSED. I was told two days in a rowe i need to speak with the manger each time no manager was there that could "reverse my fee's". Im still waiting today...
12/12/2008.

This is multi-million dollar criminal fraud that will with my help have a class-action law suit behind it. And there's no cleaning it up Wells Fargo because I now have irrefutable indisputable proof, beyond all reasonable doubt, that you {Wells Fargo Bank referred to here out as "you"} knowingly and with forethought and malice gave instructions to lower management to do several things. And love this, We now know why you thought you were not going to be caught --sorry!

Goes like this:
Step 1 -- Just like the gentleman that started the complaint a person closes out an account with absolutely nothing pending on it and does so with a printed receipt that he now has a zero balance.

Step 2 -- A period of silence normally goes by, or from what I can tell it may a "varied" waiting period for it to appear legitimate. But soon after the person, here is the fraud, charged a monthly recurring fee, to the zero balance. Now whereas you are going to claim, ah but I am one step ahead of you Wells Fargo, you will attempt to claim that the account was closed "during" the exact time period that the account did not have money in it, yet not fully in a closed status --if that makes sense, which it does not, though they remedied this.

Step 3 -- They in return do not call the unsuspecting consumer as this would render complaints such as this. They instead turn it over to a collections agency, and guys I love this more than ever, a collection agency owned by none other then Wells Fargo.

Step 4 -- This money is or never was meant to be collected by the consumer, as I discovered and taped a phone conversation> here is the jist of it. We, the consumer are not sent out any type of collections letter nor given any of the usual phone calls normal collection firms rely on. So here "DEBT" is created/manufactured and goes largely undetected or rather unchallenged as the monies are not aggressively sought. In fact most consumers will report of not finding this debt out till much later and usually through some kind of fluke, like calling in to complain about some charge and an attendant revealing the debt.

Step 5 -- This debt is conveniently kept to under a hundred dollars though besides the monthly service fee they tacked on out of thin air they now also add another charge, perhaps two extra charges: a late payment fee and a fee for being under the limit. All still less than $100.00 dollars though around the $50.00 dollar mark for each account. I had closed on the same day a personal checking account and a savings account both totaling a hundred dollars of debt. This DEBT is slated for "CHARGE OFF"and the America taxpayers are now responsible. The IRS is never alerted. My under cover bank employee has recently revealed another fact that will demonstrate malice and knowing the difference between right and wrong. It is...

Step 6 -- All debt that is sent to collections comes with an incentive to pay the bill. It is called your credit score. Wells Fargo Bank was given specific instructions that this debt would never affect the consumers credit report and further more never reported to the Credit Bureau's what-so-ever as this event could and would be the one thing to raise the red flag. Eventually the folk seeking credit would discover their credit score had been negatively impacted, though because it is never reported it never sound any bells off. Very clever though a truly air tight case. Oh yes, my confidential informant is an impeccable non-impeachable witness. She was reluctant at first especially when I informed I wanted her to do it for the fact it was the right thing to do not for money. The money could discredit her testimony against key banking officials the day of trial. We are good to go, clean as a whistle.

Closing Comments: We need though at this point more consumers that will come forward with the same scenario. In-house documents have already been recorded and copied therefore if they get the urge to purge they are a little too late! But again we need live bodies before actual Discovery and Grand Jury summons. Wells Fargo will need to absolutely credit me back every fee they ever garnished for my entire life of having banked there for me to go away and not pursue. I find it impossible that this will happen as the powers to be are not the ones reading this and probably think they are smooth sailing. Please contact me or leave contact info. for you in the comments section here. We are talking Class-Action suit with special circumstances which qualifies in anyone's interpretation of the law as punitive damages. This was no over-sight fellows. This was no accident. This required advanced planning and inclusion at the very highest levels of the banking corporation. It has gone on undetected for years and has effected thousands of consumers resulting in the theft of millions of dollars. Partake today in a Class-Action and get the refund you are entitled to. Do it because it is the right thing to do and stop corporate theft in America. We are counting on you to come forward. A public service announcement will be developed and aired on mainstream television so it is only a matter of time.

Wells Fargo no help on loans

This bank is the biggest rip off ever! They do nothing to help you with your home mortgage unless you are around 90 days behind! What good is that? Unlike other banks, they are NOT reaching out to customers who need assistance but are not behind on any current payments. They will wait until you crash and burn first before reaching out to you. THEY NEVER MODIFY ANYTHING. ALSO, THEY NEVER GET BACK TO YOU. I HAVE CALLED 20 times, handed in all sorts of applications for assistance and yet still, not even a phone call back! this bank is a scam!

Wells Fargo fraudulent activity

Due to negligence on the part of Wells Fargo and Washington Mutual I have lost my house and my good credit rating. 2 and half years after my divorce and the bankruptcy of my business, I re-established my credit an purchased a home for my self. I refinanced that home after a year to get a fixed rate and rid my self of the 80/20 scam. Wells Fargo granted my the loan but it was a variable rate loan and I was told that I could refinance after a year to a fixed rate because my credit was good. After the year I submitted the paper work for refinancing with Wells Fargo and other lenders to find that I was turned down because of my debt to income ratio was no good. I had not purchased or done anything with my credit during that year and my income was about the same. I fought with Wells Fargo for a week to find out what could be done, clearly there was a mistake, but no one could tell me. So I began an invention of my own. The first thing I did was submitted and application to pay my bill on line with Wells Fargo online banking, and lo and behold, I didn't have a $140K mortgage but I had a $268k mortgage. In short, they purchased my X-Wife's mortgage and attached it to my account. I called them and explained it to them. They act like they didn't know, surprising to me. I communicated with them for a week alone with Washington Mutual. They began accusing one another. Finally I was asked to submit all the paper work to each bank. My divorce, my bankruptcy, my quick claims deed. After that I fax them the paper work, they confirmed that they received it, both banks, I didn't here anything from either of them for about two a month. Then I received a letter from Wells Fargo, A foreclosure letter. My account had vanished from the account log on page of Wells Fargo, but my X-Wife's account was available for me. I can view the activity of her account but my mortgage account has vanished. They will not respond, my credit has been totally destroyed, and I don't know what to do. Can anyone help?

Wells Fargo harrassing phone calls

Approximately two months ago, I began receiving phone calls - sometimes twice a day - from Wachovia asking for someone I did not know. They were told that I was not the person they were seeking, and I was assured that my phone number would be deleted from their list.

Yesterday, these phone calls started up again asking for the same person as before. I have been called twice today. I returned the call and told them I was not the person they wanted, and that I did not know this person. And once again I was assured that my phone number would be deleted. What else can I do to stop these phone calls?

They call, almost always early on a Saturday morning, demanding to know when we're going to make our payment when we are still in the GRACE period. We've never had a late charge! (It's always within the grace period depending on our paydays. They can see that.)

And they're incredibly rude...they make it sound like you're a deadbeat. They say "You ARE late and we have a right to know when we're going to get paid." This doesn't sound like 'grace' to me.

So we're going to refinance this house...simply to get Wachovia to leave us alone. (and we'll get a better rate doing it.) I was just wondering if anyone else was frustrated by them.

Wells Fargo balboa forced insurance

It seems this complaint is pretty common among this board. So I fell victim to the same forced placed insurance as many others. A few months back I changed insurance companies to get a better rate. For those who don't know, in CT it is illegal to hold a car without having insurance so the companies here are very stringent about getting the coverage right and not putting their customers into a legal problem. Wells Fargo apparently never got confirmation of this. They claimed they received word of the cancellation of my other insurance but not of this new coverage opening up. Which is absurd, first off, considering CT's law. So, rather than try to confirm it themselves which any company can do easily, they tack on forced insurance through balboa. Let me try to make this as concise as possible. The collection calls begin. I called Wells Fargo and they told me they couldn't help me at all, that Balboa is a completely separate company and that my gripe is through them. I called Balboa and they said they needed more info, so I made a three-way call with them and my insurance company. My insurance company (Unitrin) is fantastic and the woman made verbal confirmation and Balboa said OK, we'll update the account, we don't need anything more. Hang up. Next day? Collection call. This is three days later now and Wells Fargo is still looking for money. Are you kidding me? Wells Fargo claims that when I make a payment (Mine happens to be 475.69 a month) the first part goes to interest, the second, goes to forced placed insurance, the third part goes to the loan. Which means that they give my money out to a separate company before taking the part that I owe them? Give me a ------ break. If I ever had to do business with Wells Fargo again, I think I'd shoot myself. What are people doing to resolve this garbage?

Wells Fargo wells fargo bank;overdraft charges

In late October, 2008 my checking account was overdrawn on 3 items, and the same 3 items continued to hit and accumulate overdraft charges at $35 a crack. There was another item that showed up that was an error and should not have been there at all...again, more OD charges hitting multiple times. The OD fees were so excessive that any money I did get I needed to live on and could not sacfifice to these fees. Finally almost 60 days later I got a nice check for about $1200 and cashed it and went to see my Wells Fargo Branch manager. Matt Kaillail is the biggest ### in the world. He never did return any of the calls I made and as I was forced to deal with a Personal Banker named Tamieka, she was the go betweeen. Even she was not professional enough to return calls except when I came into the branch on a daily basis trying to chase down a answer. I was told that Matt had the information was on vacation and would "Take care of it on Monday". so believeing this jerk, I deposited $800 to bring my account current thinking that Take care of it would mean reversing the almost $600 in OD charges that had accrued to date...these fees are pure profit and can be waived and it is no skin off anyones nose! Instead of calling me as Tamieka promised he would, I got a call from her telling me that he had looked into it and because there was no "Bank Error" he was not going to reverse the fees. Basically they stole from me $600 I badly needed to pay bills etc. I went through this last week', my 9 year old sons birthday and Thanksgiving weekend with virtually no money because of this lying no count thief at the Wells Fargo in McKinney! I intent to find out who his boss is and start chewing my way up the food chain until I get my $600 back and get this ### fired! This is not the way to tell your customers that they are important to you and you want to keep them. Matt told me this morning when I went to visit him in his office. "If you cannot manage your account it is not our fault". What a jerk! I will tell everyone I come in contact with to stay away from WF and especially that branch and that bald headed ### Matt Kaillail. I opened up an account with what little money I had left with Bank of America and told them all to F off!

wells Fargo uses software to purposefully cause overdraft by clearing large checks first then all the smaller ones to force and overdraft situation and rack up fees on the smaller withdrawals!
It is purposeful! They make billions on this scam that is so far legal but unjust and criminal!

Also note above the small amounts charged that they waited to post til after a bigger amount was first posted... and then charged me and extra 105 dollars in O/D fees. All I asked for was 2 of the O/D fees to please be reversed so I could get back on track ~ customer care or personal relations my foot! TO ALL YOU OUT THERE BOYCOTT WELLS FARGO!

Happened to me too ~ the first couple times I just dealt with it ~ then the last time I took the info down to the Branch, explained how the charges were incorrectly hitting my account which is causing the O/D's ...the Branch Manager said she didnt have the authority to change anything ~ even tho all I was asking is the extra O/D fee's to be removed and how I could prove with receipts ect and even the shops deposit records that WF was posting the charges incorrectly. When the branch wouldnt do anything about it ~ I scanned all the info and sent to the customer service contact given to me to contact. This is what I got back

*********************************************************************************************************
Overdraft and Return Check fees are posted to your account on the business day after the actual overdraft occurs.
In reviewing your overdraft fees, I found that although you made your Check Card purchase at xxxx for $8.25 and $5.75 on 10/16/2009, xxxx did not present this transaction to Wells Fargo for payment until 10/19/2009.

(more blah blah blah on how its not THEIR FAULT etc ... but note I never said it was or wasnt their fault I was asking that 2 of the 3 O/D charges be removed because I could prove with receipts that their was funds in the account at the time of the charge...but Nooooooo they'd rather lose a customer than lose their precious extra fee's and predatory income they sooooo rely on ...all Ive found are bad reports on Wells Fargo ~ so never again with me and Im telling everyone I know how they treated me...the letter continued)

At your request, I have closed your Custom Management Checking account effective today.
We realize that in today's environment, customer service often becomes the deciding factor when a customer chooses a financial institution. Wells Fargo is truly committed to coming through for its customers. ( Yah right~~!) Our goal is to continue to meet and exceed your service expectations. (If that was so a simple ~ removal of excess fee's wouldve been the answer!)
We are sorry that we failed to meet your expectations but hope you will allow us the chance to serve you again in the future. (Again ~ Never again! EVER!)

WellsFargo dod the same this to us. We are disabled and last November deposited over $43, 000 into our account. We have never been overdrawn before. Suddenly, last July we started accumulating overdraft fees to the tune of $490. Plus what they said we spent. Why, if there was no money in the account, would they allow a transaction to go through? Needless to say, the Oregon Overdraft call center began to call. I have on our caller ID, just from the past 3 days almost 20 calls. Six and seven times a day. They do not want to identify themselves ot let you talk to a supervisor. We went to our bank Fri. and I had already went through the online banking and fiund that there is a bank error and not only are we NOT overdrawn, we should have over $1200 in the account. So I call the call center to tell them to stop calling, that we just went to our bank and the bamnk manager is handling it. The woman, her name is Chandra, told me that I was done talking and asked when I made the deposit to cover the overdraft. Not matter how many times I told her that we were NOT overdrawn, she was too stupid to understand apparantly. Then when I told her for the hundredth time that we were NOT overdrawn, this woman had the audacity to start LAUGHING! At that time, my husband took the phone away from me and told her about herself. Now we have no money, overdraft charges, owing money to the bank and the whole time we actually have money in there, but until they fix it, we're broke. I was on the bank site for over 3 hours going through it line by line. As soon as this is cleared up, I'm taking our business elsewhere. Someone needs to crack down on these unprofessional, rude, snotty, ###s. They have harrassed us for WEEKS! Every day, day in and day out. No matter how many times you try to tell them that your bank is handling it, they just keep calling. Even at 10p, on Sundays (both of which are illegal). I'm in the process now of reporting them to both the Iowa and Oregon Attoney Generals. My Mom had major accounts with this bank and we've had HUGE amounts of money come in and out of our account. I'm tired of these ###s being rude even to my children! I agree with the comments above. these people are no different than predators. While their fat ### CEO's sit at their desks and their kids go to private school and skiing vacations in Europe, I don't even have enought money for a gallon of milk. All because of their bank error. My husband and I doubt very much that we'll ever see our money. Their mistake-we pay. Thanks for nothing WellsFargo!

I too have been a serious victom of Wells Fargo overdraft and wrongful practices. upon moving to Tracy Calif. in April of 2008 I opened a checking account with WF Bank. It was to be a automtic deposit account once the proper papers had been filed with the State. I opened with $600 chck & $200 Savings to hold till the automatic deposits began. I stated I wanted a basic ATM card. During the intial set up the associate assisting me was interupted a couple of times and working with another issue also. But it did not trouble me as I had my Down Syndrome daughter to look after also. The first statement arrived and I was surrprised to find that I had already had an overdraft charge. Had to be a mistake and I was going to look into it. then the stream of notices that my atms were also overdrafting. I went over the two statements and it began with a $12.00 annual fee for what ever type of account they were listing me as. I went in and explained to them that I was not to be charged any fees until my account actually began collecting the automatic deposits. I showed them the $12.00 fee and the $75 charge for automatic transfer to my savings. which began the overdrafts. for the next 4 or 5 statements I received so many overdrafts all my savings were used and in June when the deposits acutally started, Wells Fargo was eating up 3/4 of my deposits within two days of my deposits. Some were $400 to $500. I went in again. I called, I wrote and have many of there corresponding letters. Stating they were completely in there rights to clear all checks before any atms. I argued and complained. I send copies of how the atms were used. I was told by the associate in the band that I should not be in the habbit of using my ATM on such frivolous things as buying hamburgers at McDonalds! I told them what I use my atm for is my business and that that is the whole point in asking for it when I opened the account. That I surely wouldn't have used it if I was paying $64.00 a burger. I began falling behing in all my bills because they were eating up all my income! My deposits were $840 and I was lucky to see $250 - $350 of it. I called and said "you can not tell me that on the 27th my deposit was good on the 29th I am -$450.00 and still accuring.. Still nothing was done to help me. the last direct conversation from the main branch. Was very rude and a direct " Well that is to bad! you owe the default amounts and we can deduct the withdrawls in which ever order we want to! It is perfectly with in California law how we practice business!" I stated "My atm is and was good at all times. I know that if I don't have enough money the machine will tell me insufficient funds! you are telling me that two weeks after my atms are cleared you take a check from whats suppose to come out of a new deposit and it makes all the smaller atms bad! you can't do this! My whole world is collapsing and you say it's too bad!"
I am just so glad to see this lawsuit because I sent them letters stating I would sent my info to anyone who would listen. I've ruined any credit I was trying to establish! I am so far behind and even up to two months ago Wells Fargo finally closed my account threatening to take me to court and use whatever means to pay them.. I survive on caring for my daughter and her SSI and they didn't even care. I have all letters and statements. This is so wrong Im even having to lose my current place of residence because of being late with payments. WF actually double deducted my auto insurance payments because the stated they were sent back and then you would see them both on my statements. I called again. They sent papers that I would have to get notorized by a certain date or the amounts they put back in would be reducted. God I pray too get reimbursed and my life put back together as we are ruined! Sincerely, Stephanie

Wells Fargo bad service

On July 26th of this year, I called the Wachovia Bank by my house to ask if they would cash the check I received from my insurance company for car repairs. They told me to do the following: take the car to the dealer to get it repaired, then go to the bank, they would have me fill out a form and it would be signed over to the dealer so the repairs can be paid for. I go to Wachovia Bank near my house on Aug 9, 2008. I speak to a person and he gives me the phone # to Wachovia Dealer Services. I call Wachovia Dealer Services. They tell me to mail the check to their office in California and they would sign it over. I live in Colorado. My car repairs are finished and the car ready to be picked up. I don't want to wait a week for a person out of state to sign over my check to the car dealer. My Mom then calls Wachovia Bank today, Aug 9, 2008. She is told the same thing I was told yesterday. That I would have to get it signed over by Dealer Services. Not from the bank itself. So within the course of 2 weeks, Wachovia Bank reversed their policy. We asked to speak to a manager. We ended up speaking o a manager and the manager at the bank told us the same thing. If I was told I would have to go to the Dealer Services originally, I would not have taken the car to the dealer yet. The only possible bright side is that there is a Dealer Services office in my state. Unfortunately it is about a 50 mile drive to and from there. Because of the inconsistency, I would never open up an account with Wachovia and I would not recommend people do either.

Wachovia is the worst bank in the world. Since they merged with Wellsfargo they have become even more heartless. I would not recommend getting an account here at this bank. Suntrust is the best bank ever. I am in the process of shutting down my bank and going over to Suntrust. They are crooks hidden behind the wachovia name. If you like giving away free money in this economy then go with wachovia. You've been warned.

I deposited 500 hundred dollars in cash last week and received a receipt for it . The money was not deposited in to my account . The bank manager of WACHOVIA told me there was an arrow and she will fix it as soon as possible . I have been a very good costumer for almost 8 years, but I decided to take all my money and transfer to another bank. Do not trust them ! they are in trouble and their service is very bad .

I financed a 2002 Dodge Stratus through Wells Fargo. The car was totaled out in an accident.I notified my insurance company as well as my gap insurance provider and Wells Fargo and provided accidents reports etc as directed. For some reason that I cant explain Wells Fargo would not cooperate with the insurance companies.Every time I checked the status with the insurance companies they said they were waiting for a response from Wells Fargo. After a couple/three months of calling them and asking why they were stalling they kept telling me the insurance company had not them any information. Not to mention that every time I talked they would also claim that the information that my wife & I faxed never reached them.( 6 times at least) I called my insurance company and the agent had me call them with 3 way calling.wells fargo tried to calim no contact until my agent cut in.Had to do same with GAP insurance. After months of stalling they still put on my credit report that I owe them 4000.00 claiming no payment from my GAP coverage.Called GAP insurance & got proof of check amount that was sent to Wells Fargo.I checked my report again and found the exact amount that GAP insurance paid was off my report but some how or another Ihave 1500.00 that they charged me for car payments they claim I didnt make m while my accident claim was being processed. How can they charge me for lying and stalling?

Wells Fargo mentally challenged mortgage dept.

This is the most incompetent, careless and dishonest company that I have ever dealt with! I got divorced in 2004, and my home was given to me. However, Wells Fargo not only turned me down for an assumption under my own name, they issue me refund checks that both myself and my ex-wife have to sign. They completely disregard court orders. I sent my divorce decree NINE times, and NINE times they lost it. I had to hire an attorney to force them to re-issue my escrow refund in accordance with a four year old court order! What's worse, is that Hurricane Ike struck and damaged my home while all of this was going on Sept 12, 2008. My insurance company made a settlement check to me and Wells Fargo. After speaking with several people, all of whom make up rules as they go along and have different answers for the same questions, I am back to square one. I had to re-hire my attorney because the exception department at Wells Fargo Home Mortgage says that they have lost various pages of my disaster package. I have wasted almost two months dealing with these idiots, and I am in danger of being sued by my contractor because they are never going to give me my money. I am forced to live in a home with ceilings and walls that are on the verge of collapse, windows covered by boards, mold growing in the attic insulation-the list goes on and on. I cannot believe that Wells Fargo shows such little regard for people who give them business. Every day I try to reason with these people and am told different stories, lies, and no one seems to know what is going on. For an industry that is in trouble, Wells Fargo has to be THE WORST representation of humanity next to Osama Bin Laden! Why is our government bailing out ### like Wells Fargo? We should have let them collapse so those people would have to work minimum wage jobs and live check to check like a lot of us. I guess I got victimized by Hurricane Ike once, and now Wells Fargo Home Mortgage is making the suffering even worse for me and others around the Houston/Galveston area. I am speaking with a reporter from the local Fox affiliate station, and have posted a large sign on my property letting the rest of this devastated neighborhood know that Wells Fargo Stole My Insurance Check. I look forward to suing them for the incessant misery that they have perpetrated on my family.

We were kick out of our home in March 2011, while we were sending payments to Wells Fargo. They sold our mortgage to freddie mac in 2009, but still recieved payments from us...Now we are stayin with relatives next door. Right now the property cant be sold because it has no septic tank because my inlaws gave us permission to use the one on thier property and also the property line has a building/shop on it...So we are waiting to hear about our property...I feel we should get it free and clear because no one else can buy it and they cant sell it. We have been under a lot of stress and i have become physically ill from all this...And my son has also felt embarrassed from this. If anyone has a similair story, let me know...It is a shame that all this happened, but they gave us the run around and sold our property and still accepted our payments...I just want my home back. I dont want to be greedy, but the fact remains that the property should of never been financed with no septic and property line on a structure...We lived in this home for 11 years and i feel that it would be best to just give us our home for the pain and suffering we had to endure the last 7 months...

God help me. I just initiated the process of assuming a home loan with WF. The home was first purchased in 2001. I got divorced 3 years ago and was awarded the property. However, within 3 yrs I agreed that I was to finance the home in my own name and release my ex of all liability. That time has come and I am at their mercy. I am not on the loan at all, but I have been paying, on time, through automatic debits for 4 years now. My score is merely in the 600 range. Of course, as far as the credit bureaus are concerned, I don't get any credit for paying a monthly $1200 mortgage for the last 48 ms. If I don't qualify, my ex will post foreclosure and my 3 kids and I will be out on the street. If anyone believes in prayer, lift us up. You all are in my thoughts as well.

Going through it now with them. I just got the assumption paperwork today. They said to fill it out and send a check of $14 or $15, and it takes 30 days to get an answer for my request. They did give me the run around for 3 days. I just got laid off and won't afford to make the next month payment, so hope they hurry it up. If not, may have to foreclose on the house. You would think...they would want to save there investment. I'm trying to get help before its to late. And they act like they can't help you...uhhhh

Wells Fargo was not interested in helping me gain a modification. They lost paper work, they miscommunicated, sent me to fax numbers that were not correct and when I called (several times a week) to make sure they got it, I would have to resubmit and go through the same innane process. I sent a full information packet which was certified and notarized. Wells Fargo says three months later that they did not get some piece of information but couldn't tell me what it was. At one point one representative told me to take 10, 000 dollars down to the bank immedately to pay on my mortgage. I called back to get paper work that would protect me and the new representative said "'Oh no, we don't want you to pay yet, wait for the modification to be complete." Wells Fargo's final letter stated they rejected my request for a loan due to missing information-none was stated. I called the Wells Fargo President's five star customer service center in San Francisco and Mr. Jake Frahm stated, "My manages do not like to see social security disability as income." even with sufficient income to cover the loan. The Fair Housing ruled in favor with Wells Fargo-why because they had no record of any of my information. A Class Action Suit is in order against Wells Fargo. They have learned to play the game by a bumbling communication network that they are not held responsible for.

They are many companies that are legitimate and can help homeowners stop foreclosure and keep their homes.

Mortgage Assistance Group is one of those companies that holds an "A" rating with the BBB and has help over 500 homeowners keep their homes.

They give a discount to the homeowners who have been scammed and treat each client with respect and dignity.

You can reach them at [protected] and at www.mag-az.com.

Thanks and good luck,

Oh, don't worry... I have been in this loan modification process since Sept. 2008! I kid you not! I have been transferred to more negotiators than I can count and nobody cares. Nobody. I am transferred and everyone has a different answer or a "just wait". I am told the same thing time and time again. Then I get one person who seems to know what they are talking about and I can never talk to them again. I feel hosed, taken advantage of and just get angrier every day. It is now almost June and I still have no resolution!

You go man. I have been in a modifcation since Feb 2009. Everytime I call to get an up date I am told the same thing. No news yet. Your loan hasn't been assigned to anyone yet. How long does it take to give a loan to an assigned person? I keep telling them that it has been months and you keep saying that my loan information is still laying on someones desk and no one cares one way or the other if it is ever assigned to anyone. Basically that is the answer I get. I wonder if any of them is in the same boat as we are? I hope their paperwork is still laying around waiting on someone to pick it up and look at it.

Wells Fargo terrible experience

First, Wells Fargo told me that a cashier's check is as good as cash. So I sold an expensive camera on Ebay for $15, 000 and the buyer gave me a cashier's check. I took it to Wells Fargo right away and they refused to cash it. I said 'You guys told me a cashier's check is as good as cash. What's up? They just kept saying 'We don't know if there are funds to back it up.' I said 'Well then why are you telling me it's as good as cash? I wouldn't have taken it if I had known that wasn't true.' They had no answer.

I finally cashed it at the issuing bank (Sumitomo Bank), but it was a huge hassle. So yes, I also have a problem with Sumitomo Bank. They only had one branch in Northern California, I had to go there, they detained me for an hour while they figured out if the check was real, and they refused to give me a new cashier's check (only cash). The CSR said 'why do you want a cashier's check? You already have a cashier's check.' I said, 'I don't want the person who wrote it to be able to stop payment.' That just opened a can of worms because now they considered me suspect.

They also made me fill out an FBI form because I was receiving over $10, 000 in cash (after deciding they would not give me a check). So I walked through San Francisco with $15, 000 in cash to my bank. I was a little bit nervous. I then had to sign another FBI form and sit there for about another hour because the previous bank ran out of $100 bills and issued the $15K in small bills (again instead of a God Damn check).

Then I deposited about $4000 in checks in a Wells Fargo ATM. 4 checks. Suddenly checks I was writing were bouncing. I called WFB and said 'what's up?' They said 'You deposited an empty envelope.' I said 'No I didn't.' They said 'We'll do an investigation. It will take 10 days.' They finally found my checks, but in the meantime all the checks I had written bounced and I looked like an ### to everyone I had written a check. I use a credit union now. Don't use Wells Fargo. I hear B of A is just as bad. Don't use Sumitomo Bank either. I have more info, but this is taking forever.

Use a credit union. They don't fee you to death, they don't have to pay taxes so they don't screw you over.

Wells Fargo refuse to accept mortgage payment

I fell behind on my mortgage payments, I still needed to pay for Oct. payment, I called on Nov.13th to make the payment, thinking I would be current, since it is still NOVEMBER... I was told I could not make a partial payment, which confused me, so I told her I was making the full Oct payment, and was told that since it was already Nov I was also due for this month, and I had to make payments for BOTH months. I told her I only have money for 1 month, and she said she could not take my payment, and to call back when I can make both payments, because they do not take PARTIAL Payments. I told her that was crazy, and I have never heard of a creditor REFUSING to accept money. You would think with all the mortgage meltdowns and foreclosures Wells Fargo would try and be a little more considerate, but I guess they just don't care about their customers.

Hello Lynette, Catherine, Lon and all other distressed Wells Fargo borrowers,

I routinely look for posts to answer in hopes that it will not only bring optimism to those homeowners and borrowers in distress but also some basic information to assist in fighting the banks that are "too big to fail" but yet don't appreciate the bailout that we provided in their time of need. The debt collectors like Ocwen and Nationstar are simply just ### but they can be beat at their own game too just like the big banks can be defeated. My firm routinely seeks out complaints online so that we can educate as to how to fight back on our weekday show called "The Daily Complaint" (thedailycomplaint dot com) where we review a complaint and how to tackle it successfully (we are reviewing your complaints on 5/13/14).

It pains me that you have fallen victim to the unfair, deceptive and abusive practices of Wells Fargo but you do have rights and I would be more than happy to educate you as to how to fight for your rights. You should absolutely familiarize yourselves with the CFPB as well as RESPA since many abusive practices are prohibited under these Acts and regulatory entities. You may also want to check into the resources available at the FDIC, OCC and FTC as they can be extremely valuable. We can help too!

Wells Fargo is ruthless about foreclosure, dual tracking and violating bankruptcy law. They refuse to even acknowledge a loan mod review was requested and have attempted foreclosure during the pendency of a lawsuit. Very bad company and they do deserve a good class action case. My property is in Texas, a state that is friendly towards bankers. My fear is loss of equity in a home where my children were raised and I had hoped would be there when I retire. Like the rest of you, they refused payments timely sent and applied them to a disputed escrow account. Wells ultimately threw the loan into foreclosure unnecessarily. I have to agree that Wells is nothing but a legal organized crime ring.

We have the misfortune of having Wells Fargo as our mortgage company. We fell behind a dew payments and attempted to make several large payments VIA moneygram to catch up only to be served with notice of foreclosure. Once I contacted the mortgage company they said they had refused my payments! I was never notified of their refusal of payments- meanwhile they gave me a retrieval code for one payment and when I asked about the other $2500 payment made to them they said that I would need to call back in 4-5 business days for another retrieval code for moneygram... They call nonstop-One day 27 times! We have raised our children in this home and take much pride in caring for our home. We looked into short sale only to realize that we have lost $100, 000 in property value-its disheartening to think about walking away but at this point no other options have presented themselves! Wells Fargo is the biggest organized crime ring to date!

Use Western Union. Call get the Payment City and Account code (or whatever it's called) fyi the [protected] isn't really WF but some sub contractor collecting on behalf of. If you do not care to play the 1, 000 question thing when calling to get the Western Union payment code, then get if from one of the Western Union locations. I have used Kroger's Customer Service in the past got the payment city and code and successfully and had 1 months payment accepted...

Hope this helps

Refusing to accept partial payments is not new. We own our third home and every mortgage company (have had several due to them selling the mortgages to other companies) has had this same policy. If you need to make October's payment late, just be sure to make it by the 31st. If it arrives on the 1st of November, they can and will send it back to you telling you they do not accept partial payments...HOWEVER, you do not have to include the LATE PAYMENT - as long as you pay the required payment in full by the 30th of November (in other words, hold October's payment and send it in with November's and make sure it gets there on the 30th of November - NOT the first of December. (This holds true for every month).

FHA rules are that you can refinance an FHA loan BUT you have to be current and OWE NO LATE FEES even ones that are years old. This is what is stopping a lot of folks from getting their loans modified. I believe this is what some of you are experiencing. In other words, you have made some other payments late and not included late fees - those fees have simply added up over the life of the mortgage. Now, you've fallen behind and are trying to get them to modify your loan and they are saying that you have to pay ALL late fees prior to their being able to do this. This is not going to be true in every case, but is likely true in many of them.

While you are trying to get them to work with you, make sure that you continue to put what you would normally be sending to them in a separate account DO NOT SPEND IT thinking that they are going to "bail" you out - they won't. They will ask for a lump sum - if you have been putting money away that would have gone to them if they had been accepting your payments you will have that lump sum.

We have been there. Due to a job loss, we missed two payments while my husband looked for work. It took 6 months for the mortgage company to work out a deal with us in 2000 -during that six months, with the new job's income, we continued to put the house payment into our savings account. They agreed to a payment and a half for 6 months to catch us up but asked for a couple of thousand up front - since we had been paying into savings - we had that money and sent it in. 6 months later, all was well.

I agree however I just found out that you can contact your counties public trustee and ask what is needed to be done in order to cure the late payments. Wells Fargo is working with lawyers and have all there I's dotted and T's crossed. So call them and file an intent to cure form and make sure you have the letter that was sent regarding the forclosure and you will need to come up with all the past due payments and fees. This is a way to solve the problem. Once you do this I suggest you start trying to refinance with a different company.

I said this is for my car loan. I don't know about any of you, but I intend to fight. You are trying to make good on bills and they don't take it because your $79. behind... That is [censor]! I know I will be looking for a way out of my car payments permentantly for this! Hmm glad there is only a $10K loan left!

Wells Fargo mortgage renewel issues

Wells Fargo Financial Corporation Canada is stealing my home. i purchased a home three years ago using wells Fargo. my rate was approx. 7%. I have never missed a payment. my credit score is not the best but is about the same as when i first got the mortgage. when i called in to renew I dealt with a women named Lelani. She never once advised me how much my payments would be and just said to go into a branch to sign the papers. i went in to find out that my mortgage payments went from 1600 a month to 2600 a month with no warning.

she also did not allow me to read the documents and simply stated if we do not sign now that wells fargo will foreclose on my home right away. she is stealing my home. she knows that this amount is not something i can pay. i am under the understanding that they must provide 72 hours to read the documents. i was not allowed this. also she advised me that i would lose my home if i did not sign right away. now i am up a creek and drownig as i have no way of paying 2500 a month. basically its like them came to my door and put a gun to my head and said give me your house. i am going to try and fight this but have no idea how. i bought this house with no money down. if i sell it i will still lose money.

i need help my first payment on my new mortgage is due next month. i do not recommend these guys to anyone as all was good til the renewal now they have screwed me over and left me homeless .

wells fargo, the perfect front. The pitiful, pliable, customer
service team is perhaps the most ingenious part of this fine-tuned plan.
Heartless humans honed to keep hope alive. Their malicious intent is to
steal your home. Their pretense of goodwill is unforgivable.

Wells Fargo did not receive bill

We bought furniture from J&J in the summer, we had the furniture delivered Oct. 2nd to our new home. We have not received any correspondance from Wells Fargo. Even though we were in the midst of moving, we hae received all of our mail from several other businesses. We have called the furniture store on 2 occassions and they say that we will get a bill and then if we continue to have problems they will involve some one. I called and waited over 20 mins, to talk to someone and they would not tell me if a bill was sent. In the meantime, if we are "late" we never received a bill and in the long run if this hurts our credit, we will be highly UPSET!

This is the exact same problem I am having, it is hurting my credit. I have been told my wells fargo that I will be sent to collections if the bill goes 3 months past due, I have yet to see one bill. In the beginning my account was put on freeze cause they needed to verify info. I had to call and found out about the verification needed ( i was late on that payment because they never contacted me and I never recieved a bill). It happened again, they froze my account cause they need to verify I called again to see what the deal was, I was late again! It has been almost 7 full months and I haven't seen ONE bill... DO NOT DO BUSINESS WITH Wells fargo Finanical...

Wells Fargo fraudulent activity

About two weeks ago I received a phone call from someone at Wells Fargo Financial bank about opening a Wells Fargo Visa card. At the time I was extremely busy (just got home from work, trying to walk the dog, and trying to help my wife make dinner) and asked the caller if they could simply send me the information by mail, but the guy was very persistent and I sat through his 10 minute pitch about the card. During this time he asked me a few questions to verify my information so that he could send me the information package.

I didn't really think much about the phone call and figured that I would get the usual credit card package in the mail with a form to obtain the new card. It wasn't until I checked the mail on Saturday November 1st that I realized that the jerk that I talked to on the phone had gone ahead and opened the credit card for me. I did not authorize this and I made it clear to him on the phone that I only wanted an information package and not the card. When I realized what he had done, I completely lost it and immediately called the customer service number listed on the new card.

After about a 15 minute wait on the phone I finally got to talk to a customer service rep. I was completely furious about the whole situation and told her that I wanted the account canceled immediately and I wanted to know the name of the person who authorized the card to be opened in the first place. She told me that 'there is no way that Wells Fargo Financial can know this information' which just made me more angry. I admit that I did say a few curse words while I was on the phone, but I didn't think saying 'hell' a few times was enough to have the customer service rep hang up on me... boy was I wrong. She hung up on me and didn't even confirm that the account had been closed.

As I am typing this message out I am still on hold with the customer service center trying to A) determine if my account was closed by the person that hung up on me and B) to push for more information on who opened the account. I know I probably won't get an answer to B) so I wanted to pass on my experiences to everyone via [redacted].

The bottom line is this... if Wells Fargo Financial calls you about opening a Visa card and you are not interested, HANG UP THE PHONE!

Wells Fargo illegal action on innocent bank customer in regards to identity theft

In 2002 I signed as a loan based on a personal agreement with the president for IBE (International Business Exchange) I was paid $50k as a silent partner. In the end the company went bankrupt and I was never informed and move out of the country. In the meantime the bank went after the partners and in the course of this they actually went after someone with a similar name as mines. The person has been fighting Wells Fargo for four years and I was never informed as to this mix up. Over the weekend I was contacted by the ex-President and he informed me of the mix up. I felt so bad about this and Wells Fargo has ruined this man life and I am so sorry so trying to do the right thing I contacted the bank today and was just shocked as to what I was told.

I told the Post Judgement Account Officer Brent Westman who I was and that I was the person he has been trying to contact and he has been filing legal paperwork against the wrong person. He asked me my social security number and name and pretty much told me he has a judgement and that I had to go to court in order to resolve this. I told him I would meet him at any bank in Modesto to resolve and resolve this mix up to resolve his actions against an innocent customer.

Wells Fargo bank has taken this customers saving, checking, garnish this gentleman wages, he was laid off his job due to this adverse action by Wells Fargo Bank and this Mr. Westman has taken it upon himself to ignor any information that could have cleared the customer. I am not understanding how a bank can just treat a customer this way and take his money and void his bill pay on-line to cancel his payments then put the money back in his account and then take all his money and apply this to this debt that doesn't belong to him.

I went to the county records office today and found the documents and it is Prime Loan/Judgement # [protected]-26 filed in Alemeda county court. The paperwork doesn't match up to me or the other person but it has bit and pieces of both of us which is quite odd. How can a bank get a jdugement when it doesn't have the correct information 100% yet can do whatever they want to harm an innocent person.

I was told that I have to get a lawyer and sue Wells Fargo and all I was trying to do was let them know I am the person who signed for the loan and they have been attacking the wrong person. This is a financial business and someone needs to report this. I am trying to find someone at Wells Fargo Bank high enough to complaint and have this corrected. In the end I shall sue Wells Fargo and I hope the customer who has been treated this way does the same.

Regards,

Joel Miller

Wells Fargo distructive liars taking money

I had a mortgage on my house with Wells fargo. I had bought and paid for 2 houses with Wells Fargo and paid off both my loans very quickly before, so I was using them once again. I was paying it twice a month instead of once a month to pay my loan off faster but most of my money was going into intrest, so I called up Wells Fargo and said how can I send more money to "principal" each month? The agent said well you'll have to refinance you house to do that. "We won't except more principal any other way". So I stupidly went along with it not realizing all I had to do was allocate more money to principal in each payment. They also charged me a fee of $400. for this as well. About 2 monthes later my family needed me to come back home and care for an elderly person, as there was no one to help her and she couldn't afford in home health care. So I called up Wellds Fargo, asked them If I could apply for another loan on another house out of state until the house I presently had (a very lovely desirable hous)e was sold. The loan officer said quote "Yes you have excellant credit and you qualify for a "preapproved loan." So I got on a plane and went back home to find a cheaper house quickly, and was able to find one just around the corner from my elderly aunt, So I could stay with her for long periods of time.
I called Wells Fargo along with my realtor and we both talked to the loan officer and he said " I was fine and everything was ready go they had my imcome tax recordds from the past 2 years my bank account records, a copy of my listing agreemenmt with the agent to sell my old house, WHICH HE CONFIRMED WITH MY WITNESS THAT HE RECIEVED, and that I had Quote: "pristine credit". I said are you sure that I'm ok to start moving?, she needs me here immediately. He replied to both me and my realtor quote "Oh yes! your fine! Go right ahaed I'm going to E mail you your approval!" I recieved an E mail in writing that I was approved and that I should start my move!" I was charged another $400. for processing again. So I got everything on the truck, transfered all my money from my bank to Wells Fargo bank in the city back home, had all my business transfered my bills, my insurence health and home, got the closing date settled on the new house. I paid the moving company $15, 000.00 I put down 20% on the house. I had the new house appraised surveyed, and inspected Then about a week before I was ready to get on the plane, I called up the loan processor again and said quote:" is there anything else you need before I go?" he replied QUOTE: "I DON'T KNOW WHAT I'LL NEED BUT YOUR LOAN IS NOT APPROVED NOW. WE CHANGED OUR MIND AND IT COULD BE BECAUSE YOU REFINANCED YOUR HOUSE AND YOU ARE USING IT AS A SECOND DWELLING. When I said that he had confirmed that he had recieved my listing agreement earlier, he said quote:" Oh yea that's right. Well I told the underwriters that you had a second dwelling instead and they changed their minds about the loan" I told him what I had been through and that he needed to straighten it out immediatly! He said well there's really nothing I can do. We have the right to change our minds even after closing if we want to. Its legal." I called up his suppervisor and complained and they said they would discuss it ? I don't know why this loan processor lied about my house be listed, what did I do to him ? but My family is very politcal. I've passed 3 bills in congress myself to help consumers. I'm now working on legislation to prevent this "SO CALLED LEGAL CHANGING AT ANY POINT AND TIME" I usually win these things I'm very good at this, and I have many good friends in the media to expose people like this and I intend to!

Being an employee of the company, I have read over 10 false/straight up lies on this one thread. Everybody just complains about "not being approved for a modification, " yet we have about 1400 modifications representatives who take back to back to back to back phone calls all day, and approve modifications left and right. I work in a different department and after reading so many complaints about "WF denied my modification" every time I transfer somebody to the modification department due to "financial issues unable to pay for mortgage" I follow up about three weeks later, and viola, modification approved because the customer did everything correctly and how they are supposed to. You would only be denied a modification if, shocking, you don't complete the process correctly. You don't just get denied because, well we don't want to do any modifications today sorry. It costs us thousands and thousands and thousands of dollars to foreclose on a house, that is the last thing we want to do.

We are had to leave our home in GA to move back to CA because my husband lost his job. Our house was vacant for several months and with our CA expenses and no income we fell behind. We don't live in the GA home and don't qualify for a modification. You hear all about programs out there that are willing to help you and WHERE ARE THEY. Wells Fargo REFUSES to work with us. Even with renters in the home, we are out of pocket $600 every month. WE NEED HELP to catch up. familiastewartingeorgia@yahoo.com

I have also been given the run around with Wells Fargo. We experienced some financial issues when our daughter was ill. Since we didn't have insurance to cover the medical costs, we had to pay for the medications out of pocket, which were quite expensive. This happened in 10/2006. We ended up 2 months behind on our payments. We did qualify for a loan modification which gave us another month not paying the mortgage payment and lower payments for the next three months. At that point we would be able to apply for another modification that would allow us to pay larger payments to get all caught up. Somewhere during this repayment process things went wrong. Wells Fargo returned a check t0 us as NSF, which it, in fact, was not. It ended up costing us overdraft fees, late fees, etc. THEN we ran into more financial difficulties due to poor home inspections when we purchased the property...which FYI to anyone buying a home through FHA, you don't have to pay for inspections that exceed a certain dollar amount. I cannot remember the exact amount, but we paid almost $1, 000 in order to assure that we would not run into problems. We needed to replace our roof, which had passed inspection just 2 years ago. We were informed at that time that we wouldn't need to worry about it for at least 10 years. We both had shaky credit so most of the cost to repair came out of our pocket putting us behind on our mortgage payments again. BUT what could we do when the leak was so bad it had soaked the second floor ceiling to the point that it caved?! I won't get into all the details from that point on, but I will say that we fell 3 months behind on payments, tried the partial payment catch-up and WF denied. We received a loan modification, but at the end of modification period we were denied assistance in dealing with the balloon payment that was due. Wells Fargo filed foreclosure motion on our home in Jan. 2009. This was our first home and our first experience in dealing with such a huge investment. The special programs available for 1st time buyers, etc to aid you in the process, in my opinion, are a bunch of bs. We could easily have made our regular monthly payments from Dec '08 till now, but due to the refusal of the bank to provide help, we are without a home.

I hope when you go to congress, you also mention how they refuse to help people who are only 1 month or so behind! I am told that they won't take partial payments to help me get caught up (even though that is an option on their web page). I am mourning the loss of my mother on Feb 21st and requested help to get caught up after having to pay for the funeral. The woman on the phone entered all my financial information and said "There are no repayment options I can offer you." What a JOKE! I pray that you have success with your issue with them. What a bunch of... I don't know what!

I am also having problems with wells fargo and will never bank with them again as soon as my mess is cleared up. I had financial difficulty and got behind in my house payments I am currently trying to pay all of my past due payment but they return my checks and give me the run around about having to call a law office to make my payments but the law office keeps referring me back to wells fargo to make payments. in the mean time wells fargo says that they have placed a foreclosure on the house and the law office will handle the payments. This wouldn't be out of hand if wells fargo would just take their money and stop playing games. I also received a loan modification letter without even asking for it and when I called the 800 number I was rudely told I don't qualify and I had even given the person on the phone any information.

hello
sorry to hear about. your demise w/wfhm. i feel ya. i've been finaced with wells fargo for 10 years, and never been late on a payment, untill recently. my spouse broke her neck in an auto accident. lost her job, on and on problems. i am 90% disabled from the us army and have a perm income. i was late on october and when i ask to pay, they would not take a debit or a check routing & #. i had to send a cashiers check. i told them my problem and they sent me an application to modify my loan. before i even filled it out they called and said i do not qualify? they know i have alot of equity and they refuse to work with me. i still am behind for nov. and get called all hours of the day. they want to take my family's home. i lost my blood and hand for this country, only to be harrassed by a bunch of money hungry idiots. i am about to break and give up. i just don't have the strength to fight anymore, done enough fighting. i am ashamed of wells fargo for being so heartless. i'm trying to get help from the disabled american veterans, but if not they have to live in their own skin and look in the mirror. i just hope and pray that the young warriers coming home don't ever have to experience wells fargos ungrateful, distasteful acts to us vets,

hey good luck and god bless america

I agree, EMC mortgage Co. seems to be very illusive when it comes to customer service. I've been in the process of a loan modification with this company for several months now and it seems as though they arn't really interested in working with the customer/tax payer at all. Banks/lawyers/politicians oh my, does this remind anyone of a place called OZ as opposed to America. When it comes to working with any of these guys it just feels like I/we are the sacrificial lamb being lead to the slaughter. Keep your eye on the ball America, if you can!

I had a mortgage loan with EMC. I arranged a short sale of my property with EMC, and escrow closed on the sale back in October 2008. EMC owes me IRS Forms 1098 and 1099-C, neither of which I have received. I succeeded in speaking to a real live person at EMC and requested that they send me those forms. They agreed to send the forms. This was two weeks ago, and I haven't yet received the forms. I'm worried, because I'll need the forms to file my income tax returns.

Customer service does not exist at EMC. I have tried for months, during their supposed hours. It immediately disconnects when you try to speak to somebody. They do not even have an email address!

VERY SHADY! Their loans are all transferring to Chase, but in the meantime I am very uncomfortable sending them my money.

Hi, I have had the same problem, here is what you can do (what we have done) to get a hold of them call [protected] and just stay on line, don't press any buttons, eventually it will give you an option of speaking to operator, and she can direct you, or try [protected] ext 2106, that's what the operator told me to do. I think, it is very unfair to their customers that they don't let them know what is the number for actual "live person".

Hopefully, this will help you!

Wells Fargo unauthorized withdrawel by wells fargo

I have checking and saving accounts with Wells Fargo since more than 15 years. The accounts are under Family Trust account and not personal. I started a business over 2 years ago and I got a separate business credit card account for myself and my partner in the business. My banking relation with Wells Fargo Bank was great.

I paid off my business credit card account completely. But my partner did not pay his balance or the minimum payments due on his card for a month or two (card # ending with 1122).

Shockingly, and upon checking my online banking account on 10/7/2008 morning, I saw that an amount of $2, 609 has been taken from the family trust saving account, the savings that was saved for my daughter school. When I called the bank they told me that the bank took the money to pay off the minimum payment on my partner’s card. This has been done without my permission or my authorization.

I went to my Well Fargo Branch, and met with the branch manager and she helped me to make phone calls to the right departments to explain what happened. They told me that I have signed a personal guarantee on the business credit card account, which I don’t recall signing such a document.

I have requested a copy of the signed documentation to show to my attorney by sending a fax from the wells Fargo branch on the same day 10/7/08, and I haven’t received any response so far (copy of the fax confirmation is available)

What the bank has done is totally wrong, even-though if a personal guarantee has been signed – which I haven’t seen yet- the money was taken from a family trust account. Not a personal account. The bank should have called me before they take any action specially when I have a great 15 years banking relation, the bank should have gone after my partner, not punch me because I trusted the bank and kept my savings for my daughter’s school. The bank should not have punched me when I have paid off my business card completely.

I request a refund of the unjustified withdrawal of the amount of $2, 609.00 to my account.

Thank you.
