Wachovia Mortgage Illegal- Unethical re-fi

Back in October of 2007; I was TRYING to get are-fi on my mortgage .. Along came a mortgage broker; Fidelity Mortgage Direct; who PROMISED and in writing, a 2.45 % interest, fixed rate for 30 years .

They sent me a "Good Faith Estimate", "Truth in Lending Statement", "Florida Mortgage Brokerage Agreement", and "Loan Application" .. with THOSE figures on them.

When it came time to close; the figures were a 8.35% Interet rate, an ARM, with a Pick a Payment that increases my mortgage every month IF I cannot pay the actual Higher mortgage payment . With the original agreement ; my payment would have been just $285. P&I ; BUT under this higher interest etc..the mortgage payment in in excess of $1, 060 per month ...

I called my service representative who told me it would all be "Fixed" in "errors and omissions" .. so I went ahead and signed .. the next day I called and canceled, after thinking all about tit as it did not seem right ...

Within a few hours, I received a call from the head man at Fidelity Mortgage Direct ; telling me that unless I went thru with this re -fi that he was going to sue me and he'd get not only my home ; BUT everything in it ..including my dog ...

I knew that he wouldn't get the dog ; BUT as for everything else ; I wasn't so sure and I did NOT have the $$$$ to defend a court action as I am on a fixed income and barely get by anymore ... which is why I was TRYING to get the re-fi anyway ... so I was FORCED into going along with the Illegal and unethical re fi ...

I've written letters, called everyone I know ... BUT; NO ONE seems willing or able to assist me in this situation ...

Does Anyone know of a way that I can get satisfaction on this illegal, unethical re finance that Fidelity Direct and Wachovia Mortgage have me locked into ... ?

ANY information or resources would greatly be appreciated ...

Wachovia Mortgage Wachovia wants me to go Bankrupt

I have a Mortgage with Wachovia Bank that is about to balloon in 1 month, The mortgage is on a multifamily rental property that is 100% occupied and makes money and has $100'000 in equity. I have never been late with a payment in 5 years. But Wachovia will only refinance at 9% and only offer a 10 year mortgage, making the payments way to high to make keeping the property viable. Wachovia will not negotiate and has informed me that they will foreclose on the property as soon as I default when the loan comes to an end.
Why are they trying to force me into bankruptcy, the area is already full of foreclosed properties and becoming depressed they just don’t care. I have also spoken to the supervisor in charge, He was rude and made ridiculous accusations, that we had performed IRS irregularities, when I questioned him he retracted what he said and made it clear to me he wanted us to foreclose.

Wachovia Mortgage Modification Program Scam

Long Story Short. My husband and I have both lost job hours and our salaries cut. We saw the storm and stayed ahead of it. We asked Wachovia for help. We do not have a "sub-prime" but a payment options loan. No problem. Tough times hit and we asked since February 09 about the Home Affordability Modification Loan Program (Government) only. We applied and were accepted and under review. 2/3 thru the process on one of those many, many phone calls, I was told that we were "under review" for Wachovia's Modification program. I protested and was told the process can't be stopped! Also told (with much attitude from employee) I could reject offer, apply for Govn. Mod. BUT if we are denied we could not "run" back to wachovia! This is bullcrap! I never asked or applied for wachovia mod. program. I specifically asked for Govn. Mod. and all paperwork says this! I recorded the last conversation with Wachovia just in case! Now, we have to wait until the "offer" expires then reapply to the same dept. for Govn. Mod. Loan... Also, all my Modification options that I paid for in my original loan were "denied" when I asked to exercise those options. Now we are behind 2 months of payments because Wachovia suggested we not pay because first payment will be due with signed agreement! By the way, the Mod. Agreement would save us $40 a month! Is this a Joke..Are they kidding me? What did we do to deserve this except pay our mortgage for 14 years on time? We are devastated..

TRIED FOR 2 YEARS TO SOLVE A SKIP A PAYMENT OBTION THAT I HAD ON MY MORTGAGE JUST TO SIND OUT THAT I WAS SHOWING DELINQUIN THEN THEY CHARGED ME LATE FEE AND HAD MY LOAN SHOWNED AS DELINCT WHEN I WAS NOT . WHEN I TRIED TO FIXED THERE LATE CHARGERS AND PENATLY WHICH AT THE TIME WAS $395 I WAS EMPLOYED AFTER THAT I BECAME UNEMPLOYED AND I TRIED TO MODIFIED 3 MONTHS GOING BACK AND FORTH WITH PAPER WORK . AT THAT TIME MY ACCOUNT WAS 5 MONTHS LATE AND THEY HAVENT RECEIVED 4 PAYMENT THREW MY MODIFICATION PROCESS THEY TOLD ME NOT TO PAY ... AFTER I WAS DENIED .I TOLD THEM I WANTED TO BRING MY ACCOUNT CURRENT THEY KEEPED GIVEN ME THE WRONG FIGURES AND OF CAUSE THAT LOUSY $395 EXTRA THAT THEY WANTED ME TO PAY WAS STILL THERE . I KEEPED CALLING EVERY MONTH TO GET THE AMOUNT THAT NEEDED TO GET PAID TO BRING THE ACCOUNT CURRENT AND THEY KEEPED CHANGING IT ALL THE TIME THIS WENT ON FOR 4 MORE MONTH THEN ONE DAY I CALLED AND THEY TOLD ME IT WAS TOO LATE I BETTER GET A LAWYER THAT MY ACCOUNT ITS IN FORCLOSURE WITH THERE LAWYER AND KNOW I HAVE TO PAY AN ADDITIONAL LAWYERS FEE . I HIRED A LAWYER WHICH CHARGED ME $2500 PLUS I AM PAYING $300 A MONTH TO HAVE HIM FIX THIS ISSUE ..., ACCORDING TO THEM HE DOES NOT EXISTS IN THEIR FILE . THEY ARE STILL CALLING ME ASKING ME IF I WANT TO SAVE MY HOUSE . WHAT IS GOING ON ?

Hi Phil,

One thing I know for sure, regardless of where you live, the bank MUST provide you with a copy of the Appraisal and your credit report should you request it. I think that whether you are using an Attorney, settlement agency, or doing this process solo, the outcome will be same: 50/50 chance of being approved.

My advice is to be persistent, continue calling, continue writing letters, documents each call (person spoken with - ask for employee # or employee ID, date, reason for call), and once all administrative avenue have been exhausted, sue, sue, sue! I am currently suing and doing it pro se to save money.

If you stop making payments and your house has value, they will take it, make no mistake. However, there are few little tricks you can use to prolong the foreclosure for at least 2 years.

We've been trying with a lawyer to modify our Wachoviass loan for a year now. They "lost" our stuff twice. We waited for months at a time for an appraisal, results of which were then a secret.
They screwed up their arithmetic, and tried to deny us.
blahblahbla.
STILL NOT RESOLVED!
It is scary, but our lawyer tells us that only 6 of 65000 have been.
Can this be?

Has anybody had any luck with just stopping the payments?
This is driving us crazy...

I began our loan modification process with Wachovia back in Oct. 2009 and to date we still haven't been able to finalize it. I find it absolutely stomach churning that every single god given financial documentation was provided to them (within 24 to 48 hours after Wachovia's request), and they still managed to delay the review process by claiming that the fax was never rec'd, the date was missing, the name was misspelt, Snoopy ate the mailbox, and Garfield, the cat, jumped on the stack of papers and his lice/fleas ate the documents!...seriously, my 5 year old son has better (and thankfully less) excuses then the Reps at Wachovia.

Well, I don't know about you guys, but quite frankly, I've had enough. Wachovia shouldn't have accepted the bailout money from the gov't (which is really our hard earned tax dollars) if they had no intentions on bailing out anyone other than themselves! I've sued Wachovia in the past (before they acquired World Savings Bank) for extending a prepayment penalty fee and I had the entire matter resolved within 1 week...and mind you, I am not an attorney, never went to law school, and I sued completely on my own. Now, that being said, I took some of my own steps yet again for the 2nd time in hopes of getting what I was promised when we initially went through the phone interview: (1) 2% fixed interest rate; (2) lower monthly payment that included my escrows; (3) keeping my home (especially since we put 20% down payment on the purchase price back in 2005). I am keeping my fingers crossed that I will succeed for the 2nd time but it's never a guarantee!

I think that if we all ban together (picture the Boston Tea Party) and everyone writes or files a complaint to the addresses listed below, then they will have no other choice but to listen and comply. My filed complaint alone is completely useless unless it's backed up by everyone else who is experiencing the same difficulties. Below you will find the steps in filing a lawsuit and complaint in your own County, but please keep in mind that all we can do is try our best and hope it'll work:

1. gather all docs and any fax/mail/email/fed ex confirmations sent to Wachovia;
2. organize in accordance to date, all phone calls made to Wachovia, whom you spoke with, and the topic covered during that conversation;
3. go to your County's website or google "how to file a complaint in _____ County". Once at the website, you can download the forms you need to complete in order to file a lawsuit. Be watchful of the Complaint you submit to Court, because there may be 2 different lawsuit forms: (1) small claims (typically used if you are suing for less than $6, 000); and (2) civil complaint.
4. If you do not have access to the web or your county does not provide this online, you can visit your county clerk and ask for the forms directly.
5. in addition to filing your own lawsuit, file a complaint online with the Department of Banking and Insurance and also with Thrift Supervisory.
6. Lastly, once you have a copy of your filed lawsuit at hand, along with all the other online complaints you filed, feel free to drop a few lines to the following people at Wachovia:

Very similar story to report, unfortunately. We are in the same adjustable rate mortgage. We tried to refinance in October 2008. 3 appraisers came to my home because somehow all of the paperwork was getting "lost". When I questioned this, I was told it was because they were bought out by Wells Fargo. Really? I had no idea that business cannot be conducted during an acquisition! Who knew!?!?! Then things started to get worse. We were no longer able to refinance, my husband lost his job, and we tried to apply for a loan modification program. We are STILL in the process after all this time. I seriously feel like I am going to have a break down over this. We have been denied 3 times because "we make too much money". Yes, we can afford the minimum payment. So, I guess I am supposed to keep accruing deferred interest, which we currently are about 40K in the hole there, negative equity in our home, and so on. This is criminal! How can they say we can afford our payment! We don't owe one dollar of this home! We did contact our congressman and his office is trying to help. I do plan on contacting an attorney. We are an honest, hard-working family with small children who pay our taxes, and do the right thing...so sad that we are going under because of this freakin' bank!

The bank has not interest in helping you at all. This is what pisses me off about these so called experts that say ### like, "contact your bank and ask them for help." Bull *%$#%. They are for profit and not trying to lose any. Try contacting non-profit organizations, your congress person and find out if there is federal oversight over that bank or the loan you have, call your state banking and finance office and explain the situation. Ask them about your options. Call your local news station or one that would be interested in investigating for you. These antisocial ###s like to keep their ### quiet and off the air. If at all possible seek legal council and have them look into the situation. Contact your state bar association and find a referral service. They may have pro bono resources available that will not charge you. Don't ever think that a bank will help you. They probably told you your house was an asset too. How much money or residual income has the house made for you over 14 years?

They don't care about you losing our job. Their customer service is servicing their shareholders, not you. All they want is the money. ### your hardship. That's how those antisocial ### think about you, me, and all others in similar situations. Blame the victim is how our society works. They figure well its your fault your hours got cut. These banks have complete and utter control over their prey (customers). We have no recourse for their illegal activities due to deregulation. Ever wonder why all the major billion dollar banks are in Delaware? When the executives get caught they usually just get fined and pass go and continue to collect their 57, 000 dollar an hour salaries. What makes them better than you? People respect those ### more because their gambles pay off when they win big. Stupid world.

Wachovia Mortgage Loan Modification

I have fallen behind meeting my monthly mortgage payments. Compounding this is the fact that my house is worth about 60% of the current loan balance. It has been suggested I declare bankruptcy and just walk-away from my home as part of the procedure.

I have been trying to get my loan modified through Wachovia. Wachovia is owned by Wells Fargo bank, one of the biggest offenders contributing to 'Alt A' and sub-prime loan programs.

In response to request for information concerning my hardship and current financial status I have received redundant requests for information, I have received letters telling me I was 'eligible for foreclosure', I have received letters indicating I should seek a loan modification and I have received letters indicating I am eligible for loan counseling and possible loan modification. I have received a letter indicating my request for loan modification has been denied but not in the sequence one would expect given all the communications filling my mailbox.

The majority of correspondence encouraging me to proceed with loan counseling and a loan modification have arrived after the denial.

I have spoken to numerous individuals at Wachovia, answered their questions and awaited return phone calls from I guess the next department 'up the line' in this process. The phone number I filled in is for a person that has been very helpful and seemingly on her game. My complaint is not about her specifically, but more about the confusion which seems to be running out of control.

Like so many consumers I hear in the news about all this bail-out money and all these corporate excesses and fiscal abuses and wonder how this can continue.

I have told the representatives at Wachovia that I do not want to walk-away from my home. It would cost me more to rent in my neighborhood. I have told them I would accept another loan like I have now if we could amend the loan value and start the payment clock over again. I believe that once my employment situation solidifies I will be more than able to meet my obligations and specifically keep my mortgage with Wachovia (and previously World) current as I have for the past fifteen years.

It is particularly frustrating to be held in the dark in this matter in this new era of 'transaction transparency' new 'Truth-in-Lending ' requirements to further protect the consumer (even though it adds as much as three weeks to a purchase transaction) and other potential legislation to handcuff mortgage brokers like myself.

I am a loan originator, have been for twenty years and I am feeling like I am soon to be a new endangered specie; a loan officer that owned a home.

We're with Wachovia Wells Fargo formerly World Savings Bank and they are a complete and utter joke. The President and Congress need to get on the ball and make these banks stop dragging their feet, meanwhile they're taking all that bailout money and doing nothing to help consumers. SOMEBODY PLEASE DO SOMETHING TO HELP US!

Wachovia Mortgage Fraudulent company

Wachovia has been a thorn in my side since the day they bought my mortgage account. They have tried to foreclose on my home due to their accounting error. Now, they are trying to take my insurance check to repair my home after Hurricane Gustav.

Beware when you account is being bought from another mortgage company because sometimes your payments are not transferred or appropriately placed in the correct account. And without notice they will foreclose on your home for a missed payment, even though they can't prove one even existed. After several months of torture and lawyer fees, the court system that is supposed to help people, screwed me by ruling in the favor of Wachovia. And, yes the judge couldn't even find a missed payment.

And during the whole process, Wachovia returned my monthly checks, then expected me to pay all of the late fees, interest lost, their lawyer fees, etc. A payment they lost has now cost me over $25, 000.

Hurrican Gustav destroyed many parts of my area and has left me with $20, 000 dollars of damage to my home. Wachovia is now keeping my insurance check for repairs to my home. Where does the madness end!

My heart goes out to everyone who is suffering at the hands of a predatory lending scheme. I'm going to share my story with you AND THEN follow up with someone who was able to, just very recently, get Wells Fargo to help them. I want homeowners, or recent homeowners, to at least call and/or e-mail Cara K. Heiden, Mary Coffin, and Sharon Cecil in the WFHM Executive Office. I give you their e-mails, direct phone number, and address below. Please try. I'll say prayers for you and your dear families. Remember, keep trying. Expect God to bless you. And I know he will.

In November 2006, Wells Fargo d.b.a. American Servicing Company (ASC) decided to escrow on my mortgage loan. For no reason. My taxes and insurance were always paid on time. Theyd never escrowed before. Then, instead of paying my annual property taxes once, they paid them twice. And I had already paid them. Then they pre-paid my property taxes that werent due for another year. Id never had an escrow account with them, so usually the balance was zero. Now it was -$5500.00. My mortgage payment increased from $655 to $1446 a month. I cant pay it.

Wells Fargo admits their error. They promise to fix it. Then they dont. Again they promise to fix it AND reverse all the late charges. Doesnt happen. No one corrects the original mistake so the snowball effect is creating havoc with my mortgage, with my credit, and on my life.

ASC Phone calls and letters threatening foreclosure were relentless. I have spent hours on the phone trying to resolve the problem. So many ASC Customer Service agents promise all your problems are taken care of, rest assured. When you check the next day to confirm all is well (youve learned to check) they can't even find a note in the record that you ever called. So then I am forced to start the process to correct my loan all over again with a different agent (weird isn't it that you can never get the same agent because they don't have extensions, and they refuse to give you their last name. They will give you their three-letter employee ID code that has never helped me a bit. Many agents refused to give me the companys physical address when I wanted to talk with someone face to face. Over this six-month nightmare I was assured over and over and over, that yes, definitely this time, they had truly made the corrections I had been assured already been made. Yes, isnt it wonderful, my mortgage loan had been approved for loan modification and the loan I’d been told dozens of time had been reinstated, had really for sure this time been reinstated. I was always told I would receive a letter confirming all was well with my loan. I was told not to make any monthly payments on the loan because until the correction had been processed through their system, the payment would be considered a partial payment and would be returned to me. So in February and March I couldnt send in a payment because the monthly payment amount was never corrected. I was forced over and over again to start the agonizing process from square one with another agent. Most agents couldnt find any notes in my record. I had the brilliant idea that faxing the whole story, along with receipts, and other requested forms, would be the answer to our communication problem. I would finally receive a letter confirming receipt of the requested documents. Four days later Im told my documents were never received so my home is in foreclosure.

On April 23, 2007, I was emergency admitted into River Oaks Mental Hospital for 10 weeks due to a complete emotional breakdown. I was suicidal and unable to care for myself. Wells Fargo Mortgage made a mistake, and acknowledged it. However, they were unable (or unwilling) to fix the problems their error created. My sister was given power of attorney so she could resolve the issue. Upon discharge from the hospital an ASC agent confirmed my loan had been fully reinstated, the payment had been corrected, the escrow balance adjusted. They promised the late charges and additional interest charged because of their error would be credited back to the account. I insisted and they agreed they would contact the credit agencies to report their mistake, remove all negative remarks, and change all comments they had made regarding my mortgage account to paid as agreed.

Two days later I received a notice advising me of the sheriffs sale date set for my home.

My home was my savings account. And it was my retirement account. More important, it was my security blanket.

The October 3, 2007, sheriff sale date has been postponed and Wells Fargo has told me they want a satisfactory conclusion to this nightmare. Ill keep you posted. Today is October 9, 2007.

WFHM admitted errors and apologized in two letters received on October 24, 2007, and October 29, 2007, from Todd M. Boothroyd (contact info shown above), credited $12, 000 to my mortgage loan, corrected the negative reports made to the credit repositories, reinstated my loan. I breathed my 1st sigh of relief in nearly a year.

THEN THEY SOLD MY HOME AT A SHERIFF SALE. They took my home, almost $100, 000.00 in equity, and I'm lost without my home. God Bless my 70-year old mother who is now forced to take care of her 46-year old, disabled, daughter. I still believe something good is going to happen. I really do. Two years of fighting for all I'm worth just can't end like this. I will NEVER stop trying to find restitution and peace. And I will NEVER STOP sharing my story just in case it might prevent someone else from losing their home. From facing agonizing months on end. Being turned inside out with fear and pain. From losing their retirement, their live savings, their security. If I had children, I don't know how I'd be able to face it. I don't know how these companies are able to do what they do to famies who have trusted them. It just breaks my heart.

BUT remember, some of the readers of my blogs have been e-mail me sharing good news about the help they are beginning to receive from Wells Fargo Bank. So DO NOT GIVE UP!

I know help is coming soon for all families facing foreclosure. God Bless anyone who helps someone keep his or her home.

I wish you would have been able to do the FOX interview! It sounds like God is using you by giving you so many opportunities to share your story! Very few people go to the forbearance table with a specific plan, a win-win for both the lender and the homeowner. That is key and something I never considered.

Both investors and lenders would most certainly warm to homeowners who calmly expect a successful resolution.

The blog you posted saved our future! The key to ASC success was dealing with one individual, and after sending emails to Wells Fargo's President, V P, And CFO, I had a response in four days from ASC! My wife was the one who took the call that morning while I was out dropping off the kids at school, and when she called me on the road with the news which was:"We are calling you from the executive department of ASC, and are very sorry you have had to go through this, we are assigning you to an individual who is going to get things straight, and it doesn't get higher than this", I could not believe what I was hearing, something that we worked months on with nothing but confusion, misunderstandings, three months delinquent, then all of the sudden...this? It was like seeing 911 all over again, I don't believe what I'm seeing, and hearing!

I wept behind the wheel to the point of almost having to pull over, but continued driving because I needed to get home to my wife and hear it again in detail. As I walked through the door, I saw this look of disbelief in her eyes mixed with a joy I have not seen for a long, long time. When I sent those emails out, I never thought a reply was coming, but something happened. In the subject line of those emails read "Why do you want my home?" I proceeded to explain the 100's of horror stories written by ASC victims, and how they all sounded alike, as did mine. The one question they had to ask when contacting my wife that morning was "how did he get that email information?", and my wife's reply was "you can get almost anything off the internet these days", which is how I found you Kelly.

All I did was Google "ASC Complaints", and OMG, there you were, along with more than I could handle. Fox Television even contacted me based on a blog I submitted, and had been getting so many calls, yet mine stood out, and wanted to do a live interview with me at my home, but I had to decline, for that was the day we were to get the news on the Special Forbearance Option that was about to be put into motion. We got the forbearance, yet within a week, ASC called back, and based on a plan I suggested they use, was submitted to the investor, and they approved it three months ahead of schedule.

All of the delinquent payments were then rolled back into the loan, interest reduced, payments reduced, and the rest goes into the history books. I've got you to thank for this Kelly, and I have passed this info to others whom have contacted me, and told me that they are starting to move forward in a positive way. ASC has also told me that the plan I suggested they implement for us, will now be used in other situations. A plan that has never been used before. I'm a Realtor, suffering like everyone else, yet WAMU agreed to a loan mod on another property that I own, and worked so well, I had to tell ASC where they were falling short, and how this plan could make it a win, win situation for the both of us. 3% year one, 4.5%, year two, 5.7%, year three, and every year thereafter.

So there you go. It's snowballing, and God used you, as he has used me to help those who are at a total loss as to who to trust, and which direction to go. I still look back on that morning when I got that call from my wife, and immediately thought of you. I saved your blog in Microsoft word, and was able to retrieve it. I needed to say thank you over and over again. I'm a firm believer that when you do good for others, good comes back to you. You're a God send Kelly, and I owe so very much to you for what you have taught me. If not for that information I just happened to stumble across that day while on a last chance mission, our home would now be gone. Yes, I'm still in my home but now after Wells Fargo Bank dba Americas Servicing saga was all worked out, loan reinstated, $12, 000+ credited to my mortgage account -- 20 days later my home was sold at a sheriff sale. I walked with eyes wide open smack dab into the middle of a foreclosure rescuer scam artist LLC. "Equity-Strippers." To just say just the very least, and leave you alone, they forged a Quit Claim from me to them, mortgaged my property to the max hat at one time had significant equity (for me) and now I'm fighting with

I don't know where my story ended with you, but let me know if you want to hear anymore about the pain these lenders lovingly spread around -- if I were you and FINALLY had a happy ending, I sure would understand if you prefer to move on.

If I had a happy ending, well, I'd still stay very very deep in this. Too many people have too much to lose. And they are losing it.

Wachovia Mortgage Fraud & scam

After NUMEROUS attempts by me to save my home including attempts from Community Housing Works of San Diego, Fox6 News, Congressman Bob Filner, Senator Barbara Boxer, Comptroller of the Currency and every agency that I could possibly contact, Wachovia Mortgage ('Big' John Robbins (former president of the AMA); Sal Salas (just a cold hearted greedy REO ###); Jim Tyler (same as Sal); Ken Thompson (CEO... oops... former CEO... duh!), Wally Glass (oh sorry... he's just the guy who gets the commissions off the sale of my home) wins! Kudos for you! But you remember this...taking my home after promising me a modification and then selling it for over $160k less than I owed instead of working it out with me, the homeowner of over 13 years, will come back to you two times over. Because that's justice! And I would think your loss of over $702M the first quarter would clue you in. But I guess when the left hand is watching the right hand jerk off instead of paying attention to the true matters at 'hand' you better be sure that instant satisfaction is well worth it. Because there are more of us than there are of you and there are strength in numbers and thanks to you and your greedy industry partners we shall overcome. It's only a matter of time... enjoy while you can.

I am going through somthing almost just like you described. I has a home that ws almost payed for went through a terrible divorce and lost a great job. I had to refinance my house to pay my x wife off. Got refinanced at 6.8 percent intrest and had a hard time paying a 1200.00 a month payment. Applied for the hamp thinking I would surely qualify later to find out I didnt, and the mortgage went up to 1680.00. Now who in the right mind would think that this could happen legally. They tacked on escrow accounts that I had always paid myself. My faith is strong and I feel your pain. I just dont know what my options are, The keep sending letters and emails saying contact them if you are having trouble making your payment. I have called numerous times to get nothing. Wait till the have 2 million forclosures out there at one time. Then they might figure somthing out!

My heart goes out to everyone who is suffering at the hands of a predatory lending scheme. I'm going to share my story with you AND THEN follow up with someone who was able to, just very recently, get Wells Fargo to help them. I want homeowners, or recent homeowners, to at least call and/or e-mail Cara K. Heiden, Mary Coffin, and Sharon Cecil in the WFHM Executive Office. I give you their e-mails, direct phone number, and address below. Please try. I'll say prayers for you and your dear families. Remember, keep trying. Expect God to bless you. And I know he will.

In November 2006, Wells Fargo d.b.a. American Servicing Company (ASC) decided to escrow on my mortgage loan. For no reason. My taxes and insurance were always paid on time. Theyd never escrowed before. Then, instead of paying my annual property taxes once, they paid them twice. And I had already paid them. Then they pre-paid my property taxes that werent due for another year. Id never had an escrow account with them, so usually the balance was zero. Now it was -$5500.00. My mortgage payment increased from $655 to $1446 a month. I cant pay it.

Wells Fargo admits their error. They promise to fix it. Then they dont. Again they promise to fix it AND reverse all the late charges. Doesnt happen. No one corrects the original mistake so the snowball effect is creating havoc with my mortgage, with my credit, and on my life.

ASC Phone calls and letters threatening foreclosure were relentless. I have spent hours on the phone trying to resolve the problem. So many ASC Customer Service agents promise all your problems are taken care of, rest assured. When you check the next day to confirm all is well (youve learned to check) they can't even find a note in the record that you ever called. So then I am forced to start the process to correct my loan all over again with a different agent (weird isn't it that you can never get the same agent because they don't have extensions, and they refuse to give you their last name. They will give you their three-letter employee ID code that has never helped me a bit. Many agents refused to give me the companys physical address when I wanted to talk with someone face to face. Over this six-month nightmare I was assured over and over and over, that yes, definitely this time, they had truly made the corrections I had been assured already been made. Yes, isnt it wonderful, my mortgage loan had been approved for loan modification and the loan I’d been told dozens of time had been reinstated, had really for sure this time been reinstated. I was always told I would receive a letter confirming all was well with my loan. I was told not to make any monthly payments on the loan because until the correction had been processed through their system, the payment would be considered a partial payment and would be returned to me. So in February and March I couldnt send in a payment because the monthly payment amount was never corrected. I was forced over and over again to start the agonizing process from square one with another agent. Most agents couldnt find any notes in my record. I had the brilliant idea that faxing the whole story, along with receipts, and other requested forms, would be the answer to our communication problem. I would finally receive a letter confirming receipt of the requested documents. Four days later Im told my documents were never received so my home is in foreclosure.

On April 23, 2007, I was emergency admitted into River Oaks Mental Hospital for 10 weeks due to a complete emotional breakdown. I was suicidal and unable to care for myself. Wells Fargo Mortgage made a mistake, and acknowledged it. However, they were unable (or unwilling) to fix the problems their error created. My sister was given power of attorney so she could resolve the issue. Upon discharge from the hospital an ASC agent confirmed my loan had been fully reinstated, the payment had been corrected, the escrow balance adjusted. They promised the late charges and additional interest charged because of their error would be credited back to the account. I insisted and they agreed they would contact the credit agencies to report their mistake, remove all negative remarks, and change all comments they had made regarding my mortgage account to paid as agreed.

Two days later I received a notice advising me of the sheriffs sale date set for my home.

My home was my savings account. And it was my retirement account. More important, it was my security blanket.

The October 3, 2007, sheriff sale date has been postponed and Wells Fargo has told me they want a satisfactory conclusion to this nightmare. Ill keep you posted. Today is October 9, 2007.

WFHM admitted errors and apologized in two letters received on October 24, 2007, and October 29, 2007, from Todd M. Boothroyd (contact info shown above), credited $12, 000 to my mortgage loan, corrected the negative reports made to the credit repositories, reinstated my loan. I breathed my 1st sigh of relief in nearly a year.

THEN THEY SOLD MY HOME AT A SHERIFF SALE. They took my home, almost $100, 000.00 in equity, and I'm lost without my home. God Bless my 70-year old mother who is now forced to take care of her 46-year old, disabled, daughter. I still believe something good is going to happen. I really do. Two years of fighting for all I'm worth just can't end like this. I will NEVER stop trying to find restitution and peace. And I will NEVER STOP sharing my story just in case it might prevent someone else from losing their home. From facing agonizing months on end. Being turned inside out with fear and pain. From losing their retirement, their live savings, their security. If I had children, I don't know how I'd be able to face it. I don't know how these companies are able to do what they do to famies who have trusted them. It just breaks my heart.

BUT remember, some of the readers of my blogs have been e-mail me sharing good news about the help they are beginning to receive from Wells Fargo Bank. So DO NOT GIVE UP!

I know help is coming soon for all families facing foreclosure. God Bless anyone who helps someone keep his or her home.

So there you go. It's snowballing, and God used you, as he has used me to help those who are at a total loss as to who to trust, and which direction to go. I still look back on that morning when I got that call from my wife, and immediately thought of you. I saved your blog in Microsoft word, and was able to retrieve it. Yes, I'm still in my home but now after Wells Fargo Bank dba Americas Servicing saga was all worked out, loan reinstated, $12, 000+ credited to my mortgage account -- 20 days later my home was sold at a sheriff sale. I walked with eyes wide open smack dab into the middle of a foreclosure rescuer scam artist LLC. "Equity-Strippers." To just say just the very least, and leave you alone, they forged a Quit Claim from me to them, mortgaged my property to the max hat at one time had significant equity (for me) and now I'm fighting with

under investigation for mortgage fraud, forgery, and sexual battery -- six identical cases in court at the same time all Quit Claim fraud, all forgery, but I'm still fighting just so exhausted. DEAR LORD, WHAT'S UP? I don't know where my story ended with you, but let me know if you want to hear anymore about the pain these lenders lovingly spread around -- if I were you and FINALLY had a happy ending, I sure would understand if you prefer to move on.

If I had a happy ending, well, I'd still stay very very deep in this. Too many people have too much to lose. And they are losing it.

Tonight I'm going to take my legal books away from this laptop, and pray a huge thank you for your happy ending. So, so nice.

I agree with everyone on this comment board and I am so sorry to hear about all the trouble that you are all having. This is the reason I started my company. I have helped several people that have mortgages with ASC, Countrywide, and other mortgage companies that don't seem to care if they harass people or suck them dry. The comments I have heard are along the lines of trying to get blood from a stone or turnip, or something like that.

Contrary to what some people have said on here, I am not trying to be one of those people I mentioned above. My company is a nationwide company that provides services for people that are at the end of their rope. One of the helpful things that we provide is letting you know, before payment for service, if we can assist you and if we can not. If we can not, we tell you why not and what can be done to allow our company to assist you. Most companies won't do that, but we will also give you the reasons why exactly so that, if you should choose a different service, they will not be able to scam you. Now that's a way of saving money too.

I have a service that actually will take you out of the loop of contact with ASC, or Countrywide or whomever you have servicing your loan. All you have to do is tell me how we can help you. By that I mean, tell us what you are looking for us to do for you and we will pursue the help that you want, no matter what. We have all aspects of the mortgage business covered from being a mortgage mediation company, a title company, a real estate company, all the way to having access to attorneys for litigation or help to avoid foreclosure. No aspect of help is turned away.

Let me tell you, most of the customers that I deal with have told me about the fear and the frustration of working with mortgage companies that don't seem to care or give them the runaround. To be totally fair, mortgage companies have their ways of dealing with people. Some are good, some are horrible. But one thing all mortgage companies love is being vague. When they are vague, they don't have to give you information until you ASK for it. How does that help you? How can you try to save your home if you don't know how to ask the right questions?

That’s another reason why I created this company. I take your number out of their "system". When they mail you something, it goes to me. I take the burden away from you so you can live your life without the phone calls and the letters. And the rudeness! Oh, man, if I told you some of the stories I have heard...let's just say, it’s not pretty.

I know that some people are going to look at this comment and go, this guy is trying to drum up business. Well, you're right. But here's the kicker. I used to work in mortgage collections. I used to make the phone calls and send the letters. I used to work around the people that make your lives hell. And I kept asking myself, why? Why are these people not being told about the help that’s readily available? Why are these people not being helped to make payment arrangements that are realistic? Why does this company care more about the money than about customer service when that is supposed to be their primary objective?

That's why I got out. I can not stand collections. Just because they are hiding behind a company name they think that they can say anything or act anyway they like with the customers, being friendly with one and the next 40-50 they can treat like crap. Where is the customer service?

I take all that frustration away from you and create solutions that work. I know that it may be hard to swallow, but I do. I have done it for several people. And I can do it for you too.
