Two weeks ago I ordered a trial bottle of the acai berry and a trial bottle of the colon cleanse, 2 lots of 3.95 were debited from my credit card. I have just checked my online bank account to find that not one but two! Payments of £74.53 have been deducted! I have most certainly not agreed to any terms and conditions that let this absolute disgrace of a company take this money, luckily I noticed on the day this went out otherwise I would be incurring charges from my bank. I will be calling viv3 labs first thing monday morning (they are conveniently closed at weekends) and demanding an explanation and a refund of my cash. When ordering the free trial nowhere on the website does it have an option to agree to terms and conditions.

Do not buy this product, it is a scam and they will fleece you for all you have!

I will be contacting watchdog and msn regarding this as people need to know what this company is doing.

I too have been conned out of a total of £118 for two bottles of aciberry and life cleanse which all they did was upset my stomach and give me stomach pains, only took a few days worth. Knew nothing until my bank contacted me regarding misuse of my credit card. I can't believe they are allowed to take money out when all I authorised them to take was the postage charge. Rang and e-mailed them straght away and they confirmed the accounts are cancelled and no further payments will come out. Bank says they cannot guarantee more payments going through eventhough I have cancelled my card and advised the bank to not allow these companies trading as many different names to allow payments through. The bank are well aware of these companies and informed me that loads of people are being conned. I felt totally sick at what has happened as I am a struggling student with 3 children, I cannot afford this money. There was no mention of any refund from Viv3 as the terms and conditions state I did not cancell within 15 days. Why doesn't the banks or trading standards do something about this company, they should not be allowed to advertise on the hotmail website. They are still there with their clever photo's to lure you in. I will also be contacting Watchdog.

Back on 7/7/09 I ordered a '30 day trial' of life cleanse tablets for the trail price of £3.95.

I never recieved these tablets but thought to myself 'doesnt matter, it was only £3'

How wrong I was...

Today I looked at my bank account and was shocked to see that I was over-drawn, when I looked at where my money had gone it was viv3. they have taken £74.73 out of my account!
I rang my bank who gave me their number and told me to give them a ring 1st and see if I can get my money back.
When I rang the number I spoke to a foriegn bloke who tried to tell me thier conditions but I wasnt interested, I told him that there were no conditions when I agreed to pay them my £3.95 and to put me through to someone who could help me.
No such luck, he told me there wasnt any other number he could give me or put me through to, there was just an email address that I could write to.
After arguing with this bloke for 45 minuites id had enough so I put the phone down and sent an emaill to the address he gave me.
They replied pretty quick to say they had received my email and they were looking into it but still no reply about my refund so I contacted my bank again.

My bank (barclays) are now classing this as fraudulent usage and are trying to get it sorted asap, they are also going to give me back the fines I have been charged for being over-drawn and have blocked my debit card from being used anywhere else but the cash point machine, they are also sending me out a new card.

I may have got this sorted but it is not the point, this company is getting away with taking peoples money without consent and that to me is theft. if I was to take money out of someones account without thier permission I would be locked up!

This company is nothing but a group of thieves taking advantage of innocent people. I, in good faith, ordered FREE samples of Acai berry and Life Cleanse tablets and paid the shipping charges (2) on these products. I saw the advertisement for these products on a web site and because the ad used a person who lives very close to where I live and who spoke favorably of these products I decided to give them a try. Last week my credit card account was charged with $131.72 twice. I did not order these products and if they come to me they will be refused and hopefully the company will have to pay the shipping charges both ways. Maybe then they will learn how to be reputable. I am almost through the free samples and must say that I do not notice any improvement whatsoever healthwise.

I also got the supposed free trial! Until i received my credit card bill. They had taken $283.07 AUD out of my credit card without my permission. I have just got of the phone with their customer servie people who are no help and told me they had cancelled everything but i would not receive a refund. I have also alerted my credit card company as to what they have done and to stop any more attemps to take money out of my visa. What a scam this company is, i hope with all the complaints that something will be done before any more people get ripped off.

Like so many before me, I was taken in by a superb web site advertisment and like those before me, fell into the trap of (if it sounds too good to be true, then it it will be too good to be true)! After realising my mistake, I painstakeingly wrote letters to every address I could find on the Viv3 Lab web site (three in all). I received no reply from any of them. I did however receive an email from a lady to whom one of my letters was delivered. It would apprear that Viv3 Labs used this ladies address without her knowledge as their legal department. Also since writing my letters, I have found that for the exact same produce (Asai Berry) with the exact same mg content (500mg) but with far more capsules in each container, I could purchase from Holland and Barrett for fourteen pounds 95 pence instead of the seventy nine pounds which Viv3 Lab charge. This company has caused great distress to many people and should be dealt with by the police or at the very least by someone in the Internet Fraud department. I have contacted such a body myself. I have also contacted my credit card company informing them of this company and telling them to stop all further payments going out to Viv3 Lab. For all of you in the same situation, get in touch with your credit card company or your bank and tell them of this situation. Without a doubt, the people of Viv3 Lab need to be put behind bars for fraud; but AFTER repaying all of us the money they have obviously STOLEN! If there is anyone out there who can help regarding this situation, I would be very pleased to hear from them. Margrete

I too fell for the 'free trial scam' of detox and cleanse tablets. I cancelled my order within 30 minutes of placing it as I realised I had been conned when I did a web search for viv3(wish I had done this prior to ordering). Their customer service advisor, Brian Barden, told me that no products would be issued including the free trial as I was cancelling immediately but I would still be charged P+P of US $1.43 per bottle as that had already gone through. I sent over 3 e-mails to their customer support address as given by Brian and detailed on their website but only to receive the response 'no e-mail support'.
I contacted trading standards for the area and she advised writing to them direct, as other people were having more success that way, in Linlithgow but believed that all mail was then redirected to Barcelona. I sent a letter by registered post.
To my disgust I received today the 'free trial' set of products and am waiting to see if my credit card is going to be charged again.
I have sent e-mails to the addresses given by 'ex-local biller' and can only hope that the threat of police involvement, trading standards and legal action will be enough for them to stop any further supplies being issued.
If anyone has any further information as to how to contact or stop this awful company please post or contact me direct.

I took a free trial of products, from Viv3 Labs / Vitality Clean and supplied my debit card payment for postage. The web link stated that as these were a trial all that would have to be paid for would be postage. There was nothing that stated I was subscribing to a product for a monthly fee. I have no emails to which to respond etc. I do not wish to receive any further supplies of this product, and in fact would like my money returning to me that has already been debited, this is obviously a scam, and a very clever one.

I am one of the lucky ones.

I was also a victm of this Viv3 labs con. I had over $300 deducted from my account unauthorised for signing up for the free Acai Berry and Colon Cleanse products - I received no products.

I complained to - support@viv3.com - and was told I had agreed to the terms and conditions. I kept complaining and pushing back on their pathetic 'terms and conditions' excuse stating I had received no products but been charged over $300 for the priviledge.

Eventually after about 6 email exchanges (which in fairness to them they did respond promptly on each occassion) I received an email advising they would refund me. I read this with much cyncisim, however I was surprised to find the money was actually deposited into my account this week - minus about $37.

I consider myself really lucky although feel foolish for falling for the Acai Berry/Colon Cleanse con in the first place.

My advice is keep emailing them with your customer number demanding reinbursement. Ensure you block any further withdrawals from your account by notified your credit card provider. Complain to your local watchdog or similar body. In addition complain to CNN or channel 9 or whatever legit channel that were apparently endorsing the product or the latest ad 'Janes amazing weight loss secret' or 'I lost 2 pounds a week following 1 rule'.

VIV3 are a dodgy outfit make no mistake, but Acai berry does actually seem to work as a natural appetite suppressant, so I hope you can source it through legit channels and try it for results.

Re VIV3, I was lucky on this occassion - I hope you will be also. Good luck.

Viv3 Labs is an absolute scam. I ordered two free trials from them and cancelled both in writing via email well before the 15 day trial period was up, and yet they activated my subscription and put the charge on my credit card. They also kept adding products that I had never ordered to my account. After numerous attempts to resolve the matter myself, it became abundantly clear that they were not acting in good faith, so I contacted my credit card company they reversed the charge. In my email exchange with Viv3, one evasive technique they used was not to include the text of my emails when the responded. I hope they are put out of business soon!

I signed up for a free trial of this product and paid £3.99 P/P some where in the small print(surprise surprise!)was a clause saying that if I did not cancel my subscription to them in 15 days they would send more products and the cost of the products can total £500 and more !thousands of people have now been caught in this scam there is no e-mail address to cancel so all e-mails are returned and the cust.service no's are false if you do get through to one they say they will cancel BUT then continue to take funds from your A/C Some thing should be done to stop this company trading !

15 days trial commences from shipping (can take 7 days to get product and you are then victim of "auto re-ordering" terms in the small print. Have actually tried the product with no discernible benefit, am £80 poorer and a little wiser. Have researched and found numerous complaints, a complete scam!

I ordered FREE samples of Acai berry and Life Cleanse tablets and paid the shipping charges on these products (2 x £3.95 that turned into £4.15 on exchange). I saw the advertisement for these products on my Hotmail site. My debit card was charged with with the postage/packing on 14th October but then on the 31st October I was billed £72.30 twice. I have not ordered anymore of these products as I have not run out of the trial quantity yet and have not received any more. I have notified my bank not to pay any further monies to this company and have reluctantly accepted that through my own stupidity I have lost the £144.60.
Warning to everyone : don't send for anything on the internet that is supposedly 'postage/packing' only, unless you know the company you are ordering from.

This is my a/c number and order id, i am cancelling within the 15 days and another order should not be sent to me and a payment should not be taken off my account. If this is attempted i will report this as fraud. I have complied with your terms and conditions by cancelling within the 15 days. please confirms this by return to my email lauramcgold@yahoo.ie. Once again i am demanding my subscription cancelled and money not taken from my credit card.

I ordered a free sample of a diet supplement from these people and gave my card details to cover the cost of postage and package . The site was a secure site. I tried unsuccessfully to phone using the number given on their web site and also tried to send an email to cancel any further products. The phone is on an answer machine and the emails bounce back. Meanwhile a further sum of £150 has been taken from my bank account and transferred to an account in Cyprus.

I am not able to contact this company and would appreciate it if any nobody has a number, address or valid email address they would pass it on to me.

These ### have telephoned and e-mailed as per Sandra at tlc investigations advised. They no longer dealing with e-mail. Feel so pissed off would like to get a few heavies round, to the poxy directors they know who they are 1 of them lives in a street in EDINBURGH where property sells for over £1 million. Anyone for a mass meeting at 1 of there addresses.

I've been caught by viv3 labs. I purchased some tablets and was charged £3.63 for delivery. Thirteen days later over £74. went from my bank. I contacted my bank to find out who this money went to. I was amazed when they told me it was a firm in Cyprus.I've never had dealings with firms above for this simple reason. When I asked them why they had taken my money they said it was in their terms and conditions, even so, their 15 day trial turned out to be 13 days in my case. I'm going to try and get my money back starting with an address . Keep your fingers crossed for me and if I'm successful I'll let you know

es mas el producto nunca lo he recibido, esto es realmente un robo y un fraude del que todos debemos de tener cuidado.
tiene un numero de soporte que siempre esta ocupado y naide contesta, pero en fin obviamente si es un fraude nunca contestaran

A similar email arrived for the other product.

When the package arrived I called them on 3rd August and cancelled future deliveries; my first call was to a person who did not understand my dialect and was abusive and hung up. I called again and received an apology from another man, who assured me that my orders were now cancelled and that my Visa Debit card would not be charged with any monies.
On Monday 17th August I became aware that the bank was holding back money for a pending transaction to Viv3 Labs and I sent them an email which was returned because emails are not received by the email address from which their email had been sent some three weeks before.

I then found some information on this website which I found helpful and calls and emails were exchanged as follows -

Phone call to them on 17th August in which they advised me that I would be emailed within three working days.

Email on 19th August from them

Dear Customer,

Thank you very much for contacting our Viv3 Labs customer service by phone.
We would like to inform you that on 2009-07-27 you were charged for the shipping and handling cost on your free trial. The 15 days free trial starts from the day of the shipment of the order and implies that you have 15 days to test your order for free.
As stated in the terms and conditions of the purchase that you accepted during the purchase process, if you do not cancel your account during the 15 days trial period, you will be charged for the product separately and thus the free trial converts into a regular subscription. We confirm that on 2009-08-16 you were charged for the product for the amount of 118.63 USD .
We have cancelled your account. This cancellation implies that our company will make no more charges and no more products will be shipped to you.

On 27th July I ordered a supply of each Life Cleanse and Acai Berry and an acknowledgement was emailed to me quoting the details above. The products duly arrived within a week and immediately I started taking them I realised I would not be wishing to continue this arrangement and tried to email your company without success as the email was returned undelivered. I then called you on the UK number [protected] and spoke to a man who obviously did not understand English whereupon I asked if I could speak to someone who could speak English and he used a very rude expletive and hung up, by which time he had already had a note of my account numbers and order number
I called back the same number later that day and spoke to another person, who was very polite and took a note of my cancellation request assuring me that there would be no further charges on my account, and that he had cancelled both orders. All this was done before Wednesday 5th August.
On Monday of this week I discovered you had taken steps to remove £75+ from my bank account. This meant that a direct debit was not paid which has resulted in a charge of £35 on my account together with a charge of £12 from the Credit Card Company for the failed Direct Debit. When contacting your customer service by telephone, I explained that these orders had been cancelled two weeks earlier by phone and requested that this money be repaid into my bank account immediately and was told that I would be contacted by email within 72 hours. I have since had your email which advises me that there will be no refund.
I have read your terms and conditions, and it clearly states that a customer may request a full refund within 30 days of their purchase. In total, I am requesting that you refund me with the full £122 which is what this error on your part has cost me. I had purchased this product on July 27th, therefore the 30 day period has not yet ended; the terms and conditions clearly state that within thirty days a refund may be requested. On using the link http://viv3labs.helpserve.com/index.php?_m=knowledgebase&_a=viewarticle&kbarticleid=26&nav=0 I have found the following: -

"Our refund policy is as follows:
* 1. You may receive a refund of any Product that you ordered up to thirty (30) days after your order is placed.
* 2. Customers are restricted to receiving a single refund per product ordered. Repetitive refunds are not permitted unless the product, as delivered to you, is defective. VIV3 reserves the right to refuse a refund to any customer who repeatedly requests refunds or who, in VIV3’s judgment, requests refunds in bad faith.
* 3. In order to process your refund, you must supply VIV3 with Your name and delivery address. If you provide us with insufficient or incorrect information your refund will be delayed.
* 4. Depending on the bank that issues the credit card, your refund can take up to thirty (30) days to appear on your credit card statement. If you have any questions about whether a refund has been issued by VIV3, please call Our Customer Service Department toll-free at [protected] or (+44) [protected] outside of the UK.
* 5. Shipping and handling costs are not refundable"

Therefore I request the refund to which I am entitled for this product.

I have studied reports on the internet today and note that you have over 100 complaints in the last month on the same subject and would be grateful for your early reply on this matter. Failure to contact me very quickly will ensure that I pass this matter on to ‘The Judge’ in the Scottish Daily Mail as has already been done by another of your unsatisfied customers. I will not hesitate to take legal action is the small claims court if necessary.
I hope you will resolve this matter for me very quickly.

As indicated in our previous communication to you, you have accepted the terms and conditions of the purchase, indicating that unless you cancel your account within the 15-day trial period you will be charged for the product, in addition to the shipping and handling charges.
Please note that for this reason we are unable to credit you account for the product you received.

As you are now fully aware, I have studied the terms and conditions and these entitle me to have a refund of charges paid within 30 days of delivery of order. As you also now know, like hundreds of other people I have had monies removed from my card account after having cancelled the supply of your product which I did only three days after receiving the package. You will not get away with this. It obviously a scam and it is my intention - if your agreement to a refund is not forthcoming - to give you maximum publicity. I live in Scotland and come under the law of this land, and so I already know what my rights are. I would like to hear from you as quickly as possible. For your information, I quote an email I have copied from the Consumer Complaints website which lists you among the top scammers on the internet.

I ordered a Free sample of Acai Berry and Life Cleanse. I gave my credit card details to cover postage only. Two weeks later I discovered that two amounts of $149.76 had been taken from my credut account. I emailed the company but the email was sent back sying they didn't deal with customer service by email and to phone them. I phoned and got a recorded message. I live in Australia nd cannot afford to be ringing the UK all the time. I want my money back I did not give any permission or consent for this to be taken out of my account automatically. I am not wealthy, I live alone and my income from working is what I live on. If I had known the cost of these "free samples" there is no way I would have purchased them at all. I ordered both the acacia berry and the life cleanse products intending to try them and see what happened. I did not receive the orders and had forgotted about it unti the charge appeared on my credit card for 3 items of this product. I have not received the product and when I contacted the company they stated that as I agreed to the terms set out in their website that I was responsible for the charges.

As I have not received these products, I have not been able to decide whether I wish to purchase them. The company is refusing to reimburse my money and I am not happy as I have not received the product.

This is a rort and anyone thinking of purchasing these products should think again.

Please help me get my money back!

a mi me mandaron dos botes gratuitos(bueno, en realidad se pagó unos 3 euros), para probarlos, aparte de que me sentaron fatal, vomitos, diarreas excesivas, malestar general, pérdida de potasio y un largo etcetera...Supuestamente eran para ayudar a adelgazar, los anuncios prometian que se perdian en UN SOLO MES unos 15 a 20 kilos de peso corporal...Caí como una tonta, pués luego me llegaron dos botes más, pero esta vez me cobraron con mi tarjeta de crédito unos 56 euros cad uno.
Cual fué mi sorpresa, mi marido, que es abogado, va a arremeter próximamente contra ellos.

El querer estar mejor a veces se paga dañinamente.

Facts:
a) I ordered Acai Berry and Life Cleanse on 19th June 2009
b) I requested the cancellation of both orders on the same day 19th June 2009
c) I received a confirmation on 22nd June that account for both products is cancelled and that such cancellation would be effective from 22nd June (hence my cancelation was well within 15 days and in accordance with their terms and conditions)
d) On 7th July 2009 they charged my credit card £76.13
e) On 22nd July they charged my credit card £74.02

Action:
f) sent numerous emails however some of them remained ignored and others go automated reply
g) i called the provided number last week (5th august) and the lady from the call centre said she would escalate the issue and that i should hear from them within 5 days...so i am waiting...

Observations:
h) the company viv3lab was incorporated in scotland in february this year
i) the company has no director or any other officer at the moment. The person who acted as director for incorporation purpose resigned on the date of incorporation
j) THIS IS A COMPLETE AND TOTAL FRAUD. I ALSO CALLED MY CREDIT CARD COMPANY ON THE SAME DAY AS I CALLED VIV3 AND EVEN THEY KNOW ABOUT VIV3LAB! THEY TOLD ME THAT IF I DONT GET A REFUND THEY WILL TAKE IT WITH THE COMPANY THEMSELF PROVIDED THAT I SUPPLY A PROOF OF THE ORDER CANCELLATION

Viv Labs sent me my free 30 day trial packages of a/berries and detox tabs charging for postage only. Fair enough so far.
No where on the web page I registered on was there a warning to read terms and conditions. A couple of weeks later I was charged $284.86 for this product.
I phoned the UK Office of the Viv3 Labs only to be told the terms and conditions stated I would be charged if I had not cancelled within 15 days of them posting the pills. This is a very clever ruse and anyone dealing with this company should be careful. They also have more than one website peddling their "products" I see they have changed the "Free Trial" form on the Australin web site.
I asked for a refund and have been refused. The communication was by a generic email so this complaint is ongoing with this company.
I have attempted to email them on their support@viv3 labs email address. All emails bounced. I phoned Viv# labs in the UK only to be told that the computer was not working. I since recieved my refusal for a refund by email MMMM

I ordered a free trail from viv3 labs stll till this day I have not received the products. went to my bank and was told I have no money in my account as 2 payments of £76.23 had been taken out with out my consent.

I phoned viv3 labs who kept telling me I should of read their t&c they are not clear at all! I have askked them to refund the money and all she kept saying it was my fault... this is a major con and these people should not be allowed to trade... nothing is a free trail and the fact I have still no product is shocking.. watchdog should reallly look into this company...

When I discovered my bank balance have dropped dramatically last month, I went to my local bank branch to equire about this. They told me that two payments of £73.85 have gone to a company called Viv3 - I haven't heard of this company before and asked them to find what company is this. They phoned up and said I had ordered a trial of Acai Berry tablets. I was very shocked by this as I have never ordered them and asked them to investigate this. They also cancelled my card, saying it is the long number they used. Ordered a new card and new PIN. Few days later, when I checked my bank balance online as I often do, my balance went back to its original. I found this very strange.

Received a letter from the bank, saying it is not a fraud but a dispute with the company. I was very angry about this as I did not order them and wanted to know how they got my details. After couple of weeks of fighting with the bank and them refusing to help me out, I gave up. Thinking they would not take money out of my bank account again, seeing I got new long number and PIN.

However, last Sunday, after checking my balance online - discovered another £148 disappeared. Thinking I must have forgetten about few direct debits and phoned the bank on their 24 hour line, told me that last payments made from my card was 2x£74 and have gone to a company calls Viv3. I was very shocked and distressed by this, I am in an overdraft because of this! Asked them to close my account and to reopen the investiagation, they refused saying I have to pay the overdraft first. So, went to the local branch again and had an appointment made meeting with them, they said I did order them and nothing I can do but to pay off the overdraft. I am very upset about the lack of help!

After some paper hunting and checking today, I discovered that they had taken money from my bank at least 10 times! (4x£73.85, 6x£1.50 and 2x£3.77)

I'm wondering what other companies do this company have? And how is it possible for them to get hold of my bank details!?

I'm needing much infomation as possible before going to the police about this.

BEWARE BEFORE ORDERING FROM THIS SITE.

They say its a free trial, and you will be forced to give your credit card details for paying the postage.
The game starts after 15 days...money will be looted every month from your account, unless u cancell it.
they say, if you don't call them within 15 days, they take it for granted that you are happy with the product, and keep on sending their products-at prices of about 5 times higher than the market price.
THE TRAP LIES ON THE LEFT SIDE OT THE AD, WHICH U HARDLY NOTICE.i was atleast lucky enough to cancell their transaction right after the first payment...about 190 euro *F* ed.

I ordered a free trial of acai berry and life cleanse, paid postage charges, that were already more that what was stated on th web page. received the pills.

2 weeks later, I received two unauthorised charges of 84, 31€ in my visa card.

Now I have to cancel my visa.

I just wrote an email to the labs to ask for the refund.

After reading all these complaints I don't know if I will get my money back.

More news in some days.

I ordered my free trial of Acai berry and Life cleanse on 7th July 2009, I received them approx a week later, still undecided if I really wanted to use them, they remain to this day, unopened in a cupboard in the kitchen.
The next time I was reminded of my purchase was when I received my credit card statement on friday14th August and noted I had been charged 2 x 64p to a company called viv3 (p&p) then to my horror my statement also listed 2 further charges on 25th July of £74.53!
I could not contact the company until the following monday when I was informed I had not cancelled my subscription within the timescales, so I was therefore liable. If this was not bad enough when I contacted my credit card company they informed me that another 2 payments of £74.40 has also debited my account on 8th august. I got back onto viv3 who said as I had not cancelled the subscription, they had sent out a second batch. I have not, as yet received this second batch and neither do I want to!
I have so far been charged £299.14 for my supposed 'FREE TRIAL'

I was one of those customers who actually read the terms and conditions, who cancelled within the required period, who was nevertherless subsequently charged £150, who received automated reply to emails where complained about unauthorised charge, who had to take it with a credit card company, who was eventually offered part refund but...
and there is big BUT...
viv3 would only refund me if i accept their "condition"
I am lost for words...the audacity of these people have no limits...
see below viv3's email of yesterday to me and my today's reply...

Dear Sirs,

I absolutly DO NOT ACCEPT your condition in relation to the refund.

The reasons are:

1. I placed the order for Acai Berry and Life Cleanse on 19th June 2009

2. On my request dated 19th June 2009 the cancellation of my accounts for both products (Acai Berry and Life Cleanse) was confirmed to me by email on the 22nd June 2009 - well within required 15 days - (see attachment no. 1)

3. Despite complying with your terms and conditions on my part, on 7th July 2009 you made an unauthorised charge for the full price of Life Cleanse to my credit card amounting to £76.13

4. Furthermore without any aditional order being made on my part you sent me another bottle of Life Cleanse for which you charged £74.02 to my credit card on 22nd July 2009

5. Following the above events I took the matter with you and my credit card company and it was agreed during the three way conversation between me, your customer service employee Kate and a lady from the credit card company that upon return of the unwanted bottle you would make a full refund of £150.15.

6. I returned an unopened bottle of Life Cleanse together with the letter (see attachment n2.) by special delivery on 6th August 2009

7. According to Royal Mail confirmation (see attachment n.3), the product and the letter was delivered to you on 7th August 2009

I therefore request you to:

a) Make the full refund of £150.15 to my credit card
b) Confirm that such refund is due to me by virtue of error on your part
c) Confirm that there was no breach of your terms, negligence or error whatsoever on my part and that you will not block my account details and/or make a report to the credit agencies in any form
d) Confirm that no further charges will be made by your company to my credit card

I have just found out today that my credit card was charged with £74.63 from NatureBerry, a company I had never heard of. I called my bank and found out that this was a transaction that had been made by ViV3 Labs - I was a bit confused as all I had ever ordered from them was a free sample of acai berry capsules, for which I only had to pay £3.95 for.

I called the company and they told me that it was stated in their T&Cs that after 15 days from receiving the product, they will immediately take money from your account for a monthly subscription of the capsules. I told the lady I was talking to that I was not aware of this and that I wanted my money back as I didn't want to sign up for a monthly subscription. She then told me that it would not be possible to cancel the order that they had already charged, but that all future orders would be cancelled. I told her that regardless of what the T&C said, I did not want the product and that I wanted my money back. She told me that this would not be possible and I would just have to accept that I would lose the £74.

I proceeeded to call the Consumer Direct (http://www.consumerdirect.gov.uk) and told them about this issue. The guy was very helpful but informed me that because they had covered themselves in their Terms and Conditions, they were not obliged to pay the money back. However, he did tell me that because of the number of complaints on the internet abou this issue, they would be keeping an eye on them to make sure they do not dupe anymore consumers. I am determined to follow this up and get my money back no matter how long it takes.I am absolutely mortified that companies are allowed to do this and there is nothing one can do about it.

I really hope that anyone else out there who is considering signing up for this will NOT DO IT, cos it is a scam! Do not sign up to any free sample offers from Viv3 Labs!

In regards to the Acai Berry & Life Cleanse pills, it is not clear that if you do not cancel within the 15 day trial, of which you need all that time to actually see any results - in my case an increase of weight despite a healthy diet of daily salads and vegetables as well as daily exercise - that you will be charged for not only the first bottles sent to you, but also automatically new bottles are sent out to you for which you are charged.

You cannot communicate via email, you must make a phone call to the UK. I sent back the still half full trial pack, as well as the unopened new bottles that had arrived within 2 days at full postage cost to me, and was told someone would contact me after I had cancelled the subscription to discuss if any refund is available. I received an email with 3 days just stating that no refund was available, that I agreed to the terms & conditions, which I understand, but beware! there is no clear instruction and you do think that you are just signing up for a free trial only - not for an ongoing subscription. Also, there is NO discussion on the subject of refund. They say 'no' and that is it. I tried entering in to a dialogue with them and that doesn't work. We all need to ensure that our word about this scam is out there to save others from incurring the costs so many of us have already fallen victim to - that's 89 pounds per bottle - & they charge you for the free trial, so I'm up for 4 bottles, postage & handling & I still sent everything back to them... By just stopping the pills and keeping up the healthy diet, I have lost the 2kgs put on within that 15 days - don't fall for this scam!

Foolishly I selected a free trial on Internet for the detox pills offerend by this company. After 1 month the pills finally arrived. Thay said that I will be charged 3.95 € but in my account appeared 4, 12€ twice. But this was the beggining because some weeks later appeared a second discount in card account where was took from this company the amount of 85, 67 € twice. I sent a letter asking them why this amount was charged without my authorization and they replied that the 3, 95 where charged only as handling and postage and that after 15 days of not cancellation of the subscription then immediately the product will be charged.
What a crroks are these people. This is a total scam.
Please be aware of it and run away if you see some advertisement from this company.

I had opted to try the free trial of acacia burn and focus cleanse and given my credit card details for the shipping and handling charges. the trial was for 30 days, but in the small print it said that they will start charging me after 15 days if I did not cancel in writing. after the first charge I called the company and made a complain, I was told that I will not be charged any more and the complaint department will get in touch. they did email me and said that they will not refund the money I had paid £149 but I will not be charged any more. now this month I have been charged again for £149 and when I called I was told that as I had cancelled late I was charged for the next month as well.
This is blatant fraud, I want my money back.

I live in New Zealand and have also been scammed. I also paid for the postage ( $11.95) on what was to be a free trial of the colon cleanse. I have recieved my next statement only to find that I have been debited $72.00, what for I do not know. I have to contact my credit card company to get this sorted out, but how many other people in New Zealand have been scammed

My credit card company has given me an alternative number, but the customer service dept. say they are not affiliated with viv3 labs.

Let's put those crooks out of business! Also: vitalRezV (clipper health) is scamming the same game with slightly different pricing but just as bad. Also they are trying to force you to buy 3 months at those exorbitant prices. That's triple $118, or triple $79.

I purchased a free trial of acaiberry weight loss tablets, and was debited $7.48AU from my credit card. One week later I was debited $147 .31 from my credit card again, I was ripped off badly, I can not even get a hold of them. I don't even know what this was for...I want my money back'.
