Sub: complaint against buyer: top step development ltd, hongkong.

Dear sir / ma'am

We arham international, india are export company dealing with supply of grains, cereals & agro commodities

We have supplied indian maize (corn) as a part of partial shipment as per our

Contract no: arham/1161/14-15 dt 11 oct 2014
Buyer: m/s top step development ltd, hongkong.
B/l no: gosubom6071560 vessel: hammonia istria 7e for usd 19764.80
B/l no: gosubom6074256 vessel: oocl newyork 011e for usd 29836.40
Payment terms: 100% documents against payment via bank

Surprisingly buyer m/s top step without any justifiable reason have refused to accept documents & demanding of usd 10, 000 just for providing no objection certificate (which is mandatory once goods have leave loading port with buyer name on bill of lading) which have resulted total loss of cargo as it is perishable goods & additional cost including
- re-export of goods,
- cost of re-documentation & bank charges
- losses due to change in plan for future shipments at last moment.
- bank interest
- loss of future business with other buyer & inconvenience cost due to stuck in problem.

Total value in monetary terms : usd 93942.38

Fyi, we have started this business with capital borrowed from bank & some family n friends. But unfortunately this problem have given a stop in our business & ruined my career too. Also, we have loss confidence over other buyers & scared of doing any business in future special with any hongkong company.

We would request you to help us in recovery of losses from m/s top step & take a serious action against him so that some other innocent doesn't became his victim.

Also, request you to cancel his all trade licence and take all possible action making sure he don't take undue advantage of any other supplier in future & breach terms of contract.

In advance, we express our gratitude for your time and consideration in support of our endeavor. Making him teach a right lesson with recovery of our losses will be considered as great success to quality & fair business practices.

We agree with ARHAM INTERNATIONAL. We have faced the same problem and had requested ECGC to ban / Blacklist TOP STEP DEVELOPMENT LTD. Luckily we had escaped with minor damage.
This is a typical scam and many exporters must have burned their fingers.
The scam goes like this - TOP STEP DEVELOPMENT will post frequent enquiries on the internet. Exporters will contact them and they will agree with the fair price but with ridiculous terms like delivering shipments within 1 to 3 days (who can commit to deliver the shipment in 3 days when transit time itself is 7-8 days? we maintained a written communications on this and made correct documents without such commitments) taking advantage of the miscommunication and without giving time to think. Also he will ask for extended demorage period (For negotiations later on). And will orally accept the extended delivery. Then he may accept the first shipment smoothly and will place order for the second. For this shipment, again there will be ridiculous terms but this time exporter will get oral confirmation again for the delivery time and that's when they get trapped. Top step development (Peter Chan) will tell exporter that he will not accept the cargo because of the delay on some other reasons he may come up and will threaten the cargo will be confiscated by the govt. as he wont provide the NOC ( which technically is not the case) and exporter will face total loss.
This is where our technical knowledge and experience helped and we could escape with a minimal loss.
This person is still posting requirements on the internet and sometime with different name. People should beware and should not enter this trap.

This racket is well hardened and will resort on abusing and threatening if required.
