SwipeAuctions.com Unauthorized $249 charge to credit card

SwipeAuctions claims I authorized a $249 purchase on 10/10 or 10/11/10 of a promotional “5000 Bonus Bid Package” that they offered – not in one of their auctions – but by including it (camouflaging it, if you will) in a list of dollar items that I had already bid on and won. They go on to say that I could have declined to buy this item by clicking an “X” in the “Status” column that normally shows only whether an item has been paid for (“Leave Feedback”) or not (“Buy Now”). So even though this $249 item was placed (disguised) in a list on a page entitled “Won Auctions” and was never offered as an auction item, I effectively bought it by default since I didn’t actively decline to buy it. They claim I “actively” purchased it. Needless to say, they have refused my requests to have this charge reversed. I have filed a dispute claim with my credit card company.

Although they promote their integrity in refunding if not satisfied with the program, I was never able to get the refund of $159.00 US on the basis that they had recently lost their Merchant Processing Provider and to contact the bank of my credit card.

I did that, and the Visa people tell me this is wrong and they will not credit the amount I want the net people to be informed about this scam and to tell them to stay from them.

went to the website to "look", asked for info, had to enter prior to searching, contacted the customer service, they gave link to orms, said fill out, write expedite, and would have refund within 30 days, filled out, mailed and faxed, that was October, still no refund or response. Contacted Wachovia, said no assistance they could offer. Seems like a hard $159.00 lesson learned,

They billed my credit card for $159.00 without my consent and I called them and talked to an agent
by the name of Victoria#sa1408 and she said I would be refunded the $159.00 plus 2 payments
they charged of $11.95. I called back to see why I had not received my refund and was told
they did not have any money to refund the people that were scammed.

they asked where they should send my winnings I filled out the registration form including cc info wanting only to preview the site then decide whether or not I wanted to participate. They immediately used my info to take unauthorized money from my account. many other people express a similar experience.

Stay away ! Sounded like good thing to try, after they took my money decided I didn't want it, so tryed to get refund and guess what when I tryed to they were shutting down and no refunds. Well did get money back because I got my bank after them. Took awhile but finally got it back.

We thought we had to put in our credit card info for anything we were going to bid on - TOTAL SCAM. The next minute we see they charged us $159. That minute we went to their online chat - had to fill out 5+ pages of ridiculous BS, including a copy of our driver's license. We have all the paperwork and the copy of our online "chat." The paperwork stated they needed all of this "for the bank to be able to issue a refund." BS! Any vendor who uses electronic billing (i.e. a credit card online) can electronically REFUND AT ANY TIME! They were just playing for time. The paperwork stated after mailing, we had to wait 28 days, then go online to "chat" again to make sure the refund goes through. Now the website is defunct and no one can get their money.

THE ONLY THING YOU CAN DO IS TO CONTACT THE ATTORNEY GENERAL IN THE STATE OF COLORADO. Go to:

SwipeAuctions.com fraud want refund

I was on the auction site and had 4723 bids left in my account which I paid for on my credit card. I have paid over $300.00. My login name was 66queen and password was prom queen. When I made a complaint about no products being up for auction only bids were, I got no response. Recently I found out they were shut down. I want a refund on all the bids I paid for.

SwipeAuctions.com $159.00 Refund

I apparently got sucked into this as well! I should have googled the complaints first and then maybe I could have saved me alot of trouble! I signed up & found out a week later that they deducted $159.00 from my account. I contacted them online and the rep said they would cancel my acct and refund my money. I was so happy, but its been a month now and I havent seen any money. I contacted them again today and the live chat rep gave me a number to call. I called that number...this new rep says that im not going to get my money, appologives to me and stated that she is now ending our call & HANGS UP ON ME! Omg, I havent been so mad in my life! I guess I have learned my lesson the hard way. I cant believe that people can be so insensitive! Good Luck to all of yall out there who fell for this ridiculous website! Sure wish I couldve rcvd my refund :0(

I signed up to what I thought was an auction site, similar to others I have used like, bidz.com and ebay.com. I entered my credit info because I thought it would be used when and if I made bids on their auctions. Oh no, they charged me $159 just to join their site. I tried talking to someone on live chat to tell them I was mislead and I kept getting automated messages. I dont think I was talking to a live person! They referred me to a site that wants me to print, sign and mail in a refund request. I did not have to do this to authorize you to charge my account, why should I have to do this to get my money back?

Whats worse, I have done some research on this company. It appears that the same person who was behind the acaiberry diet scam and numorous other shopping scams that continuously bill customers for products they dont get and/or dont want, may be behind the Swipe Auction site!

Beware people! Look up Swipe Auction (previous name : Swipe Bid) scam online. Also look up Jesse Willm.

I was deducted the amount of $159 from my bank account... I talked to a person that I did not like their bidding system so I quit and asked if I could be refunded the money. She said YES, and just fill out the form that she send me and sent it back to them via mail so I can get refunded. More than 30 days had passed ( which is required for me to wait for the processing) and still no refund from them after completing all the necessary papers.

Now I am trying to contact them thru a live chat... but it seems their system is already out of service.

Hope you can help me with this online scam. Thank you very much!

On 9/25/10 I signed up with Swipe Auctions-When I realized what they were doing I contacted them and said cancel my account and refund the $159. They sent me forms to fill out, which I did and sent back right away. Then on 10/2017 I was told my request had not been processed, wait 28 days and check again. On 10/25/10, contacted them again, was told my account has been credited. As of today, 1/5/11, I still have not received the credit. If this is not a SCAM, then what is? Now they have an internet posting telling how easy it is to get a refund--DO NOT BELIEVE IT!

We are continuing our research on swipeauctions and the Jesse Willms connection. It seems there is a pattern of people complaining about unauthorized charges from a variety of Jesse Willm's companies. If you look at his other companies like Just Think Media and JDW Media, you will see credit card charges concerns across the board. It was done with teeth whitners (Dazzle Smile), colon cleansers, ACAI Berries.

If you get directed via POP UP to a "Flash News Story" offering colon cleansers, acai berries, teeth whitners, swipe auctions, be advised to be very careful.

It will give you the info you need to know. Why not do your homework instead of complaining about unauthorized credit card charges?

was charged 159.00, right away I asked for the funds back. After much run around and days of complaining, I was able to print out a refund sheet. well this is over 5 pages want VERY personal information, information that your bank doesn't even ask for, so I try contacting again and again. I now find that the site is closing. I also see that they are still selling "bids" how can this be still taking funds and being closed. I printed out some of my chats with their on line help/support which is no help. Alsio on my bank statement I have many charger internationalones even which I have received nothing for nor ordered. How can I stop them from charging my account! Are these out of country scam artisit?

Swipe Auctions nabs another sucker. On September 22, 2017, after realizing what I had done (Agreed to be charged $159.00 for membership), I immediately contacted Swipe Auctions. They sent to a page to download a pdf, fill it in, and mail it in to them for my refund. I thought I would be respectful and give them time. On November 5, 2017, they inform me their "Merchant Account" has closed up shop. I find this very interesting as my bank statement list the following:
"09-27 #VISA CHECK [protected].00
MERCHANT PURCHASE TERMINAL 490763
AW SWIPE AUCTIONS COM [protected] XX"
It appears to me that Swipe Auctions IS the merchant account. I will now try to go through my credit card issuer and see if they will pursue this illegal activity. It almost looks like a class action could be looked at here.

I was just charged 159.99 for this auction site. It did not say anything about this charge before i was going to join. I called my credit card company to tell them not to put this on my card. I want this taken off as of right now. I refuse to pay this fee that i was not told about before i joined. If i have to i will call the Ohio fraud if this is not aken off.
I'm sorry about this, but the site should tell about this charge so people know ahead of time. I just can't pay this amount. Please to not tell me there is no refunds, because it will not get paid.

SwipeAuctions.com Refund

This company was somewhat deceitful in collecting my $159 sign up fee, but it did. Now I want my money back and they are doing their best to slow down the process. I submitted a lengthy request form (which had to be mailed by the way), a copy of my drivers license etc. to get my money back. At the time I didn't think much of it other than it was alot of work to get back money I was entitled to. Every time I chat or call with them they start by telling me that I didn't submit the paperwork and to call back October 31st to see what the status was. I couldn't get anyone to tell me that they did or didn't receive the paperwork other than the one individual. So now it's october 31st and I live chatted with them as I was told I had to do. They told me to call back on Monday when refunds was open. I have a feeling they tell everyone to call back on a sunday so they can keep my money for another day. What a scam!

Same thing they told me. What a scam. They took my $159 and knew all along they were going to take it...it's part of the scam. I called my bank and they immediately gave me a $159 credit so I suggest you do the same. This guy ought to be hung up by his testicles!

On october 1, 2010 I saw the commercial on line Isaw the price was 19.99 after i enter my credit card the charge was 159.00 I called rt away asking if it was a scam the operator reassured me no I still said
I want my money back.they send me to a site for the refund application I sent it priority mail no answer when I call again they sent me to another site no application fund what do I do they stole my
money just like whos protectecting us please help me

I've just had the same problem.

I contacted them after the initial 21 day refund period only to be told they needed an extra 4 days to process my request. They did confirm they had received the form.

Now as like above - I've been told the following -

" Swipeauctions is winding down operations due to merchant shutting down our processing and is no longer accepting new customers. In addition, Swipeauctions will not issue refunds for membership fees (see the Swipeauctions' Terms & Conditions). During Swipeauctions' wind down period, all products corresponding to already paid winning auctions will be shipped in accordance with the Terms & Conditions."

Any attempt to get anymore information from the rather unhelpful customer staff via live chat returns the following comment -

"Ashlyn#SA6730: I sincerely apologize, but I have no further details to provide to you at this time. As a livechat agent, I have not been fully informed of all the details behind the shutdown. Therefore; I am simply unable to assist you with any further information."

This is very frustrating and wrong on there behalf.

I have filled out all the paper work for my $159.00 refund, due to the fact that I think your site is a scam. I have not heard for you in any form and it has been a month since I requested the refund. My credit card statement has come and I will dispute the charge if I do not hear from you in the next three days.

I disputed the charge on my credit card. I filled out the information they needed to dispute it, and today I got a refund back on my credit card!

Browsing net found swipe auctions and filled in the application only to receive an email telling me I was being charge a fee! Immediately tried to discuss on line apparently the charge is obvious everywhere! Filled in a refund form and sent it off. Three weeks later again to the support line only to be told my refund was reject 'no order number' requested order number - number supplied. checked emails the number supplied is NOT the number on the original email. The site may be legitimate but gives all the appearances of being a scam.

I have been trying since September 30, 2010 to get a refund. I completed the form they required, contacted them two weeks after I mailed the form to them and was told I needed to wait two more weeks as they were backlogged (yeah, I just bet they were). Tried contacting them today and was told they are shutting down their operations and no more refunds would be issued. Tried to complain the the live chat agent pretended ignorance. I'm furious to say the very least!

I have been trying for over two months to get a refund from Swipe Auctions. I have filled out the paperwork and mailed it back to them just like they told me to do . I have tried calling but all I get is a message. The message says contact them through the website but now it seems to have been shut down. I guess this was an expensive lesson for me to learn. I think I fell into the same trap. I just saw a charge of $159.00 on my debit card account which I never authorized. I never heard of this company, never bought anything from them and when I googled the name, I found this whole list of fraud alerts. I think I am stopping at my bank today.

what a ripoff.. I immediately asked for a refund and was told I had to fill out this ridiculous form which I did, sent it certified mail they received it on 10/29/10 its now 12/06/10 no refund. and now apparently no website. does anyone have a suggestion?

Hi Everyone
Warning stay away. I thought I was filling out a membership form however, I was Purchasing a membership! 159$ and then good luck getting a refund. I immediately contacted their customer service department ( a minute after the transaction was processed) and they told me I needed to fill out paperwork and submit for a refund. They said they could not just refund and cancel the membership. 6 weeks later no refund!I have conyacted Chase credit cards and submitted a dispute. This site is a total scam stay away!BBB next for a dispute.

I am KH from New Jersey and same result here for charge of $159.

As there request on same day of dispute, I sent refund request with their refund authorization on October 16, 2010. As of today (Apr. 24, 2011), no response and no refund.

Everyone who read this messgae, stay away from SWIPE AUCTION.

Was told today on their livechat and the phone( neither of them help and they are rude) that ( word for word)-SwipeAuction.com is winding down due to merchant shutting down their processing and is no longer accepting new customers. In addition, Swipeactions will not issue refunds for membership fees.

I was trying to show the picture of my chat conversation, but I think due to my slow internet connection I am not able to, maybe tomorrow when I get to school.

I'm going to try and sign up again later with another email to see if I was lied to-Probably-

Same thing happened to me Guernelli

After I filled out the refund form mailed it in and contacted SwipeAuction.com a couple of time. Today being the last were I was told they are shutting down and will not be giving out any refund. I have already sent in a complaint to the BBB and I'll be emailing you to Jennifer. I even tried to have my bank cancel the transaction right after, but for some reason they wouldn't. I'll be talking to them tomorrow.
If it wasn't for that NBC lady I would of never tried this.

SwipeAuctions.com Difficult & drawnout Refund process

I came across Swipe Auctions online and tried to bid for an Ipad. Their website is misleading and contains a lot of fluff but does not highlight the fact that they charged me $150++ when I registered (and provided personal as well as credit card information).

Because of this, I decided I did not want their business and avoided making a transaction. I also requested for a refund via the website's online chat (the only means of contacting them). I was instructed to mail in a Refund Form and contact them 14days after mailing out the form. The form itself indicates that I should get results within 14days.

When I contacted them after 14days, they then told me that the processing has increased to 28days and that I will have to contact them again. The form that they had me complete did not indicate anywhere that the processing time was 28days.

This is unacceptable and unethical and is a scam. I believe Swipe Auctions is deliberately making it difficult to get my hard earned money back.

What I want them to do is refund my money Asap via my credit card. I do not want them sending a check as I have read nightmares online about how Swipe Auctions keep giving reasons about being unable to close out a refund because of technical difficulties. All those are excuses.

I have kept records / transcripts of my conversations with the Online Chat option to help substantiate this complaint.

I want to let anyone reading this complaint to learn from my mistake and avoid any transactions with Swipe Auctions.

I, too, have been dragged along with the promise of a refund since Sept. 20th. It was supposed to have been issued on Oct. 19th. I followed up with their customer support today and they said they are "winding down" and will not be issuing any refunds. Looks like we are out of luck. Unless my credit card company can get the refund.

SwipeAuctions.com Fraud

My guard was down since the SwipeAuction link came from a family friend (should have checked since the source is an elderly person I normally trust).

The registration process is the scam. There is no CART and no REVIEW and no CHECKOUT process before your card is charged. The online chat is a further scam. I had to cancel my credit card and file a complaint with the credit card FRAUD Dept.

I may not get my money refunded, but I have some fighting chance. The FRAUD Dept said that I should NOT send in the three page hand-written refund form SwipeAuctions.com is asking for since it asks for even more personal information and a hand-written signature.

This is an offshore scam operation. They make me sick!

Swipeauctions deducted 179.00 out of my bank account even i did not bid on any offer. I had sent in the refund form in 9-2010. Today 12-27-2010 I ask for my refund again, Dan(the rep. from Swipeauctions) told me that I am not qualified for a refund because I had passed the 45 days inquiries.! This is a serious ripp off. I wish for a class action lawsuit against SwipeAuctions in the future.

This is a real dirty scam from that SwipeAuctions gang that preyed on innocent consumer who thought of good and affordable merchandises.

I should only hope that there will be a class action suit against this company. I have also been ripped off for $159.00 and tried to follow the instructions to obtain a refund. I had no idea that I was being charged that amount just for using the site. There was no section to review the application before aggreeing to the any fees. I spoke to a customer service person and they said I wasn't allowed the refund and I should have read the terms in the top lefthand corner of their site before putting in my credit card information. All sites ask for credit card info but always let you view before committing. The rep said I could try to get a refund by following the refund rules. It would take about 10 days. Unbelievable! If there is an accidental charge for any customer, it can be adjusted almost immediately. It's been since last November, and another request was sent in January. I still haven't received a refund. If anyone hears of a class action suit, I'm in!

I read that there were 100 free bids and swipeauctions.com was taking the credit card for possible purchase. I was thinking ebay type thing. I read the entire text box where I was doing the credit card application. Nowhere did it say that I would be charged $159.00. When I complained, it was a secondary text box they said that had the 159 amount in it. Cheat? Yeah, big time. Someone figured out the system with attorneys. Too bad that people think they need to cheat to get ahead. This dual text box in the credit card info page has to change. No one should get away with that. They didn't require a written application mailed in to get my money. I shouldn't have to wait 28 days for their company to rectify the fraud. Very bad time to be out that money...unfairly.

When you sign up for swipe auctions they never tell you that they are going to charge you but at the end of the process they inform you that your order summary is $159. They never tell you that you are purchasing anything or that the will charge your card.

Never trust this company or web site. They WILL take your money! There is no notification that you are being charged until after they have charged your card. This is a SCAM! They are there to take your money; don't let them. Keep clear of this company and this scam.

When you apply for a membership in swipe auctions, to bid in products, it is quite unclear that there is a cost for the membership and that cost is $159.

Too late I realized about this cost, and immediately asked for a refund. I was given a link to download a refund form. I downloaded the form and followed all steps as described. I mailed my refund form (refund is not available online nor through their online support). The refund form instructed me to contact swipe auctions in 2 weeks so they could start the refund process. I called 2 weeks later and I was told that the wait period have been increased to 4 weeks and I needed to contact then again (they gave me a specific date to contact then again). I called back when I was told and finally I was able to get them to process my refund.

But in my next credit card bill, I got a charge from swipe auctions for $11.95. I contact them again, and I was told that I had automatically enrolled in an auto pack when I signed for my membership. Although I cancelled my membership, I still got charged for this "auto pack" and a refund was not available. I asked to them to cancel this "auto pack program". Let's hope next month I will not find a new hidden charge in my credit card bill.

My impression after the above experience is that this business is misleading customer in the cost involved in participating in their auctions. Also, they have made the refund process complicated enough that I am sure many customers get lost in the process and are not able to complete the refund process, therefore, never getting their money back.

i signed up Swipeauctions site on the 26/9/2010 assuming its is a free membership.
Once i entered my details and clicked proceed, my credit card was charged for $159 membership fee.
There was nowhere stated that when you sign up you will be charged a membership fee of $159.
i have been trying to get my refund, sent in the refund form and waited for more than a month now and they still saying that i should send the form back with the complete info (No Descriptor etc) and contact them in 10 days.
They really make it hard for me to get the refund back. not like anyother retail or store where they can just simply refund it back to your card.

Please help me in regards to this fraud.
i believe there are many people with the same problem as me.

This company took the money out of my account for the initial sign in fee without disclosing that I would immediately be charged $159 for looking at items to bid on. I did not know that companies could do this, nonetheless I am furious that this could happen to me. There are several addresses for this company, no phone numbers, so I do not know who to contact to get a refund. There is supposed to be a money back gaurantee but I have had no luck in getting my money back as of yet. I contacted my bank and the money is on "hold" and it looks like I am out the money. This web site needs to be shut down!

Swipeacutions.com was in my e-mail so I answered it. Boy how dumb. I filled out the registration because I wanted to learn how to bid. How confusing that was. I got charged $159 like BAM! and requested in their chat service provided to reverse the charges. Chat room said directions were clear and simple. Bet me. I now have to fill out a refund request on a form they provided and send it in via mail then follow up in 15 days with their chat room. I never received a receipt which has the order number for refund. Now What.

It seems that SwipeAuctions as of today has either permenantly or temporarily shut down its doors. The site claims "We regret to inform you that recently the Swipe Auctions site has been undergoing financial issues. Unfortunately, due to the high popularity and overwhelming amount of winners on our site it had simply become unsustainable to continue running our auctions. While immense efforts were put forth to try and mitigate these issues, all such efforts were permanently stopped on October 31st 2010 when our merchant bank refused to process any further transactions".

Now, if that doesn't sound like the worst explanation of a company who is probably going under because of lawsuits, not because of so many winers, I don'tknow what does. Anyways, here's my story. I was schemed into signing up with them on 9/22/10, which then charged an initial $159 to my credit card. (I thought it was more of a eBay type deal where your credit card is used when you win an auction). I tried to dispute the charge with my credit card company but there was some kind of note on the transaction from SwipeAuction saying that their charge is lawful. So, to get that refund requires you to fill out a refund form as they claim they need a written request for this refund (okay, seems legit, but why won't a live chat conversation do? or an email?). But the catch is YOU have to call them after not 15 days as I was originally told, but after 28 days to verify if your refund form was received and if it is, then request with them the refund again via a livechat. Now that is shaddy! If you forget, or have a lapse in judgment, you just lost $159! And its easy to forget because since the bank can't dispute it, you have to pay it on your next bill or its more interest on your account. So I do all that, get a confirmation on 10/20/10 that my refund will process in the next 6 - 10 business days which ends today and now I learn of what is stated on their website. But here's the thing, my request should have gone through before 10/31/10 when SwipeAuctions claims they lost their merchant bank. See the scam yet? So now I have to email a support team who will look up my account and we'll go from there and it may take 72 hours for them to reply and per the live chat am still not guaranteed my refund! Most ridiculous procedure, company, website I've ever dealt with. Their livechat customer service reps are the worst I've ever dealt with. If your question requires too detailed of an answer or is one that the rep doesn't know, they have these pre-written replies that they will send back to you saying thank you and what else can I help you with today. I even had a supervisor on the chat who refused to give me her boss's name! I had to pretty much demand it 4 times! Hopefully their doors are closed forever.

SwipeAuctions.com Stole my money

While on facebook, I saw a Google advert for Swipe Auction. I decided to take a look. Interested, to find out more I had to register. I looked at form and at no time saw anything about charges. Like ebay, before you can bid, you have to open an account. Again I checked and no charges. After submit. "Congratulations! I just gave them $159. Disgusted, I looked to complain. I found the one-to-one chat and eventually a two way typing conversation took place. I was told that I should have read the disclaimer before clicking submit. I wrote that I did. Shortly a form appeared on the screan clearly showing "If you press submit, you will be charged $159. I wrote back that that was not the same form...end of discussion.
I then tried to re-register and carefully checked everything. I used a made up name and bank details and got to submit. Then I stopped and checked. Still no mention of the $159 .
This was a brand new bank account I had opened with $100 to work on ebay. I rushed down to my bank and found I was overdrawn and in trouble. It was only because I brought the proof with me that I was able to get away without a fine.
I was able to downlaod a return form for my money. On the refund form it clearly states that you will not get a refund unless they can be sure it is you. They want a photocopy of any goverment issued ID that matches the attached information. They say this is required by their bank to prevent fraud. (what a joke).
This outfit will start up again when you you stop this one. If the B*****ds were in JAIL. maybe not. They are going to hurt a lot of families worldwide. With Christmas on the way and a recession to deal with I think the Canadian and USA government should step in and deal with these animals.

Just thought I would let all the people that Willms and his team have scammed and that includes jennifer, also Jesse I am not against people who are GAY. I have a gay nephew and he is great.
I bought the domain name www.the jessewillmsstory.com I have it for sale at $30, 000.
I am sure after Jesse goes to Jail of someone pays him back that some young film maker from Hollywood will want to feature the biggest internet thief of all time. Jesse Willms.
I still want my $159 back. I will continue with this till I get it.

(a) SwipeAuctions Marketplace

SwipeAuctions operates an online marketplace (the 'Marketplace') that enables registered users to view, bid on, and purchase products (' Products'). Each product auctioned through the Marketplace is auctioned for an indefinite period of time based on the total number of Bids (as defined in Section 7(b)) received by that Product.

(b) Bids

Before You can bid on a Product, You must purchase a membership for $159.00 USD which comes with 300 bids (' Additional'). Bids may be purchased in packs of 135, 300, 1325 and 3000 (' Bid Packs') for the then current price listed on the Website. Payment can be made by Visa only. BID PACKS ARE NON-REFUNDABLE. Once a bid is used, it is deducted from Your account and cannot be used again. SwipeAuctions reserves the right, in SwipeAuctions - sole discretion, to change the Bid Packs fees and charges in effect, or to add new fees and charges, by posting such changes on the website or providing notice to You. In addition, you do not hold SwipeAuctions - responsible for any overdraft charges or fees which you might incur during the ongoing Membership.

(c) Auction Structure

Each time a registered user places a Bid on a Product, extra time (typically a few seconds) is added to that Product's auction period (' Auction Period'), and the bidding price of the Product is increased by $0.01. An auction ends when the Auction Period reaches zero. The auction winner (the ' Winner') is the last user to place a Bid, as determined solely by SwipeAuctions - records. UPON END OF AN AUCTION, ALL BIDS USED ON THAT AUCTION, WHETHER BY THE WINNER OR NON-WINNER(S), WILL EXPIRE AND WILL NOT BE CREDITED OR REFUNDED TO THE RESPECTIVE BIDDERS. 17. INDEMNITY BY YOU

You agree to defend, indemnify and hold harmless SwipeAuctions and its officers, directors, employees, agents, affiliates, representatives, sublicensees, successors, and assigns (collectively, the ' Indemnified Parties') from and against any and all claims, actions, demands, causes of action and other proceedings (collectively, ' Claims'), including but not limited to legal costs and fees, arising out of or relating to: (i) Your breach of this Agreement, including without limitation any representation or warranty contained in this Agreement; (ii) Your access to or use of the Website or Services; or (iii) Your provision to SwipeAuctions or any of the Indemnified Parties of information or other data.

The Indemnified Parties will have the right, but not the obligation, to participate through counsel of their choice in any defense by You of any Claim as to which You are required to defend, indemnify or hold harmless the Indemnified Parties. You may not settle any Claim without the prior written consent of the concerned Indemnified Parties.

18. DISPUTES GOVERNING LAW

This Terms of Use Agreement shall be treated as though it were executed and performed in Alberta, Canada and shall be governed by and construed in accordance with the laws of Alberta, Canada (without regard to conflict of law principles).

AS USED IN THIS AGREEMENT, AN ' ARBITRAL CLAIM' IS ANY CLAIM OR DISPUTE YOU HAVE AGAINST OR WITH SWIPEAUCTIONS OR THE SWIPEAUCTIONS INDEMNIFIED PARTIES, OR ANY CLAIM SWIPEAUCTIONS HAS AGAINST OR WITH YOU, ARISING OUT OF OR RELATING TO THIS AGREEMENT, THE SITES, THE SERVICES OR ANY ADVERTISING RELATING TO THE SITES OR SERVICES, INCLUDING THE ENFORCEABILITY OF THIS AGREEMENT TO ARBITRATE BUT SPECIFICALLY EXCLUDING: (1) CLAIMS BY SWIPEAUCTIONS TO COLLECT FROM YOU UNPAID FEES AND LATE FEES; AND (2) ACTIONS FOR REMEDIES IN AID OF ARBITRATION OR EQUITABLE RELIEF RELATING TO INTELLECTUAL PROPERTY RIGHTS, AS FURTHER DISCUSSED BELOW IN THE 'REMEDIES IN AID OF ARBITRATION; EQUITABLE RELIEF' SUBSECTION. EXCEPT AS OTHERWISE EXPLICITLY NOTED HEREIN, SUCH ARBITRATION SHALL BE CONDUCTED UNDER THE ADR SIMPLIFIED ARBITRATION RULES THEN IN EFFECT (' SIMPLIFIED RULES').

(b) WAIVER OF RIGHT TO A JURY TRIAL

BY REGISTERING FOR OR USING THE WEBSITE OR SERVICES, YOU ALSO ARE AGREEING WITH SWIPEAUCTIONS THAT YOU AND SWIPEAUCTIONS HEREBY WAIVE THEIR RIGHT TO A JURY TRIAL FOR ANY ARBITRAL CLAIM. IF FOR ANY REASON THIS AGREEMENT TO ARBITRATE IS HELD NOT TO APPLY TO AN ARBITRAL CLAIM, WHETHER SUCH ARBITRAL CLAIM IS AGAINST YOU, SWIPEAUCTIONS OR THE SWIPEAUCTIONS INDEMNIFIED PARTIES, BOTH YOU AND SWIPEAUCTIONS STILL AGREE TO WAIVE TRIAL BY JURY.

(c) JOINDER OF CLAIMS

BY USING REGISTERING FOR OR USING THE WEBSITE OR SERVICE, YOU ARE FURTHER AGREEING WITH SWIPEAUCTIONS THAT NEITHER YOU NOR SWIPEAUCTIONS WILL JOIN ANY ARBITRAL CLAIM WITH THE CLAIM OF ANY OTHER PERSON OR ENTITY IN A LAWSUIT, ARBITRATION OR OTHER PROCEEDING; THAT NO ARBITRAL CLAIM WILL BE RESOLVED ON A CLASS-WIDE BASIS; AND THAT NEITHER YOU NOR SWIPEAUCTIONS WILL ASSERT AN ARBITRAL CLAIM IN A REPRESENTATIVE CAPACITY ON BEHALF OF ANYONE ELSE.

(d) NO EFFECT ON SUBSTANTIVE RIGHTS

THIS AGREEMENT TO ARBITRATE DOES NOT CHANGE YOUR OR SWIPEAUCTIONS' SUBSTANTIVE RIGHTS, JUST THE POTENTIAL FORUMS FOR RESOLVING DISPUTES. IN ADDITION, YOU CAN STILL BRING ANY ISSUES YOU MAY HAVE CONCERNING THIS AGREEMENT, THE SITES OR THE SERVICES TO THE ATTENTION OF FEDERAL, STATE, OR LOCAL GOVERNMENT AGENCIES, AND THEY CAN STILL, IF THE LAW ALLOWS, SEEK RELIEF AGAINST SWIPEAUCTIONS AND THE SWIPEAUCTIONS INDEMNIFIED PARTIES OR ON YOUR BEHALF.

(e) FINALITY, APPLICATION OF ARBITRATION AWARD

ANY ARBITRATION AWARD MADE AFTER COMPLETION OF AN ARBITRATION IS FINAL. AN AWARD AND ANY JUDGMENT CONFIRMING IT ONLY APPLIES TO THE ARBITRATION IN WHICH IT WAS AWARDED AND CANNOT BE USED IN ANY OTHER CASE EXCEPT TO ENFORCE THE AWARD ITSELF.

(f) INTERPRETATION

In rendering an award, the arbitrator shall apply the substantive and procedural law of Alberta, Canada, without regard to its choice of laws principles. The arbitrator shall not have any power to alter, amend, modify or change any of the terms of this Agreement, nor to grant any remedy that is either prohibited by the terms of this Agreement or not available in a court of law.

(g) HEARINGS; FEES & COSTS

Either party may demand that any required arbitration hearing or hearings be conducted other than in person, even if the Simplified Rules would otherwise have provided for an in-person hearing. Any required hearing fees and costs shall be paid by the parties as required by the Simplified Rules, although the arbitrator may, in the award, allocate all or any part of the costs of the arbitration, including the fees of the arbitrator and the reasonable attorneys' fees of the prevailing party. If any party files a judicial or administrative action asserting a claim that is subject to arbitration and the other party successfully stays such action or compels arbitration, the party filing that action must pay the other party's costs and expenses incurred in seeking such stay or compelling arbitration, including attorney's fees.

(h) REMEDIES IN AID OF ARBITRATION; EQUITABLE RELIEF

This agreement to arbitrate will not preclude either You or SwipeAuctions from seeking provisional remedies in aid of arbitration, including without limitation orders to stay a court action, compel arbitration or confirm an arbitral award, from a court of competent jurisdiction. Furthermore, this agreement to arbitrate will not preclude either You or SwipeAuctions from applying to a court of competent jurisdiction for a temporary restraining order, preliminary injunction, or other interim or conservatory relief, as necessary, to preserve the intellectual property rights of You, SwipeAuctions or third parties. THE PROPER VENUE FOR ANY ACTION PERMITTED UNDER THIS SUBSECTION REGARDING 'EQUITABLE RELIEF' WILL BE THE COURTS LOCATED IN EDMONTON, ALBERTA, CANADA; THE PARTIES HEREBY WAIVE ANY OBJECTION TO THE VENUE AND PERSONAL JURISDICTION OF SUCH COURTS.

19. TERMINATION

WITHOUT LIMITING ANY OTHER PROVISION OF THIS AGREEMENT, SWIPEAUCTIONS RESERVES THE RIGHT TO, IN SWIPEAUCTIONS' SOLE DISCRETION AND WITHOUT NOTICE OR LIABILITY, DENY USE OF THE WEBSITE AND/OR SERVICES TO ANY PERSON FOR ANY REASON OR FOR NO REASON AT ALL, INCLUDING WITHOUT LIMITATION FOR ANY BREACH OR SUSPECTED BREACH OF ANY REPRESENTATION, WARRANTY OR COVENANT CONTAINED IN THIS AGREEMENT, OR OF ANY APPLICABLE LAW OR REGULATION. This Agreement shall automatically terminate in the event that You breach any of this Agreement's representations, warranties or covenants. Such termination shall be automatic, and shall not require any action by SwipeAuctions. You may terminate this Agreement and Your rights hereunder at any time, for any or no reason at all, by providing to SwipeAuctions notice of Your intention to do so, in the manner required by this Agreement.

(a) Effect of Termination; Survival

Any termination of this Agreement automatically terminates all rights and licenses granted to You under this Agreement, including all rights to use the Website and Services. Upon termination, SwipeAuctions may, but has no obligation to, in SwipeAuctions' sole discretion, delete from SwipeAuctions' systems all User Content, Your Personal Information and any other files or information that You made available to SwipeAuctions or that otherwise relate to Your use of the Website or Services. Subsequent to termination, SwipeAuctions reserves the right to exercise whatever means it deems necessary to prevent Your unauthorized use of the Website and Services, including without limitation technological barriers such as IP mapping and direct contact with Your Internet Service Provider. Upon termination, all rights and obligations created by this Agreement will terminate, except that Sections 1-4, 6, 8-12, 14-21 will survive any termination of this Agreement.

(b) Legal Action

If SwipeAuctions, in SwipeAuctions' discretion, takes legal action against You in connection with any actual or suspected breach of this Agreement, SwipeAuctions will be entitled to recover from You as part of such legal action, and You agree to pay, SwipeAuctions' reasonable costs and attorneys' fees incurred as a result of such legal action. The SwipeAuctions Parties will have no legal obligation or other liability to You or to any third party arising out of or relating to any termination of this Agreement.

20. NOTICES

All notices required or permitted to be given under this Agreement must be in writing. SwipeAuctions shall give any notice by email sent to the most recent email address, if any, provided by the intended recipient to SwipeAuctions. You agree that any notice received from SwipeAuctions electronically satisfies any legal requirement that such notice be in writing. YOU BEAR THE SOLE RESPONSIBILITY OF ENSURING THAT YOUR EMAIL ADDRESS ON FILE WITH SWIPEAUCTIONS IS ACCURATE AND CURRENT, AND NOTICE TO YOU SHALL BE DEEMED EFFECTIVE UPON THE SENDING BY SWIPEAUCTIONS OF AN EMAIL TO THAT ADDRESS. You shall give any notice to SwipeAuctions by means of email or by contacting Live Chat.

21. FORCE MAJEURE

You acknowledge and understand that if SwipeAuctions is unable to provide the Services as a result of a force majeure event SwipeAuctions will not be in breach of any of its obligations towards You under this Agreement. A force majeure event means any event beyond the control of SwipeAuctions. In the event SwipeAuctions is affected by a force majeure event, it shall promptly notify You of the estimated extent and duration of its inability to perform or delay in performing its obligations, on a reasonable efforts basis. SWIPEAUCTIONS SHALL NOT HAVE ANY LIABILITY TO YOU WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER FORM OF LIABILITY FOR FAILING TO PERFORM ITS OBLIGATIONS UNDER THIS AGREEMENT TO THE EXTENT THAT SUCH FAILURE IS AS A RESULT OF A FORCE MAJEURE EVENT.

22. GENERAL

This Agreement constitutes the entire agreement between SwipeAuctions and You concerning Your use of the Website and Services. This Agreement may only be modified by a written amendment signed by an authorized executive of SwipeAuctions or by the unilateral amendment of this Agreement by SwipeAuctions and by the posting by SwipeAuctions of such amended version. If any part of this Agreement is held invalid or unenforceable, that part will be construed to reflect the parties'' original intent, and the remaining portions will remain in full force and effect. A waiver by either party of any term or condition of this Agreement or any breach thereof, in any one instance, will not waive such term or condition or any subsequent breach thereof. This Agreement and all of Your rights and obligations hereunder will not be assignable or transferable by You without the prior written consent of SwipeAuctions. This Agreement will be binding upon and will inure to the benefit of the parties, their successors and permitted assigns. You and SwipeAuctions are independent contractors, and no agency, partnership, joint venture or employee-employer relationship is intended or created by this Agreement. Except for the SwipeAuctions Parties and the Indemnified Parties as and to the extent set forth in Sections 11, 16, and 20(b), and SwipeAuctions' licensors and suppliers as and to the extent expressly set forth in Section 14, there are no third-party beneficiaries to this Agreement. You acknowledge and agree that any actual or threatened breach of this Agreement or infringement of proprietary or other third party rights by You would cause irreparable injury to SwipeAuctions and SwipeAuctions' licensors and suppliers, and would therefore entitle SwipeAuctions or SwipeAuctions' licensors or suppliers, as the case may be, to injunctive relief. The headings in this Agreement are for the purpose of convenience only and shall not limit, enlarge, or affect any of the covenants, terms, conditions or provisions of this Agreement.

Well now, for a start I want my money back. Make it clear on the form that you fill that you will recieve 300 bidding credits after having $159 deducted from your account. by just taking it, many young mums and dads may not have that or it is in the account to pay for a home bill. By you taking it thay are out several ways. Overdraught at the bank etc. If your producys and deals are so good and better than ebay you do not have to cheat. Looking at the list of companies that you have that have been under investigation does not give us confidence. When I get scammed out of my families money, I have to answer to them. To them them I am an idiot for giving you my banking details. I went down to my bank and put $159 in ten mins. They also advised me to cut up my card as you have indicated that you will be able to withdraw funds. Your refund form is wrong. It says if you fail to give exact details you will not get a refund. It asks for your order no on the email you sent. You DO NOT put an order no on it. Now you must know what your up to and pretty soon you'll be starting another co to replace this one. You claim 1 million reg on this site. At $159 each...wow! that's before you have any buyers. come on!.
I will send you the refund form. Is it a real address in Aurora?. I will not have the same bank no as my card was cut. I am not going to give you my private Government Issued details as they are my Green Card, Social Security Number and Passport.

hello my name is Fred Graden went to swipe auctions looked around and said hmmm maybe i'll join the next thing i know is there is 159.00 taken from me on the spot so i called the # mind you this is 3 months ago so i said let me call then, , okay so i do and i get a girl that says they are no longer taking new customers and any customers with a problem well might as well go suck on an egg ! so FOR ALL WHO ARE WAITING FOR REFUNDS FROM THIS STICKUP COMP: YES I HAVE BEEN ROBBED BY THEM AND I HOPE THEY ALL BURN IN HELL! SwipeAuctions.com collecting money without proper authorization

Wish I had been smart enough to do a check on Scambids before i signed up (as i usually do) but I also got sucked into their web.
Saw an ad on Facebook for great prices on electronics .
Like others i thought i was registering to bid ( I use ebay all the time and even love it more now !)
I did not realize until too late that I was charge a registration fee.
On their site they show a sample of the registration process, well what is a flag there was not flagged on my registering. They need a 2nd screen for confirmation just like all other trusted sites. I alway check for the trusted site lock symbol before inputing credit details, Swipeauctions is backed by Truste's privacy seal.

As this was recommended by facebook and having the truste's seal I thought i was safe, noooo

I took my chances and thought for my stupidity maybe just maybe I might luck out and win an auction and get my money back in savings. no such luck

But what really got me...
As I was bidding at the same time i was bidding a popup screen comes up which I thought was my bidding process and clicked... oops OMG I just purchased $500 worth of bids (once again no confirmation of your purchase) Ok my stupidity for falling for this once, but twice no way.
Immediately I got onto live chat support and told them this was a tragic error and so wrong how it is processed. They need a confirmation screen on all charges being processed.
They're respond sorry u made purchase we cannot refund...

I told my chat girl i would be reporting this to Visa, the bbb and anywhere else I could. Their tone then changed and they did agree to credit me back my purchase.
The bids are gone from my account but it would be 7 days before my card is credited back
(later told 2 days) mmmmm suspicious now

I will keep an hourly watch on my charges to visa to ensure no more charges and that the refund is processed
After this I wanted my account cancelled and to be deleted off their records. You cannot easily cancel your subscription you have to contact them (another warning flag)

Iwill give them the thumbs up on my chat support and issues being resolved (just hope I do actually see the credit processed)

Only time will tell if they do come thru and are true to their satisfaction guarntee. I will keep you posted on my refund and if any further complaints against this company

I have proceeded on complaints with
#1 Visa (they called me on a fraud alert within the hour of $500 being charged while I was investigating further into getting a refund out of swipeautions)
#2. Truste's website for standing behind such a business
#3. Facebook - for allowing such a company to ads thru their site
I am processing complaints with
#1 BBB
#2 CRA
#3 Service Alta
and considering Internet Crime Complaint with the FBI also

I have found that Visa can fine a company for practice such as this, and after 2% of total sales being chargebacked they can pull the merchants account.

Anyone who falls victim to Swipe or any of their affiliates MUST report to Visa we need this website shutdown

2nd update.

Today finally I see the $495 credit back to my credit card.
(I did loose $25+ on the exchange but that is my cost for being under cautious i guess)

Thank you Jennifer for your assistance as noted before having a 2nd confirmation page before actual charge is processed would not only assist the many people who have issued complaints on this process but also assist your company with the monitoring of these complaints and the paperwork in processing credits. Appreciate your follow thru and hope to see these changes made.

When I see the $159 also processed to my c/c I will provide the update again.

Update: I have been contacted by Jennifer @ Swipe Auctions and she now has also issued the refund of the 1st original purchase of $159 to my account.

Neither the $495 or $159 are as of yet showing on my credit card but I will post a further update once I do see these credits processed to my credit card.

Jennifer did note in the email she sent to me that my suggestion of having a 2nd confirmation page will be passed onto the management team.

Here's hoping they do step up and correct their unfortunate ways !

Hi Kelly I too saw the same promo video looking like it was legit.

Truste's contacted me today and asked me to keep them informed on the refund process. I advise you to also contact them (email contact avail on their website Truste's security) If we can manage to get their security seal pulled we will then be able to help some others to not fall victim to these people and their illegal practice.

When I filled out the refund form I do not see any notice asking for my driver licence copy to be sent it. Good call on your part not sending this in I definetly would not of either had i noticed it.

For 5-1/2 mos. I have been waiting for these SCAM-CON ARTISTS to refund my 159.00 that they deducted from my bank acct. w/o my knowledge?! I am by far not done with with this issue - they will refund my $$ whether its through an attorney/lawsuit or whatever?! I followed every written letter, fax, and everything they told me to - I knew I should have just called the Better Busness Bureau right off the bat!

they took my money and wont give it back they have all these letters and copy of ID's you have to send them then they tell you have to wait three week's . and after that they play this e-mail game these guy's are crook's, con men, what ever you want to call them . they should be hunted down and put under jail!

I am just a 16 year old boy and I accidentally signed up with swipeauctions.com and got $160 removed from my account. I requested a refund but still haven't gotten any response.With me not being an adult, is there any advantage i have if I was to to pursue legal action against them?

I did not authorize swipe auctions to bill my credit card. I have since spoken to them and they said they would remove this charge from my credit card. They have not done so and now say they cannot issue a refund.

I went into the site, this is very dangerous before you know it you are being charged $159 without realizing what is happening. They took over 1 month to refund, and then continue to charge auto charges? they refuse to refund even though account is cancelled, this is illegal, please so something about them!

This Penny Auction Watch site is Major scam(pennyauctionwatch.com). Also known as "PAW".

PAW is a front for these dishonest penny auction owners to make their sites look legit. Penny Auction Owners plant positive experiences on here(Complaints Board) and on the Penny Auction Watch forums(PAW) to bait people into playing and buying bid packs. Buying bid packs to bid on items? What a joke and scam!

Go to Flippa[dot]com and search "penny auctions for sale"

There you can see how these operates by the use of controlled bots on autobid to scam any real people into buying more and more bid packs until the reserve price has at least been met for that item that's bid on. They aren't in the business to LOSE money and will never ACTUALLY sell an item below value. If not enough real people are bidding on a particular item for a while, they will end the auction to a bot name. They will then list the bots name in the "Auction History" section to make it look as if REAL people actually win and auction is honest+fair.

You can buy your own Penny Auction from Flippa.com and start scamming also. So easy to do.

Also. Google, "penny auction website script" and see how these scams operate. The scripts are cheap to buy.
To build up traffic to your scam penny auction you must plant positive experiences on forums such as PAW(PAW is a front). You must also dispute ANY negativity or complaints on forums such as this.
For EX, tell the angry complainer that he must be crazy, use stupid bidding techniques and unlucky because you win all the time and just won a 52inch Plasma for 2 bucks. People WILL start believing you if you plant enough fake postitive experiences/reviews. JUST make sure to use different names each time you fake post. If you use same name over and over again telling everyone you win all the time, people will begin to catch on and realize it's just a fake post planted by the Penny Site operator/owner.

They cheat you and make a killing from people like you that bought into it. Some will even go as far as to advertise on social networking sites such as "FACEBOOK" and write stories of winning items for $4 and so on to get people to join the site.
I call it their, "Fake Social Environment" where they ask and answer their own questions attempting to be perceived as an honest and fair auction. For EX they will say, "I just won 12 Lap Tops for $40 and they all arrived today in factory sealed boxes! I love this site!"

Anyone can do this... so easy to make money. MAKE sure that the server that hosts your scam auction is located outside of the USA so you can get around federal gambling regulated laws. If heat gets to much, then shut scam auction down and create a new one. Repeat process.

You use to could post on PAW right away but now they have a Moderator that must approve your post first.. I wonder why that is? ;)

I got scammed as well. My credit card company call me from their fraud prevention unit almost immediately after I clicked the button. I asked if there was something about this site I needed to be aware of and was told it was a routine call. I wrote it off as a strange coincidence but later returned the call ( caller ID what a miracle that is ) I got the persons name and a case # just to be sure it was genuine and it was. I did all the typical protocol they requested and called my credit card company as well. My credit card company (Chase) was very helpful and said I had 90 days to dispute the charge and gave me an address to send ALL the imformation I could gather and they would handle it from there. I sent it out on Nov. 12 I'll let you know how it turns out. As a side note I was somewhat amused and confused when I registered for this forum and a link appeared on the side for a "Penny Auction". Incidentally age unfortunately has little bearing on this issue try that one on the porn sites! 16 and a credit card? Nice job, pay your bills on time and you'll grow up to be somebody. Talk to my kids when you get there. Moral of the story- Don't trust links and if it seems to good to be true it probably isn't.

Use caution or avoid Swipe Auctions or Swipe Bid. Not realizing there was a "charge" for "looking and considering" my journey begins to recover my $159.00 that was "Swiped".

I initially posted a complaint about Swipe Auctions, regarding a $159.00 credit card charge. When you put your information into the account regarding how you will pay for your purchases, you need to READ THE TEENY TINY SMALL PRINT that accompanies the "agreement" before clicking 'I agree'. I did indeed get my $159.00 back, however, I called my credit card company the very day I registered to inform them of fraudulent activity on my account. I also emailed Jennifer, as noted on the Swipe customer service instructions. Jennifer stated she had credited back the $159.00 and deactivated my account on the very next business day. I called my credit card company to verify the credit and they informed me that yes, it had been removed. Know before you click...read all the small teeny tiny print, then call your credit card company prior to making any demands of the purported business you're dealing with. It saved me a massive coronary. Good luck to all and stay off sites such as Swipe. You get what you play for...remember that. Nothing's free, or next-to-nothing.

Don't know what you consider "clearly" states. The website does have some small print which is also only a few shades lighter than the blue background on the charge of $159. However, most consumers/bidders are experienced in the "ebay" process. Which as everyone knows records your credit card information and holds it until you make a purchase. Even then it prompts you if you want to use what is on file vs. some other means of payment. I argue that the SwipeAuction knowingly mislead consumers into signing up. Even using marketing schemes saying they were better than ebay. Yet another luring ploy to get consumers to sign up to their website.

11/03/10 FYI - SWIPEAUCTIONS website and business has been shutdown and No One will recieve a REFUND for anything. Call for yourself [protected])

If anyone knows of a class action lawsuit against SWIPEAUCTIONS please post. I will gladly sign up.

I don't recall ever seeing that screen when I was registering for the "Privelege" of viewing auctions. I too am now trying to get a refund. I have also registered a complaint with the Better Business Bureau and the FTC. My next step is to contact my bank and report this as fraud.

This happened to me too. Swipeauctions charges $159 to my card without properly notifying me. They also added a monthly charge for some other feature, again nothing that I knowingly consented to.

The site is very cluttered and designed to distract you from whatever micro-print notifications they may have there. The business practices of this company is sicking.

SwipeAuctions.com Unethical Marketing

I am not here to slam a respectable charity. I am here to slam World Vision, Feed the Children for their association with SwipeAuctions. Why would any honorable charity want to be linked to such a scamming website as this? I found some of the answers today and would like to share here:

SwipeAuctions and World Vision, an unholy alliance?

I hate scamming of any type. I hate scamming online merchants and especially hate scamming charities that are sworn to help the needy but instead use many of the funds raised to supplement their manager’s lavish lifestyle and greed. After some research today it would appear that the unholy alliance between Jesse Willms’s Swipe Auctions Penny Gambling Website and World Vision would not be so far fetched as I first thought.

Is it possible that World Vision has a very checkered past and present, with allegations of frauds and scamming? Does it seem to be a partnership of like minds melding into a natural combining of unscrupulous talent? You decide whether this type of fundraising is what you would expect from any charitable foundation. Just take a look at information found today following a Google search of “World Vision children's charity scam”

It is my opinion formed from reading these two job offers from World Vision’s Chief Financial Officers, that they are in serious need of a marketing strategy that would at least appear to be less scamming and criminal. Maybe Jesse Willms could exchange some of his expertise in marketing for a better public image as being a very charitable, ethical, and honorable man, if this transaction has not taken place yet.

I was interested in finding that the charitable organizations have watchdogs too, not much dissimilar to the penny auctions watchdogs that oversee these auction sites. I wonder why our credit card company Visa hasn’t issued a similar ALERT to Jesse Willms scams?

Ministry Fires Two of its Own Accountants After They Report Potential Fraud or Illegalities to the Ministry’s Board.

Feed the Children, long accustomed to controversy yet still the largest ministry in the MinistryWatch.com database with nearly $1.2 billion in revenues, is being sued by its former Controller and another staff accountant for wrongful termination. According to the Oklahoman’s website, the two accountants claim that they were wrongly fired after going over their boss’s head to report what they believed to be the Chief Financial Officer’s intentional refusal to pay $1.1 million in taxes owed to the state of Oklahoma. Thus far the ministry and its Chief Financial Officer have not responded to these allegations. This is the sixth lawsuit the ministry has faced this year, including a lawsuit from five former board members who were relieved of their duties and then fought for and regained control of the ministry. As part of a settlement concerning the leadership of the organization, their news release states, “Under the terms of the settlement, Larry and Frances Jones will relinquish operational controls, giving them more time to continue with the organization in the capacity as spokespersons with responsibilities for generating support for the organization. The board of directors will continue to be in controlof the organization.” Feed the Children has a history of controversy and accounting concerns, including the revelation that a former CFO once falsified the ministry’s audited financial statements over the course of two years. Also in the last year, an employee of its South African subsidiary has been accused of embezzling $100, 000 and it was also suggested in internal memos that Larry Jones own son has had work performed on his home with ministry funds and had a ministry credit card even though he was not a ministry employee. There are many other allegations as well, but there is no need to go into all of them as what has already been noted is sufficient to justify a Donor Alert on this ministry. It is clear that this is a ministry that is still struggling with acting in an upright manner, even after its recent court-mandated governance overhaul. Donors who have contributed over $1 billion to Feed the Children should prayerfully consider redirecting their donations to other similar Christian ministries that have a history of operating with integrity, efficiency and transparency.

I think we all know World Vision, it’s one of big charity organisations around the world. They promote sponsoring child in third world countries, supporting in health and education. In Australia alone, I very often see World Vision stalls in many Malls and their ads on the TV. Many of my friends are also participating in sponsoring a child through World Vision. But what I just saw today on ABC Foreign Correspondent just shocked me, speechless, if it was true.

The Penny Auction Watch site is Major scam(pennyauctionwatch.com). Also known as "PAW".

PAW is a front for these dishonest penny auction owners to make their sites look legit. Penny Auction Owners plant positive experiences on here(Complaints Board) and on the Penny Auction Watch forums(PAW) to bait people into playing and buying bid packs. Buying bid packs to bid on items? What a joke and scam!

Go to Flippa[dot]com and search "penny auctions for sale"

There you can see how these operates by the use of controlled bots on autobid to scam any real people into buying more and more bid packs until the reserve price has at least been met for that item that's bid on. They aren't in the business to LOSE money and will never ACTUALLY sell an item below value. If not enough real people are bidding on a particular item for a while, they will end the auction to a bot name. They will then list the bots name in the "Auction History" section to make it look as if REAL people actually win and auction is honest+fair.

You can buy your own Penny Auction from Flippa.com and start scamming also. So easy to do.

Also. Google, "penny auction website script" and see how these scams operate. The scripts are cheap to buy.
To build up traffic to your scam penny auction you must plant positive experiences on forums such as PAW(PAW is a front). You must also dispute ANY negativity or complaints on forums such as this.
For EX, tell the angry complainer that he must be crazy, use stupid bidding techniques and unlucky because you win all the time and just won a 52inch Plasma for 2 bucks. People WILL start believing you if you plant enough fake postitive experiences/reviews. JUST make sure to use different names each time you fake post. If you use same name over and over again telling everyone you win all the time, people will begin to catch on and realize it's just a fake post planted by the Penny Site operator/owner.

Anyone can do this... so easy to make money. MAKE sure that the server that hosts your scam auction is located outside of the USA so you can get around federal gambling regulated laws. If heat gets to much, then shut scam auction down and create a new one. Repeat process.

I do agree that World Vision has no moral right to sell their good name in this manner. Maybe Jesse Willms has seen this charity's bottom line (Over 1.2 Billion in deposits) and wants a piece of the action. World Vision has been hit with allegations of inappropriate financial conduct by their CFOs and perhaps one is a golf partner of Jesse Willms.

SwipeAuctions.com Unauthorized Charge

On Sept 12th 2010 I was looking for a site to sell some home items and came across AW-Swipe Auctions. I wanted to see if there were any allturitive sites to E-Bay. I landed on AW-Swipe Auctions at URL: http://www.swipeauctions.com/landing.php?catid=11. To get into the site you have to register and they give a form, like most sites to fill out. I saw a couple of items and wanted to see what the average price people were getting for it. When I clicked on the item, my Internet Explorer 8 froze up. It was late so I just did some PC House Cleaning and shut it down. On 15 Sept 2010 I got an alert from my bank about a charge for $159.00 from AW-Swipe Auctions. I have no idea what it was for. I didn't purchase or bid on anything. When I went back to the AW site to try to find a Customer Service number or mailing address and there is nothing listed. The only thing that I thought might help was to click on a link in the top right corner of the web page in small print "Already Registered? Login Here" and it brought me to the Register Form AGAIN. It said my username was already in use and the password I had created was not valid! This is a total Scam and I, with my Banks Help plan to file charges. I have a copy of the HTML code from AW-Auction's Site. If there is anyone with Web Master Training maybe you could help.

I had the same expeience with swipe auctions. They charged my card, I called and cancelled with them a few minutes later. Then I called my credit card co. and cancelled that card. Well 2 months later there is the charge for $159! I am going to dispute this with my credit card comany and "swipe your money auctions"! This is total fraud.

I am the newest victim in this scam. I have pursued the matter with my bank, and I just received work today that "the merchant was able to verify the cardholder, so the charge is valid". WHAT THE HECK? I told myself. So now it looks like I have to send in the 4 page form with my personal information as well as a copy of my ID to "verify that this isn't a fraud". Hello swipe auctions, your asking me if I committed fraud? Did you look in the mirror?

SNIPEAUCTIONS IS A HUGE SCAM STAY AWAY FROM THESE CROOKS!
I had signed up for an $11.95 cent full money back garauntee for 30 days. All of a sudden it says my account was charged $159.00. I asked for an Immediate Refund and
All I got was some chat idiot who sent me a 4 page document that she wanted me to fill out and send back for a refund.
THIS is a SCAM.
STAY AWAY from these ###!
I am PLANNING to get the FEDS to SHUT THESE JERKS DOWN and have my LAWYER sue them for FRAUD!

SwipeAuctions.com SCAM charged $159 not authorized

SCAM do not enter your CREDIT info. Thought I was ONLY going to be charged cents per bid. They charge my card $159 WITHOUT my approval. They then make you jump through hoops and direct you to a form to get a refund. I cancelled my CC account--this is a SCAM!

I am so pissed
I have worked for over a month to get my $159 back and they have just stung me along and now they are shutting down the merchant account from which my refund was being processed so I'm just screwed. I called customer service only to be hung up on. These guys are shysters and I'm an idiot for falling into it.

I got scammed for $159 and got nowhere with their chat room customer service. I was told they were winding down and no refunds would be processed. I contacted my credit card company, told them the whole story and offered to send copies of the paperwork I have. In 48 hours I had confirmation of my refund credit. I then went to the chatroom to have a little talk with whoever came on the line. Here is how it went...

I finally got my refund after writing to Jennifer. It took 32 days to receive the refund. When I email Jennifer it took another 4 days to receive the refund so it was a total of 32 days. I dont agree with the way they do business but Jennifer helped me get my refund a little faster. They told me it would take another 10 to clear my bank so it would of taken a total of 38 days. I will not do business with this company.

I feel that SwipeActions.com tricks and cheats and scams -- those are the accurate descriptions of what this "business" does, in my view, because the (very large) tagline on their webapge says "Please Register to Bid on Auctions". It does not say "Please Register to Buy the right to bid on auctions." Although no decent business would force a "Registration" into a "Purchase", the "Live Chatline" at SwipeAuctions.com insists that there is no difference between registration and purchase, when I "chatted" with them to ask for a cancellation and a refund. There is no voice telephone number that I can call for SwipeAuctions.com. ...I will tell all my friends about what this website really is. I hope you will do the same for your friends.

Wow look at the Swipe Auctions scammers boasting about sponsoring children through Worldvision - using the name of a respected charity to try and make themselves look good!

Go to swipeauctions.com and see how they boast about having 1 million members then boast about sponsoring 120 children - well it costs about a dollar a day to sponsor a worldvision child so that's 120 dollars a day they are donating to charity (which they will no doubt write off against tax anyway) compared to the 159 million dollars they will have earned from 1 million members membership "fees"!

159 million dollars versus 120 dollars - how freakin generous! (NOT)

What a lowlife Jesse Willms is to need to boast about his "generosity" at donating 120 bucks a day (less than the cost of one swipe auctions "membership") when he has scammed millions of dollars from people! He is even pumping out press releases to boast about his "generosity" at donating .[protected] percent of the money he stole from people to charity and keeping the rest!

Jennifer or whatever your real name is you should be ashamed of working for these scammers.

SwipeAuctions.com scam

This site needs shut down and now. They get $159.00 from you and there was 12 auctions running, 4 of which were points to their auction site. 2 of the auctions were walmart discount cards. OMG I dont shop walmart. I contacted SwipeAuctions.com for a refund--2 minutes after I entered. They sent me a link to fill out forms and it will take 15 days after they receive the snail mail form.
I am going to contact BBB
PLEASE DON'T WASTE YOUR $$$$

I fell for the scam as well...I thought they wanted my info for future purchases...why would you pay up front for something ou havent even seen yet or tried..on the page I filled out it didnt say I would be charged 159.00 but on their sample page it said it and I saw it after the fact..I called immediately and requested a refund and the hoops they make you go through to get this refund...chat persons name, which I found I needed that after I had left the chat...order number..which never came by email..so I had to go back and ask for that ...and then I had given them my business address but they wanted a gov.id with my info on it and it has my home address so I had to contact them again to get that changed otherwise no refund.. and I have to remember to contact them 28 days from now or no refund...any excuse to not give a refund...but this only happened today so I dont know if I will get it or not...who can we contact to shut this scam down?

You are lured in by the promise to bid on items such as i-pods, etc. with the chance of succesfully acquiring these items at low cost. You will see advetisements mentioning some well known company's that are supposedly vouching for this site.
You are then asked to provide registration details in order to be able to start bidding on the items and are asked later for your credit card information. At this point, your credit card is directly and immediately charge 159$. There's no prompt to ask you if you're sure or to tell you what's going to be provided for your money. If you were to go forward, you would see auctions with an almost impossible chance of winning, with most of the avaialble purchase items being chances to purchase more bids. In order to get your money back they want you to mail in a signed-off form, but you need to use up your bids first. To get out of this without mailing in my info, I threatened to involve the legal authorities including the FBI. I then had my charge reversed. You may want to dig deeper into the individual's websites that are documented on the internet in order to be aware.

I never have an idea about the way swipeauctions doing business. for every bid you have to use your bid. Imagine how much it cost you for 1, 300 bids...$495.00 that is a scam. As soon as I used the bids that you give when I pushed that payment, I think you give me a bids of maybe 25, then after that, you are asking me to purchase a bids of 1, 200 something for $495.00 dollars...I said to myself Bullsh...t. How expensive is this. So after that bonus bids, I already ask for a refund. $159.00, I need that refund, please... I very strongly agree with them being a rip off company! I am going through the same thing and I didn't understand that they were deducting the $159.00 dollars at time of start up! I took it as I had to bid at least the $159.00 to start . I thought they needed the credit card # just to have so if I did bid on something just like E-Bay and Amizon .com . On 11/24/2010, it will be 1 month that I have been waiting on my refund.
I guess I have lived and learned but will make sure they get what they deserve!

I have also fallen victim to their scam. I followed all their refund request papers and was also told they are not able to issue my refund. Please do not fall victim to this scam as I did. I also want my money back.

Ive followed all there refund request guidelines and now they dont want to abide by there on policy. i dont have 159.00 to just give away im am a single mom who is trying to make ends meet this situation has really put me in a bind and i just want my money back.

I did like so many others... wanted to browse through the products auctionned and gave precious information of my cc and thought they needed it in case I was to purchase a product. As soon as I realized through the screen that I was been billed for registration, I did not even complete the process and tried to cancel by going back. Of course my attempt was unsuccessful. I called them and mailed in the form. Called back (2) and it was the same process as all the others... they said my refund was approuved and it would be credited within the next 5-7 days of course it was not.

I called Allied Wallet and they had my cc purchase, I have asked them to make the proper credit arrangement with the merchant and made a complaint on their customer service.

The worst part is all the lies, the make believe. These people behing this scene will pay for what they are doing to all of us. What it teached me is not to trust the internet. It is really too bad for all the honest people whom are trying to do business and earn a living.

I even sent an email to Jennifer@swipeauctions.com.

I am convinced that all these people behing this scam will have to pay for their wrong doing, one way or another. Watch out cos karma is coming.

have ask for refund with in seconds, they told me i had to fill out forms .i did so this was 10/09/10.i still at this time have not seen no refund yet? i called 11/30/10 they give me this e-mail address (support@swipeauctions.com)send a request of release of funds form, and in 2 days i would get an e-mail back, i have done this twice and i still have not received anything from anyone back. icalled this number today and it said too go to swipeauctions.com and click on the blue tab, but the website is gone

I did look at their site and at first sounded good, too good, and of course, after leading you all over the place, spednding a lot of time, the grand finale, next thing i know they are wanting money to be a part of it, and i just got out of there, closed browser, and did not agree to buy a thing!

I was almost taken in by the extraordinary prices on item such as "brand new laptops", etc. However, after further internet investigation I found that this website has changed names due to problems and that is is a scam. Only after paying $159 fee can you then bid on items (like Macintosh laptops for $109, or very nice cars for $1000. I couldn't find any info about mailing fees, but just felt this was not right. I believe in the freedom of speech, but it's usually the people who don't have the money or elderly people that end up getting scammed by websites like this one. I didn't sign up, but if you are interested in seeing about closing down this web-site, I would gladly participate to prove that it's a scam. I know there are a lot out there and you need to be careful, but there are also a lot of desperate people who will put together $159 to get a new car for $1000 or less. These people need help.

If you are interested in any help from my side of if you find out something different, I'd be interested in hearing about it.

I am very frustrated and feel the need of complaining against this site, as a fervent internet user of sites like BIDZ, EBAY, OZSALE ETC.. I notice and add on my facebook page and decided to give it a try, as some have stated here the process to join is no were as clear as they are trying to say and is very misleading even on the right top was a link that says no thanks and thats the one I did touch i didn't accept the button on the bottom, but still they said welcome to swipeauctions you can now start to bid at that point I didn't realise they have charge me 159 dollars, and I WRONGLY TOUGHT I was just biding to see who was going to win and then pay for it as every other sites do, the biding was 5 fix bids at a time for a macbook computer in a matter of minutes they was a pup up window telling me you have no more credits to bid I was tooooo in the biding i accept the window not realising i was buying to bid, well for my SHOCK my card was charge with 495 more dollars, well straight a way I write to the live chat and they told me that they can refund the joining fee but not the bids packet that I bought I told them I didnt even buy no packet and I wasnt happy with the way they SCAM MY MONEY, how cant it be possible that these people even sleep at night knowing that the THIEF INNOCENT PEOPLE MONEY in such a low dirty way and think is OK. for me to win that mac Im sure i would have to buy more and more credits and in the end it would have been cheaper to go to Mac store and buy it, so much good testimonials on there site YEA YEA YEA, I really think something must be done to CLOSED SITE LIKE THIS FROM THE NET.

I saw the auction, web I did not know I had to pay for a membership. I was anger when they took the money from me! I never bid on any thing I went and filled out the refund from and they said they would refund my money and the from was for the bank and this was the only way I can get refunded...they said 10 to 16 DAYS it has been 30 day and this keeps up I going to report them to the attorney General for fraud! ( I never said it was ok to take $159.00 from my account...) You should do the same if you have not received your refund also!

I was interested in buying a new road bike. Did a Google search and this site popped up. I submitted my debit card information (Without authorizing charges), under the assumption that this would be for a future purchase. Next thing I know, I see a charge for $159 pop up. I immediately called and asked for a refund. I was directed to fill out a multi-page form (which I immediately did). 8 weeks or more have passed, with no sign of a refund. Will keep trying but for now, this complaint is only the beginning!

hello my name is Janice I to feel like l have been scammed bye swipe actions. l spoke to someone on there instant live chat support line. l was assured if l was not happy with the site l would be reimbursed my $159.00 well l was charged in US FUNDS $168.32 -- checked with my visa company...monday sept 20th/10 2:22AM is when l joined this auction, scam. l went on the support line chat again and asked that l would like to cancel and get my refund back. she told me that l had to fill out arefund request And l could get it on there web page.. well l coudn't.. so l tried the chat site the next day again well l got this nasty guy after l told him l was going to report the company consumers affairs he finally, directed me to the refund request form.. l finally got the form filled it out and mailed it off Sept. 24 /1o REFUND CENTRE 3124 S. Parker Road, #A2-K271, AURORA, CO80014 USA...I CALLED TO MAKE SURE THE LETTER HAD BEEN RECIEVED L WAS HUNG UP ON ! PHONED AGAIN AND GOT A NICE LADY THAT SAID MY REFUND WOULD BE CREDITED BACK TO MY VISA ON THE 25TH OF OCT/10... NO REFUND WAS CREDITED...CALLED ON NOV. 1 /10 SPOKE TO A GUY AND WAS TOLD THE SITE WAS CLOSED AS OF OCT. 31ST./10 WHAT A CROCK---- NO REFUNDS WOULD BE REFUNDED... The webpage is misleading and does not have all charges and information in a readable or understandable area. There is no way to get into contact with these people to tell them to remove you from their mailing or any other list. They instantly charge your credit card and again there is no contact number to reach them with. The whole site is one scam after another. All a person wants to do is see what it is about so you can investigate further prior to signing up. I don't have the money they just scammed from me. I don't want their stuff, I am not even sure what they are doing. I have been involved in Ebay and Bidz and they are up and up. How can I get my money returned and get off their stupid list?
This is the deduction from my bank and it was done before it would go to next step of sign in, then won't allow you to go any further.

Initially they will advertise as internet auction website similar to e-bay. To verify membership they will ask for credit card and other personal information. Once provided with the info - they will automatically charge $159.00
Once the victim starts disputing their rip-off practices - they will offer their ‘100% Money Back Guarantee’. In order to get the money refunded the victim has to fill out 4 page long application and mail it to them on paper along with a copy of government issued ID.
After weeks of ‘processing’ the victim supposed to receive the refund but it never happens.
Instead they direct the victim to their automated costumer service where he gets the following message:

“Verlie#SA9298: Swipeauctions is winding down operations due to merchant shutting down our processing and is no longer accepting new customers. In addition, Swipeauctions will not issue refunds for membership fees (see the Swipeauctions' Terms & Conditions). It has always been our intention to refund our valuable customers as per our Money Back Guarantee, but with the merchant account shutting down and not allowing us to refund, we are unable to assist you any further with a refund.”

Since they take not only peoples money but also their personal information based on government issued identification documents, it is very likely that the whole scam is run with criminal intend and associated with illegal or even terrorist activities (possibly counterfeit of US issued id’s for foreigners, etc.).

According to internet sources; SwipeAuctions.com is operated and owned by Canadian software pirate and scoundrel Jesse Willms whom over past years performed several internet scams via his Canadian based Just Think Media company. The company has several thousands BBB complains and is currently investigated for fraud.
