Threatening Collection Call
This firm called me demanding to be paid on a payday loan that I did not take out. In looking up the firm at http://800notes.com/Phone.aspx/1-844-618-6189 you will find there are numerous complaints about the same call I received. They will not send you any documentation but demand in a loud, threatening voice that unless you pay them $690 right now on a payday loan of $300, they will take you to court at which time you will be paying $2, 690. I told them I needed more information. What is really bad is they have all your information - social security number, address, work and cell phone numbers. I will call Gateway Lending which is who they claim I owe and find out if they have my information. I want to know how they got all this confidential information. They may have hacked a file.
When I research more I will be starting a class action lawsuit - anyone else interested?
Fraud & Collection
Evonne Martin from Stark Law Firm called my husbands work and said that they had a case against him for fraud on a $300.00 loan in April 2014 that he did not receive and if he paid it today they could settle it for $690.00. If it went to court it would be between $2000.00 to $3000.00 after we paid the court cost. They called at our house the number came up Toll Free Caller [protected]. This is very disturbing for us, since we pay our debts and know who we owe. They did not tell us that they were a collection office but that they were from Stark Law Firm. They said the papers would be mailed to us with proof.
Federal law (the FDCPA) mandates that a debt collector states that they are a debt collector trying to collect on a debt, every time they communicate with a consumer. Law firms that delve into debt collection are required to adhere to the same mandate. The same federal law prohibits any and all deceptive collection practices. The law is written using the 'least sophisticated consumer' as the benchmark for determining if a collection practice is deceptive or not. For example, to the least sophisticated consumer, the calls you received sounds like the debt is real, and they are about to be sued for not paying it (because the firm did not disclose that they are working as a debt collector and not as attorneys, and use legal sounding statements like 'settlement'). This makes Stark Laws approach to debt collection very deceptive. When you get the letter from them, send a letter to them requesting validation (not verification). Request two specific things from them. 1. Proof that the debt is real, and 2. Proof that they have 'legal standing' to demand a penny from you. This is usually enough to stop them because they can rarely prove the first and can never prove the second. Also state that they are not to make any further contact by phone. Request that all contact be made by U.S. mail. Do NOT sigh the letter. Send the letter certified with return receipt requested.

Had the same call from a "Stark Law Firm", they said I owe then money through a creditor called Excess. The phone number called was [protected]. the amount of money requested for the anonymous $300 payday was $690 based on interest, or they said they'll sue me with fraud about $2690. They had my SSN and all other personal info. They wouldn't send me any written notices or etc..

This is almost certainly a scam. Probably overseas as well. I would love to pursue them if there was any way to do so (I'm an attorney), but it doesn't appear that there is.
