Smith, Dean and Associates / Threat and harrasment

I received a call stating that I would go to jail and the Sheriff's would pick me up if I do not pay them within 3 hours. I was scared and decided to do rearch on this company.

I called the Payday Loan Office and asked who they were and they told me that the is the collection agency that they do use.
I was going to pay them right away after they said that. I decided to do more research. I than contacted the General Attorney and Sheriff's Dept.
They informed me that they were violating all FTC rules since this is a civil matter.

I called the attorney and decided to make payments through him. I informed Lisa Smith of this and that is when she decided to call me a spic and ignorant.

Her daughter and son were saying the same comments.

First off did you borrow money and did not or will not pay it back ??? People always want to mix the message and say these collectors are rude and say these things. Wee you would not be getting the call if you would be resposible with your money and pay in a timley manner. Payday loan companies use this as a last resort after numerious contact and offers for you to pay in a timley manner, after you were sued and had a judgment but are no longer working were they can garnish your wages. I'm so tired of hearing the victim is the customer. Yes I own a payday company. My disclousures tell the truth. I follow the best practices and try to collect my debt through my attorney. When it comes back unserved or you are not found our only recourse is a collection agency. You in reality stole my money. So all you have to do is pay it back.

Smith & Dean & Associates are breaking the law by LYING to people saying they will be arrested if they dont send them money by a certain time. Also, its ILLEGAL to share personal information about that person with their family or nieghbors. I am planning to sue, everyone else who has been crooked by them should too. We cant let them get away with this.

A good friend was awakened by a call this morning by people identifying themselves as attorneys and the sherrifs dept. telling her that she had till noon to pay a cetrain amont of money to Smith Dean or she will immediately be arrested. Being a single mother of three
my friend frantically rushed to get a money order in fear of loosing the kids due to her arrest. The money spent was to be used for food and the apartment the family was to move into at the end of the week. After some research I found that these people who called were in fact Lisa Sanchez and Maureen Bishop, employees of Smith Dean, not lawyers and cops. False claims of one being arrested by falsifying their identity is illegal. We also found that Smith Dean was in touch with relatives which in itself is illegal. Being unable to move and having to struggle financially because of Smith Deans selfish and illegal scare tactics has been quite a devastating to my friend and her family. Be sure suit will be filed. Do not be fooled by these crooks, you cannot be arrested they're just bill collectors not bail bondsmen!!

CALL the FTC EVERYONE AND FILE A COMPLAINT !!! This is the only way we can stop this company the number is 1-877-382-4357!!! The FTC says that until they get enough complaints nothing will be done!!!

I am so glad that I decided to research this before paying these creeps anything. I have filed a complaint with the Better Business Bureau of Jacksonville, FL, the Federal Trade Commission, and am currently searching for other agencies to whom I can report these collection terrorists. The lady at the Better Business Bureau said that over 40 complaints have been filed on Smith Sean & Associates in less than 2 years!! Don't give these criminals any money!!! They cannot arrest you!! They are a collection agency, no matter what they say about "fraud departments" or "affidavit division". TELL THEM THAT YOU KNOW IT IS ILLEGAL TO USE THREATS OF CRIMINAL PROSECUTION TO COLLECT A DEBT!!! When they call, don't back down!!

I just spoke with an Attorney, Jeremy from Bromagen and Rathet Law Firm. He will help. From what I understand lawsuits have already been filed against Smith, Dean and Associates. He will take my case as well. I pay nothing as Smith, Dean will be required to pay all attorney fees. I suggest you take the time to call. This company needs to be stopped. Their illegal debt collection practices are so horrible that I feel I must do something on principle. The more of us that file...the better. Jeremy can be reached at or (904) 242-0860.

I unfortunately fell for these embiciles tactics. I was contacted while at work on my cell phone and was given 1 hour to pay $715.20 or go to jail on 2 felony counts. My job/career were being threatened and due to the time line, I had no time to do research. I hastily made arrangements to pay the funds and then after the fact, did some research. What a bunch of animals. I never disputed the fact that I owed money on a payday loan. However, the branch I used closed their doors and ceased operations. I tried to explain this to the individual I spoke to and he told me he did not want to hear it. I could talk to the judge if I did not pay within 1 hour when he was "going to court". I have been in contact with the county attorney, the attorney general and a personal attorney and I will be filing suit. I also will be filing in small claims court. It is not about the money to me personally, it is about stopping these crooks and liars before they harm someone else! They have collected from the wrong person and they will pay. I am devoting my entire week to contact every entity possible and attack these people from every front. I want these scam artists shut down forever. I look forward to my day seeing them face to face in court. I however am not lying and am not giving them a time line. I will let the justice system work and let it take the time it takes. In the end, they will lose and I will take great comfort in knowing I did my part in stopping them. Beware and do not fall prey to these pukes!

These people have called me for the last 2 weeks. They say I owe money and I have never taken out a paydday loan. They have told me I will be arrested if I dont pay them. I have a handicap son at home with me and I can't be arrested, so I told them I would pay it but I decided after getting a call at 5 am today that I would do some research on them first. Thank you for opening my eyes to their BS. I will be calling the FTC about them and also the Att. General's office.

I was called by Smith Dean and Associates at my job by a mr Tom Curran who was very rude, he threaten to file papers to get a warrant out for my arrest and stated that i would be arrested and they would come to my workplace. i was frantic. i called the check cashing store and the lady there stated that there was nothing they can do and that it is now in the state of florida's hands. i spoke to tom 3 more times in which he hung up twice. until i found ths website. they are fraudulent and doing illegal things to get money that we are aware we owe but are not that worthy to be arrested for. I am so mad i got worked up for nothing at all.

They had me so upset by the message that they left that my boss thought someone had died!! Yes I owe the money, but I have also lost my job twice in a year. I had been working with the company when the manager came in and picked up my file and took it to these crooks. They won't be calling me anymore. Call the cell phone company and have the number blocked! Oh and they say they won't take payments, but they've cashed the money orders!

A man called Tom Curran called my placs of business. He accused me of fraud because I have been unable to pay my payday loan at this time. He said I would have 2nd degree felony charges. And that if I dont pay $400 and some odd dollars that I would be arrested at work. I told him I didn't have it and that I am a mother of two children, one a newborn. He didn't care. I told him I would have to call my husband to ask if we had the money becuase I only had $125 on me. He got mad and wouldnt give me the time to call my husband. He then wanted me to send the only money I had on me to him through moneygram. I told him I don't know of one around here and he got mad again. He told me I had ten minutes. I was freaking out at work. I went to talk to my boss and he told me that they cant do that. So I did some research and saw allo the complaints about them. When he called back 3 hours later, I told him to not call my place of business and that I was getting a lawyer. A week later, he calls back and asked me what the deal was and if I was going to pay anything on it. I said not to you and he hung up on me.

I too received a call from Tom Curran a couple of hours ago, saying the cops were on their way to arrest me for 2nd degree fraud charges. He said the only reason he called me was bc I had no prior criminal charges, and that he could drop everything if I paid the balance within an hour! He had me keep in contact with him while I was trying to borrow the funds from friends or family. After I made the payment he took my email and said would be emailing me the affidavit that clears my name, and charges.
Panicking did not help me, I left without doing research on the company, my friend also asked me to verify it wasn't a scam but I believed Mr. Curran. Yes, I owed on a payday loan, but calling my place of employment threatning to file charges and have me arrested was not the most proper way to discuss the situation.

I too received a call this morning from Tom Curran threating me with jail time and 2 felony accounts. He said he went through my records and found out I have never been in trouble with the law and he would do me the "favor" and give me a chance to pay. I understand that this needed to be paid but we just lost our home, I lost my job after I went to the payday loan place and I have no money to pay this. If I did I would have. It wasn't my first time getting a loan from there so it wasn't like it was intentional. This really pisses me off because not only was I freaking out but it had my 9 yr. old hysterical because she thought I was going to jail. How can people like this get away with it. I got 2...2 letters from the payday loan place about a month or so after the insufficient funds. Never got a collection letter, Never got a law suit letter. Yes I understand that the loan place needs to make money too but to say I "stole" money from your company is completely wrong! People have tough times and I know those who take advantage and play the poor me ruin it for us all but damn! You are threating the wrong people! Who can I complain to or talk to about this? This is wrong and really threatens the stable mind of the children in the home.
