I sold a car, new owners never transfered it to there name, car got towed, now cost of tow went to collections under my name. Rickenbacker refuses to remove this from my credit even though there is a bill of sale on record at the DMV showing I had sold the car! They say the only way to remove this is to pay it, and then take new owners to small claims! I have no record of who they are or where they are! Help smb!

Thanks for all your input, I too was a victim of mistaken identity, on May 9, 2011 just found out that Rickenbacker has place Serious Negative Delinquency on my credit report back on 2002, and I have a collection debt of $2242.00 I tried calling them, no answer, I was trying to clear this issue with them, but no ware to be found.no website no updated Tel #. I'm so upset, I'm trying to buy a home and they just brought my credit score down.

Breaking news! Rickenbacker is closing their doors and ordered by the district attorney of Santa Clara to withdrawal all negative credit reporting. To be added to the list of people wanting to have their credit report cleared contact the Santa Clara Consumer Protection Department at [protected], ask for Cory Finnegan.

This company is a fraud and they cheat people. They tried to smear a collection on my credit report that was not mine and they had no proof aside from the name of the person being the same as mine. I got them good though, i filed an identity theft report and a complaint with the LA superior court. I fought back. They take advantage of people who do not know how to fight back or do not have the time to do it. Do not let them do that to you. They are awful!

I used to work for [censor]enbacker group and they a have a call center in Lima Peru they pay us less than $2.00 an hour an we work more than 50 per week and don pay us over time, they treat us really bad, a guy called Fernando always come to Peru, and treat employess really bad, can someone do anything, do customer service from another country itś ok itś not against the law?

File a complaint with the office of the Attorney General. It is a simple online process (just google it). I had the same thing happen to me and after four years of fighting someone finally told me to file the complaint with the AG. Two weeks later (today!) I received a letter from the AG with a copy of the response they received from Rickenbacker saying the debt would be removed from my name and the credit agencies would be notified that it was in error. Thank you Attorney General Brown! If they get enough complaints, the AG will be able to do something to shut these scam artists down. Please help me spread the word of how to handle this situation. It has prevented me from being able to buy a home and cost me hundreds of dollars in the process. If only I had known it would take a simple online complaint form...

As a representative of Rickenbacker Collection Services, I have some valuable information for readers who have an account in collections with our organization.
First and foremost, if you receive a notice of collections, immediately contact the collection agency. There may be a pending credit reporting action and ignoring the collection notice will not help you.

If the account was placed as the result of the towing and storage of a vehicle:
If you sold or transferred the vehicle to another party prior to the tow date, there are options available to you:
1. Provide a copy a notarized Bill of Sale, signed by the seller and buyer prior to the tow date
2. Provide a copy of an acknowledgment from your state’s titling office, indicating that the transfer took place prior to the tow date
If you were the owner of the vehicle at the time of tow:
1. Every state has a provision that allows the towing company to charge for the towing and storage services of the vehicle.
2. Turning the title over to the towing company does not extinguish the debt.
a. If the vehicle is sold, the sale amount is applied to the towing and storage fees.
b. If the sale of the vehicle does not cover the total fees, then there will be a deficiency balance.
i. The deficiency balance is what the towing company submits for collections.
c. If the towing of the vehicle was the result of an accident, consult your insurance policy.
i. if the policy does not cover towing and storage costs, then it is the responsibility of the owner to pay for the services of towing and storing the vehicle.
ii. If the policy does have this coverage, then a claim for the towing and storage must be submitted to your carrier according to the guidelines of the policy. Consult your insurance representative.

If the account was placed as the result of a credit transaction, medical service, retail purchase or any other type of service or purchase.
The original creditor will be named in the first communication notice from the collection agency. Gather all of the records and documents you have available regarding that transaction. If you dispute the debt for any reason, send your explanation of your dispute along with a copy of your records, to the agency from which you received notice. This will initiate an investigation of your dispute. It is also recommended, that you follow up with the agency by phone around 10 to 14 business days after the date of your letter. Many agencies will accept communications by fax and/or email.
You have the right to dispute a debt which you feel you do not owe. If you know that you are responsible for the debt, many agencies will accept a lower settlement payment to close the account or work with you to set up a payment plan that meets your budget.
The most important thing to remember is that ignoring the debt, yelling at the collection agents, and sending threatening letters to the agency will not resolve the debt. Communicating in a manner that is of the interest in resolving the debt is more effective and more for your benefit.

DO NOT call them back. Either Jessica, Brooke, or Anthony will try to help you and yell, put you on hold, give you some attitude and respond to you with "bleh bleh bleh"... You also find out that this company succeeded scamming people in CALIFORNIA for the last 40-50 years.

Truth: Yes they are located in Morgan Hill, CA and they also go by numerous other phone #... such as [protected], [protected], and [protected] DO NOT give them any of your information other than what they know if you do call them.

I was caught in a fraud ring when we sold our car to someone and that other person was a junkyard worker who then worked with another towing company to fake a tow and got our information from DMV and then worked with this collection agency to get money from us.

THEY WILL DO EVERYTHING TO REACH OUT TO YOU AND GET TO YOU ! I sent them bogus 1000 page fax and harassed them myself ! They were laughing and playing games, making fake accents in their bilingual tones...

To know that there are individuals out there who do this for a living is SICK !
REMEMBER before you ever CALL back ANY #, please do some research and you'll be shocked to find the information. Apparently I am not the first one to be involved in a similar incident that involves a car, towing, or some vehicle incident.

The exact same thing happened to me. I sold my car two years ago, and it was towed. Now I'm stuck with the bill even though I sold the car. I'm contacting the Better Business Bureau and then an attorney to go after The Rickenbacker Group.

Im having the same problem. I have been dealing with them for about a year now saying i owe money on a car i never owned. But what is funny is see the money there trying to collect for is a honda civic, i owned a honda accord. Now when i talked to two different people and they both kept going back and forth saying yea its the honda accord then another person said no its a honda civic. Me and my dad asked for information from them and it took nearly 3 months to get the information they had on me..This is on my credit history for a car i never owned. They also have my parents on a car they never owned. There trying to get 1500.00 in towings fees. Im so frustrated i dont know what to do anymore these people are ###en rude ###s and something needs to be done..

I have same problem with this company, and they keep ask me to pay for the money but the car not be long to me. and they keep ask me to update the information for that car, then i have to went to the DMV 3 times to get the record somehow they said that they did not receive anything and they keep hassarssing me by phone and ask me to pay the money. Also, they put me in bad credit report. I think we should bring them to court because that company could ruins our credit history and we could ruin our future for this. I have same problem with this company, and they keep ask me to pay for the money that i own them by my toyota corrola. But the car not be long to me anymore, and they keep ask me to update the information that the card not belong to me, then send the record from the DMV to prove that not belong to me 3 times. and now they keep hassarssing me and ask me to pay the money to them. Also, they put me in bad credit report. I think we should bring them to course for this because that company could ruins our credit history. I had the same problem as everybody else, I got my car town away and the towing company sold it and they never change the name of the owner. Lucky for me I have copies of the ticket the insurance cancelation and records from the DMV that prove the car was not mine when the police took it. I have a really close friend that works at a collection agency that in Nation wide and she is going to help me suit the sh** out of this company. I have provided her with the information and she is working on the case. I am not paying a penny to this company because I do not own them sh**. Good luck to all of you that have to deal with rickenbacker because they are the worse collection agency. As for me I am moving forward on putting complains at the BBB and all the credit bureau.

I had 3 recent accounts placed with Rickenbacker, After placing them, I never heard back from this company. I tried calling over and over again to a Mr. Baker and never got a call back. I had to use another company after 6 months. I finally got my money after using another collection agency. I would never use this company again. You submit accounts and never speak to anyone again... pointless!

I worked here over 9 years, the company is now downsizing due to lack of business. Dee claimed I am "too black" to work here anymore... I am now contacting obama, orpah and civil rights dept. We have another experience with Smart Collect www.scollect.com and www.rickenbackergroup.com. We hired them to collect on some accounts for us. It seemed reasonable...10 bucks per month.

We paid for months and months. Watching the notes in there system do nothing. Yet they collected the money. They would ignore emails and voicemails. They would constantly mix up accounts...we had our clients receiving letters with other clients info. Whe I would get ahold of them...within seconds they added notes to there system that they attempted contact...literally while I was on the phone hitting the refresh button.

We finally cancelled the service. About 2 weeks later they recieved a check for $174.95 on an account they had been "collecting on". They called us and said we worked so hard and we collected this money for it. If you want it pay a $60.00 fee and we will send it to you. WHAT! You guys must be in love...why after you never did any work...just collect money month after month...would I send you another $60.00 for you to steal.

Stay clear from these scam artists. Smart Collect and the Rickenback Group are first rate scam artists. This is extortion and blackmail.

I am wondering if anyone else has used there service with simular experiences.

I just want to share my experience with Rickenbacker group, I told them my situation, I sold the car, new owner never changed the registration over etc etc. They worked with me gave me some time to get the money and actually I found the guy I sold the vehicle to. I asked the buyer to pay this fee he said no take me to court, so I did. I paid Rickenbacker first, so it would come off my credit report and then sued the buyer for the payment I made lawyer fees and missing work. Now I get a bi- weekly paycheck of $609.37 from the buyer, until March of 09. You do the math! I won this one and it was because Rickenbacker gave me some good tips. So for me Rickenbacker group is one hell of a company!

I got a call from Rickenbacker Group. The only reason I knew it was R.Group was because it was on my caller I.D. The man said "I need you to verify your address", etc. I said what for, what do you want. He would not answer. I told him I do not give out personal info to people I don't know who they are or what they want". He hung up on me. What is with that bull crap. What kind of business is that?

Yes, beware of Rickenbacker! They are liars, and you do NOT have to take any harrassment from them. Call their bluff, because they know that they are totally full of it. They recently came after my small company for a completely bogus debt, and I told them I simply would not pay it because I did not owe it. The representative said that they "have no other alternative but to continue to call" and I told them that I would have no other alternative "to continue to hang up on them". This company is evil. Do not let them bully you!

Same thing happened to me... my husband sold his car to a family member and that family member sold it to a cousin, and they never changed the name! The car got taken away from cops and we were the ones screwed!

Turns out the car was sold on an auction and WE had to pay 900+ dollars or else it was going to be taken to collections... Lesson learned that you cant even trust "family".

Rickenbacker Collections is a bad company. More like a sweat shop. All of their agents are out of peru. They do business with company's and laugh at their cause while ripping off their customers... Carlos Casas is the owner, ext 107. One of the most two-faced people you will ever deal with. Un happy fat little man. It is one of the worst collection agency's I have ever done business with. The last time as well. A real shady company. Be-ware.

I would file a small claims law suit against Rickenbacker Group. Take in your proof that you sold the car and that the new owners have not transfered the car into their name. This co seems to want a scapegoat to pay their fee and like since they cannot find the real owners of the car and your name is on the title still they are trying to force you to pay. I would bet you any kind of money this would not hold up in front a Judge and not only will they lose the towing fee but have to pay for court costs as well.
