I was hired at the beginning of September and to my knowledge to originate loans and help increase the production of the office as a whole. I was told I'd have a small base salary and the rest of my comission would come from the closing of loans. Either 10% of loans I help out on, whether that of other loan officers or Raul's personal loans that he didn't have time to tend to and the other was 50% on loans of that of spanish speaking clients which only I was able to manage. At the time of the first loan closing in which I helped he had no problem paying me the 10% for helping but I also had a spanish speaking borrower which I worked from the beginning with the clear understanding this was a 50% comission loan for me. He asked me to keep track of all loans i touched in a pipeline to ensure no confusion. I closed the loan and it funded, no problems. When it came down to pay me for this loan, suddenly Raul had no memomry of ever saying he had agreed to 50% although he nor anyone else in that office was capable of closing nor working with the borrower being only a spanish speaker. This was a primary reason why I was hired to begin with, the fact that I was bilingual and had invested 7 plus years in the mortgage business. Raul insisted that I had a big understanding and I cleary must of missheard him. I realized at that point a lot of the talk I'd heard about Raul's potential to do this, was very real. It was happening to me although I'd been very clear I was counting on that comission to be able to make a mortgage payment on my own home. I resigned the following Monday and then he almost made it not poissible for me to collect my final paycheck for which he clearly owed me the very small part of my base salary. Raul insisted in "trading" my final pay for office keys I no longer possesed. I cleary told him it was not right and he could not withhold my last paycheck period. Raul inlcuded 10% comission instead of my earned 50%. This was the difference between $2, 000 plus over the $300 I received, which obviously couldn't begin to cover a mortgage statement. There was no winning a discussion with Raul and he refused to accept that he had made a clear and conscious choice to keep the comission I earned for myself. He's become a person I have no respect and an addition employee after my is now experiencing the same exact situation. Raul is refusing to pay her for her own personal loans after he advised her that her position is being eliminated and then turned around and told her that due to job abandonment he by law did not have to pay her at all for loans she clearly closed!
