Providian Bank / Collection Letter

I filed bankruptcy in 1999 and filed against Providian Bank (Chase credit card) and the balance was a little over 1800.00. I received a collection letter today for over $3, 000. What is going on with this company? The collection company is from Portfolio Recovery offering me to pay half of the amount. What am I suppose to do? Are they going to try and collect the money out of my checking account now?

    They should not be able to attach your bank account unless they get a judgment against you.

    Do not pay this company a red dime.

    Do not talk to the collection agency on the phone. Send a cease and desist letter to them; state in the letter that you are reporting them to your State Attorney General for attempting to fraudulently collect on a debt that was discharged in a 10 year old bankruptcy. Instruct them that they are not to contact you at home, at work or on your cell, all correspondence is to be in writing. Also instruct them that they are not to sell, convey or transfer this alleged debt to any other collection agency. Junk debt buyers (JDB's) have a habit of reselling accounts that they are unable to collect.

    Check all three credit reports to ensure they have not added this collection to your report. If any are reporting this collection, dispute it in writing. Also - be aware that junk debt collectors will file suit in the hopes that you don't respond in order to receive a judgment against you. Open all of your mail no matter how insignificant it appears.

    Send a letter of complaint to your State Attorney General stating that you are being contacted on a debt covered under a bankruptcy from 1999.
