Eric Scott Kindley, 49, a prisoner-transport officer, was arrested yesterday in Stockton, California on charges related to sexually assaulting females in his custody, and threatening them with a firearm while doing so. During his initial appearance today, a federal judge in Sacramento, California ordered that Kindley be detained over the weekend, pending potential transport to Phoenix, Arizona, from where the complaint was issued. A complaint merely establishes probable cause, and Kindley is presumed innocent unless proven guilty.

According to court documents, Kindley operates Special Operations Group 6, a company that contracts with local jails throughout the country to transport individuals who have been arrested on out-of-state warrants. The probable cause affidavit alleges that from January through May of this year, Kindley engaged in sexual misconduct in his Dodge Caravan with three different female prisoners during three different transports. The transports were from California to Arizona, Alabama to Arizona, and Mississippi to New Mexico. In each instance, the victim was handcuffed and restrained, and taken to secluded locations where Kindley sexually assaulted her. All the while, Kindley threatened each victim with his firearm and warned them that he will get away with his conduct because no one will believe them.

The probable cause affidavit further alleges that during the transports, Kindley bragged to the victims about sexually assaulting other female prisoners during prior transports.

This investigation remains ongoing. Anyone with additional information is encouraged to call the Phoenix Division of the FBI at [protected], or can email the Civil Rights Division at the Department of Justice at Prisoner.Transfer@usdoj.gov.

This case is being investigated by the Phoenix Division of the Federal Bureau Investigation and is being prosecuted by Special Litigation Counsel Fara Gold and Trial Attorney Maura White of the Criminal Section of the Civil Rights Division of the U.S. Department of Justice and Assistant United States Attorney Abbie Broughton Marsh of District of Arizona.

Family members allege inmate mistreatment

Writer:
Troy Hooper
Byline:
Aspen Daily News Staff Writer
The mother and sister of a man accused of passing counterfeit bills picketed outside the Pitkin County Courthouse on Sunday and Monday with signs reading: “Inhumane treatment. Shame on the Pitkin County Jail.”

After getting to know Sheriff Bob Braudis, the women put down their signs. But their crusade isn’t over yet.

Susan White and Helena Williams are the mother and sister, respectively, of Francesco Anthony Saputo, 29, of Escondido, Calif., who is being extradited to Aspen from San Diego. The women claim Court Services Inc., the California-based prisoner transportation company extraditing Saputo, is mistreating him. He has been en route to Aspen since Oct. 5 in a prisoner transport van and has told his mom the Court Services Inc. driver has been falling asleep at the wheel, and depriving him of food and the restroom for long periods of time. Even though the drive from California to Colorado only takes a day or two, prisoner transport companies take far longer because they are constantly picking up and dropping off inmates. Saputo’s van apparently is in the Southwest and should arrive in a day or two.

“They were screaming to wake him up because he was running off the road, ” White claimed, based on a conversation she had with her son. On the other side of the signs disparaging the Pitkin County Jail, White and Williams’ signs read: “CSI Services — Where is My Son/Brother?” White said Saputo told her that the driver drove for 36 consecutive hours at one point, and dozed behind the wheel.

“There’s a lot of hanky panky going on, ” she said.

White and Williams traveled here from New York.

Sheriff Braudis approached the women on his way into work Monday morning at the corner of Galena and Main streets.

“I run the nicest, most humane jail on the planet, ” he told them.

A little while later, they paid a visit to his office. After talking it over with the sheriff, they agreed to stop picketing the Pitkin County Jail.

“Cruel and unusual punishment is something we’ve never been accused of and we’re not into it, ” Braudis said. “We are going to investigate this and if there is any cruel and unusual punishment component that is sustainable we won’t use them again. We’re doing everything we can. I’m going to assign an investigator.”

Pitkin County sheriff’s investigator Bruce Benjamin will be assigned to interview the driver and all the inmates on the van when it arrives this week. This is the first time Pitkin County has hired Court Services Inc. for extradition. Jails began turning to private transport companies in the 1990s as a more cost-effective alternative to flying cops and criminals on commercial and charter airlines.

A message left for Court Services Inc. was not immediately returned.

The Internet is littered with complaints against the company and its operator Eric Kindley. The FBI arrested Kindley last year on conspiracy and gun charges for allegedly providing an employee an unregistered handgun on a commercial flight. He was later acquitted because, Kindley’s attorney said, he was just doing his job. Former employees of Court Services Inc. complain they haven’t been paid; others accuse the company of shoddy business practices; and a CSI extradition agent was reportedly arrested earlier this year, accused of having sex with a female prisoner.

Inyo County sheriff’s deputy Lyle Oyster, who is listed as a reference on a Court Services Inc. brochure, said his experience with the prisoner transport service has been positive but that his jail no longer uses its services.

“We’ve had no negative experience at all. Honestly, we don’t use many transport companies anymore mainly because they don’t come up here, so we use other agencies to do our transporting now, ” Oyster said.

Don Bird, administrator for the Pitkin County Jail, said out-of-state extraditions only happen here a couple of times per year. Having it take over a week for an inmate to arrive from California is not all that unusual either, he said.

“It can vary. We’ve had it take longer than that, depending on where they’re coming from. They don’t just pick up this guy. They picked up this guy in San Diego, then some other guys. It takes a while, ” he said.

Saputo is the third man to be arrested in connection to a minor-league counterfeiting scam that plagued Aspen over the summer. Between $1, 500 to $1, 700 counterfeit $100 bills were passed to 10 or more businesses in town. Andrew Allan McCollom and Christian Adam Gaxiola, 30, are facing forgery, conspiracy and theft charges. All three men drove to Aspen together from Escondido, Calif., to go on “a shopping trip, ” according to Saputo’s mother.

White claims her son is innocent and was in the wrong place at the wrong time. She also said she believes Aspen police mishandled evidence, and that the only case they have against him is a photo of him making a purchase at a store.

“How do they know there’s a counterfeit bill in his hand?” she asked. “It’s a very weak case. You can’t base a case on a picture from a store. ... And they mixed all the bills together. The money was passed around. That’s not how you handle evidence.”

Aspen police officer Ian MacAyeal declined to discuss evidence in the case. He noted that a judge found enough cause to issue a warrant for Saputo’s arrest. Saputo was collared for drunken driving in California about a month ago, when the warrant for his arrest in Aspen showed up and the extradition process began.

Van carrying inmates crashes on pass

Writer:
Troy Hooper
Byline:
Aspen Daily News Staff Writer
A vehicle carrying an Aspen arrestee slid off the road Tuesday on its approach to Independence Pass and had to be assisted by sheriff’s deputies.

The accident comes the day after the mother and sister of Francesco Anthony Saputo, 29, picketed outside Pitkin County Courthouse, claiming the driver for Court Services Inc. was endangering Saputo and others by allegedly falling asleep at the wheel. They said the incident bolstered their claims against Court Services Inc.

Sheriff’s deputies in Lake County, where the accident occurred, and in Pitkin County, which assisted in the accident, said the vehicle slid off the road in snowy, icy conditions but it was never in danger of going off a ledge. Colorado State Patrol, which is investigating the accident, did not return messages.

Two of the inmates in the vehicle were taken to Leadville while the vehicle was pulled out of its predicament and later released back to Court Services Inc.; a sheriff’s deputy drove Saputo from the Lake County side of Independence Pass to Aspen. The deputies said no citations are expected. An ambulance was called, however, because one of the two employees for Court Services Inc. apparently injured his leg after he exited the vehicle.

Appearing before Judge James Boyd on Tuesday, Saputo became emotional describing his extradition from California. The drive from California to Colorado took a little over a week to complete.

“[It] scarred me mentally. I’ve been abused and deprived of my rights to eat, sleep, ” he said as his mother and sister sobbed beside him. “I’ve been on this field trip with this company that has not housed me or fed me.”

Messages left for Court Services Inc. in California were not returned. Research shows the business has had run-ins with the law before.

Chief Deputy District Attorney Arnold Mordkin advised the court he is likely to charge Saputo with two counts of forgery, theft of more than $1, 000 and conspiracy to commit forgery and theft.

Aspen police allege Saputo used a counterfeit $100 bill to purchase a dog toy and a cookie for $31.64 from C.B. Paws. Authorities believe Saputo is one of three men who spent between $1, 500 and $1, 700 in counterfeit bills on small items so they could pocket the real cash.

Evidence against Saputo listed in an arrest warrant consists primarily of video footage of him making a purchase at C.B. Paws. Saputo’s mother, Susan White, has questioned how authorities can be sure that the money in her son’s hand is counterfeit in the video. Andrew Allan McCollom and Christian Adam Gaxiola, 30, were previously arrested in the alleged counterfeiting caper. The three men drove here from California in August.

Mordkin declined to discuss evidence in the case but he claimed that Saputo is complicit in McCollom and Gaxiola’s alleged crimes. He asked the judge to set bond at $12, 500. Saputo pleaded for a lower bond.

“The charges brought against me are hideous, heinous and they are not fair. ... I pose no flight risk to this community, ” said Saputo, who noted that he has worked for about a decade as a bricklayer and that he is currently enrolled in nursing school. He also said he has a child to take care of in California as well as his sick 84-year-old father whom he assists with in-patient care.

Judge Boyd took Saputo’s circumstances under consideration and set his bond at $3, 500, which was well below Mordkin’s recommendation.

Saputo’s mother, White, and sister, Helena Williams, flew here from New York to support him. They had picketed outside the courthouse on Sunday and Monday, censuring the Pitkin County Jail for hiring Court Services Inc. After meeting with Sheriff Bob Braudis, they agreed to drop their sidewalk protest. Braudis has assigned an investigator to review their complaints.

HAHAHA well Eric you can threaten me all you like. If you want to go to court then by all means file a lawsuit. We will then see who comes out on the winning end.Sorry it took me so long to reply but see I have a life other than surfing around on the internet. The reason you have not filed a lawsuit against me as of yet is because you know that I know where all of your skeletons are buried and have the maps to each and every one of them. The only reason you are still in business is because no one has been able to get all the former employees together in one place so we can all compare notes. That is until now. For anyone interested in joining the Eric Kindley forum simply go to http://erickindley.proboards.com/ you can also call me at [protected]. Now Eric let us see how many other people you screwed over. As for having several other screen names, you wish. You yourself know you are a miserable excuse for an employer and there are MANY former employees out there that have been ripped off and taken advantage of by you. You think because we are all scattered across the country that we will not be able to join up and compare notes. You are wrong.

I agree with you Geoorge, History has proven strength has always been in numbers. I have a feeling there is so many more EX employees that we know are out there that have a hatred against him but wont want anything to do with this or any other site. I would like very much to see justice done. But snakes are good at getting out of holes and leaving others behind to get captured. I know there is quite a bit of us out there who were left behind. I do find it ironic how everytime he responds to a complaint he repeats himself but just words the story differently ( Meaning he accuses everyone who posts against him all of the same thing, it's repeat of what he types to everyone just words it different to each person). And of course he has NEVER take responsibility for anything he does it was always his screw up employees, Which in his mind that puts him in the clear. I believe in God and believe he sees all and knows that if he doesn't pay in the end for hurting others then while he is still on earth Karma will get him. Karma has this funny way up sneaking up on you when you least expect it if not then it will be one of the inmates that he mistreated will catch up with him lol for his sake he should pray for karma..lol

I'm not going to say that Eric is a criminal. Or that he should or shouldn't be held accountable for his actions and the situations that he put's his former and current employee's into. I would ask as a former employee who has experienced most of the problems expressed in these post's why don't we do something other than just complain. There is strength in numbers. Could we not band together to stop this man. With all of the State and Federal laws alledgedlybeing broken I'm sure that someone would love to talk to former employee's and take statements to use against CSI and Eric Kindley. The question is how do we all get together?

You would have been stuck paying the bill for the rental, fuel and any meals or expenses out of your pocket. He has never done anything safe or with any concern for agents as long as he can send off a bill and collect his money. Then you would not have been paid...very sad

I was almost to work for him starting 8/15/09. we had never met. I reside in another state. I worked for a transport company previously and enjoyed it. I applied to CSI wanting to relocate. Eric called me and asked me to fly an inmate out to CA, I agreed although we never met. Then he called and added some more stuff. I am a female, 35 years old, 5'1 and 140 lbs. He asked me to get a rental car and pick up 3 adult males, in OKC, MN and AR. Instead of flying he wanted me to drive. He wanted to me to drive in an uncaged vehicle, without a firearm, and alone. I had read this stuff about him before he asked me and was giving him the benefit of the doubt but now I understand. My previous employer would have never allowed me to transport 3 adult males (possibly more) in an unsecured vehicle and without protection.

one of the inmates who was on board that van of PTS has been admitted to a hopsital in Ky and worse off than she was during the intial accident. Sometime after 2200 and 1am they took her and she had another surgery where part of her lung has been removed and she is in very serious condition...We need to pray for everyone who was aboard the Van that was in the accident. This isn't a post to bash anyone, But to remember what can happen to any of us out there...

Well Concerned Friend, with all of that knowledge you have, it's a wonder why you haven't shared with us all of the other transportation companies out there that do not follow and conduct thier business inappropriately. That's because you and everyone else have their head too far up Eric Kindley's ### to fail to notice what all of the other prisoner transportaion companies are doing. Maybe it's time you and everyone else turn thier heads for a moment and focus on other companies with far more poor standards of running their business than C.S.I.

If you have knowledge of prisoner transportation business, then I'm sure you have heard of one of the latest accidents, killing two agents and one inmate. The agent driving fell asleep behind the wheel, killing the other agent and one inmate. This happened with one of the supposedly larger transportation agencies. However, the point bieng, the agents were driving too long, with little sleep and this happened. This company makes thier agents drive for 48 hours before having a rest and then they get to house thier inmates and rest in a hotel. On thier 48 hr run, they take turns driving and trying to get rest in a van, which I'm sure wouldn't be too comfortable. With little sleep and long driving hours, this can be dangerous for everyone involved.

Also, some of you who have posted talk about driving for hours and days without showers and other hygene issues. Well, then if you work for other agencies who have transporters, you run into this all the time. Some of the decisions are even made by the employees. If they feel they are running behind schedule, they put off taking a shower for days. Pretty bad judgement for employees, bieng the fact that you should maintain a professional image your whole run, especially when you have to enter different courts and facilities.

So, everyone can continue to critisize Eric Kindley, with Court Services, but let the truth be known that there are more agencies out there that have bad practices. The truth is that all of these agencies have more than one thing in common, being they all know each other. At one point in time they have all worked together or know someone that has worked for each other's company. It's all about who can deliver the most bodies in the most timely matter, not thinking of the outcome it can have on the employees, employer and everyone else involved. I personally know someone who has worked for more than one of these agencies and they all seem to have the same issues .

All of you can rate this how you want, but I speak nothing, but the truth!

This post is from a friend!

With considerable knowledge regarding safe and legal business practices I can confidently assert that Eric conducts his business inappropriately- not following DOT REGS, lack of Back Ground Checks, renegging on dates of payment for employees, failure to comply with laws in regard to number of days worked consecutivley, refusal to provide automobile insurance on company vehicles, requiring that employees take out their own income tax and disregard for saftey precautions such as lack of employee training and letting an employee transport inmates alone.

Ok since I have already been accused of being here I decided to join in on the discussion here. I am Heather S. I was the former Director of Operations for Court Services, Inc. Everything that the former employees are saying about Eric Kindley are true. He does not like to pay employees and when they get fed up and quit he then does not pay them at all. He likes to say that he is a "Christian" but I have not seen any Christian behavior out of him. I still have copies of logbooks and trip logs and also prisoner transport sheets that show drop off times and locations. Simple math shows that DOT drive times are not being followed. Also there was not proper insurance on the vehicles to do the trips. I am sure there are plenty of other former employees that can attest to this also. As for Eric using drugs I can not say yes or no to that as I never witnessed him doing so. As to hiring employees who were NOT qualified to be employeed because he did not do proper background checks that I can attest to as I had to work with them. There is alot more I can share and will. But for now I need to run. For any of the former employees who would like to get in contact with other former employees feel free to contact myself and I will give you the address to a bulletin board we have all about Eric Kindley.

Thanks,
Heather

It doesn't surprise me to see all of the comments about Eric Kindley above, being I too have been one of his many screwed over ex-employees. He is indeed a pathelogical liar, cheat and scam artist. He lies so much he actually believes himself. He does not follow the company policies and guidelines that he addresses to his employees. He tells you he will pay you one amount and then pays you another, when he decides to actually pay you. You know payday always is a different day, huh Eric? He doesn't answer his phone and when he does he's better off texting anyways because he can't hold a conversation on the phone. You can never understand what he's talking about. I was angry at him for a long time and he still owes me money for work that i had done for him, but I have moved on to better things now and realize i will never get my money and he will never change. So, I am not mad at you anymore Eric; I wash my hands clean of you, I just feel sorry for you because no matter how many people complain about you, you just don't get it!

Well what you are describing is spot on for ho w the organization is ran. Sad really because from what I have been able to put together from various sources he wanted to do it properly in the beginning but then the green eyed monster called greed got ahold of him. He then started running routes very sloppily and hiring anyone who was willing to drive.as long as he got the rounds done and the billable hours turned in he could not give a ### how you looked, if you slept, or what you wore.

RNnorine, ...

I did not personally address anyone on this site, but since you chose to get personal with me, i'm going to respond to you.

First of all, I have never stated on this site that I have or have'nt worked for C.S.I. or Eric Kindley. F.Y.I., I have no relation to Mr. Kindley either. I am able to say whatever opinion I have on this site. Yes this is called "Complaintsboard.com", but I happen to voice my opinion in the comment section of a complaint and you don't like my opinion because it's not negative like yours or most people on this site. There are no rules, saying that you have to agree with what everyone else says. Everyone is entitled to thier own opinion and I don't really care if you or anyone else dislikes what I say.

When you work in prisoner transportation, your life style may be a little different, being you spend alot of time out on the road. However, you do get the opportunity to take a shower shave, brush your teeth, and to rest. If you did not do that, then that's your fault and very careless of you. There is places you can house your inmates, so you can do all of this. No one can make you drive for hours on end with no sleep and not cleansing yourself. You have the balls to go on this website and state how you felt all about this, but you could have stopped this at the time if you wanted to, but you chose to work like this, so its just as much your fault as his. And if you were driving in an unsecure vehichle with six inmates, no partner, or protection, why would you even continue to work for him? Why would you even start your trip if you had an unsecure vehichle? Probally because at the time you didn't care as long as you were going to be paid, right?

Oh, and by the way RNnorine...NEWS FLASH! C.S.I. is not the only prisoner transport company that has been accused of not following regulations and company policies. Why don't you go work for one of the other companies and I guarantee you will be on here crying about the same thing. Or better yet, why don't you jump on board the short bus, where all of the other ex C.S.I. employees go...I'm sure you would find that atmosphere on the rd more comfortable!

So, once again I ask, If someone told you to jump off a bridge, would you? Let me answer that for you...Probally YES, because you did everything else that you claimed Eric made you do or told you to do. So, RNnorine you can go suck a D#*k because obviousley you must be good at that being you bowed down and did everything Eric supposedly wanted you to do!

You can do us all a favor and take your curly hairy ###, find the nearest bridge and...JUMP. And well your at it, you can jump off of this post too. If you don't drown, you can hop aboard the short bus with all the other ex C.S.I. employees! WAKE UP DUMB ###!

Miss Cali, …
Who has not worked for Eric Kindley but sure do know who he is.
I’m guessing you’re his ex, lover, or a relative.
You said you never worked for Mr. Kindley “SUPPOSELY”. If you where a honest person who is trying to do the right things in life, or not live on the road, hotels, different states, not showered, shaved or brushed your teeth in two or three days, driving around from state to state with 100. Bucks, that’s supposed to last for two days, or driving around with a loaded weapon over 20hours or more half a sleep, plus having a Kindley Liar texting you and promising you will be off after another pick up that he just added on for you.
Then you may say whatever you please!

Yes there’s always two sides of the story, Yes nobody is perfect, Yes Eric pays you in the beginning (LATE)then scams you. Yes he doesn’t care for his ex-employees or current workers. Yes it’s not his fault for the sexual assault for that female inmate. Yes it’s his fault for hiring anyone who will complete the job, for his money. Yes it’s his fault for not filing paper work for a extended background check on these individual workers. Yes he rents a rental van for you to haul 6inmates on board with no cage, partner or protection. Yes I’m sure everybody is pissed off at those individual ex-employees who committed the crime.

I don’t know you, I don’t care, I can careless who the f*?@ you are!
It’s been over a year that I don’t work for Mr. Eric Kindley. My aware words are for any other individual who wants to work for him.

I’m sure everybody on this complaint board list is agreeing with every word I say!
So go cry in your little shell and stop try to stick up for this Pathological liar who scams everybody that he meets, or who he hires! I know he doesn’t check a criminal background investigation on his employees, I know he doesn’t do a lot of professional documentation that he should. He should be out of business, he doesn’t care who he hires or what he hires, he wants his funds and not pay his employees for completing the job for his lazy fat ###.

Miss Cali, Go kiss my curly hairy ### and shove your words down your throat where Eric’s been.
By the way I’m sure everybody knows what the topic is for this page, but stupid people like you want to cheer and say sarcastic words for the stupid human beings (like you).
However the web-site is called (Complaint Board) (not cheers for a scam artist).

And heres what Mr.Kindley had to say on the other end.::::::::::::::::::::::

Actually he hired two agents who were NOT 21 and that is a violation of Federal Regulations. He had one employee who had a suspended driver's license for DUI's who was driving for the company while suspended. It is a huge NO NO to have two male agents haul a female inmate. He was warned about this numerous times but did it anyway. The individual who committed this rape was a felon. Which also is a violation of Federal Regulations. He should have NEVER been hired he was a FELON. He did not do background checks, does not have operating authority and probably does not have insurance on the vehicles.

But it is also a warning to anyone who considers working for this sleaze. Sorry, but no respect for anyone who even attempts to defend this POS.

Has anyone who posted on here actually read the complaint of this post? I understand that everyone is angry at Eric Kindley for his supposed wrong doings to each of you individuals who have such claims, but why isn't anyone angry at the agents who supposedly sexually assaulted the female inmate, or the agent who neglected the inmate to the public? Eric Kindley did not make these individuals commit such acts, they are the ones who made those choices. The only thing I see that Eric Kindley may have done wrong here is not run a extended background check on some of his wack job ex employees who continue to cry about the same issues from the past. You can't tell me that none of you people didn't ever do anything wrong the whole time you worked for him? There is two sides to every story, but I don't believe that all of you have accurate claims to wrong doings. You all talk about money being owed to you, well if he didn't pay you from the start, why were you people stupid enough to keep working for him? So as far as I'm concerned, its just as much your own fault...best advice ...move on and consider it a lesson learned!

HMMM glad I am not alone with my experience, Everyone who was honest and was burned by Eric just know that of course you were not good enough to work for CSI. You were not a good enough criminal and you had morals. To do what Eric does continually you have to be a liar and a cheat, and a criminal.

Sorry to disappoint u, but this is not Eric. You seem to have a wierd obcession with C.S.I. and Mr. Kindley for someone who has never worked for him though. Shouldn't you be busy running the short bus with all the other ex C.S.I. cry babies, or have I mistaken your identity for someone else?

Illegal things he forced you to do? So, if someone told you to jump off a bridge would you? Get my point? Actually, don't answer that. No one can force you to do anything that is illegal. In the end it is you who makes the responsible decision of what you should or should not do in your work performance. Although, there are two sides to every story, but it seems your side sounds like all the rest of the cry babies above. Well, maybe you weren't cut out working for C.S.I. If you people would have just done the job and cut the drama, there would be no post!
