Portfolio Recovery Associates Debt Collection

I sent the letter below to PRA. I do not know what they are collecting for back in 1991. I am an African American living in a redlined zone watching foreclosure all around me. Thank God, after two illegal foreclosure attempts by HomeSiding Lending and than Washington Mutual, I am mortgage free. I am still owed $6, 000 I paid to stop the foreclose and this money does not appear on my mortgage histories or the end of the year tax statement. Most recently, I know have a several attempts to collect debts that are not mine. I have a case worth investigation, See letter below.

This comes to dispute your undated mailing which I received on December 24, 2008. The two separate mailings displayed the above reference numbers.

One of the envelopes contained a letter stating I had a loan dated 10/7/1991 which I deny. The other envelop contained a dispute form with a different reference no. and no information about what was being disputed.

I request that all telephone calls stop immediately and that I receive only written and dated communications regarding this matter. The correspondence from PRA states “PRA purchased the account:6/30/2005”. I request full disclosure with all supporting documentation regarding the party that sold the alleged loan of over $8, 000 to PRA.

I request a response from PRA no later than 20 days from the date of this letter confirming that this matter has been closed.

I RECEIVED A LETTER STATEING I OWE A CREDITOR HSBC BANK THE AMOUNT OF 590.51. UNFORUNATELY LIKE MANY OTHER PEOPLE MY FINANCIAL SITUATION IS LOOKING GLIMM. Hsb card I do not own such a card. My personal has been stolen in year 2010 from storage of personal thing like my passport, birth certificate and importance paper that has been recover. I never use credit card (HSB) I ONLY USE CREDIT CARD FROM BANK ONLY, still having problems I wrist the bank because money is away being delete out of my account with my knowing or there no money in the account at all when I know I put money or check into my account. My job the same problem, now I do not have job. The bills was exceeding my check every week and you taking money from my working check (VNA) in years of [protected]. Plus had a car accident on the job in the year 2009 in the spring time. I do know of hsb card or bill, so stop calling me about someone bill which is not my bill. It mean somebody is using my single name, (you need to fingerprint that person). I NEED GET MY OWN FINIANICIAL STRAIGHT OUT ON MAKING A LIVING FOR MY SELF TO. I have just received a letter from PRA that I owe Capital one 3000 dollars. I have no knowledge of this nor do I ever remember having a Capital credit card. No dates or info as to what it was about... A real SCAM.! ! !

Thanks to your site I am finding this is one more troll attempting to collect on bad debt placed into my credit history files by criminals who have stolen my personal identification. I have submitted multiple criminal police reports and copied those reports to county & state prosecutors and to the Federal Trade Commission and nothing gets done to help me recover my good name. I pray that others who are suffering this injustice meet better success than I have in restoring their good name.

This is in regards to my Capital One Bank credit card. My work for sometime has been very very slow, and it's difficult to pay on this. I would like to know if I can send what ever I have and it will be applied to the principle not to late fees, or over the limit fees. When my work picks up I can get back on track. My account [protected]. I hope to be caught up on this in the near future but at this time its been very hard on us. Let me know if you can work with me on this.

I have recieved a letter from Portfolio Recovery ###.LLC. stating i owe Orchard Bank $534.81 acc.#[protected] i havent owned a credit card in 15 to 20 years and the statment doesnt give purchase dates nothing.Unless they cough up facts of purchase or some means to prove i owe i am gonna look at this as a scam and will pursue legal action.

Portfolio Recovery Associates Wrong person

These folks have called my home # a few times and repeatedly ask for a person I don't know. The debt is for some credit card company I NEVER had business with. One time the caller stated they are sending the sheriff to collect the debt at such and such address(not mine). I asked the d.o.b. & s.s. # and those were not mine either. They are obviously trying to collect somebody else's debt from me. Wrongo! I firmly told the guy that it was against FDCA to discuss a debt with anyone other than the debtor and making idle threats about the sheriff collecting debts. I told him I was a debt collector years ago and basically told him he was an incompetent collector and had absolutely no business calling our ##. Another thing-we have had our ph # for 14 months when we moved here from another state, the debt is from 9 years ago.

Next time I will remember to hit the "record button" on my phone and string this guy along. Have these yo-yos ever heard of phone #s changing or "recycling?

Yep, sounds familiar. Sorry you had to go through that. I changed my # twice on cell phone because of B.S. like that with Capitol One. I've NEVER had a C.O. credit card! They kept leaving automated messages from "Karen" and to return the call you had to have a ten-digit credit card (which I never had) to get through. A rep got through somehow and i spoke to the woman and she was extremely rude. I tried to explain, nobody believed me. Don't they know that you can get more flies with honey, not vinegar? Hello! Be rude and people get angry. Anyway, i hope your sit. gets resolved soon. Mine did by changing my # to a new prefix.

Portfolio Recovery Associates Scam and cheating

Out of the blue in early September 2008 I received a call from a creditor claiming to be collecting debt. I knew I didn't have any outstanding debt, so I took the call in good faith believing that this was an honest mistake that could be easily cleared up. The creditor had my name incorrect and and incorrect address history and claimed I owed a debt from 1991 (I was still in high school then). I told them it was definitely not my debt. They asked for my bank account information and threatened to ruin my credit. I told them I would not give them my information and that this was not my debt. That I would investigate further. They called my several times a day, harassed my underaged daughter, and told me I would be sorry when they put a damaging report on my credit. I raced to get a copy of my credit report to see if this mysterious debt appeared there. It did not. There was no record of this debt at all on my credit report. BUT there was a new hard inquiry for 'collections' from portfolio recovery associates. I have written them and asked them to remove the illegal hard inquiry, which violates the fair credit reporting act. The inquiry remains on my credit report. I don't know what to do to combat this fraud.

this company sux, and isn't legit. Don't send them a penny and contact the Better bus bureau and/or attorney General. yes they prey on anyone who they think they can scare into sending money! Don't send a penny, and always ask for proof in writing, but even if they send you proof, it still can be scam artists doing that !

DO NOT agree to payment arrangements until you have verified the calculations BEFOREHAND! They screwed me out of money on a settlement because the guy could not divide a payment by 2...so I lost over $100 because of HIS error...and their excuse was that the Vice President approved the settlement... PLEASE! the VP would not be in charge of approvals...senior management would... I am sure the VP was working the call center at 8:30 pm at night... make sure you write every person's name down that you talk to... you have to ASK them because they do not say their name when they pick up... :( At least I am DONE WITH THEM FOR GOOD ! LOSERS!

FRAUD - I have never been late with a payment ever. I woke up 2/11/18 to a drop in my credit score of 46 points due to PORTFOLIO RECOVERY. This is a fraudulent attempt to collect on a non existent capital one charge. They asked for my name, they didn't even know it. They thought my name was Christopher and lived in a different state. I spoke with someone that said probably the social was entered wrong. This is going to be a big issue trying to remove. They have to send out a package and I have started dispute. HORRIBLE company.

No LEGITIMATE organization calls & asks for "YOUR BANKING INFORMATION." That is ALWAYS A SCAM. NEVER GIVE ANYONE, your personal or banking information over the phone. Today it's May 13, 2017; with the information age, these attempts to defraud people are far worse now, than ever before. NEVER give anyone, or any organization your personal or banking information over the phone, over the internet, or by mail. If you don't know them, it's more likely an attempt to "defraud you, " than a genuine claim against you.

I have a case in small claims court brought against me by Portfolio Recovery Associates LLC. At the trial earlier this week I asked the court to dismiss the complaint based on lack of evidence and PRA attorney said they did not know in advance that I would require documented verification of the debt and a witness with personal knowledge of the debt and the account it arises from, and if they had known I would come to court demanding that proof they would have brought it to court. Their attorney claimed that my failure to get this debt verified within 30 days of their initial contact with me means I have no legal right to ask for verification now.

What happened next was so appalling I still cannot believe it: The judge adjourned the hearing to a later date to give PRA more time to gather together proof of their claim. Their attorney stated the witness with personal knowledge of my account that I am asking them to produce will be an employee of Portfolio Recovery Associates. Seriously folks...it seems the good judge will accept that PRA employee as a witness with personal knowledge of my debt and the account that it arises from. Wow, just wow. PRA attorney has no shame, but that's to be expected with bottom feeders like debt buyers. The most unbelievable of all that transpired is the poor judge seems to not be aware of how this is supposed to work.

When the Judge asked me what I expected to see as proof I listed some important documentation that was missing in their evidence, things like an initial contract I allegedly signed, actual date a credit account was opened, itemized transactions over the life of the account including charges, payments, interest, penalties and other fees if any, to verify that there is actually a debt and for what amount. Without documented account history how can any of Portfolio Recovery's claims be verified?

Anyway... the judge asked PRA attorneys how much more time they needed to prove their case and they asked for 30 days. And surprise, surprise...they were awarded 30 days. Plus, they don't even have to appear for these small claims cases they file in my county--they just phone it in. Seriously, folks, the Defendant (me) was ordered to appear in person but the Plaintiff may continue to appear by the phone!

Portfolio Recovery Associates LLC, filed this legal action, then came to court unprepared to prove their allegations! The case should have been dismissed for lack of evidence. They brought nothing to court. Nothing. And the judge is a piece of work, too! His whole attitude was such that I got the impression he resented me for even appearing to contest this action because in my county, Portfolio Recovery Associates small claims actions are cranked out by the dozen, month in and month out. Debtors don't bother to show up because, well, I am a glaring example of what happens when one does! Neither the PRA attorneys and this county judge are used to having to work for anything...it's all done by default here...no one ever comes forward to challenge PRA here.

Until I came along. I gave them a run for their money. And I forced the judge to actually look at the evidence and not just assume the claim is valid. Judge actually has to do some work, and he is not happy about that

I realize now that I have a snowball's chance with the legal system here. Maybe PRA has this judge in their back pocket. Or maybe judge is ignorant of laws governing what constitutes proof in debt collections. Whatever is going on here, this judge did not even try to hide his partiality to the Plaintiff, PRA.

Portfolio Recovery will win yet another case, not because it has merit but because the judge has bent over backward to give them the benefit of all doubt.

And then I will file an appeal. I will take this before a new court and new judge, hopefully one that has a clue not only about federal collection laws but legal procedure mandating that this case should have been dismissed when Plaintiff appeared with no proof of their claims. In spite of all that has gone down here, I still have confidence that not all judges in my county court are obtuse. Or God forbid--corrupt?.

My question is how do you get them to stop.. I receive a bill from them stating that we owe such and such from Capital One.. when we had already paid them off.. So i wrote them back told them we paid this off.. They sent another letter stating i need to send them proof.. REALLY? this company calls from alot of different numbers.. i can't block them all.. but they have said that they BOUGHT these accounts and collect.. CAN THAT BE LEGALLY DONE? It is 2015 and I see these complaints going back as far 2008 if not sooner.. why hasn't anything been done to horrible company? I found a lot of helpful information on just reading the complaints. This is getting crazy PRA, Allied Interstate are ones that buy OLD DEBT or as I have been told is that they see debt from way back and decide to go after you for money.. this is why they are making money.. so many are giving into them. I will give in to them at all.. Thank You for your advice and help..

Best thing to do with these guys is to pick up the phone and put it on mute. Each time you do that it costs them a few dollars. Never talk to them or give them any information (they'll rip you to shreds), just answer and put them on mute. If enough people do this, it will no longer be profitable for them to stay in business. They make their money by robo-dialing thousands of people daily, hoping that one or two will pick up and they can sick a 15 dollar an hour employee on them.

I really think they are just a scam company
They sent me a bill for $2637, they claimed it was for a credit card in 1999. Tried to tell me i shouldnt let my debts go so long. So I tracked things down, the company they "bought" the debt from is out of business. The statement said it came from a bank that is out of business.
I called the bank that bought the first bank they have no idea where when or the amount of anything.
So I called Portfolio Recovery again and told them all this it took 15 mins of me talking to a supervisor to get them to open an investigation into the account.
They sent me a letter today saying the account is closed zero balance
This has happened before with the same company and my family. If you dispute it they do an "investigation" and a week later its gone
I did all the work tracked down the companies
If you notice every time they contact someone its a debt that at least 10 yrs old

PRA has called me several times, most of the time asking for someone named Latasha Brownlee who I don't know, and then proceeded to leave a detailed message regarding her personal information and all kinds of stuff. Then they called for me and said that they were trying to collect some information on a neighbor of mine and asked me to call back. I don't know Latasha Brownlee and I wouldn't give out any info on any of my neighbors anyway. In any case, like the other people on this forum, I never call back nor do I ever answer their phone calls. They call all day and all night and even on my cell. I don't know why and I don't care.

Portfolio Recovery Associates Shady, Sneaky, Watch Out!

I got a notice in the mail from this company to pay a debt that I knew nothing about and had never been contacted about before. I immediately sent them a dispute letter (always recommended) and asked them to provide specific information in writing about this debt as proof that I owe it. They replied with a lame response that gave me nothing I asked for except a "pay us or interest will continue to accrue." I have just sent yet another round-2 dispute letter, but not before I contacted my attorney which I informed them of in the letter should they not provide me with the specific info in writing that I originally requested and they continue to pursue this.
This bottom-feeder company and others like them pay anywhere from 1-3 cents on the dollar for their "accounts" and are ruthless in their attempts to get their $$ back. Just google "portfolio recovery associates complaints" (or any of your other favorite collection company names) and you'll see links and links to people's horrible experiences with them. Portfolio Recovery told one poor guy that he had papers "served" to him (unbeknownst to him at the time but later discovered, these papers were found tucked into the bushes on his front lawn)!
When you get a collection letter and you question it, be absolutely sure to respond. If you're supposed to appear in court, do so, since by not appearing, these guys are winning by default. So much so that the prez of Recovery Assoc. has since started other collection companies due to their intimidating success. Protect yourself and Don't let them get you - if you're not sure about the debt, speak up!

Portfolio Recovery Associates falsifying information

I'm no expert on credit collections activities but I'm certain that chaning information in order to ### the age of an account in order to continue to collect is against the law. They are trying to harass collections on an account from 1999. They are reporting it as a "medical" account, which I believe allows them to collect longer and they have changed the opening age of the account to 2004. They refuse to validate the account with any type of written information. Yet the account is always verified for the credit bureaus. HOW is that possible?

I also had a simular problem with this company. They changed the date of the account to last year (originally the date was 2005). Anyways, I would think that this is illegal. But these people are obviously dirty. The day after I spoke with him, trying to make arrangements to pay this debt, Very nicely by the way, this person
contacted transunion and added $7.00 to the account to create new activity. Does anyone know if I can dispute this?

Portfolio Recovery Associates Calling wrong person!

I just moved and have a new number. Apparently Portfolio Recovery (collections agency) is looking for someone with the same first initial and last name. Every night about the same time, after I have retired, they call. It is an automated message and says if I'm not "Chad" to disregard. It wakes me up and I get up for work at 2:00 A.M. so I go to bed very early. I have not been able to find the right person to make this stop. It is even on the weekends! Apparently some brilliant person thinks there is only one C. Wilson in Scottsdale, Arizona and it MUST be Chad. I cannot disconnect my phone as I have elderly parents that may call. My number is also unlisted. As with most collection agencies, it doesn't matter if it is a mistake, they will drive you absolutely NUTS! What do I have to do, pay off Chad's debts to be free of them? Move? Change my name?

Portfolio Recovery continues to file court papers against me on charges that were fraudulent from 2014. This issue was cleared up years ago, and now in 2022, they are at it again. I need this to stop.
