Pay Day Loans Breach of Contract

I have a pay day loan with Everest Cash the original fee was $75. which was cool...I was told by the customer service guy that I spoke to that their fee was only $75 that day if I accepted the loan of $500, that I could pay off the loan any time...So > > >
They sent me an email giving 3 different options, I took Option #3.. I wanted to pay the fee's $75 plus $125 towards the balance.
I checked my account on the the schedule due date and they only pulled $75, which was their fees..
I called Everest Customer Service and the Lady Laugh at me and said not only could they pull the $75 but they will be pulling $150 on the 1-25-13 and there's nothing I can do about it.
I just received another email that the amount due on Feb 8this $150 with a balance STILL of $500
I have called, emailed and even been on Chat which I have to conversation saved that this lady and I had that day...I told her to apply $200 towards the loan and asked her if I could pay it off the loan she told me that they are pulling $150 fees..which per the contract the fees were $75 and they all ready pull...on the 1-25-13 they pulled another $150...Help I don't know how to stop them..I called Chase and they Said that even if I do close my account and open another that by Law they have to let Pay Day L format.. just let me know the fax number ...Thanks

I was destitute for a few bucks during Christmas and went to them for a loan. At first, it seemed that it was a good plan. Then, I saw that the loan had tripled and I was paying nothing on the premium. Six payments of $600 went towards interest alone! I was so heartbroken as I do not like to make payments for a 30% daily interest on a loan. What a mistake to go there. Pay Day Loans are land sharks...they bite you in the end.

My Mother applied for a pay day loan and was denied the loan but the information was then forwarded to another company and was enrolled into ID THEFT and was charged 31.98 and the charge was never authorized. I contacted them and I received the run around and no refund was done. I have contacted my bank and have filed fraudulent charges.

I've been charged fees that i did not authorize. They said i authorized it online but in a phone conversation i told them that i did not. The representative said the fee is for a monthly service. I advised i did not want the service. She (Sarrah) said the service has been canceled but she would not refund my money. Now I am out of my money and they are not providing me with a service. They are just taking my money.

You took money out of my account without my permission and the bank charged me an overdraft fee on top of the $33.95 plus $35.00 and i need to be refunded my money immediately.

I went to look at my checking account and Theft Protect Service had taken money out of my checking account without my authorization!

My bank is not cooperating. They're telling me that because I went to the site and applied for a loan that it's legitimate and there's nothing they can do. Any suggestions?

Pay Day Loans Fraud

I saw the commercials starring Montel Williams for Money Mutual . Being a little short on cash, and my car broken down, I went to thier web site, and filled out an application. The application includes giving your bank account info and against my better judgement. However, I used an account I hardly ever use carring a very low balance. I began recieving as many as 50 approval e-mails a day. I opened one offer and saw that the interest rate was almost 900% APR and declined the offer, and began deleteing the e-mails. One company, SSM put $200.00 in the account at Third Federal Bank of Newtown PA with out my knowledge or approval. SSM then began to take $60.00 every other Friday until the account went negative. (4th attempt) Third Federal did not contact me about unusual activity but continued to pay the items tacking on 30 NSF until the account was 200 overdrawn. I was then contacted by the collection Dept of Third Federal, I explained I had no idea what was going on, and Promised to come into the bank the following week. Meeting with a Bank Rep, I was advised of who was withdrawling funds, and given the Contact info. I spoke to a woman at SSM who said that thier policy was that if you did not decline, then they assumed you accepted the loan. She dais that if I never used the money, then perhaps a lender could reverse all the transactions. I called back several times and each time that rep was unavailble and was the only one who could help me.
In the mean time, even though I had filed fraud documents in a Third Federal branch, I recieved a letter signed by Ronald Keck VP of Collection treateniing to do several negative thing that included; Filing a report with the credit bureas, the IRS (unearned income) and contacting the Police. I did finnally pay off the bank total loss to me was $195...

Pay Day Loans harrassment

I received a call claiming if i didnt return their call they were going to take me court, i ignored it for a while until they called my mother in law telling her that i owed them money, i was wondering how in the world they know
that i always used her as a reference, they new my social security number how do they find out all this stuff, i knoew something was up because when you get cash advances they all ways deduct the money you owe them from your account, you dont get no money until they are sure you can pay them back i admitt getting payday loans but i never used them, i have two that i always use and that all. They called from [protected], the person would not give me no information as a matter of fact they were very rude and hung up on me, the only way i found out who it was i had to call back later and asked.

Pay Day Loans Scams

One of my employees took out a pay day loan, which she repaid over a year ago. Numerous people have been calling her at home, on her cell and now at my business to terrorize her. "Ryan", "Ryan Jewels", and "Michael Stevens" are all Eastern Indians claiming that she owes them $1000 and that she must authorize a charge on her credit card for that amount or she will receive a summons tomorrow at 11:00 am and she will be arrested. They called over 35 times using extreme profanity. When we would hang up, they would call back and just say things like, "F*ck You", "You are a two-bit [censored], " etc When I confronted them on the phone about their scam, they called my business repeatedly and only yelled their profane comments.
I searched their phone number, it is landline located in Southern CA, in the area of Beverly Hills and West Hollywood. It is [protected]

Pay Day Loans Harassing Phone Calls

Wow! These people Jason Smith and William Dean started calling my boyfriend telling him that I was going to be locked up for 2nd degree check fruad and it was a felony and they were working on behalf of cash n Go. Well I did get a payday loan but i remebered paying it so i said before I pay them let me check the internet and sure enough the were scams they were not lawyers at all but a collection agency what the heck I went to cash n go and paid the moeny I owed them no problem, I told the man they could have just called. Any way if you get a call from these nuts be polite and tell the that you will deal with the PDL lender directly. The world we live in I tell you.

How about ANGIE smith? She called my home at 5:15pm to let me know that if I did not contest, then that was considered to be waiving rights to attorney etc. and to be put on the "docket for 9 am (tomorrow!) I was supposed to work till 9pm but came home early, to her alarmingly hostile vioce mail. I returned the cal to said law office only to be hung up on twice. Once by the receptionist and once by the EVER SO CHARMING Angie Smith (IF that IS her name). This person attempted to quote details of my payment arrangement with my payday loan company...but they were incorrect. (So if I agreed to make payment arrangements...why are you calling me?) She quoted these details and then in the same exact sentence said they were irrelevant. To that I replaed "If they are irrelevant..WHY are you speaking of it?" THIS really got under her skin; she lost her cool and within 60 seconds had hung up on me. Now THAT is professionalism it its FINEST.
To said LAW FIRM...you CAN reply to this with your chaming legal terminology and legal jargon...but nothing beats the reaction I got from her...THAT says a millions words. I care not about any reply this said "law office" tries to come back with. And THAT really is funny...to watch them get their panties in a bunch...really? Why so offended? If you walk tall then you really shouldn't worry about what us poor (non-bill paying people) think or write about you.

JONNA Wilson...not JOANNA, JONNA! If you want my money...you could AT LEAST pronounce my name correctly. BUt why would YOU bother...I was a POS in YOUR mind before you even dialed. Anybody ever told you that you get more flies with honey than you do with YOUR attitude?

I also received a phone call for these people, I immediately knew they were full of it when they told me that they were gonna have people coming to my house, my job, my family members homes to locate me and arrest me for writing a worthless check. Now granted I do owe a debt for a payday loan, but they never told me the correct amount and the right company that I borrowed from. These people have taking collection to a whole new and illegal method. My wife is a bill collector and she spotting this illegal activity out as soon as she heard the voice mail they left. Do not send this people a damn dime and do not be frighten by them. No one could be locked up for not paying a debt. If that were the cause the jails would be over-flowing with people that don't or can't pay their debts. They also said that they had got my bank statements, now you know they can't do that, only a judge can order that for a case in court. BOTTOM LINE THESE PEOPLE NEED TO BE ARRESTED FOR IMPERSONATION AND REPRESENTATION OF A LAWYER'S OFFICE WITH NO BAR LICENSE ON FILE. Take this advise from an ex-police officer of the law. Thanks.

I received a phone call today at work from an attorney's office. First of all I could hardly understand this person because the accent was so strong. When I said I didn't understand the company's name, they transferred me to a "junior attorney" Once again I couldnt understand them so they transferred me to their "lead attorney" LOL Anyway when the "lead attorney" got on the phone I asked him to spell the company name which I have at work. I then interrupted him again and asked where are you located? He stated California and proceeded to tell me I had serious felony charges pending... So, I interrupted him again and asked for the physical address of the company and their phone number, they hung up on me and never called back. Too funny just dont fall for their scare tactics. They may call me again tomorrow, but that's okay I will just keep asking them questiions till they get mad and hang up.

I recieved phone calls of the same nature and I never even took out a pay day loan. I applied for one and was denied! These people are trying to extort money from people who don't understand their rights. Even if you owe money to collection agencies or pay day loans, no one can arrest you for not paying them. I even had a police officer come to my house and tell me that. The officer told me to just ignore the phone calls. Hopefully these people can be stopped if enough people complain!

i recieved a call from Angie Smith on 6-14-10, stating she was from a Sherrif's office, I called back and found out it was from a corperate office affiliated with Smith Dean, she then called my home and told my 13 yr old that if she didnt speak with me that she was going to have the police to come and arrest me. She called my job and stated that she will have my a-- locked up, when I asked for a supervisor she hung up on me, I called back to only be yelled at and hung up on.

Smith, Dean and Associates called to collect on not even my debt but a family members, being that its not my debt and none of my business I explained that person did not live there, but was a family member and to please not call my home anymore. A gentleman named Jason James began to make threats againest my family member and preceeded to tell me thier business. i explained once again the person did not lived there, and they threated to press charges againest me for aid and abetting in a felony case. I mean really tell your ###ic people to at least get a general knowledge of the law before trying to threaten and scare people. The only thing that scared me was what and idiot this guy was and it will be a joy to write an formal report for the court to help those who will be in no doubt sueing you in the near furture. Oh and by the way I also took it upon my self to call federal trade commission and will be alerting news. Perhaps a shining light on smith dean and associates from 9 on your side, will give them a deserved kick in the rear.

My employee from my workplace received a call from David Baker and when calling the number back the company name was AMS. When searching the internet for information if there were any complaints against this agency I came across David Baker's name being affiliated with several different collection agencies with similiar complaints. I was just curious about this since I can't imagine there is a David Baker who works for every collection agency dealing with payday loans.

Also, I never refused to pay anything. There was a mixup with my insurance company, and with a doctor who turned my unpaid account over to Smith, Dean & Associates.

I never recieved a copy of the original bill. I was unaware of any outstanding debts for this doctor's office, so why should I be treated like an animal?

The FDCPA is here for a reason, and that is to protect debtors from unlawful collection acts, such as the tactics used by Smith, Dean & Associates.

The bottom line is that you should pay your bills before you have to deal with the likes of Smith, Dean & Associates.

Smith, Dean & Associates can also call debtors and tell them lies, such as "we are not a collection agency, we are a law office". "We are going to send a Jacksonville Sheriff's Officer to your home or work and serve you with a claim to garnish your wages."

Well, which Florida Bar-approved attorney does your company represent? I found ZERO on the Florida Bar website. It's public information.

Smith, Dean & Associates brow-beats debtors and use scare tactics and other very unethical collection methods. They are famous for misrepresentation, unwarranted and illegal threats, and other FDCPA-violating methods.

There are a lot of bad comments about Smith, Dean & Associates, because Smith, Dean & Associates is a bad company.

They threatened to garnish my wages if I did not pay a bill in full by a specified date and time. I say, bring on the garnished wages. I'd love to see you work your way through the legal system, when you do not actually own the debt in which you are attempting to collect.

Learn the laws, follow the laws, and you won't have to defend yourself against angry consumers on the internet.
