MORTAGE LOAN / false forclosure
4 1/2 years ago wells fargo raised my escro and did not send me a statement. i was still making the same payment. my loan is a va loan and is required to have a statement when the escro is changed. when i found out i got a lawer and had him contact wells fargo.when he tried to contact wells fargo they informed him they had sold the loan to aurora.(very suspect since the va is how i found out?)aurora has refused payment for 4 1/2 years with one exception which they cashed.
I dont know if they applied it to the loan or not i have been paying taxes and insurance since then. aurora had filed for forclosure and went through 3 lawers.
i had thought i would get to court this year but aurora dropped the suit. they still have not cashed the checks sent them. and have not contacted me since they dropped the suit. Both the VA and HUD state that the escrow cannot be raised without a statement to the buyer. clearly federal law is being violated by these lenders. Aurora i am sure will want all kinds of penalties that they do not deserve since it is them who refused payment.
