Morgan Pottinger McGarvey refund

This law firm is absolutely the worst to deal with on any matter. I was having an automatic withdrawal from my account to pay a debt the debt was paid in september in full, I phone the company they stated they would stop the automatic drafts. One month later they were continuing to withdraw money when i called the company back, the representative told me he had not had time to stop the payments. I had overpaid morgan & pottinger by $300.00 the first person i talked to stated i would be sent a refund in 10 days, then it was 15 days, then 20-25 days, last word i got was 29 days. These people are ridiculous, i should have called everyday just to make sure they did their job...

Morgan Pottinger McGarvey Garnishment

This company is fraudulant and ruthless. You can not even speak to them. You try to have a coversation with them and with them, it's their way or no way. I called to speak to them about a garnishment they had placed on my check, for 25% of my paycheck each payperiod. I had no clue what the debt was. When I contacted them, they were VERY RUDE, to say the least. Finally, I was told that it was a debt that pertained to a credit card from 2001. (9 years ago) In Ky the Statute of Limitations on a credit card debt is 5 years. I mentioned that to the guy I was speaking with and he immediatley told me he did not care. That they were garnishing my wages and if I had a problem with it, Get a Lawyer. My main problem with this issue is that I was never notified of a court hearing or process to dispute the debt or anything. One day I get a notice in the mail telling me that my wages are going to be garnished and if I had any questions contact the Company. I tried that. They are not willing to work with anyone on unresolved debt. My only choice now is to file bankruptcy. I am a single working mother who lives check to check now. I can't afford to have an additional 25% of my check taken away. These people are vultures and have no sympathy for working people. My intention when calling them was to work out some type of payment plan with them. Now, I will file bankruptcy and they won't get a penny!

Morgan Pottinger McGarvey Harrasement

This law-firm continually calls my business phone and threatens lawsuits and worse for a debt that is not mine to begin with. They are also barking up the wrong tree because I am not a resident of KY, or any of the states they practice it. I have already went thru hell with the credit bureau's and now 4 years later these yahoo's show up and demand money. I have written, and sent a certified letter to them to stop, and it did, for 6 months. Now they are back again. I am not going to give them my SS over the phone so they can look up the correct debtor. These guys are a Rouge law-firm and need to be shut down. FYI the debt is way out of the statute of limitations.

They use to call me non stop about a yrand a half ago and even came to my parents house to serve me!Im confused because i feel like iots a scam but am feared my wages will be garnished. any suggestions on how to stop these dummies!

Morgan Pottinger McGarvey Collections Practices

In 2002-03 I had a credit card with Capital One with a $500 limit. Due to a discrepancy I stopped paying on the account in Jan 2004 where my last statement showed a balance of $350 -- all late fees, member fees and interest. In 2007 collection attorneys Morgan & Pottinger bought or were retained to collect my credit card debt which had climbed to $980. M&P filed a judgement against me to collect via garnishment. So called reasonable fees were added in the amount of $980 interest and over $700 in additinal interest charges. My wages were garnished (I had just been promoted) and it lead to losing my job in Dec. 2007. I also had to quit school where I attended evenings to take a 2nd job (and I've never been able to return to school). The total garnishment for 4 months was over $1600. In April 2007 my checking account at Republic Bank was garnished when I deposited $400 to cover my car payment of $390. The ACH debit was covered BUT I also got a letter from the bank stating that the $400 was garnished ($100 for the bank fee, $300 to M&P). In addition I deposited $225 on the following day when I realized my account was overdrawn. Too late though because 6 checks I wrote were returned insufficient funds (all small amounts such as $15, $25, $26). My overdraft protection was terminated Feb. 26 so in essence the bank used the same funds twice. That is the $400 deposit was used to pay my car payment (which I authorized to Toyota Fincl Svcs on 4/14). On 4/17 a letter was sent to me from Republic stating the garnishment would be paid on 4/30. I contacted the bank who would not release the funds without a fax from a court. After that my account with fees with overdrawn $743. I believe that Republic Bank used the same funds twice -- how is this legal? In September 08 I made arrangements to pay Adjustment Bureau LLC a downpayment of $300 toward the bank debt and $75 per month. In all I paid this collector $475. In January 08 I lost my job and was unable to continue the payments. I was ready to renegotiate a payment plan in March 08 but when I got a letter from Morgan & Pottinger stating "we've been retained by Republic Bank to collect your debt" I realized that Adjustment Bureau, who I'd been paying for the overdrawn account, and M&P have the exact same address. Their letters, including format, font, are identical. I then called Adjustment Bureau and the collector denied they are related. "We're in the same building but on different floors." she told me. I believe this is a scam and intend to pursue this further. I'm intersted in a class action suit if any are out there. My research also indicates that Republic Bank is also affiliated with Morgan & Pottinger. I believe that as a customer of that bank I was due some loyalty -- instead they basically stole from me and now are further penalizing me by overdrawing my checking account. In all the original debt of $350 to Capital One has ballooned into a huge and never ending amount. It has also caused tragedy in my life including job loss, check cashing fees, loss of income, loss of medical benefits, loss of future 401K, loss of SS benefits, relationship problems, health issues, a car reposession, and more. In all the monetary cost to me has been loss of future earnings and expenses in the amount of over $500, 000, possibly closer to 1 million. In addition the credit score it has left me will cost me a fortune in interest. All this over a disputed $350. Morgan & Pottinger: Your company has no scruples, your tactics are predatory and you cause great harm to good people. While you drive around in fancy cars, living in a great home, you are doing so by driving others to bankruptcy and worse.

They are definitely trying to take me to court over a debt for a stolen credit card. I responded when they sent me a letter about the card 6 years later, I responded within the 30 day limit. They never have taken a moment to prove this is mine, merely threatening my with court and saying, "This IS your debt". They have sent a sheriff to my home twice, filed suit against me and left a "service notice" in my screen door NOT delivered to me by a sheriff. This does not count as service. They also merely sent one by mail, not certified or anything. Again NOT service.

They continue to try to get me to settle a debt that they refuse to tell me anything about, except that a Verizon phone was purchased on the card in 2006. The area that I live in doesn't even have Verizon service! I try to talk to them about this and all they do is threaten court action. I am VERY interested in a class action lawsuit against this firm.

I agree they are ###. I am currently in dispute with them over a payment plan I set up to pay off my debt. I pay $100 a month and have done so for about 6 months now. I have always paid on time and have no incident until now. I mailed my payment on 3/23/09 for the payment due on 3/30. They claim they never received the payment and the check has not been cashed. I assume there is a mix up with the postal service and the check has not arrived. I received a letter dated 3/31/09, ONE day after my due date, stating they had not received my payment and would begin the garnishment process. I received the letter on 4/7/09 and called them immediately. I left a message with my account manager, who never returned my call. I called today, 4/9/09 and spoke with the account manager, Terry. I was told that I could stop payment on the check, costing me $32, because they cannot guarantee if they receive the check that they won't cash it...this is despite my asking them not to cash the check if they receive it and offering to pay the $100 payment over the phone today. I asked to speak to his manager and was basically told the same thing. I was very upset over this and I am sure my attitude on the phone showed it. I don't blame them for the check not getting there, but I do feel they should have a way to set up a notification alert in their system for instances like this. In addition, my ill feelings towards this company were further made worse based on the letter I received yesterday (dated 4/3/09) notifying me they had already started the garnishment process. They don't even give a person time to respond! I asked the lady how was I suppose to help solve the situation if they don't give someone time to do anything about it?!?! In the garnishment letter, there is approximately $150 in extra charges added to the balance plus a $10 probable court fee. It's apparent this place tries to find ways to make money off of people who are attempting to make good on their debt. I filed a complaint against them with Better Business Bureau today. We'll see what happens...

Morgan Pottinger McGarvey Scam

This company procured Morgan and Pottinger of Louisville, Kentucky to draft a lawsuit against me for an account I have absolutely no clue as to what is going on. I contacted the lawyer's office and no return calls except for a lady named Cindy and not even her. So far, nobody is talking. Neither this office nor palisades. With no working # and no contact us. Something is fishy and perhaps the lawyer's office may be being scammed as well. The name of the agency doesn't mean squat if the company they are representing is not listed with it. The consumer doesn't have to have a high-faulting degree in finance to know that they do have the right to know who is contacting the collection agency in the first place. I have never heard of palisades collections and they do not appear on any of the bills of the companies I am dealing with period. this company needs to be reported to whatever governing agency oversees collection agencies, attorney general's office or whoever. Besides, do the employees of this agency keep up on their bills too?

I just read Morgan and Pottinger / Garvey filed bankruptcy this past February. Irony? Lol They held on a lot longer than I originally thought but if you refer to my first post about them going under back in 2014, I saw that coming before they decided to merge with McGarvey. I sure am glad I left that place when I did. A company that bashed bankruptcy laws and talked poorly of those who filed for it... Good thing they got to use those sames laws so their personal assets weren't affected...

Morgan Pottinger & Fenton McGarvey are tied together they also just dropped another name. Corrupted attorneys had an ambiguous debt laws put in place (none like it in any other state and if went to Supreme court would be struck down) to help them with criminal endeavors there were other states that had corrupt laws(not exactly alike( the DAKOTAs and were sued. Here is the kicker. Some of the same shady lawyers that were names in the debt collection rackateering (sic) suit now work for Morgan+P and Fenton MCGarvey. So yes they can be sued also Morgan Mcgarvey is a state senator in KY and works for Morgan Pottinger.

Morgan and Pottinger filed a lawsuit against me and received a judgement for a credit that I had defaulted on in 2008. I had lost my job and was employed but barely making enough to pay my electric bill let alone anything else. In 2012 I finally found a job making a decent wage and almost as soon as I did Morgan and Pottinger filed suit. I knew that I owed the money so I called and set up a payment arrangement even gave them my checking info, I never had any issues with them. I early 2014 I received a settlement from my fathers estate and I called them to pay off the account, they sent me a paid in full letter. I thought it was over. NOT! Now here we are in 2015 and I am attempting to refinance my mortgage well it seems as if it just slipped their mind that they needed to send a letter of satisfaction to the court in my county. So after many calls and being lied to over and over the attorney for the mortgage broker I am working with called to see what the issue was. The rep stated that the letter had been sent to the court on 4/23/2015... NOT! The letter was sent to one of their attorneys in my state and he would sign and send the letter to the court in 30 maybe 60 days. Well the bank is not going to wait 30 or 60 days to close on my mortgage. I lived up to my end and paid the debt, now they need to expedite the process after 14 months and clean up their part of the mess. I have filed a complaint with CFPB, FDCPA and the states attorneys office. MORGAN AND POTTINGER do your due diligence and resolve this issue. LIARS, LIARS LIARS!

Avoid service if you're in KY. They can not sue you if they can't serve you. Also most payments made extend the statue on some debts so if you haven't paid on a debt for years and you've not been served DO NOT start a payment arrangement because that can restart your statue of limitations. Also don't do an agreed judgment just go to court if you were served and they most likely won't get a default judgment because you appeared. Odds are the company won't be around much longer anyway. The company itself is in more debt then any of the people they're trying to sue on. I've never in my life seen a company ran so horribly by so many ###s. The CFO, Mike Wise, is truly running that place in the ground by some ill minded dream that they will grow the ESOP by purchasing all these companies that are going under or doing bad already. They are an ESOP but if you're not in with the big wigs who decide everything about the company, you're screwed and not valued at all. Just in the past few months a select group of management was promoted to other management roles with ridiculous titles and of course given hefty raises while the employees that do make the company money get screwed out of bonuses and raises. So my take on all this is that the big wigs are aware they screwed up with their investment choices and they're gonna make sure they get as much out of the company for their selves before it completely goes under. They won't even hire enough staff to get things done correctly. Right after a huge Audit with Bank of America, they let go a bunch of employees. Good employees at that! Their bad decisions will catch up soon enough but the real people that suffer from the poor decisions they make unfortunately hurt the real working employees that were just doing their jobs.

Morgan and Pottinger. Do you think that you will do this to a Veteran? I would check the laws if I were you. There have been many Lawsuits that people have lost to Soldiers recently. JP Morgan just lost a five million dollar Law suite.

Wow. Where do we begin. We were a few days late on rent. We paid the rent and fees. Received a verbal conformation that the rent and all connected late fees were rendered. Good to go. Notified 10FootCeling ETown LLC that we will move out in 30 days. No problems. 5 days after the 30 day noticed had elapsed and we had moved, we received a notice that we owe Morgan & Pottinger rent that was past due, and that we should not send the payment to 10FootCeling ETown LLC. We needed to pay them directly. The First class letter was not addressed to us. It said "Tenant" on the envelope and SIR/Madam on the letter. It also stated that we were current tenants. In the meantime, 10FootCeling ETown LLC denied us access to the payment history on the website. It also said that any current or past due rent payments must be paid to these people. In my opinion, the letter address as tenant was done so the Postal carrier would not forward this letter in order to void us of any carnal knowledge of this. We were not tenants at the time the letter was sent. Really. We will have JAG look into making sure these business get added to the "blacklist" so Soldiers will not get scammed by these people. I have conferred with several Soldiers that have informed me that they tried this exact (or a little different) tactic on Soldiers and CIV in order to try to extort money from them. They will have some pretty high authorities to answer to. I hope their business can survive without Military tenants. I'm thinking that we can get together and sue these crooks.

student loan proceeds are exempt from garnishment . see Schaerrer v. Westman Com'n Co., 769 P.2d 1058, 1063 (Colo. 1989) ("Our examination of the federal statutory scheme reveals that Congress, by carefully circumscribing the use of garnishment to collect on defaulted student loans and prohibiting garnishment of funds in the Secretary's control, did not intend to allow free and unrestricted use of state garnishment procedures to attach the proceeds of a GSL").

you should be able to successfully set aside any garnishment order that affects student loans

This company is a fraud, they are not representing Capital One or any other company. If you call the creditor in which you had an account with you will find out that Morgan & Pottinger are not working for them. It's time we all fight back, I have filed a lawsuit against them for the money they took from me, overdraft fee's, harrassment, and suffering. I suggest everyone tries to fight back.
