Mel Harris and Associates obtained a default judgement against me for an alleged debt that I was never informed about until my bank account was frozen. They blatantly falsified documents and claimed I was served papers at my home with a ridiculous description of the "recipient" that couldn't be an further from a description of me or any of my family members (who can verify their presence at my home that day). The judgement was vacated and I am going to court next week to fight their allegations. It has been 5 months since this ordeal has begun and they have yet to verify the alleged debt...instead they try to bully me into giving them information. There is a class action against them in California and something NEEDS to be done in NY. These people are crooks and need to be stopped, why has the government not stepped in??!!

    Well I know that I owe the $$$ that their claiming. But I never got a summons and they froze both my accounts with out letting me know. Bc I know I owe the $$ I've decided to pay them.

    I suspect it is too late for you, alas!, but for anyone else in a similar situation, I strongly recommend that you NEVER settle with these predators. Unless you are being sued by the original creditor, my advice is to go to court, stand up to these people, disavow any knowledge of their client (which in most cases will be easy to do honestly, since the client will be a third-party paper buyer, perhaps a fictional entity owned by the law firm itself, that purchased the putative obligation - or something that passes for such - for anywhere from 0.8 to 3.8 cents on the dollar, depending on how old it is). If they ARE representing the original creditor, let the matter go before a judge or court mediator -- you will probably get a better settlement. I know from experience that Mel S. Harris will readily back down if you refuse to settle. I've been sued by them twice. The first time I settled with them -- I didn't know any better then. The second time I refused to settle without seeing a bill of sale that would establish that their client actually owned the debt. Needless to say, no such document was forthcoming, and they elected to abandon the action. I've repeated this experience with other law firms in similar matters. The paper buyers have no real standing. And Mel S. Harris is one of five or six law firms that flood the New York City courts with hundreds of thousands of these suits every year. They use the litigation process (1) primarily to collect default judgments -- very few defendants appear in response to a summons -- and (2) as a means of psycho-terror by which to extort money from the ignorant. Don't let it happen to you! Be humble, play dumb, but be firm! And don't let yourself be intimidated.

    i am in the same situation with you Nesha...but like Will says, i should've never settled with them...
    I never received any documentation from this, as they claim, and never received a summons, i just found out about what they were doing after they froze my account.
    I learned about my mistake because afte everything happened, i know i would've felt more confortable dealing with my creditor, not with this Mel Harris people...I hope it doesn't happen to me again, but if it does, now i know what to do...
    Even when I when to my bank to resolve the matter, they told me...in my bank, how they know the Mel S Harris were nothing but a bunch of sons of *******.

    I AM IN THE PROCESS OF DEALING WITH THIS COMPANY I CALLED THE NUMBER 212-571-1004 AND WAS TREATED LIKE DIRT BY MRS. TAYLOR AND SHE HUNG UP ON ME AFTER ASKING WHAT THIS SUMMONS IS ABOUT IS THERE A MEL S. HARRIS OR IS A FAKE COMPANY???? I CONTACTED THE NEW YORK STATE ATTORNERY GENERAL, IF THERE ARE ENOUGH COMPLAINTS MAYBE SOMETHING WILL BE DONE!!!

    Reading these comments finally makes me feel like there is hope!!! My story is the exact same as everyone elses-fake summons, missed court date that I didn't know existed, frozen bank account, etc... I was a sucker and tried to settle-I'm honest, I owed it. Yesterday I recieved in the mail a bill from them for $258 saying I didn't pay my monthly settlement amount. I knew something wasn't right, I consulted my past bank statements and it states that they did take out the money every month. This is unreal and out of hand, these people are not getting any more of my money. I just emptied my bank account, so when the freeze it again all they'll get is $9.

    How do you handle the situation if the debt is not yours and they already started taking the money out of your paycheck... but I repeat.. THE DEBT IS NOT MINE... someone else with the same name.

    I totally agree with you all! My accounts were frozen because Mel Harris & Co swear I owe $3800 in credit card bills, when in fact it's way less than half of that. What can I do to get this taken care of? What have you guys done? Is anyone reporting this to the US Attorney General? What about the government in general??

    While deployed my accounts where all frozen, and when I told that I was away they I was told I must fax them paper while in a combats zone of a payment agreement .when I explained we did not have access to a fax they said to email them an agreement
