McCafferty Ford Sales Inc. / Poor service!
In July 2002, I purchased a 2002 Ford Escape from McCafferty Auto Sales Inc, in PA. I paid the dealer using my credit card and also traded in my 96 Honda Odyssey (over 96000 miles). At the time of transaction, I did not carry the Honda Odyssey title with me since I was just looking for a new car and was not planned to buy one that day. After all kind of promise and entice by the McCafferty salesman, I agreed to trade in my 96 Honda Odyssey and buy a Ford Escape from the dealer. In case I might change my mind, the dealer insisted that left my 96 Honda Odyssey together with all the documents (registration, insurance etc) in the car and drove the Ford Escape home. The McCafferty salesman also promised me that it is perfectly ok for them if I could just bring in the Honda Odyssey title any time which is convenient to me. But when I got home, I searched everywhere and realized that the Honda Odyssey title have been lost. I called the dealer the second day and told them the Honda Odyssey title was lost, and was told by the McCafferty salesman to get a duplicate title in my spare time. I then went to the PA moto vehicle office in Langhorne in the following Saturday, but was told that they cannot issue me a duplicate title without the registration card, insurance card etc. I called the dealer and asked them for help because all those documents were left in the car at the trade in time. The McCafferty customer service lady forwarded me to different departments and none of them was interested to gave me the required assistant in fetching the document left in the traded-in Honda Odyssey. After about 2 months, I was finally being connected to the manager in McCafferty trade-in car sales dept, but was told my Honda Odyssey had been shipped to another state for sale. The manager told me that even he could not locate the Honda Odyssey at the time. He also told me specifically not to worry because he can get the duplicate title with all my signed trade-in documents. Several months after I met the trade-in department manager in McCafferty, I start receiving phone calls from other departments in McCafferty asking for the 96 Honda Odyssey title again. I explained them all my experience regarding the title and asked them to do something in their side to resolve the issue.
But none of them get back to me with the proper solution. 9 months after I traded in the Honda, I was finally put through with one guy in McCafferty, who managed to send me some forms for me to sign to get the duplicate title. I signed, dated, and personally send the signed forms to the guy within a few days I received the forms.
On the day I purchase the Ford Escape and traded in my Honda, both I and the dealer signed to complete the transaction. It is the dealer who ignored the possibility that the title may be lost. I myself have no knowledge that the title could be lost. Considering the dealer was in this business for years and have been handling numerous of sales and trade-ins, they should be responsible for any consequences of taking a trade-in car without receiving the title.
It is the massy internal management and poor communication among people in McCafferty caused the delay to obtain the duplicate title. If they have sent me the forms in obtaining the duplicate title at the time I informed the Honda Odyssey was lost, they would have received the title much earlier.
The dealer should not ship the trade-in car to another state for sale without a title. If they have had the car in their location, I would have obtained the dup title much earlier as the document required to get the dup title was left in the car.
As individual consumer, I am actually the one being suffered by running around to obtain the duplicate title because their poor business management and improper business handling.
Based on all the information in kbb.com, the 96 Honda Odyssey, which at the time worth less than $5800.0 would only, depreciated less that $500 in 10 months instead of $2400.0 as the dealer claimed. Being able to afford an attorney as a financial much stronger company does not grant them the title and privilege to claim whatever financial damage they want to take from poor individual consumer. Plus it is not even my, the consumer’s fault to cause the delay for them get the duplicate title.
The dealer had never provided me any document regarding when they actually sold the Honda Odyssey, how much they sold it, who they sold it. Without those evidences, it is totally irrelevant and unfair for them to come out any claim amount and ask the money from the consumer who has already suffered just too much in this matter.
By May 23, 2003 McCafferty Ford Sales Inc has received all the documents to obtain the Honda Odyssey replicate title. McCafferty Ford Sales Inc also had shipped the 96 Honda Odyssey to another state other than PA for sale over 8 months before May 23, 2003. The fact that they filed lawsuit at May 23, 2003, the time they have already received all the documents for the duplicate title, is a total disrespect of the proper business legal transaction process. No doubt, their purpose of such lawsuit against consumer is just an attempt to blame all their poor business performance to their consumer.
