MagicJack it works, but...

Ok gang - I have had one problem with my Magic Jack and it was a issue with voice mail. One message and if anyone else called me - they got a mailbox full recording.

Now - on to customer service, and I will be brutally honest here - the online support was effective for me. That being said, here is my advice to buying a Magic Jack.

I too saw the infomercial. The first thing I did was google them. I can't believe that with all the people complaining here that they did not see the issues with credit card charges and take the retail route.
Best Buy carries it. Buy it from the store and you will have no suprise charges.

There have been some tech issues with the device. This is a mass produced device that is subject to a MFG
flaw now and then. AGAIN - buy at retail. If it does not work, bring it back to retail. If they don't replace it,
call your bank and cancel the transaction.

Back to customer service - folks you have purchased a device that retails for 40$ off the store shelf and includes a year of phone service inclusive of long distance, voice mail, caller ID, 3 way calling. Heck, I was suprised to find out after using call waiting that when I picked back up on my first call my friend said he was treated to music on hold! My phone bill thru Cox Cable in Oklahoma was 40$ a MONTH and DID NOT include those features. I think you need to be realistic in your expectations. For a $20 a year dial tone dont expect to be able to reach out and touch someone each time you have a question. LOOK at the website. LOOK at the materials provided. AFTER you have looked - THEN open a chat with a rep and be nice. Don't spend 10 minutes telling them about how "you feel" about the problem. Give them the specific tech problem that you have and follow the instructions. If you decide that you want to challenge the questions, end the conversation with the rep and figure it out on your own. I do tech support for a living (NOT Magic Jack) and I assure you there is nothing more fustrating than dealing with a customer who has a problem and won't follow the troubleshooting steps because they have decided the the suggested solution wont help them. If you are going to be that hard headed,
get string and a couple of dixie cups and have at it. Nuff said!

If computers scare you, if you don't like reading instructions, or if it is your preference to have someone "walk you thru" instead of reading the owners manual, then don't buy a magic jack. It's not for you.

I purchased one for two reasons - 1st - my landline was way too expensive for no features. 2nd - I wanted a i-phone from at&t and they insisted that I buy a $40 a month media package to have it. All I wanted was a MP3 player that was a telephone and I pay a ton for broadband at home. So I cancelled one at&t cell (my wife keeps her's) and my cox line. I saved $55 a month.

If you want to buy a Magic Jack I will offer you this simple check list. Make sure you have the following or you will have problems:

1 . High Speed Internet - Cable preferred - DSL will work but it has to be very fast. You will normally have to keep your dialtone so consider Magic Jack to be a solution for a second line or unlimited long distance .

2. A good PC with available ram. My magic jack is connected to a older laptop connected to the modem with a ethernet cable that is basically only used for the Magic Jack. It has less than 1 GB of RAM and If I surf on it while I use the phone my calls get choppy. That's not Magic Jacks fault, it's my computer. I WOULD NOT reccomend using a magic jack on a PC that has a wireless connection. It will be more likely to have problems.

3. Your computer must have a POWERED USB port. It will not work with a hub. Look in the owners manual for your PC and make sure your computer has this. If not - your Magic Jack WILL NOT work.

4. A backup power supply for your PC is not necessary - but helpful (if it's not a laptop). Make sure if you get a backup power source if you are using a cordless phone that it is also connected so that if you lose electric you still have a dial tone. A cordless phone can also have issues, so before you contact the magic jack crew with a problem make sure you've tried a regular phone and have the same problem.

5. A cell phone. Folks it is an electronic device. It can fail. Have a plan B. Even if I had to replace the USB device every year - I would still save a ton of money!

I don't work for Magic Jack. I'm just a dad that has figured out a way to save enough money to help pay for other things. I hope this helps. God Bless you!

I have worked in the computer industry all my life. The "Magic Jack" seemed, well, magic to be able to offer all of these services for about $20 a year. After reading the NEGATIVE reviews, I was skeptical, but after reading THIS particular review (thanks, Chris), I'm going over to Radio Shack and buying one tomorrow to test. Hey, at $20, that's just a round of drinks with me mates.

Bottom line is that 80% of the people on this planet are nill on real computer skills, and that is a shame, as computers are the future.

I'll try a Magic Jack and report in the future what MY findings are. By the way, I am NOT replacing current COX phone or Verizon Cell Phone at this point, and I do not recommend anyone doing the same. Try it out IN PARALLEL with your current service before pulling the plugs on your existing phone sevice. Enough said.

MagicJack Unauthorized charges

Had had good reports on Majic Jack product from friends. An E-mail from that company recently appeared in my E-mail box. Opened the link to and read it. It offered a years service for $19.95. Sounded good.

Started the order process, which of course required my Credit Card data. I provided it. Then I discovered that the cost was now $39.99. Oops! Had to be a mistake so i went back through the same process with the same result. At no time did I confirm the order with any type of final authorization.

I thought it would be nice to call this company to be sure that I would not be billed. Could find no E-mail address, phone number, or physical address. Did discover today the you can IM with their customer service.

Today, to my surprise I received an E-mail informing me that I had a confirmation order number and that it was being delivered via UPS. (in other words - already shipped). Immediately tried to 'reply' from Yahoo. They must have fixed that as I kept getting a message about 'formatting problem on the Majic Jack address.' Then called my credit card company and was informed that I had a 'pending' charge in excess of $93.00 from Majic Jack. Getting serious now!

Managed to get 2 phone numbers which I will share-[protected] and [protected]. The latter gets you to billing. After a 5-10 minute hold I was informed by a recorded message that I was number 5 in line and that the waiting time was appx. 34 minutes. So much for patience! Tried what the recorded message suggested and had a lengthy IM chat with an 'upper -level' person. The person was polite as well ambitious in responding to my very specific requests.

Have been promised a 24-48 hour response via E-mail. Waiting for that reply! Will let you know.

If their reply is unsatisfactory, I will begin the process of requesting investigations by my State Attorney General and the Federal Trade Commission. Buyers beware of any request for Credit Card info 'before' a final cost is verified! Also, I will no longer do business with companies without their business address and a phone number for Customer Service.

MagicJack unauthorized billing

I am writing to tell my experience with Magic Jack. Before I purchased one, I checked it out and found they did not have a local prefix for my area. They did tell me that in early 2009 they would be adding local numbers, so I was going to wait, because I thought people would get charged if they called me from my hometown. However, when I went to their website, it clearly stated that as long as someone lives in my area code, that incoming calls would be free for them. I also talked to their customer care chat and was told the same thing, except they actually said anywhere from the US or Canada. For this reason I went ahead and bought one and tried it for a week and it seemed to work fine, so I dropped my old phone service. However, after a month and a week, my brother called me and told me he had been charged for long distance for calling me. I then contacted Magic Jack's customer care and at first was told the same thing again, but when I informed them of what my brother had said, they changed and said, 'Well, it depends on the prefix' This is when I began getting very suspicious. I asked for contact information and was told they could not give that information out. The only way to talk to these people is through online chat and you can not file complaints and can not actually get any information about their corporate offices. One of their customer reps actually gave me an email address claiming it was for their corporate offices, which the email addy looked very strange for somebody in upper management, so I asked directly if this was really for their offices and was told yes. However, when I wrote them I got a response and it was from their billing office. They simply lied!

Now, I wanted to give information to anyone that has experienced problems with Magic Jack and can't file a complaint. I have talked to my state's department of consumer affairs and they gave me several agencies to file a complaint, which I have done. I recommend all of you to contact the Federal Trade Commission, The FCC, and your state's attorney general's office on this matter. This device is a good idea and mine does work, but it is a problem when someone calls me from 100 yards down the road and has to pay, all because I was not aware of this and was basically lied to so I would go ahead and purchase this device. I have been told lies on 4 occassions by them. This needs to stop and they need to be forced to provide information to people that do have problems and start telling the truth about their product if people ask. I do ask, PLEASE, if you have had a problem, to contact the agencies listed above. This is the only way to make them change the way they do business.

I ordered the Magic Jack VoIP today. I was to understand I was to receive a 30 day trial. I made my purchase with my Bank of America Credit Card as instructed by the site. I was told that after 30 days if satisfied I would be charged $46.90. I agreed to these terms. Only to find out 3 hours later my credit card had been charged the full amount; not pending, a full charge.

I attempted to call several time only to find an automated system to nowhere. As for the online chat support, I felt as if I was talking to a child. I explained the problem and was told they could not remove the charge as of yet. The product must now be sent and returned if still dissatisfied.

In my experience with Magic Jack, although not yet receiving the produce, I would never do business again.

The phone service is choppy and most calls have to be dialed twice. I kept it for 6 months doing all the upgrades and whatever the person I chatted to told me to do. Still was terrible voice connections. I had purchased the platinum preferred plan-$59.95 extra charge-and that is all I am asking them to return. On january 5, 2009 I called to cancel and get my refund back on my credit card. Since I had not activated the 5 years-they would be able to do this. Well, it is 2/25/09 and 5 chats later, no credit. I have the RMA ID# and luckily I save purchases in e-mail. very convenient to copy and past info from. I will not give up-they promised me it was posted to my card yesterday. Not Yet! This is a really bad scam and I am sick of it

Well after getting magic jack they have a billing system that we go though. Everyone is told that there is one price that you receive. I paid my bill in full 106.85 39.95 For the magic jack 59.95 For the 5 year service and 6.95 For the tax. I got the credit card bill on 01/07/2009 I should have been paid in full. However I got another bill for 46.90 On February 02/06/2009 I did make any other system up grades or order more service. When I contacted magic jack I was told that I did not pay the full bill! Yes I did pay the full bill my credit card company receipt said so! I called magic jack all they do is give me the run around! I never got my refund! Then I looked at rip off. Com and a few people wrote that they had the same experience with magic jack ! Check it out tell the people don t buy magic jack there is some fraud going on there!

I ordered Magic Jack -- It works okay but I was billed an additional 39.90 for an additional years service on two lines. I did not sign up for this nor did I know it until I questioned my bill. At that time I was told it was too late to get a credit because the 30 day free period had passed. I also found out you had to insert a code to get credit for the extra year. Interesting and convenient since I would have never known that I had paid for 2nd year if I had not complained. I also only got the codes with the explanation of how to use them after I complained. Seems odd I would have bought an extra year before the trial period would have expired. In fact amazingly I bought the extra year before I ever even got the jack. I now have spent over an hour texting four differenct customer service representatives and have been promised an e-mail from the billing office. Another interesting point is that I never received an invoice until I contacted customer service. Of course the invoice showed that I had ordered the extra year for both jacks. Hmm Does anyone smell a class action lawsuit here. My guess is that the average american doesn't even realize they got scammed or gives up once they are reminded of the 30 day policy. I should have stayed with vonage

They turned mine off for no reason except their rep.s Destiny and Loren said it was the mistake was made in THEIR billing dept and swore it would be back on in 24 hours. Well it never happened. Plus they said they would send an e-mail and they never did that either. Worst of all they refused to give me a phone contact or the billing department. They indicated I was powerless, and this is all their mistakes, not mine. They turned it off in 4 months. Yes they are a scam, they need more than be reported, they need to be sued royally

How is Magic Jack supposed to know whether someone is going to be billed to call you? in the US, you don't pay to answer calls, you pay to make calls. it is up to the caller to determine whether or not they are charged by their provider.

How can you expect MagicJack to know whether someone else's long distance provider is going to charge them to make a call... sounds to me like you should have gotten them a magic jack also...

the same here, we got charged 2 days after ordering a MJ but somehow they sent 2 in package and wife wanted one.. Here's the kicker, we got charged 39.95 plus ship/hand =$46.20 and then a month later another 39.95. The 30 day trial got billed in 30 days but the other MJ was billed instantly, bait and switch

MagicJack unauthorized storing of credit card data for future charges

This company illegally and without authorization stores your credit card information permanently in their databases. I found this out when I went to place another order of the product and found that it already had all my credit card data from the previous transaction eventhough I make it a point to never store my CC data on any website that I purchase online from. I always am happy to re-enter my credit card info and was surprised when I found that it was pre-loaded on this site. So then here's my ordeal with their customer service in terms of getting it removed. To summarize, it went nowhere, I have yet to meet more incompement people anywhere else. Their staff is a prized collection of [censored]ess that are dead weight on this planet.

I was transferred 3 times in the chat and still could not get my problem resolved. The chat was ended by the last guy with some random incoherent sentence that did not make any sense, actually none of it made any sense. So Be patient and enjoy - I have changed my name to John in the chat transcript just for privacy's sake. The support personnel's comments are in Blue font.

John - I got the same problem as yours. This morning after I renewed my magicjack subscription for another year using a credit card, I logged on back to the system and saw my credit card information in there! Would you please update us on whether/how the so-called "Admin" ever removes your credit card info? Thanks.

Bad bad definitely bad customer service could not get local calling they would not fix the problem. They kept on ending chat sessions because I wanted an answer. They need to be customer service not excuses our next level of expertise but situation resolved.I sent my magicjack back to Radio Shack and told them they should not sell the product its a con.

Wow...Such hatred. Magic Jack has worked well for me on a netbook for over a year.
No problems with purchase (picked one up at WallGreen's) late 2009. It is now late 2010!
Customer service exists. FAQ handle most questions. $20 for the unit and $20/year is a good price!

NOTE WELL: Magic Jack is very advanced technology! It requires the installation of a
program into your computer (Quite automatic after plug in!). It requires time to start up again
with each computer boot cycle! It requires you to log an address for 911 service (which it
did flawlessly on my computer. You can change that address at will if you move the system).

You should also set your computer to "wake up upon LAN activity". Then your computer can "sleep"
until a call occurs. It then wakes up and Magic Jack connects the call (either in or out!).

It drives two phones and an answering machine. The audio is pretty good (typical VOIP quality).
My only complaint is their answering service comes on after a fixed four rings! I would like to be able
to control that myself (minor annoyance...local answering system is set to three rings!)

This thing is incredible technology (is NOT your AT&T wire line of the past!) at a very
low price for a phone connection. Much simpler than Skype (which is also good if you understand it,
and/or want video connection!).

Get with the program or buy a cell phone. Most folks can handle cell phones now--but at $50/month!

They have locked my account because we disputed where magic Jack charged 2 credit cards for the same transaction. We asked for the problem to be fixed by Magic jack, they in turn told us they had noting on file where they charged our second card. We simply destroyed the card they had on file and had a new one re-issued. Problem solved.We now use prepaid credit cards to process transactions and have canceled all cards they have on file for us to prevent the problem.

The phone number we use the magic jack for is our business phone. we have had this thing for over 2 yearfs now and no problems until this recent problem in January.

Now we can not purchase anything, they will not even allow us to pay to renew our service, they won't let us transfer the number to another provider, and they have interrupted our business telling us our case is till in review.7 months to review where they tried to scam us and steal our money processing unauthorized transactions.

The problem, I think, is we found a way for them to provide exactly what they offer without the ability to steal from us and they do not like it. Thus hey found a way around us by locking our account, allowing the number to lapse without service so we lose the number and the account and they an try to start fresh.

I agree they need to be stopped, but they know jut like everyone reading this knows, no one has the money, and no attorney will work this case probono, thu allowing companies like Magic jack and thousands of others to continue screwing people and getting away with it.

To be honest I think it's time attorneys began to do what they are trained to do. Stop worrying about filling your pocket so bad, and start helping people who literally have a case, are being interrupted, hurt, and destroyed just because a large company knows they can get away with it. Stop worrying about that huge house you live in, that fancy car you drive, you can be an attorney no matter if you live in a trailer or a 3 million dollar mansion. You can defend honest hard working people no matter if you drive a Mercedes or a pinto. When the attornesy don't ask you for money up front, when they can sit with you and help you win a case without the need for you to dish out their fee, thats when companies will stop this crap. And not until.

Here's the deal rich fancy pants attorney, I don't get paid for my services until after the job is complete, correct, and approved. I provide my own tools, My own labor, and my own products to complete someone order. I do not get paid up front for my work so what makes you better than me? Now After I do the work, and don't get paid for the job I send invoice after invoice with accruing finance charges. I am still not paid, then I have to come to you, the attorney, Provide the tools you need to complete your job, the contract, the proof, the invoices, and access to my financial information to show where no payment was made. You see using the tools I provided for you the contract has been broken, they have broken the law, you know that, I know that, yet I have to pay you to take them to court. I have to pay you up front to make a person pay me what is clearly owed...problem 1.

Now let's say I pay you, we go to court and win, You have already been paid, but this client still does not pay, and then 3 months later Poof I am back in your office, and you demand payment again up front to help me peruse the judgment to put a lien against his assets. And guess what if that client does not sell that asset, I still dont get paid. So who really wins? THE ATTORNEYS.

I challenge any attorney reading this to prove me wrong. Take this case help stop this company from breaking the law and ripping people off.

Or show me what I need and Ill help everyone take these people to court my dang self. Companies like magic jack need stopped, they will not quit walking on top of us unless we stand up...Literally.. and fight back.

I attempted several chatroom conversations with two representatives from 6 pm to 9:50 pm PST. They did nothing, ignored my requests for help and said, there's nothing we can do. I kept reiterating that basically too bad. I asked for a manager, I asked for an address, I asked for a corporate number, they refused and disconnected the chat conversation. I researched the company information, they don't exist at the address they indicated, it belongs to a woman. When you call their so called 800 that I found after resarching the web, it rings to a non-existing number that goes to a circuit busy. When you check their domain registration, they do not list a name or contact, they registered as private. When you research online, they were denied in the state of Alaska, showing networth of $1k. I believe they are a scam preying on people and taking their money not providing any kind of service that they claim. I saved a copy of the chatroom conversations with the 'so called technical reps' who for almost four hours, did nothing and basically said, 'Oh well.' roseroberta: Something to be aware of if you are thinking about buying a MagicJack. I haven't had any problems using it on an Intel-Based Mac. However, I just ordered my fifth one (the other 4 were for friends out of the country) and the company mixed up my shipping address. I have heard rumours that their customer service is bad. Actually, it is horrible. You cannot speak with anyone. Everything is done by live chat. They are not trained to handle anything outside of the manual they read from. They cannot form proper English sentences. They do not go out of their way to make things right for the end user. A few days ago I discovered my order was sent to the wrong address and it has been a nightmare trying to get it fixed. From what I understand, they went from selling a few hundred per day to 8000 per day. Unfortunately, they don't seem equipped to handle the administrative side of the business. There are a lot of complaints with this company, which is owned by http://www.ymaxcorp.com/. You can google "ymax and complaints". Most of the problems are customer service. I suspect they will face a class-action lawsuit in the future to straighten them out. My advice if you order... Make sure everything is correct with all ordering details. If you have a problem be prepared for a long battle getting it resolve. On the other hand, the four previous orders arrived perfectly. From a hardware/software point of view, you have an occasional echo, service interruptions, no Mac technical support (still in beta), etc... But, most of the time, it simply works well. Roseroberta was rude to everyone she spoke with and unwilling to listen! I have a couple of friends who have this service. They are very happy with the quality of the phone, and the simple instructions plainly laided out for use. I understand her frustration but she could of asked the question differently and in a polite manner. If she did not have the phone how did she expect to be able to see these servicrs provided? Thumbs up to Jordan for remaining a true gentleman! It seemed she was trying to pick a fight from the beginning, by taking everything personal and wasted a lot of her own time and there's by doing so, Lloyd was trying to be respectful and she did not appreciated it and came off as prejudice from the very start of the conversation. I too hate pushing buttons and want someone who can haswer my questions, would like to have an address and phone number to reach, however these things can be asked in a polite way! When you smile and are kind to others you would be shocked at how things turn out to be a win-win situation!

MagicJack false advertising

Advertised a 30 day trial that you would not be charged for until the end of the 30 days. They charged the next day and also charged for the 5 year plan to boot. I was not expecting this and have an internet account for internet purchases only which would have become overdrawn if I hadn't called the bank for another reason and found out.
The product did arrive 2 days later and I have it hooked up and it does work fine...except I am now finding out that other peopkle are being charged long distance to call me. This should have been disclosed at the very beginning, not in some fine print that is too small and too long for any normal person to take 4 hours and a microscope to read. This product could be soo valuable and such a great item if only it were being marketed properly. I agree with many of the other complaints that I have read about the tech support. No Live phone number, the tech usually takes for-ever to get, but once you do they are very helpful. They just need to do what they say and say what they mean. Integrity is where a company either makes it or falls on their own face. Practise makes perfect. Maybe by taking a few of these complaints very seriously and turning the problems around in a BIG hurry this company will make a good product even better. I also do not like the website where you are trying to get your magicjack set up and it keeps trying to sell you. You already bought and all you can get is a new page trying to get you to buy again instead of a real help me set this thing up page.

claims caller id works with any phone. Had 2 magicjacks sent to me and neither one displayed caller id # or name just incoming call. Days of troubleshooting to no avail. They even told me to waste $ buying an Ac powered USB port. Their risk free trial verbatim 'YOU OWE NOTHING WE'LL EVEN COVER THE POSTAGE TO RETURN IT' is not honored as you must pay s/h to return it. There is no 800 customer service # and their chat line is useless. Their techs/sales end the session if you try to get them to abide by their promises. DON"T BUY THIS $^^$#%^&* device.

MJ is advertising that the user can call anywhere in the USA. That is a lie. Several exchanges cannot be called from my MJ phone including 308-235-XXXX, 435-723-XXXX and 541-226-XXXX. I have complained to them for over a year and their so called engineering department will not respond with a fix. Now, MJ will not let me chat with them; no one responds to my chat requests. MJ does not have a phone number to call to complain and no address can be found for their business.

1) Someone needs to initiate an class action suit to publish a phone number to call with complaints that can be tracked by the public and the FCC and FTC.

2) Investigate their chat methods and why they will not email chat sessions to their customers upon request. I have requested this several times and nothing happens.

3) Stop their false advertising.

Can anyone help fix this and make them accountable to their customers?

You MUST deal with service companies in writing. Do NOT rely on phone calls or email.
Yes, on paper, sent via USPS, UPS, FedEx, or your favorite flavor.

You MUST deal with service companies in WRITING.

Follow EACH phone conversation with a snail-mail summary of your conversation to the place you send your bills. Include your name, address, and account number.

If you continue to be defrauded by service companies file a FORMAL complaint with the "Public Utilities Commission"

...

remember you CAN also sue them in small claims court. In most jurisdictions the filing fee is about $60. WHEN you win your case you will recoup this investment.

I plan on ordering the magic jack. If you understand their policy front and back, they say that they will put a 'Hold' on the funds until the 30 days is up. If you do not get a hold of them through their support within the 30 days givin, they will Keep the funds with no refund.

Now what this means is that the funds on 'Hold' are actually taken out of your account and put in their 'Holding Account'
How else can they guarantee that people are going to actually pay? It may be a bit unorthodox, but it states in their policy and agreement that this is what you are getting yourself into.

I encourage everyone to read the agreements/full information WHENEVER buying anything over the internet.

One thing everyone also needs to realize is that the money WILL be taken out of your account within 3 days of signing up for the trial. This money will be on a 'Hold', in other words you can get a refund within 30 days. But yeah.. I know that they take money within the first 3 days because they tried with me. I didn't have sufficient funds in my account and my overdraft limit is set to 0 (impossible to overdraw).

I will order the magic jack tonight, and get back to this forum after everything has happened in great detail.

I Love the new magic jack. If you understand how everything works then it's an AMAZING product.

The Put a hold on 50 dollars on my account at first (paid for fast shipping + tax + shipping) as expected, but then they refunded it within 3 days. So I was able to withdraw and use the money. I am going to be charged $50 around the 4th of next month. The free trial is just a bit tricky, that's all!

There are just some small problems for me, but so easily worked around.
Before I had 512RAM on my laptop that had the magicjack. The thing is whenever I played a game like DotA or World of Warcraft, my phone typically didn't ring and whatnot.
I was planning on upgrading my RAM anyway, so I upgraded up to 2gigs of RAM and now the program runs very smoothly with no lag!

Another problem was that my area code has to be a Seattle area code.
On the website, they say the area code 360 is available, but when actually applying for a number, 360 wasn't listed (all the other WA codes were)
So my number is a Seattle number now, which is of NO problem to me whatsoever BECAUSE all of my friends/family/work all use mostly cell phones or other phone plans that have unlimited long distance in US.

I highly suggest this product. I have been using MagicJack for just 2 weeks and its awesome!

Also side note - Their voicemail is pretty unique in my opinion. You can save your voicemails into different folders. On top of that, MagicJack sends you an EMAIL of the voicemail! SO EVEN IF YOU MISS %100 OF YOUR CALLS, JUST CHECK YOUR EMAIL AND LISTEN TO THEM ON YOUR COMPUTER SPEAKERS! HURRAY! Hahaha

MagicJack manufacturing

The Magic Jack plugs into a USB port. I have enjoyed using my Magic Jack for over a year but last night the unit broke away from the USB plug and fell to the floor. The USB plug appears to have had 4 points that were soldered (not well) to 4 points inside the unit and that's all that held the 2 parts together. The Magic Jack is too heavy for the plug. I always noted that the weight made the unit hang down a bit. They won't replace it since it broke on my end. I am not willing to pay another $50 or so to replace it. SO..IS THAT HOW THEY ARE ADDING TO THE BOTTOM LINE AND SELLING SERVICE SO CHEAPLY? By selling such poorly made units that they know you will have to replace them>

EXCELLENT: Furthermore, I have the same problem. Just try soldering the thing together! SURE...?!?! Copper tabs curl off the board etc. in short what seems a simple task requires a minimum $100 bench set-up. You'd think you could just buy another unit transfer your current number and download your contacts from an online contact back-up, however there may be Microsoft Outlook merge program which you should have had some common sense to use or your current back-up. Now, paying for a completely new Magic Jack Unit replacement after a reasonable warranty period is expired is fair but it is not available, So I buy another Magic Jack, for example, then I port my old Magic Jack number and then see if I can import from my back-up. Whhewww! Still, I paid for two years of service yes? NO! That was for free as part of the deal. Remittance is to cost of manufacturing/distribution and admin operations, yes the product services cost... 19.95/yr., however within the initial offering these services are free, example answer.com for magic jack tech info and are at the mercy of their fees. However, porting my old Magic Jack # might return my service considering it is still working...seems logical ...no? It might even even give me a pop-up box asking me if I want import from my Outlook...oh! what logical hope! NOW the five year service is optional but that's at the time you buy the unit. SO, for an addition $20 on the original 39.95 pricing the unit and total services as part free( 2 yrs ) and then this optional upgrade of three years for that additional $20 thus 59.95. In other words you're getting 3 yrs service at the time you purchase the hardware. This is still some conjecture here, the idea is that you're offered hardware with the first 2yrs service free, as if the service cost them too much within the fixed overhead costs...I won't say anymore here about VOIP licencing here. The most draw backs of electronics units are their physical junction points Wifi's, Aircards have similar issues however there is reasonable recovery there.
It seems being ready willing and able to spend another $40 as long as porting your current magic jack # would be easy enough, as there is that option, however if you enter those menu's and it doesn't allow porting in your own magic jack number to the new one ...oh well! My suspicion is that if it successfully ports, downloading your contacts would be part of the execution program. I have yet to try this theory. Respectfully; entiky05@hotmail.com

I used Magic jack (#1) on my desk top happily for a year, and period expired but I kept it connected, and used it once in a way. It showed a message it will expired shortly, please renew. I did not renew, few days later, suddenly it said upgrading and changed / screwed up my entire window xp pro. Changes to the system made by Magic Jack did not allow to use restore point. Computer started freezing, not working properly. After few restart it worked ok but all restore point were useless. I had another Magic Jack (#2) which is brand new, I connected and it did not work at all on that desk top computer, but it worked on laptop fine. Contacted tech but they could not make it work, their knowledge was limited it did not work at all on my desk top, and on lap top it worked fine, without any effort.
So I formatted my desk top and re-installed xp pro but still Magic Jack (#2) will not work, I contacted tech they could not make it work. It appears that MJ is copying xp serial key or some file (How Microsoft recognizes your system) and not allowing me to even use NEW MJ (#2) on that desk top computer. When service expires they should stop allowing use and not screw up OS. I am going to look for class action attorney to look into this. FCC is useless, they don't do any thing. If anybody has such experience please report here for attorney to look seriously.

MagicJack warning: must plug into usb port

I bought Magic Jack after seeing an advertisement on the Internet. It worked allright at first for about 3 Weeks then It started not Ringing the Phones at the other end when I made calls. Then one day I started Magic Jack and all of a sudden this Message would come up, Warning: Must Plug Magic Jack in USB Port, It was in the USB Port and My computer even Recognized it. After going back and forth on the Instant Messenger trying to talk to Technical support for a few days trying to get it to work, They sent me a replacement Magic Jack. the Replacement got the same Message. I finally had to go back to Vonage.

I had the same problem ---warning plug into usb ---to make majicjack work i had to format it and copy my adressbook.xml back into the majicjack after formating it then start it and all worked until i shut of the pc.Now i booted it up today and it did not whant to format nothing worked ? but i fdid go to my daughters home where she was able to format with Vista then I got it back on my xp system a could not? however it then upgraded with the upgrade that majicjack just came out with .. after it stareted up and the warning came back then this is the funny part it after i rebboted it stared up again and majicjack was back to normal it works fine now without doing anything...

More then likely the problem lies within your computer. The problem being that your USB ports on the computer is not supplying enough voltage. MagicJack fraud and cheating

I first placed my order by phone, as it was all automated it didn't take my address, it told me one but it was wrong. Not knowing what to do I went online to try an contact them to straighten it out. When I finally got in touch with them, they proceeded to tell me that my email address was registered to someone other then myself, they gave me her name an address, it was a woman who lived in pittsburg pa. as I had this email address for four yrs. I knew then I was being duped.

Every time I tried to correct the issue they continued to tell me it wasn't me, however I always got there email response at my address. Long story short I wound up paying for this other womans which I had ordered 2 jacks an 2years service which was around 70.00 $. When I never got my order they took it again this time it was for 1 jack an 1 yr. o I was charged again for this order of which I finally received. However I am still out my 70.00$ as they would not believe I wasn't the other lady even though my bank account info they took proved otherwise.

Did you also ever know that magicjack tried to charge me over $90.00 for a free 30 day trial? And what they don't tell foljs is that when your credit card company/bank denies a transaction (thanks to my bank - wellsfargo), magicjack takes $1.00? Yes, they tried over charging me $90 instead of $39.95...they never knew I had authorized my bank not to allow any charges from them apart from $39.95 + 6.99 shipping and handling - and that should be after 30 free trial days. But these dupes (without any phone numbers or addresses for such a "reputable" company) wanted to charge the card even though it was a trial---and my bank disapproved!

They managed to run away with $6 but I am done with them. I think the inventor of this magicjack should sit up and sort out some of these complaints, else, soon, he would be done and out because nobody would patronize his product. As of now, about 80% of consumes believe that magicjack is FRAUD - and I SECOND!

Consumers, BEWARE! We don't even know the ID's of the people we chat with and you can wait for hours before you get some to chat with you - they simply SUCK! For now, I am sticking to my phone company until I get a credible one---maybe, I must try vonage or...!

MagicJack does not work with wireless on laptop!

I have the magic jack now and so does my dad. His phone works pretty well but mine is crap! I have it hooked up to my laptop on wireless. Whenever I pick up the phone, it is choppy and breaks up worse than a cell phone. In order to make it sound half-way decent, I have to hook directly to my modem which does nothing for me because I have a router for a reason. Now I have to get a real home phone for service because this one is very crappy! Unless you plan on using directly with the modem, I don't recommend it.

i have read a lot of in-favors and not so in-favors. I have had 90% of my problems with magic jack is with the customer service. There are no real people to speak to; it takes way to long to try and get a problem diagnosed; the customer service people do not for the most part understand what you are trying to explain. I resent the fact that there is no human contact with this company. I have had magic jack for a long time, years, and there were a lot of disconnect problems when an upgrade popped up or something else of that nature on my computer, or the static was there many times. So i decided to get the Plus version. It was still cheaper than going back to a land line. As the ad said i connected it to my modem and went to check the phone number and it gave me a new number which i did not want. Upstairs to the computer, contacted them and it took them 2 hours to figure out that the new plus needs to be plugged into your computer before it works with just the modem. Would have been nice if the directions had told me that. My computer son and I reviewed the instructions on the package and there was no mention of this instruction to connect to computer first to register the product. After hours of frustration, the interruptions are gone, the phone line is in perfect use, and i do not have to have my computer on to use the phone. I am now a happy customer. I just hope i never have to contact their customer service again.

I purchased my Magic Jack six months ago and it worked just fine. This week it stopped working properly as each time I make a call it is very choppy, intermittent and sounds like the audio is stuttering. I have the same problem on my laptop as well as my desktop. Magic Jack live agents tell me that it is ISP's fault with poor line quality and excessive jitter? I have two different ISPs, one for my laptop and one for my desktop. Does this sound reasonable?

I actually got a virus in my Magic Jack and my virus protection was not able to clear the virus out. I got online help from MJ for about 4 hours then gave up. I asked if I could buy a new MJ and get credited for my existing international minutes that I have purchased and the remaining time on my MJ. I thought they would be happy...but I was wrong. They would not credit me the time I have already paid for.

Then I asked an address where to send in MJ to be repaired but I was told that would not be possible by a first level technician named Blake and he turned off the chat. That wasn't it, he somehow this high level technician, Blake, locked my computer out of accessing their site again. So, no where to ask for help again or complain or ask what was mine and already paid for. I think that was crappy way to do business or treat a client like that.

I was getting discconect when I was trying to make a call, PLEASE try to use different phone who ever is having similar issues, this will help, nice and clear phone call, I will recommend this to my friends, thanks MagickJack Team.

We just purchased the Magic Jack and have it connected through our WiFi laptop. It seems to be connected correctly as we get a dial tone. However, as soon as we finish dialing a phone number it goes quiet and causes us to lose our internet connection - every time. We tried to call my stepfathers cell phone and it must've reached him somehow because he was able to call us back on our "new number", however it had the same outcome. As soon as I picked up, it went quiet, eventually hung up and disconnected our internet. Does this each time we make/receive a call... Not sure what's going on...

I have been using my magic-jack for 6 months now, and I have it plugged into one of my spare laptops that's connect to the internet over my wireless network. It has been working fine since day 1. So you must have a slow ### internet connection or crappy home phones if your setup isn't working correctly. Or you ended up with a bad magic-jack unit. I have a 60Mbps download speed now, and a few months ago it was only at 12Mbps. It works and sounds much better now that I have faster speed, so people should seriously keep that in mind before you buy this product, if your broadband speed is less than 6Mbps I would not have high hopes for this to work that well. It would also be nice for magic-jack to disclose this type of info on their website that way everyone who is interested in it could get all the facts upfront.

Realistically though, what do you expect for a $20 a year product?

I am having the same issue. I can dial from the soft phone but not from the actual phone. It worked just fine for about 2 months then a windows update occurred, rebooted my computer and it stopped working. I have tried everything with customer support and they still can't get it to work. Finally I reformatted my entire hard drive, only installed Windows XP Professional and it worked again for about 2 weeks until it happened again. Power went out, my computer rebooted and now I can not make outgoing calls from the phone no matter what I do. I have tried it all, can anyone help?

MagicJack horrible scam!

Magic jack promises, and never delivers. My phone calls are all broken up, I tried all and I mean ALL of their "so called fixes" they do not work. I demanded another one be sent to me. That one was worse that the first. They got me, and this guy is swimming in money from all of us goofs! I spend a total of thirty or so hours "chatting" with person after person and they could not fix my problem. I hate this product and I would not recommend it to anyone with a short fuse because it will frustrate you to no end. I am throwing my away. Anyone want it? Just pay shipping and it is yours!

First off I would like to defend Magicjack and state for the record this is a truely a great product. Like all new things there are minor bugs and flaws with its setup and use. They have since cleared most of them up and has an upgrade to their product which again corrects flaws. I have been using this product now for 1 yr and saved over 500.00 by eliminating my cable company phone (39.95 monthly plus tax) As far as customer service phone number - when my magicjack arrived it had a phone number and after a couple of calls I spoke to a customer service rep and cleared up my billing issue - same as everyone else you get billed quickly not like the 30 day free test drive and then they will bill you. This was corrected within 7 business days. I would also state for the record that you need a good internet connection - dial up and low end dsl will work but very poorly. Cable or Fios (verizon) is ideal. Plug and play - I also got my area code. So for all you people out there who think this is a horrible product i beg to differ. I am a computer network technician by trade and have fully beat this product very hard in testing and really did not have to tweak it at all. Just remeber that your connection is the key element and if its slow so will everything you do will follow that speed including your Magicjack.

MagicJack Fraud and cheating

Before the 30 day warranty was over, I asked for a replacement Magic Jack because tech support couldn't help to get it to work, but they denied me a replacement. They said it was my USB and computer and to get a new one to use the Magic Jack with.

It started working on its own after 2 weeks, but the voice quality was so bad I could not hold conversations with people 80% of the time, tech support told me it was probably my computer, my phone, or my internet net speed. I replaced all (new computer, increased internet speed to fiber optic, and purchased 2 new phones). I have done all that their tech support has told me to do.

It has now been 5 months, and my problems have escalated. Now my phone will not ring (a line prob. Not a computer prob). It says that the line is disconnected when people dial my phone number, and a lot of times it will be a constant busy signal even though I am not on the phone. When I can make a call, there is a beeping sound that won't stop, and the phone calls will drop in the middle of my conversations.

On Feb. 13, I emailed Dan Borislows company email address ([protected]@magicjack.com) I was answered by a man named Marvin. Marvin was not able to help me, he would not fix the actual line he just kept trying to reset the actual magic jack and taking me through the same steps the techs online always do.

As of Feb. 17, Marvin stopped emailing me and has refused to answer me after I made this request: “Can you switch me to a new phone line and send me a new Magic Jack as per my original request the first few days I had this while I was under your 30 day guarantee? As of today, Feb. 19, 2009, my incoming call problem is still not resolved, my phone line still does ring, voices are choppy, and voicemail doesn't come on half of the time.
I tried to send an email to Marvin/Dan but they will not answer now. I have sent a complaint to the FL Attorney General, BBB, and now complaintsboard.com.

I am urging Anyone else having problems to file a complaint with the FL Attorney General and the FTC.

NOT ONLY DOES THE MAJIC JACK NOT WORK ALL THE TIME, SOMETIMES IT DOES NOT WORK AT ALL, DROPPED CALLS, BUSY SIGNALS WHEN I AM NOT ON THE PHONE, AND NOW THEY WILL NOT HONOR MY EXTRA YEARS SERVICE ( WHICH I REALLY DON`T CARE ANYMORE).
THE ONLY SMART PEOPLE ARE THE ONES THAT DREAMED UP THIS SCAM, AND HAVE RIPPED OFF MANY, MANY PEOPLE LIKE MYSELF.

MagicJack it is a fraudulent ponzi scam

Purchased The Magic Jack in April of '08 and it is an absolute fraud. After using the product for 45 to 60 days problems were experienced. Though the initial problems were taken care of, the same problems reappeared continuously. The majority of the Customer Service people try, but immediately the hand of failures is shown by the questions when Firewalls need to be removed, it is your phone even though it is the same phone that you have used and when you change the phone it still remains the same. The problem is with YOUR equipment, the recommendation is to buy additional equipment and your system may work. It is ongoing but one thing is definitely now showing as a white flag of guilt. Magic Jack is offering a 5 year renewal program for a 60% discount. IF Magic Jack was properly working for even a slight majority of the new buyers, given the current economy the sales would be going through the roof simply by word of mouth. Certainly the retention rate of existing customers would not be dropping to the point that a 60% reduced price could be justified when sales are already robust, or is there a requirement for this discount because the Ponzi scheme is coming apart? Please try to be nice to the CSR's that try to help you, they are only trying to make a living by keeping a job helping people with something that they know does not work. That has to be frustrating and they also have to eat and pay bills. Have read some that have had some success, but am curious as to why these people would look under Magic Jack compalints to post there adoration for the product. One specifically said that he was "a good friend of the inventor and the Magic Jack works perfectly". That sounds much like my being 50 years old and saying that I can prove that I am honest because I have a note from my mother, or maybe I missed something. What does the rest of the population feel about that? Anyways, for anyone that reads this prior to buying into the Magic Jack scam, don't buy it yet, maybe in a few years it will have a better network. For those that have joined the ranks of us "CHATTING" on this board, you are among company of those that are interested in trying something new. A Pioneer as such because many people will not try something until it is proven in a clinical test. My friends, we are the clinical test. DO NOT BUY THIS AT THIS TIME, unless you want to be a Pioneer of something that does not work as of yet.

I had just posted a complaint on another subject. I saw "Magic Jack" on the left side of my computer screen. I read one complaint. My MJ hasn't been working for over a month. I thought it was a problem with my computer! I've tried all the "help" recommendations but haven't been able to use the phone on a regular basis. Yes, I guess those of us who purchased Magic Jack are the "pioneers."

MagicJack unauthorized charge

On November 19, 2008 I ordered a majicjack and was charged $43.85 November 20, 2009, but I never received the Majicjack in the mail. On December 17, 2008 I called Majicjack to complain that the Majicjack was never received. December 18, 2008 I was charged $100.99 for two Majicjack which I received in the mail. Todate I was charged a total of $144.84 and have onkly received two majicjacks.
Majicjack had a special on in December, 2008 and I should only be charged for one majicjack.

MagicJack customer service chat bad otherwise service good!

I recently started using Magic Jack and personally I like it but I don't like the customer service chat. If people follow the instructions and use a fairly new phone as well as get the upgrades (available on their website) if needed and their internet service provider and computer are pretty good then there are no problems. I have to admit for myself I did have to contact customer service because they billed my Debit Card right away when I thought there was a free month but that was my fault for not using a credit card which they were easily able to help me change and I got my money back the next day. Their customer service responses are sometimes generic and it will seem like they are not listening to you and I was switched to another customer service rep. This person was very helpful and assisted me with my billing issue and helped me setup my magic jack completely. I think since this company is fairly new respectively, like all companies they have to work out some kinks especially with contacting customer service. But as other here have said that they don't have a customer service number that is untrue they do it just has a very annoying repeating message while you wait for someone to answer. That number is : [protected] but this is only for billing issues and you could be on hold a while. Regardless they need to get more live Reps and thats that. But honestly I recommend anyone to try it for the free month and if you don't like it you'll be refunded, it's worth a try at saving money especially in this economy!

To enable your use of the magicJack device, you must first download the magicJack Software. Some enhanced features also require you to purchase the magicJack device. In addition, you need a computer running Microsoft® Windows (XP, Vista, 7) or Intel-based Mac® with a high speed Internet connection and, if you purchase the magicJack device, an available USB port. Bear in mind that the magicJack device and/or the Software are dependent on these requirements and the failure of one may prevent the magicJack device and/or the Software from working. We can not guarantee that the magicJack device will always function without disruptions, delay or other imperfections. There may be power outages or Internet service disruptions and you may experience other disruptions unrelated to the magicJack device, which will interfere with the quality of your communication. Although once you have purchased a magicJack device or downloaded the Software, use of the magicJack device and/or the Software is free, you are responsible for getting the things you need to make the magicJack device work, and that may involve third-party fees (such as Internet service provider or Internet airtime charges). You are responsible for those fees. In addition, you must provide and are responsible for any additional equipment necessary (such as a communications adaptor or a headset), to use the magicJack device or the Software. The magicJack device may not be compatible with non-voice communications equipment, including but not limited to, home security systems, medical monitoring equipment, fax machines, satellite television systems, or computer modems.

The goods and services offered by magicJack provide a multimedia experience which includes a voice over Internet information service feature. It is not a telecommunications service and is subject to different regulatory treatment from telecommunications services.

2. Ownership and Risk of Loss of magicJack Device
You will own the magicJack device, but not the Software included on the device, which is licensed to you under this Agreement for a one year term, and bear all risk of loss of, theft of, casualty to or damage to the magicJack device, from the time it is shipped until the time (if any) when it is returned to us in accordance with this Agreement, or the warranty covering the magicJack device, if any, expires. If, within 30 days of placing your order, the magicJack device directly from our website, you are not satisfied with your magicJack device you may either return it to us for a full refund of the purchase price, minus shipping and handling, or exchange it for a new device. The full refund or exchange offer is applicable only to the purchase of your first magicJack device. In order to receive a refund or exchange you must request and receive a magicJack RMA number by e-mail and the magicJack device must be returned in its original packaging, be accompanied by proof of purchase and you must pay the expenses of shipping. Request your RMA here http://my.magicjack.com/returns.html. You will receive your refund or your new device within a reasonable time frame from the time we receive your package; which is approximately 14 days for an exchange and 45 days for a refund. If you purchased the magicJack device from one of our authorized agents, please contact the distributor or retailer directly to learn about their refund policy.

3. Internet Communications Feature
a) Incoming Calls:

When you first register, as part of the available features, you may elect to choose a unique phone number, which will allow you to receive free phone calls over the Internet. The phone number chosen will be allocated provided we determine that it is legally permissible. If you are eligible for a phone number, it will be allocated to you as soon as reasonably possible after we have received your request. YMAX Communications Corporation may be the provider of your phone number and/or inbound calls. We do not guarantee that a requested phone number can be allocated to you or that you can make use of the incoming call feature. The allocation of a phone number to you does not constitute any transfer of title, ownership, license or other rights with regard to the phone number; and the phone number is not portable to other service providers. We may, without any liability, refuse, change or terminate any phone number at anytime. If we change the phone number that has been allocated to you, we will notify you, stating the effective date of the change and your new phone number. If you do not wish to accept this new phone number, you are entitled to cancel this Agreement; however, you will not be eligible for any refund unless you terminate the Agreement within 30 days of purchase of the magicJack device and qualify for a refund as further described in Section 2 of this Agreement. We will not be liable for any damages resulting from the change of the phone number.

b) Outgoing Calls:

Once you have registered your magicJack device you have agreed to these Terms of Service. You may now elect to choose the feature allowing you to make free outgoing calls over the Internet. You can make free calls to other magicJack device users located anywhere in the world, and to subscribers on traditional telephone networks or wireless networks in the United States. You will not have the ability to call any number that would require the addition of any charges to your phone bill, such as 900 or 976 numbers or any other "fee per call" type service.

4. What Is Free and What is Not:
The magicJack device allows you to receive for free incoming calls using the phone number you have chosen. If you choose outgoing service, the magicJack device allows you to make free outgoing calls to other magicJack device users located anywhere in the world, and the subscribers on traditional telephone networks or cellular networks in the United States. We may provide for a fee, premium prepaid services, which may be powered by YMAX Communications Corp. ("YMAX"), including inbound calling, International Calling and Conferencing services and the rates for those services will be governed by listed price lists or tariffs. magicJack may make available to you, for an additional fee, enhanced versions of the magicJack Software ("Upgraded Software") which provide new features and functions.

5. Emergency calls
The services are not traditional telephone services, so we are not required to provide you with access to emergency 911, E911, or similar access to emergency services. However, when you register to use the magicJack device, you will be enrolled in the voluntary 911 service, if you register a U.S. service address. magicJack will take commercially reasonable steps to provide you with emergency service calling. This requires your cooperation. Initially, we will use the address you give us when you register the magicJack. You must update this address whenever you change the location from which you place your calls. You agree that each and every time you change the physical location of where you are using the magicJack device, you will update the Emergency Services record at http://my.magicjack.com and provide the new address where you are using the magicJack device. If you fail to do so the free voluntary 911 service will not work.

You understand and agree that the 911 emergency dialing feature is provided to you as a convenience. magicJack and/or YMAX will not be liable for any damages resulting from any call made using the emergency dialing feature. You understand that the voluntary 911 service will not work in certain circumstances, including, but not limited to: when you relocate your computer or magicJack device to a new physical location different than the one you registered with us; if you experience broadband connection failure; if you experience loss of electrical power at your location; if delays occur in the system making updates of your registered physical location. You assume the risk that you may not obtain emergency service when you use the 911 emergency dialing feature. You should always have an alternative means of accessing 911 or similar emergency services such as a landline telephone. It is your responsibility to inform others who use your magicJack device to make phone calls that they should be prepared to access the 911 emergency numbers through a traditional landline or mobile phone.

6. Proper Use
You agree that you are responsible for your own communications and for any consequences that arise from them. You agree that you will use the magicJack device in compliance with all applicable local, state, national, and international laws, rules and regulations. Among other things you will not agree to, and will not authorize or encourage any third party to: (a) prevent others from using their magicJack devices, (b) use the magicJack device for any fraudulent or inappropriate purpose, or (c) remove any copyright, trademark or other proprietary rights notices contained in or on the magicJack device, including those of any of our business associates, from whom we may have licensed certain components used in the magicJack device. Violation of any of these obligations may result in immediate termination of this Agreement, and may subject you to state and federal penalties and other legal consequences. magicJack reserves the right, but will have no obligation, to investigate your use of the magicJack device in order (a) to determine whether a violation of the Agreement has occurred or (b) to comply with any applicable law, regulation, legal process or governmental request. magicJack reserves the right to block calls to numbers that abuse its services such as, but not limited to, traffic stimulation numbers. If magicJack sees excessive use, including but not limited to, a customer whose usage is twenty (20) times more than the average magicJack's customer's usage, or a customer who calls more than 50 different telephone numbers per day, or systematic or intentional misuse, it reserves the right, in our sole discretion, to terminate your use of the magicJack device and/or Software immediately, and you will not be entitled to get a refund of any licensing fee or any other fee you may have paid to us.

7. No Resale
Unless expressly authorized in writing by magicJack, you agree not to reproduce, duplicate, copy, sell, trade, resell or exploit for any purposes any portion of the magicJack device or the Software.

8. License
magicJack grants you a personal, non-transferable and non-exclusive right and license to use the magicJack device and Software on your computer; provided that you do not (and do not allow anyone else to) copy, modify, create a derivative work of, reverse engineer, reverse assemble or otherwise attempt to discover any source code, sell, assign, sublicense, grant a security interest in, or otherwise transfer any right of the magicJack device. The initial term of this license is for one year and may be renewed upon the one year anniversary of your magicJack order or purchase (for an additional fee) for additional terms. If you do not renew your license within sixty days of expiration, we may revoke the phone number, at our sole discretion. You agree not to modify the Software in any manner or form, or to use modified versions of the Software, including for the purpose of obtaining unauthorized access to the magicJack device. You agree not to access the magicJack and/or YMAX services by any means other than through the Software and the magicJack device.

9. Payment
Use of the magicJack device is free. Your purchase of the magicJack device and registration of the magicJack device gives you a license to use the magicJack and the Software for one year. To continue using the magicJack device and the Software after the end of the initial one-year term, you must renew your Software access license for additional one-year terms at magicJack's then applicable license fee. Failure to renew your registration after the end of the initial term or any renewal term will result in immediate termination of your license and access to any magicJack or YMAX feature. You will not be able to use the magicJack device and your right to use any phone number that was allocated to you will be canceled. For your convenience, magicJack offers an auto-renewal program. Your credit card will be automatically charged on the last business day of the current term for the prevailing renewal fee. You can elect to disable this auto renew feature at any time by going to http://my.magicjack.com. magicJack offers a thirty-day refund for the magicJack device.

You agree to be responsible for any applicable taxes, fees, or charges, now in force or enacted in the future in connection with the license and your use of the magicJack device and YMAX services.

10. Privacy Policy
Your registration data and certain other information about you are subject to this Terms of Service. You understand that by using the magicJack device you consent to magicJack's collection and use as set forth in these Terms of Service, including the transfer of this information to and from the United States and/or other countries for storage, processing and use by magicJack, its affiliates and business partners to provide you with information about communications-related service.

You acknowledge, consent and agree that magicJack and/or YMAX may access, preserve and disclose your account information if required to do so by law or in a good faith belief that such access preservation or disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce this Agreement; (c) respond to your requests for customer service; or (d) protect the rights, property or personal safety of magicJack, its users and the public.

You understand that the technical processing and transmission of the magicJack device may involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices.

11. Advertisements
You also understand and agree that use of the magicJack device and Software will include advertisements. Advertisements will be served through the magicPage™ Software or the magicJack softphone - the software/softphone attempts to serve local advertisements and classifieds using a completely automated process that enables us to effectively target dynamically changing content. Our computers may analyze the phone numbers you call and your registration information in order to improve the relevance of the ads. We do not provide any personal information to our advertisers or third parties. magicJack has a policy of restricting advertisers that it believes are inappropriate, but it does not guarantee the accuracy or integrity of any advertisers and does not endorse any of the advertisements that may appear in connection with use of the magicJack device. You also understand and agree that use of the magicJack device and Software may include certain communications, such as service announcements, administrative messages and newsletters, and you will not be able to opt out of receiving them.

12. Indemnification
You agree to hold harmless and indemnify magicJack and YMAX, and its subsidiaries, affiliates, officers, agents, employees, partners and licensors, from and against any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of or relating in any way to, your use of the magicJack device and/or YMAX services (including but not limited to the cancellation, absence, failure or outage of the magicJack device, including specifically any claims arising out of the failure to complete emergency service calls). In such a case, magicJack will provide you with written notice of such claim, suit or action.

13. Modification
magicJack reserves the right to modify or discontinue the magicJack device and Software, temporarily or permanently, with or without notice to you. YMAX reserves the right to modify or discontinue its services, temporarily or permanently, with or without notice to you. We will not be liable to you or anyone else in the event that we exercise our right to modify or discontinue the magicJack device or Software and/or YMAX services.

14. Termination
You agree that magicJack and/or YMAX, in its sole discretion, may immediately terminate this Agreement and your license to use the magicJack device and Software and/or YMAX services, without any refund. magicJack and/or YMAX may terminate this Agreement for any reason, including, but not limited to, (a) breaches or violations of this Agreement or other incorporated agreements or guidelines, (b) requests by law enforcement or other government agencies, (c) unexpected technical or security issues or problems, (d) use of the magicJack device or Software or YMAX services in violation of any laws, regulations, or rules, or in any manner that disrupts use of YMAX services or the magicJack device or Software by others, or (e) nonpayment of any fees, including license renewal fees, owed by you in connection with the magicJack Software, (f) changes in any rules or regulations that affect our ability to provide the magicJack device or the Software or YMAX services. Termination of your license includes cancellation of your ability to use the magicJack device and the Software, without refund and deletion of all related account information associated with or inside your account. Further, you agree that any termination of this Agreement will be made in magicJack's and/or YMAX's sole discretion and that neither magicJack nor YMAX nor any of its agents or affiliates will be liable to you or anybody else for termination of your license or this Agreement. We may offer Vanity numbers for an annual fee. These numbers are non transferable. We have the right to revoke your usage of the vanity number at any time and for any reason. If the number is transferred, as determined by the change of an account name, or as determined by the change of the authorized name on a registered credit card, or as determined by other means, the vanity number will, at our discretion, be revoked and the magicJack license terminated.

You may terminate the use of the magicJack device at any time. Remaining balances of international minutes will not be refunded.

All provisions which must survive in order to give effect to their meaning will survive any expiration or termination of this Agreement, including without limitation, all of your representations, warranties and indemnification obligations.

15. Intellectual Property Rights
You acknowledge and agree that the magicJack device and the Software contain proprietary and confidential information that is protected by applicable intellectual property and other laws. You further acknowledge and agree that content contained in sponsor advertisements or information presented to you through the Service or advertisers is protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws. Except as expressly authorized by magicJack or advertisers, you agree not to reverse engineer, modify, rent, lease, loan, sell, distribute or create derivative works based on the magicJack device or the Software, in whole or in part.

16. No Warranties
YMAX services and THE magicJack DEVICE AND SOFTWARE ARE PROVIDED "AS IS", WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF QUALITY, PERFORMANCE, NON-INFRINGEMENT, MERCHANTABILITY, OR FITNESS FOR USE OR A PARTICULAR PURPOSE.

YMAX and magicJack MAKE NO WARRANTY REGARDING THE OPTIONAL FREE 911 EMERGENCY DIALING FEATURE PROVIDED. ALL CALLS MADE USING THE 911 EMERGENCY DIALING FEATURE ARE MADE AT THE CALLER'S RISK.

YMAX and magicJack MAKE NO WARRANTY AS TO THE COMPLETION, CLARITY, OR OVERALL QUALITY OF ANY PARTICULAR CALL MADE USING THE SERVICE.

YMAX and magicJack MAKE NO WARRANTY THAT ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED.

YMAX and magicJack MAKE NO WARRANTY ABOUT THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR THAT OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS. ANY content DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS DONE AT YOUR OWN DISCRETION AND RISK AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH content.

NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM YMAX or magicJack OR THROUGH OR FROM THE SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THIS AGREEMENT.

17. Limitation of Liability
magicJack can only be held liable for direct damages resulting from failure to perform its obligations under this Agreement. In this respect, direct damages means the amount you actually paid for the magicJack device and Software license during the year in which such damages occur. To the maximum extent permitted by applicable law, magicJack will not be liable for any indirect, special, incidental or consequential damages whatsoever (including but not limited to, damages for loss of profits or confidential or other information, for business interruption, for loss of privacy arising out of or in any way related to the use of or inability to use the magicJack device or Software, even if magicJack has been advised of the possibility of such damages.

YMAX can only be held liable for direct damages resulting from failure to perform its obligations under this Agreement. In this respect, direct damages means the amount you actually paid for the magicJack device and Software license during the year in which such damages occur. To the maximum extent permitted by applicable law, YMAX will not be liable for any indirect, special, incidental or consequential damages whatsoever (including but not limited to, damages for loss of profits or confidential or other information, for business interruption, for loss of privacy arising out of or in any way related to the use of or inability to use the magicJack device or Software, even if magicJack has been advised of the possibility of such damages.

Some jurisdictions do not allow some of the exclusions or limitations as established above, so they may not apply to you. In that event the liability will be limited as far as legally possible under the applicable legislation.

18. Export/Import
You agree to comply with all export and import laws and restrictions and regulations of the United States and foreign countries, and not to export, re-export or import the magicJack device or Software or any direct product thereof in violation of any such restrictions, laws or regulations, or without all necessary authorizations. Neither the magicJack device the Software, nor the underlying information or technology may be downloaded or otherwise exported or re-exported (i) to Cuba, Iran, Libya, North Korea, Sudan, Syria, or any other country subject to U.S. trade sanctions applicable to the magicJack device or Software, to individuals or entities controlled by such countries, or to nationals or residents of such countries other than nationals who are lawfully admitted permanent residents of countries not subject to such sanctions; or (ii) to any named party or individual on the U.S. Department of Treasury, Office of Foreign Assets Control list of Specially Designated Nationals and Blocked Persons, and/or the U.S. Department of Commerce, Bureau of Export Administration Denied Persons List or Entity List. You acknowledge that the Software contains encryption technology, the export of which is restricted by the U.S. and certain foreign laws. By downloading the Software or using the magicJack device, you agree to this section and represent and warrant that you comply with these conditions.

19. Automatic Updates
The magicJack device and/or Software may communicate with magicJack's servers to check for available updates to the Software and/or magicPage™, including bug fixes, patches, missing plug-ins and new versions (collectively, "Updates"), however magicJack has no obligation to provide you with such Updates and we do so solely at our option. Updates do not include access to the Upgraded Software described in Section 5 above. To ensure that you have the most recent Updates for the Software you should periodically visit http://www.magicJack.com to check for Updates. magicJack may send and access magicJack cookies on your computer. A "cookie" is a small file containing information about you that is sent to your computer when you visit a website. When you visit the website again, the cookie allows that site to recognize such things as your browser, user preferences and other information to optimize the performance of magicJack. During the Update process, the Software may send to magicJack or its partners a request for the latest Software version. By installing the magicJack Software, you hereby agree to allow magicJack the option to automatically provide Updates from magicJack and/or its partners' servers.

20. Representations and Warranties
You represent and warrant that (a) all of the information provided by you to magicJack to use the magicJack device and Software is correct and current; (b) you have all necessary right, power and authority to enter into this Agreement and to perform the acts required of you hereunder; and (c) you are at least 18-years-old.

21. Entire Agreement
This Agreement is the entire agreement between you and magicJack and YMAX and governs your use of the magicJack device and Software and items and/or services which may be provided by YMAX, it trumps any prior agreements between you and magicJack and/or YMAX. You also may be subject to additional terms and conditions that may apply when you use or purchase certain other magicJack services, affiliate services, third-party content or third-party software.

22. Waiver and Severability of Terms
Even if magicJack and/or YMAX do not exercise or enforce any or all of its rights or any provision of this Agreement it does not mean that we waive the right or provision, and we may still enforce those rights and provisions later. If any provision of this Agreement is found by any court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of this Agreement remain in full force and effect.

23. Statute of Limitations
You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the magicJack device or Software or services of this Agreement must be filed within one year after such claim or cause of action arose or be forever barred.

24. Choice of Law; Binding Arbitration; Forum
This Agreement will be governed by and construed in accordance with the laws of the State of Florida, without giving effect to its conflict of laws provisions or your actual state or country of residence. Any claims, legal proceeding or litigation arising in connection with the magicJack device or Software and items and/or services provided by YMAX will be resolved by binding arbitration. The arbitration shall be administered in accordance with the then current Commercial Arbitration Rules of the American Arbitration Association. Any matter to be settled by arbitration shall be submitted to the American Arbitration Association in Palm Beach, Florida, and you consent to binding arbitration in Palm Beach, Florida.

25. Five Year Warranty or Two Year Warranty
magicJack may (but shall not be required to), offer for purchase, from time to time, a Five Year Warranty or a Two Year Warranty for the magicJack. This Five Year Warranty or a Two Year Warranty is limited and warrants that for a period of five (5) or two (2) years respectively from the purchase of the magicJack, the magicJack Hardware shall be free of defects in material and workmanship under normal authorized use consistent with the product instructions. This product warranty extends only to the original purchaser. In the event that magicJack receives notice during the warranty period that any Hardware does not conform to its warranty, Customer's sole and exclusive remedy, and magicJack's sole and exclusive liability, shall be for magicJack, at its sole option, to either repair or replace the non-conforming Hardware or refund the purchase price in accordance with this limited warranty. Hardware replaced under the terms of any such warranty may be refurbished or new equipment substituted at the option of magicJack. Actual delivery times may vary depending on the customer location. As a condition precedent to the Five year Warranty or the Two Year Warranty, the end user must: 1. Obtain a return material authorization (RMA), which will include an RMA number (available at the magicjack website). Returns without an RMA number may be rejected by magicJack. 2. Ship the items being returned to magicJack, freight prepaid, together with a written description of the claimed defect. 3. Pack the items being returned in the original packing carton and with the original proof of purchase. 4. Pay for shipping and handling fees for the shipping of the replacement magicJack.

26. One Year Insurance Plan
magicJack may (but shall not be required to), offer for purchase, from time to time, a One Year Replacement Insurance plan for the magicJack. This Replacement Insurance plan is limited and insures your originally purchased magicJack for one full year from date of purchase. This product warranty extends only to the original purchaser. In the event that magicJack receives notice during the warranty period that any Hardware does not conform to its warranty, Customer's sole and exclusive remedy, and magicJack's sole and exclusive liability, shall be for magicJack, at its sole option, to either repair or replace the Hardware or refund the purchase price in accordance with this limited warranty. Hardware replaced under the terms of any such warranty may be refurbished or new equipment substituted at the option of magicJack. Actual delivery times may vary depending on the customer location. As a condition precedent to the One Year Replacement Insurance plan, the end user must: 1. Obtain a return material authorization (RMA), which will include an RMA number (available at the magicjack website). Returns without an RMA number may be rejected by magicJack. 2. I have been on the phone with majic jack agents for 5 h ours + and I still have not gotten an agent that can successfully get my majic jack to work so I can call and receive calls. Now I cannot even get an agent to respond online, does anyone have a telephone number that I can contact someone with magic jack?

MagicJack undisclosed compatibility issues

I haven't been able to make this thing work for more than a day at a time. When I shut down the computer, the jack isn't recognized on boot up. I have repeatedly downloaded updates and it will work as long as I don't turn off the computer. If I do, same story. I went round and round trying to get the Live Chat customer service to pop up (they do that thing where they try to wear you out clicking page after page until you finally get to log in to the chat, "Click here... no click here.. no click here... try the FAQ, now type in your question... now click here"). Long story short, customer service said, "past 30 days... no refund." Period. I also never got the email with the renewal code for the second year I prematurely purchased when I ordered the darn thing. I asked numerous times to have it resent and they would say, "we resent it." and there was nothing in my box. "Can you check your junk mail settings, please?" They aint on. Believe me, I WANT THIS email. Anywho, they finally gave it to me in the LiveChat but I had to go through all my credit cards and give them 8 numbers off the card to verify my account.

Oh, and it turns out they KNOW it won't function with several popular music/media CD burning programs but they never mention that on the website. I was told to delete Nero software and it will work. Well, great... I paid more for a professional version of Nero than for the damn jack! Yeah, delete the software... that's an answer.

When I asked for a list of compatible software they said, "unfortunately, aint none." I am expected to buy different versions of burning software and have a go until I find one that works.

Do yourself a favor and DO NOT BUY THIS PIECE OF GARBAGE.

My technical problem was very similar.

Don't ever get MAGICJACK voip phone service. They took my 5 year subscription fees, then couldn't fix a problem 1 year into the 5 year service, and would not refund the remaining four years after over 45 hours spent online with numerous chat sessions in an attempt to solve the problem. At less than two dollars an hou...r, getting the lousy $65 back just wasn't worth my time anymore. Mine will go in the trash.
