M & I Bank Signature Card

We are a third generation family business. My Grandfather, Father, and I have banked with the same bank for over 50 yrs. ( West Bank & Trust, to Valley Bank, which became M & I Bank. My Business bookeeper forged my signature to company checks made out to cash.
She then took them to M & I Bank locations, and they handed over the cash to her.
Over $300, 000.00 over a a few year time frame.
They claim no wrong doing, pointing to the Signature Card that they had me sign, limiting their liability to 30 days.
I thought I was signing the "Signature Card" so they had "my signature on file" and would safeguard me from forgery attempts.
Instead, they didn't check any of the forged checks for signature quality, instead handed over cash to a non-signator on the account.
How can THIS be the way a Bank Conducts Business with its customers?
We survived competition, big box stores, bad economic conditions, but the bank that calls itself: The Business Bank will be a 3rd generation business' undoing. Using the "signature card" as a weapon against you.

They offer home loan & mortgage products which they have no intention of giving the customer. You pay the regular fees to apply, then they tell you are not eligible. We have a credit rating over 750 & both have been at job over 7 years & have proof of other income & still coulld not get a loan product. It was blatant fraud! We requested a refund and were denied. Do not do business with M & I Banks.

THIS COMPANY IS TOTALLY NUTS! THEY CLAIM THAT I MISSED A PAYMENT 2 YRS AGO...THIS IS NOT THE CASE! SO I MAIL AN EXTRA PAYMENT...THEY HAVE CHARGED ME WITH A 25$ LATE FEE FOR A YR AND 2 MONTHS NOW...AND THEY CONTINUE TO CALL AND HARASS ME BOUT 4 TIMES A DAY..THEN WHEN I GET UPSET W/THEM..THEY HANG UP ON ME! THIS IS THE WORST BANK I HAVE EVER HAD TO DEAL WITH EVER! AND THEY HAVE THE WORST CUSTOMER SRVC I HAVE EVER ENCOUNTERED!

I responded to an online ad that promised $100 cash back for opening a new account. Although I have satisfied all requirements, M & I Bank continues to give me a run-around, and will not credit me the $100 that the promotion spelled out in writing.

I would love more information. This does not even sound possible at all and I would have expected the media to have picked up on it. I personally don't us M&I due to other business practices I don't agree with, but this put my over the top.

M & I Bank Fraud against me and my business bu M & I Bank

Dear Michael,

This is in response to your letter dated December 01 2010 which indicates that either I did not make my position clear in my email or The Federal Reserve has misunderstood my entire complain. I am not seeking private legal advice or any kind of representation for the injustice done to me.

My only reason for complaining to the Federal Reserve is HOW CAN A FDIC INSURED BANK GET AWAY WITH DISCRIMINATION, CONPERICEY AND SUCCESSFULLY DRIVE A MINORITY SENOIR CITIZEN SMALL BUSINESS OWNER INTO CHAPTER II. As I mentioned in my email that since M & I Bank wanted to sever all relations with my business (still do not know the reason, although we were making all the payments to M & I bank) why did they not let me refinance my business instead KNOWINGLY sold my note to a developer (TradeCor Desert Sky II LLC) who had all intentions to destroy us. My SBA 7A loan through Wells Fargo Bank was being processed and seeking payoff statement from M & I Bank. Mr. Eric Anders of M & I Bank sent a payoff statement of over $2.00M so that I do not qualify for this SBA loan and few weeks later sold my note to Mr. Perry Mann of TradeCor Desert Sky II for $1.2M.

Was Mr. Eric Anders of M & I Bank bribed? Or is he a raciest? This is very serous and the Federal Reserve needs to look into this. I am definitely not asking the Federal Reserve to recover my monetary losses.

Please treat this matter as URGENT and investigate why my family business was driven into Chapter II and a family of four is being deprived of their livelihood. If this as asking for too much then there is no Justice prevailing in the Federal Government’s Federal Reserve system.

This is a civil and criminal crime and conspiracy against a senior citizen and a small business owner by M & I Bank and a Commercial developer. I have all the documents to prove all of below.

1) In December 2007 M & I Bank sold us a SWAP loan to refinance our business which we did not understand. My wife and I trusted them because M & I Bank convinced us that our monthly payments would remain constant irrespective of the market interest rate.

2) Our monthly payments were never constant and M & I Bank admitted that our note was inputted incorrectly in their system.

3) After two years of complaining to M & I Bank trying to get our money back, Mr. Eric Anders of M & I bank decided to break off relations with us and gave us until May 31st 2010 to refinance or sell our business.

4) In January 2010 Mr. Perry Mann owner of TradeCor Desert Sky II suddenly comes to our location and make us an offer of $1.250M. We reject his offer. Mr. Parry Mann said that M & I Bank is willing to sell him our notes at $1.25M. We mention this to Mr. Eric Anders of M & I Bank and he had no comments.

5) Due to pressure from M & I Bank, we approached Wells Fargo for refinance. Wells Fargo started our loan process offering us an SBA 7A loan. M & I bank agreed to take $1.9M and write off the rest to compensate us for excess funds taken from us.

6) Wells Fargo requested M & I bank for the payoff statement to finalize the lending process.

7) Once M & I bank found out that our loan with Wells Fargo was going through, they sent a payoff statement to Wells Fargo for $2.4M thus stopping our refinance of the SBA 7A loan. (This loan had a limit of $2.0M)

8) Few weeks later M & I Bank sells our note to Mr. Perry Mann of TradeCor Desert Sky II for $1.25M. This proves the conspiracy and gross discrimination against us.

7) Mr. Perry Mann after successfully buying all our notes for $1.25M puts us immediately in Trustee Sale.

8) Until the last day before filing for Chapter 11 we begged him to take the same offer of $1.9M that we were giving to M & I Bank thus making him a clean profit of $700, 000, but he refused. Who gives the right to M & I Bank
to allow TradeCore Desert Sky II to extract extra $700, 000 from a senior citizen small business owner? Was some one bribed ? Is there any Federal or State agency that will investigate this injustice to me and my family ?

9) After filing for Chapter 11 Mr. Jeff Pevone a commercial real estate agent calls my son Sonny threatens him that if we do not hand over our business to Mr. Perry Mann we will face consequences.

10) Three days before the creditors meeting in the bankruptcy court I get ruthlessly assaulted by four young adults (asking me to give our station to the rightful owner) and I end up losing vision in my right eye.

11) I attend the bankruptcy court hearing with burses in a wheel chair along with my wife

12) In the bankruptcy court. We were humiliated by Mr. Perry Mann’s attorney when (under oath) he asked us in a derogatory manner if knew English. This is a serious violation of our civil rights and we consider this racial profiling.

M & I Bank and TradeCor Desert Sky II should be bought to justice.

All my payments with M & I Bank were made on time. I have all the paperwork to prove it. All the lawfirms I have talked to want at least $50, 000 retainer and I do not have that kind of money.

M & I Bank Bad constuction loan

We took out a construction loan with M & I Bank to Build our ADA home for my disabled vet husband.. The bank stated in their paperwork that M & I Bank would send out an inspector to check on the progress of the house BEFORE they gave the draw to the builder..The builder did not finish the house and the work that he did do was substandard. When we ask M & I Bank for copies of the inspections they told us to get a lawyer because that was "company only " reports. Then we were told that if the home was not complete that they would take the property and start proceding against us. We paid cash from our 401k for the acerage. The bank gave us an option I feel we were forced into and that was another loan for the same amount as the first one to finish the house..I believe that we were taken advantage of as we did not live close to the building site. After calling lawyers in town I found out that M & I has all the best construction lawyers in town on retainer and I had that verified. The house is 2 1/2 years old and the foundation is going.. IF YOU HAVE HAD ANY SIMILAR PROBLEMS WITH M &I BANK please let me know . I am working on a class action suit. [protected]

M & I Bank Lack of Goodwill

As a teacher at a Shakopee Public School, Sun Path Elementary, I am involved with a school fundraiser called Pennies For Patients. It has been heartwarming to see how excited the students have been to donate their coins to benefit the Leukemia Society.

Unfortunately, a pall was cast over my fundraising efforts that left me greatly angered. I was eager to get a count of the coins collected mid-week. I made a phone call to the nearest bank to the school- the M & I Bank located on Greenwood Court. I was hoping to take the coins to that bank to use the coin counter since it was the closest in proximity to the school. I called ahead of time, stated my name, my school and the reason why I hoped I could use their coin counter. I was told that there would be no problem. I reiterated my request several times; Sun Path students had collected a large amount of coins. At this point, the weight of the coins was incredibly heavy. I did not want to have the slightest chance that there would be any problem when I arrived at the bank. Having been reassured several times that I would be able to use the coin counter, I felt confident that I would not have an issue.

Sadly, that was not the case. When I arrived at the (nearly empty) bank, the manager refused to count the coins with the coin counter. I stated that I had called ahead of time, but she said no- because I was not a customer. I offered to pay a fee but was also rebuffed. I was told that there would be ‘no benefit’ for the bank to help me with this.

I understand that banks have policies, however I am disappointed that the employee with whom I spoke to on the telephone was unable to inform me of the policy when I had asked several times. I am also sad that when the M & I Bank employees saw me struggling into the building lugging the weight of thousands of coins that, out of goodwill, could not have helped a local school (not to mention a worthy cause).

Given the nation’s current animosity towards the banking institution, I cannot say that the folks at M & I Bank helped bolster my confidence or trust in banks. I now know that I cannot take my school’s coins there to be counted. I also know that I will not ever consider that branch of M & I Bank for any of my future banking needs.

That's really sad to hear. No, it doesn't benefit the bank directly to let you use the coin counter -- but it doesn't cost the bank anything to let you use the coin counter either. The manager should have kept the promise that the employee had made (even if the promise shouldn't have been made), because it really benefits an institution like a bank to be known in the community for keeping its word. Sounds like the branch manager was terribly short-sighted.
