Lend America Warning: Don't make the same mistake

First of all, the closing consisted of multiple Truth and Lending Statements, all with different amounts, which I refused to sign. My loan was not what was promised to me. Then it took Lend America over 1 month to pay off my previous loan, which effected the amount of credit I recieved from my old mortgage company and a late payment on my credit report. With a HUD loan, we were promised Lend America would pay a premium for Unemployment Insurance and Rainy Day Foundation, and when I was out of work with a serious health issue 6 months later, I was unable to apply for the Rainy Day Foundation because Lend America had never paid the premiums. Lastly, it is now February 11, and I have yet to receive my mortgage interest statement resulting in the inability for me to file my taxes. Each problem resulted in hours and hours of repeating the problem and customer service passing me from person to person. This entire experience has been a nightmare, and I strongly caution anyone considering using Lend America for any service. I did file a complaint with the BBB with the intentions of warning all prospective Lend America clients, but the only result was an email response from Lend America which did not even address the issues or apologize for the inconvenience their actions have caused me and my family.

Lend America lend america

in fall of 2009 i spoke with lend america for a first time home buyer loan three months later they finally contacted me back and said that we were pre-approved for $223.000.00 loan.. they would have another department get with us to go farther. In jan. 2010 i recieved an email from someone saying that they would like to help us in purchasing a home that they were from the company lend america. I send back an email saying that if they could please send me a listing of homes in my area. 2 weeks later i get another email sayiong that they are soryy but they cant help us any longer because they dont dealwith the area i live in . I t would of been nice to know before i wasted 6 months and gave them all my personal information/...

Lend America Lost check

I actually got my refinance done and everything paid off, but one of the checks to the credit card company was lost in the mail. I have been trying to reach Lend America since Nov. They closed the company but were still "maintaining customer services", which was a joke. No one called me back despite numerous calls and messages.

Payment was done thru PSS Settlement Services/Mortgage Disbursement, but I cannot locate them. I have a substancial check in the postal black hole and I cannot locate the bank to (1) see if the check has cleared and (2) reissue if it hasn't cleared. Meanwhile, the agreement with the credit card company has lapsed and I am being hounded by them. (I am still keeping the agreement I made, but the check cannot be located.)

Does anyone know how to reach this company or PSS?

Lend America Non Payment of Mortgage

I did a refi with Lend America that closed 11-13-09. I called Lend America on the 19th of Nov. and was told the loan had funded and good to go. Todate my old mortgage is not paid off and I am now getting current with my old mortgage company Chase. Nothing was done by Lend America after closing but send my account to there servicing unit that accepted my payment for Dec. I cant even begin to explain how this has impacted my family and my ex- wife. There is more details but I think every one gets the message of whta I m currently dealing with. Home owner in Iowa

I am in a similar boat, but I have not received anything for their lawyer. Are you organizing for a class action suit?

I believe that there are a number of folks in this boat and it would benefit us to organize.

They partially funded my loan, never paid off the previous lien holder. Now collections is calling me from Lend America wanting payment. Fortunately Bank of America is still current and therefore my home is not in jeopardy, but it very well could be had I not followed this so closely.

I had been direct contact with Lend America right up until the December 4th when they closed the doors. Never once did any of the people I was speaking to indicate that there was trouble ahead.

So Merry Christmas to me...and I guess a bunch of other people.

We are in the same boat, we just were informed last week that our loan was also not paid off to Chase so now we are 2 payments behind according to them but Lend America cashed both payments...did you get the letter from the lawyer?

Lend America Not paying off original mortgage

I was told by NYS Dept of Banking that Lend America was shut down by HUD.
I began a refinance with Lend America (LA) in May 2009, to date this loan has not been funded. I received all the documents for the loan process online (BusinessSpaces) on May 06, 2009. I paid for the appraisal May 30, and had the appraisal conducted in June. I received an approval letter from LA in JUne and a letter from my home insurance company stating that Lend America was the new mortgagee and I was no longer responsible for the bill. In August I contacted LA because I still hadn't closed and was wondering what the holdup was. I was told that the loan was suspended because of credit issues. I asked why I had not been informed and was simply told "I'm sorry, I thought someone called you". I was then advised by John to reapply because the time period for the application was expired and was given a new loan number. After correcting the issues on my credit I was told that I would be closing on the loan on Oct 26, 2009. An attorney came to my house on October 26 with all the closing documents. My husband and I had several questions that the attorney answered after calling Lend America. We closed and receive the settlement statement from EAM in November. Wells Fargo the original lender has not been paid off yet. So I paid them on Dec 1st instead of sending my money to LendAmerica. I'm not sure if this was the right thing to do. Wells Fargo have 4 payoff quotes (June and Oct) requested from Lend America but no payoff. I was told by NYS Dept of Banking that Lend America was shut down by HUD

Its 2016, My house was stolen through fraudulent, fabrication in origination. The refinancing of our home was done through lend america. Now, would someone please tell me, with all the knowledge we now have, where we already proved through the courts and consumer protection, and the mailing a rescission letter dated March 4, 2015, WHY our elected leaders are so blind to the malfeasance in our financial house?
My house, like many, many, many others was STOLEN! Restitution via settlements is warranted. You cannot just push this under the carpet. Michael Ashley owes me a 450, 000 dollar house along with 500, 000 pain and suffering. My spouse die in this process of this Biggest economic CRIME against humanity. By letting Micheal Ashley go so he started up another mortgage firm to do the same thing. Bankers need to be JAILED.

We can join the screwed by Lend America club, i closed my loan on oct 12, 09 week later received a loan proceeds check, made couple of payments now we find out months later these ### didn't payoff our old mortgage.
Our Govt is failing us miserably, no oversight until it is too late. Let me know about a class action suit against the ### Ashley.

still no progress here. The only advice I have now is keep your eyes upwards, and let your thoughts and prayers go with the eyes. I have been through the wringer of emotions with this mess. Mostly depressed and moody. It has caused problems between my husband and me. I just found out today the LA will probably file for bankruptcy so there might not be much hope for this to be fixed in the near future. They will have to pay for this somehow, someway..we just have to be patient ( hard to do, I know), and justice will be ours. Keep complaining to everyone you can think of, keep calling and e-mailing. There is a small group of customers who are planning a class action law suit. I think that if enough of us get together and storm the White House with a keg, we may be listened to, (ha, ha, ha). But maybe all of our voices will get through to someone who can make that little bit of difference here. Keep your chin up and let us know how things are going

We too have been effected by Lend America. We were contacted by our first mortgage company and informed that LA didn't even contact them for payoff. Now we are 2 months behind on that mortgage because I have been paying LA the last 2 months. We cannot afford to come up with this money because I am currently on disability and my husband has been laid off. I contacted a lawyer last week and they advised who to contact but in the meantime we could still lose the house..

Ok, so the check my 1st lender got BOUNCED! If any of us "regular" people wrote a bad check (even for $10), we might land in jail. No one seems interested in doing something about this. I talked to the FBI earlier this week and the agent made me feel like I was bothering him. I dont get it. Is the law on our side ( the law-abiding, tax-paying, rule-following people)? I feel like the law is protecting these crooks/scam artists. I hear Michael Ashley has already started a new company doing the same thing. I wonder how many ex-LA employees he has hired? Or how many he paid off to keep quiet. I want him nailed to the wall for this mess. I hired a lawyer who, in a week, has not gotten any further than I did on my own in a month. We finally decided this morning we arent going to pay LA another dime until this is resolved. We will keep our 1st mortgage current. That loan is escrowed so my real estate taxes and home owners ins will be paid. I cannot take much more of this, I am a complete basket case. I keep telling myself that GOD does no give us more than we can handle, so HE must think I can handle this ( with HIS support I can). SOOOOOO... I need to follow my own advice and CALL, FAX, E-MAIL, WRITE, COMPLAIN, COMPLAIN, COMPLAIN, and hang in there. Good thoughts and prayers to all!

They finally paid off my mortagage after 2 months of this. We paid LA 2 payments and our 1st lende4r 3 payments during this mess. I just found out this morning my payoff was received by the 1st lender and now we are due a refund from them. DO NOT GIVE UP! I was talking with agents from the HUD inspecor general office, SCC, the SCC bureau of insurance, I e-mailed the FBI, the FTC, NY attorney general office, consumer affairs, BBB, anyone in the government whom I thought could help. I even e-mailed my local delegates, senators, congressmen. I posted lots of complaints on websites like this. These websites are monitored frequently companies and government workers. I have an appointment friday with a lawyer, just to see if I have any other legal recourse here, like compensation for pain and suffering, ha ha ha. Even if you feel you are against a wall hang in there. Please, if you can, contact a lawyer. And e-mail, e-mail, e-mail, call, call, call. We cant let them win. I am not stopping just because I got my loan taken care of. Prayers and good wishes to all!

We are in the exact same situation. We closed our loan with LA on November 12th, 2009, and they were supposed to disburse funds on November 17th and they never did. We did not receive any money from them at all. They were supposed to pay off our mortgage and many other items, but failed to. I am now in contact with my state representative, hoping that they can give us some advice and get to the bottom of this. I am not paying Lend America anything until they keep their end of the agreement. In my research I have found Lender's Liability, where LA is responsible for completing their end of this agreement. If anyone has any other information, please keep posting. I filed a complaint with the Federal Trade Commission. If they get enough complaints they will launch an investigation. Everyone needs to file a complaint so that they will investigate this situation and hopefully we will all get the relief that we were seeking in the first place.

We refinanced our home with Lendamerica three months ago the 1st. month I made a payment to them not knowning they never paid off my 1st. moratage...the 1st. moratage company wanted to forclouse on Dec.3rd so we had to pay them three months payments and now lendamerica says we owe them, also.
We have had to pay our insurance and taxs which we in our contract for lendamerica and now they are calling me wanting a payment ...a night mare here . what are we to do?

Lend America scammed

We closed Oct 3rd, and they havent paid off our 1st mortgage. I get the royal runaround from all of those crooks. Never get any calls back from messages left. Had to pay $1500 to 1st lender 2 weeks age to get out off deafult and prevent foreclosure

Lend America Possible Fraud

Ideal Mortgage Bankers, doing business as Lend America and Lending Key (Ideal), allegedly violated several Federal Housing Administration (FHA) origination and underwriting requirements, according to a review by the Department of Housing and Urban Development’s (HUD) Mortgagee Review Board.

The Mortgage Review Board alleges no fewer than 12 violations, finding that Ideal made false certifications, failed to document borrowers' income and approved loans that did not meet the FHA’s minimum credit requirements, among other charges.

More than $14 million of loans were subject to false certifications, says U.S. Attorney Benton J. Campbell, who, at HUD's request, has filed a complaint against Ideal in federal court in Central Islip, N.Y. The complaint seeks a court-ordered injunction that would prevent Ideal from making FHA-insured loans. According to a press release from Campbell’s office, the complaint also seeks relief against Lend America’s executive vice president and chief business strategist, Michael Asshley.

HUD has notified four of the company's underwriters that it was suspending and/or proposing debarments for their actions in connection with these violations. Separately, HUD issued pre-penalty notices to these underwriters advising them that the department is considering imposing civil money penalties against them as well.

Ideal has 30 days to respond to the board's notice, and the underwriters have 30 days to oppose their suspensions and/or proposed debarments and to respond to the allegations in the pre-penalty notice.

"Any FHA-approved lender that seeks to do business with us must follow our standards - it's just that simple, " FHA Commissioner David Stevens says. "If we determine that our partners are not playing by the rules, they'll cease being our partners.”

A spokesman for Lend America released the following statement: "The company was taken by surprise, expects to continue in business and will respond more completely once all allegations are reviewed."

I recently received an abundance of calls from homeowners that refinanced with Lend American that claim their original loans were not paid off and now they have two loans. Unfortunately, I can not assist you with trying to get your loans to fund. In the past I have assisted some borrowers, which ultimately many of the loans were paid off. What I am doing is looking into an agency that can assist you. I will on my own free time call back to all that have left me a message. In the meantime, I do suggest that you consult with an attorney. If you have an FHA loan, please call FHA Resource Center. You should also make a complaint with the Federal Trade Commission. Again, I will try to find the appropriate agency to assist you and I will post the information as soon as I do come across that agency.

The Judge absolutely did not through this case out. Honorable Bianco did not rule in the Government's favor concerning the T.R.O.

This case is still active and the Government will proceed with the case. I did have the opportunity to read the complaint entirely. The 40 loans only focus on the State of New York and for a short period of time. Borrowers of those 40 loans that the Government is using as an "EXAMPLES" went into default within a short time after the loan funded. We are all certain that there are more than 40 borrowers. Even if there were 5 borrower, 5 would be sufficient, it is still fraud and damages all of us as citizens of the USA.

Lend America Wins Round With Feds

Court rules Long Island lender can keep making HUD loans while government lawyers press a civil suit.

The feds have lost the first round in their fight to stop a controversial Long Island mortgage lender from making government-guaranteed loans.

Late Wednesday, U.S. District Judge Joseph F. Bianco of the Eastern District of New York denied a government request for a temporary restraining order that would prevent Lend America from making such loans while a civil suit seeking a permanent ban is being decided.

Federal housing officials have accused Lend America of falsely certifying that would-be home buyers who received $14 million in loans were financially sound enough to meet the government's mortgage insurance requirements.

Such accusations might rattle Lend America less so than other firms. Michael Ashley, Lend America's chief strategist, knows what it's like to survive a bruising legal fight with the government. In the early 1990s, Ashley was working at his father Kenneth's mortgage lender when the government accused it of defrauding Freddie Mac ( FRE - news - people ).

"They go after the entire family, " Ashley recalled in an interview last year. "They came after me; I was young and inexperienced, newly married, baby on the way. On my attorney's advice, I pleaded guilty to mail fraud to get it behind me."

Ashley was given probation and told to fork over $30, 000 to Freddie Mac. He was allowed to reenter the government-regulated mortgage business by the end of the decade. His father wound up serving nearly four years in prison.

we too have been cheated by lend America. first mortgages not pd. off, other bills not pd. after two mo.of sending lend America payments we had to go back to paying old bills and mortgages. It has been an uphill battle ever since. then the loan was turned over to loan care, who is in the process of foreclosing on us. we are about to loose a home that we have lived in for 17 years because lend America did not follow through with their part. How CAN THEY TAKE YOUR HOUSE FOR MONEY THAT YOU DID NOT RECEIVE? What has our world come to that the crooks come out the winner. The ironic thing is we had never been late on our house payment until this happened. We need to to bond together and stand our ground some how. If anyone has been successful in their battles with this any information would be appreciated. alost at the end of our rope!

I say we make Michael Ashley responsible, since he got our money he will not be out of anything but stolen money! Better yet, we all get together and get a keg and go see Obama. Get him drunk enough and he might be able to help us before he jumps on his plane ( which we pay for), and go on another tax payer funded trip...

FHA/HUD is not going to help any of us. I have been in contact with them and the FBI in NY and VA, the attorney general offices in both NY and VA, the BBB of NY, consumer affairs, the SCC, both of my senators in VA, my house of rep., my local delegate, and anyone else who I can complain to.I am only getting help from 1 or 2 people. After we caught up the 2 past due payments on our 1st mortgage, and kept is current for the last 2 payments, and paid LA 2 payments, we have decided NOT to pay LA until they pony up. We have hired an attorney. It is very hard to get info from anyone because no one knows what is going on. I have been told that the New York Banking Commission has taken over some of the loans from LA. And just in the last few days, I have been told that Ginnie Mae is taking some of those loans. Your story mirrors ours and a lot of others out there. When we re-fi ed, we got some cash out, and some of that had to be used to catch up the 2 late payments. Now I found out LA asked for a new pay off just earlier this month. I don't know what will happen to any of us. I pray everyday that something breaks and we will all not be held responsible for this mess, and maybe get to keep what we have may have received without having to repay. That would really piss off Michael Ashley. He will get his, someday, someway, somehow. In the meantime, keep praying and keep complaining. They monitor this site, thinking we are stupid enough not to know. The Feds also monitor this site. Maybe, maybe, maybe somewhere over the rainbow...

we also closed on our loan with lend america the beginning of october. like so many others, our old mortgage company has not been paid off yet and has only had contact with lend america once when the buy-off amount was requested. i have called close to everyday for two months and of course have received the run around. now that they have closed their doors, the company servicing their loans have no idea, or so they say, who to direct me to. if lend america has never paid off the old mortgage, is our contract with them still legal? in reality, our loan really hasn't been closed out. we are making payments to old company to avoid foreclosure, and i guess that will leave us in default with lend america as there is no way we can afford two mortgages. that was the point of refinancing and moving to a FHA loan in the first place. what can the FHA resource center do for those of us that put their trust in lend america? please keep me posted.

The judge saw right through what appears to be a NOTHING more than a witch hunt for Michael Ashley. It was thrown out because there was not one stitch of evidence ! no need to say anymore please 40 loans out of 12, 000 you do the math. The percentage is much less than any other mortgage bank on long island.

Lend America Not Paying of old loan

We closed on a loan 8/31/09 everything seemed good then we started getting calls from our old lenders saying that we where late. I contacted customer service and they assured me that the money had been sent, but the telephone calls continued demanding payment from the old/current lenders. Lend America insist the payment has been made but the calls keep on coming. What is one supposed to do in this situation?

Have any of the situations above been resolved whereby the original mortgages have been paid off? We have a similar situation...we closed on 10/19 and the disbursement date was on 10/23. Checks were issued on 10/23 but never sent to our original mortgage company for payoff. We had to call the title company to find out that Lend America had the payoff date changed to 11/16. We are waiting until Monday to see if our original mortgage gets paid. In the meantime, we have not made any payments to Lend America and our original mortgage company has been made aware of the situation and is working with us. If the payment is not received by 11/16, we will have to get our lawyer involved.

I cannot express enough how adamant I am that others pay attention and do not use Lend America to refinance. We closed 3 months ago and LendAmerica still has not payed off our original loan. We have been threatened with foreclosure from our origianl mortgage and are having to obtain a lawyer. Don't waste your precious time and money with a company that does not follow through. This company obviously makes a practice of not paying off the first mortgage.

Good luck I think we have the same problem I closed with Lend america on the 3rd of September and here we are Oct 1st and nothing has been paid to my old/current lender. After 20 days worth of calls back and forward and no real answers they claim loan is fully funded but no one seeems to know where the money is ! I feel your pain I have contacted my state rep and have even emailed the white house concerning his matter.

You might have to take it to court. Get an attorney! Contact you state Attorney General and ask them for proof and good luck! Please post so we know how it goes!

Lend America Unreputable

DO NOT USE LEND AMERICA!

I refinanced with Lend America and it was the biggest mistake one could make. I was contacted by loan representative named Arsen who assured me that this was the best way to go. It started with my having to close the loan not once but twice. The first time there were numerous mistakes in closing documents the closer found and had to spend time on the phone getting corrected. I thought all was well and the loan would fund. I was contacted my Arsen again and was told some ### excuse that I had to close a second time. Again the closer had to make corrections and I had to print my own closing documents. After the loan funded, I was contacted by my prior lenders that the payoff was not correct and I had to come up with money to pay the difference. This created a hardship for me to say the least. A couple of weeks after the closing I was contacted again by Arsen saying they needed my financials again. I asked to speak to someone else who could better explain as to why they would need information that was given a month before. Since no one called me back I didn’t send the same information they already received during the processing of my loan. Several months later, I had financial hardship and requested a modification and this is when the real nightmare begins for me. The Loss Mitigation Department is over loaded with people like me. When I finally was able to speak to someone I was told to contact HUD. I contacted HUD and explained what I was up against and HUD reviewed my financials they said I never qualified for the FHA Loan that I got through Lend America to begin with and felt the loan was fraudulent and they did not follow FHA’s guidelines. The HUD representative that I was assigned felt I qualified for FHA’s new HAMP Program and he would speak to Geri from Loss Mitigation. I finally was able to get her on the phone and she stated that that program was a last resort for me. I reminded her that she told me I did not qualify for Lend Americas’ modification programs so this was in fact a LAST RESORT for me in terms of modifications. I was given two month forbearance and was told I am on her list! I have consulted with a couple of attorneys and was informed Lend America has a bad reputation and is disorganized to say the least. I was also told that if I got a modification through them it would be a miracle and that I would end up in court for a foreclosure hearing in which he would represent me free of charge. Having said all this, I am a single parent who works hard and is not willing to lose everything I worked for. My only hope is to get them to modify my loan since my house is now worth less then the mortgage. SO I REPEAT DO NOT USE LEND AMERICA THERE ARE OTHER REPUTABLE LENDERS OUT THERE AS YOU CAN SEE FROM THE COMPLAINT BOARDS.

Back in June i saw a tv add for lend america... it said credit does not matter... so i called them trying to get my home i have been paying on in my name.. they said no probelm i have to pay off 3 old credit cards in my credit report .. so i did even tho the tv add says credit score doesnt matter.. after i did this i have got nothing but the run around told that my score wansnt high enough yet they raised the fico score to 550 which i was told didnt matter because i had started my loan before it was raised .. i have been paying on a home for 4 yrs with no late payments which is in my uncles name because my cred was bad from a divorce.. finally on Aug 18 2017 i got an email saying they were submitting my loan to the underwrites since then i have not heard a word phone calls or emails will not be returned.. is there any lawyers that can help all of us that are getting the run around .. there tv adds are false advertisement they should not be aloud to do this

We started our refinancing in Dec with them. What a mistake. It was March before we were final, we had to write a check for taxes owed, which they lost and took even longer to complete, took forever for them to pay our previous lenders and now they won't streamline our loan as promised when we signed up. I'd give anything to start over and make better choices, I sure wouldn't go with Lend America! Joel Delgado is a liar and doesnt ever return your call, none of them do for that matter! I'm thinking of calling a local news station or magazine to get this taken care of as well as let the rest of America know not to deal with them, we all should! Bet they'd return our calls then.

I was told repeately that my mortage loan was approved. All I had to do was to pay the appraiser to appraise my home. The amount was too much $900.00, but I only agreed to pay $650.00. Upon completion of the appraisal, I did not get the loan because the house did not apparise enough. The appraiser told me that my area was hard to do. I thought that the appraiser was not suppose to collect from the borrower. I wish that they could be made to pay for all the heartache that they put people through.

We tried to get a refinance with them in june of 09 we were told we were pre approved and they didn't see any problem with it well they got an appraiser thru westside appraisal and he was in our home area so he came out and did the appraisal we had to pay for it
then he screwed up on the appraisal and we worked with lend america for 3 months to try to get it done all this time they kept telling us it was the appraisers fault they could not get in touch with him finally when they did they kept putting us off after 3 months they told us that they could not do it that the house did not appraise for enough He didn't even acknoowledge some of the things in our home that would have made the appraisal more I do not recommend them to anybody

We refinanced our home with Lend America in September 2017 and the loan dispersement was on Sept 10th. Bank of America has still to receive the payoff and all attempts to resolve this with Lend America have been futile. I get, "We will put a tracer on your money Mr. Peters." Over and over again. I am channeled to only one person, even though I have asked to speak with a supervisor or higher up. I have called bank of america and they have been utterly rude and unhelpful. After I explained my situation to a loan officer at Bank of America, they sent us a notice of Acceleration and intend to foreclose on November 18. I can no longer ask for help from B of A because they sent us to collections. We have never been so much as a day late on any payments with them and I only ceased paying when the loan actually funded. The second issue is that with this loan with Lend America, they are collecting escrow payments for our property taxes ($6, 000/year) and now we have received a bill from the assessors office asking for the taxes. They we never notified either. We are going under.

I first contacted this company in Dec. 2017 when my husband lost his job. I was told then that when he found employment they would be able to help. After he found employment I contacted them again in Aug. 2017 remitted the information was told they would call back. Never received that call. They advertise that they have all this money to help families keep their homes but they don't follow through on what they advertise. They should not be allowed to go on t.v. and say they will help when all you get is lip service. Families are loosing their homes something that most have worked all their lives to obtain and they advertise hope when there is none. I find myself in a position where I might loose my home and can not get anyone to help. This is America the land of promise but all I see now is misery. Something should be done to these companies that give out hope. No matter where I turn I can not get the help that I need. Something is wrong when the American people are in the shape that they are in now. When you look around and there are so many illegals here that live off what should be ours they get help but we cant.

Our originally mortgage was with Lend America, they told us 6 months after we closed we would be eligible for a streamline to reduce our interest rate and interest rate. Lend America said this would be a 10 day process. Our 6 months was up and we should have been eligible for our streamline in April 2017. Finally our steamline went through in October 2017. We closed on October 14, 2017, we paid our October payment at closing as instructed by Lend America. About 10 days we started receiving calls that our October payment was late, I explained that we had done a streamline through them. The collections calles continued for 30 days. During this time I spoke to Lend America daily and was told this would be taken care of. Finally the collection calls stopped after I got a copy of the cleared check from my bank for the October payment. As of December 1, 2017 our old loan is still not closed and shows we owe 6000.00 dollars, yet we made our first payment on the new loan on November 1, 2017. No one at Lend America will resolve this matter and because our old loan is not been closed we still have not received the 2400.00 dollars we are due from our old loan escrow account. We have now had to hire an attorney to try to get this settled. The amazing thing to me is this was all done internally, our original loan was through Lend America and our steamline was through Lend America and we are still being jacked around. I think President Obama should be more concerned about taking care of these scam lenders then some other matters he is focusing on. Mislead in Missouri

If you believe that you were treated differently or unfairly based on your race, national origin, sex (gender), religion, familial status (presence of children under 18 years age), disability from Lend America regardless is you got the loan, I would like to speak with you. I was working with the company to get my home loan modified..etc I spoke with an employee, Purelight Allah who was helping me. He asked that I fax/email several doucments in which I did. A few days later I recieved a letter stating that my account would close since I didn't provide all the necessary paperwork. In addtion, I recieved NO doucmentation on what I was getting help with. Mr. Allah ran my credit with my permission but never provided me with disclosure notices..etc.
I called him last week and left a message stating I needed explanation about the closure and wanted to fix the problem. No return phone call. I then called the main phone number for lend america asking for a new person to help me. They refused and said that mr. allah was going to help me. The gentleman over the phone called mr. allah right then and asked the mr. allah contact me right away. He told the other employee from lend america that he would call asap. Well a day later, still no phone call from mr. allah. I called the customer service dept to complian and that person didn't return my phone call.
I feel compeltely scammed! The gentleman over the phone yesterday told me that mr. allah by law was supposed to provide me with a 45 page disclosure notice. I never recieved a single doucment from mr. allah other than the one pagers "borrow's certification & authorization" and "letter of authorization for wingspan"
In addtion this man told me he would be able to modif my loan or work out a short pay off. Apparnetly lend america doesn't do these service. So what the hell was he trying to sell me.
I just hope something was not screwed up on my loan by lend america where I am going to loose my house.
This place is a scam!

Lend America giving out private info to third parties

Here is a copy of an email I sent to Lend America. Their answere to my complaint was to villify me for having bad credit as iff this whole thing was my fault that they where terriable!

Also my name and number was given wihout my consent to a legal office that does home modification. I feel that I should have been notified of the fact that I was not getting the loan by some fromn you company and not a person who does not work for you. I was looking to refinance not modify my mortgage. Wolfgang told me in any eariler conversation that you (LendAmerica) did not deal with any outside loan modifcation companys. I also feel put upon to have paid for an apprasial and now be expected to pay for a modification. Unless this matter is resolved I feel it is my duty to report your company to FTC and the BBB.
1. In regards to the refinance on my mortgage. I started this process in April. I never received a call back from your company. I called back and spoke to Wolfgang. He gave me the confidence in your company to continue to work with it instead of going to another company. He ordered an appraisal and everything was going well until I found out he was no longer working for your company. I had planed to use some of the cash back to pay my taxes but... the next person who was assigned to my case was Brian Dowling. He was not very good at returning calls and requested lots of information. I was very quick to get this info to him but every time I finally got him on the phone...he needed more information, i.e. LOE's, more pay stubs, doctors notes. I complied with everything even tough I felt like I was jumping through hoops! I finally contacted Chris Ryan, Brian's supervisor to find out the status of my loan. Again more information was requested. I was easier to contact Chris and he finally had the document expeditor Pinchas Barwigdor contact me directly to get all the paper work he required. Things finally started moving along and the file went to the under writer. Now I find I am being denied the loan due to back taxes. I did offer th borrow the money from my mother-in-law even though I feel if the loan had been done in May or the beginning of June I would have been able to pay those taxes before they where listed as past due. Apparently the underwriter is not pleased with my score or the back taxes. If this is the case fine. I feel you have wasted 3 ½ months of my life on a loan that was never going to happen and I can not in all fairness recommend you to ANYONE else. I feel if the underwriter felt so strongly about my loan, LendAmerica should have been up-front instead of wasting my time and theirs. I really need this refinance due to difficult financial constraints of having a disabled child and the need to give her the attention she requires. I wonder if I had gone to one of your competitors if this would have been taken care of months ago.

My complaint is against the direct lender Ideal Mortgage Bankers, LTD. Dba Lend America. I was trying to refinance my home with an FHA loan. My complaint is that they gave personal information to a third party mortgage modification attorney without my consent, lied to me and generally treated me like insignificant trash. Here is everything thing that happened while dealing with this company.
I called Lend America’s toll free number in March of this year. I was told that they would run my credit and get back to me by Monday. A week later I still had not heard back so I called again and spoke to Wolfgang. He told me he would personally handle my account. It took a few days for him to access my information. He said he was waiting for a supervisor to unlock everything because he did not want to run my credit again. He told I qualified and he was ordering an apprisal that I would have to pay for. A third party contacted me and they set up the apprisal. I took almost two weeks to get the appraiser out here and then another week to get the report. I was in contact with Wolfgang during this whole process. He wanted to do the mortgage in both mine and my husbands name. There were several bills we would be paying off and the rate would be 5.5%. Closing cost would be around $3900. I am enclosing the copy of my credit report that he emailed me. My score was 534 and my husband was 560, which are within the FHA guidelines. I tried calling Wolfgang for 5 days with no return to my calls. I finally called the general number and spoke to the first person who answered. I told them I was looking for Wolfgang and they told me I would need to talk to Chris Ryan. They transferred me to Jeremy Shippy. I called back and used the prompt for the directory and got Chris’s extension. I called him several time and did not leave a message. I finally reached him and asked him what was going on. This is mid May. He told me Wolfgang was no longer with them and Brian Dowling would be handling my case. He gave me his extension. I called and left a message. I did not hear from him so I called back the next day several times without leaving a message until I reached him. I appeared they had not received my apprisal. I called the Management company and had them resend the apprisal. I finally reached Brian the next day and he told me we would be closing soon. He gave me three different closing dates. He sent me a package Fed EX that I signed paperwork about rates and such. I was getting 6%. He said the rates went up. Closing cost where 8900. He said I had to pay a lot of “points” because of the low amount of the loan and the credit score. He had Funding Suite contact my creditors and agree to pay them for me. They called my currant Mortgage Co (CITI Bank Rep. Jodie [protected]) and asked her inappropriate questions twice once with me on the phone in a conference call. Jodie called and told me about the first time. Then Brian told me then need additional information. I got it back to him within a day. Then he need more information. This took awhile since he need a letter from my daughter’s doctor saying she was disabled. This is now July and the Doctor was on Vacation. I still had it back to him within 10 days. Then he needed more information. Again I got it back to him within the day. Each time I talked to him I asked if I was getting this loan. He said yes it was just taking awhile because my credit score was so low. He finally stopped returning my calls and I got back in touch with Chris. He told me he would be handling my case personally. We talked several times and he requested additional information as well. Again I complied quickly and again I continued to ask if I was getting this loan. Again I was told I was but it was taking awhile again due to the low score. He had the document expediter call me directly and he request more information. I complied quickly again! Chris told me it was going to the underwriter. I called Monday and he said the underwriter was looking at it to call back that evening. I called and did not reach him. I called on Tuesday and he told me not to keep calling him HE would call me as soon as he heard something. I got an email from him later that afternoon to call him ASAP. I called and he asked if his associate had reached me and I said no. I asked what number and he had been calling on my fax so I told him I would unplug my fax and what for his call. About 20 min later I got a call from a man named David and he told me he worked for an Attorney that did debt consolidation and other things as well as mortgage modifications.. He said that Chris had asked him to call me hoping he could help me since I did not get the loan. I was angry and embarrassed ! I flat out asked him how much this was going to coast me. He said they could cut my payment in half. How much I asked again. He told me maybe nothing but probably around 500 to 600. He would call me back. He would not give me his number or the name of the law office but he could also tell I was mad. I sent an email to Frank Lagrega and Michael Ashley telling them why I was upset with their company. Frank called me . The upshot of the conversation was that my credit was terrible and I should have expected not to get financed. Did I really feel I needed to lodge a formal complaint? Chris would be fired if I did and was I really that mean of a person? Chris called me that night and let me know that he was just helping me and now I was going to get him fired unless I changed my story. That they would give me my appraisal fee back but if I complained to the Attorney General’s office, he would lose his job and I would get nothing. I spoke to Frank aging the next day and again listened to how bad my credit was and how they did everything possible to help me. I wanted to speak to Frank’s supervisor and he told me I could speak to the head of underwriting. I told them they where not listening to me . I understood that I did not get the loan and that I wanted to fell that I mattered, my business mattered I wanted the time I had wasted back and not to have payed for an appraisal. Again they went on about my terrible credit. I started to interrupt and was told that he had let me speak now I needed to let him speak. They had tried everything they could but could not get my loan approved due to my credit and they could not sell it to their investors that if they funded this loan they may be stuck with it. I told him that I did not want to hear about my credit anymore that they where rubbing salt into wounds. I didn’t care about not getting the loan and they weren’t going to make me think that the way I was treated was justified due to my:”lousy credit score. I was mislead, lied to, my information released to a third party, and then made to feel small and delinquent . I said I had a complaint and I felt they could not correct the situation unless it was brought to their attention and that is what I was doing and their answer was to NOT Listen to ME! Frank agreed to mail out a check for the appraisal fees and then he sent me an email which I will enclose. I don’t think a company that is Ginnie Mae certified should treat people the way I was treated and if they will not address the problem they should be held accountable.

Update On Lend America Scam.

I have learned from an unnamed source that Lend America is about to enter the wholesale loan business. The goal is to dump a lot of bad loans on the market and declare bankruptcy. They can then buy back this bad debt at a fraction of the cost, foreclose on these homes and make a huge profit off the sale of these properties. I guess they where not making enough padding the closing costs they have sunk to a new low and found another way to rip our government and the people off. I truly feel sorry for Michael Primeu who is the Company head on paper and who will most likely take the fall for Micheal Ashley's scams. You can always ask Michael's father about that. I wonder if this will be another power play between Primeu and the government with Ashley caught in the middle. If you believe that have I got the mortgage for you.

Update on my complaint. Mr. Wilkerson called my fraud investigetor early last week to tell her that they had not done this. My investigator said that was fine but, the State of Iowa required that in writing! It has been 12 days and we still don't have this in writing! I was also told two months ago that Cris Ryan had been fired but I found out today that up until last week he was still working for them and only left because he got a better job. How can you trust someone who lies more than they tell the truth!

Answers? I Think Not!

After many days, (this complaint was forwarded on the 25 of August!) Lend America has finally responded to my complaint. Remember I had five simple questions I wanted answered and to refresh your memory here they are:

1. How did this happen?
2. Who was involved?
3. Why did this happen?
4. Who let it happen?
5. What are they going to do to insure this doesn't happen again?

Luckily they stopped this company before they became "To Big To Fail". People like this are killing my industry with their greedy, self absorbed and short sighted get rich at the expense of everyone. jail is to good for these people.

How smug to think you could move into the old American Home Building and scam Uncle Sam and the public out of billions of dollars. From what I hear Mr. Ashley believe's he is the "Teflon Don" of the mortgage industry.

If there are any honest employees that got caught up in this "Jonestown" of a company, know that there are honest brokers and bankers out there to work for. Start looking for a new job now as all of those displaced employees who do not find themselves in jail, will be fighting for the same jobs.

Honesty and Integrity still exist in Huntington.

I agree that this company is a big snobby bunch who did the same thing to me.I was treated very bad by an Lend America rep.who did not even know how to began to start a loan for refinancing.He went through many details, then said for a previous thing from years gone by with credit, and then said they do not refinance certain homes.Why could he not began the process by stating what they do refinance.Never will deal with them again.Hope Fox News drops their add.

Lend America Can't Settle

We are selling a house we used for rental. May 30th was *supposed to have been *settlement day. It is NOW Aug.10, 2009. Settlement so far was set up and canceled 6 times thru *Lend America ! The *Buyer is getting the cold shoulder and so are we. Neither side ( our Realtor included) is able to get a phone call-BACK . Left Messages are not returned and when they DO answer the phone the same thing is said, "I have the PKG. on my desk and will have it on your desk by Monday for *Settlement. They do not TELL you which Monday and what YEAR. Joe Giacube and John Waszkiewicz are the TWO main players in the handling of the exchange of home owner. Our rental is PAID in full YET they are dragging their HOOVES! The *Buyer for our house works for a Court House and I hope to GOD she opens her mouth to several Attn. there .I have read several of the stories here and I feel bad for what this SHARK of a Company is doing to the Public!I am also in agreement with what one other person had to say, " Lawsuit against the Company...Better Business Bureau and any other Complaint Service out there. This Company fails to also realize the INTERNET reaches more people than a written letter!

I have to say that I was very skeptical that I would be writing a positive comment about ever getting to settlement when I responded to Mr. Savitsky's request for information in regard to the posted complaint. However, I am pleased to say that on August 25, 2009 I made it to the table and completed settlement.
A very large THANK YOU goes out to Mr. Savitsky's paralegal assistant Ms. Renni Campo (finally got your name right) who worked tirelessly to get all the parties involved on the same page and keep them there as well as providing continual updates that kept the lines of communication clear.
My second THANK YOU goes out to Paul Podgorski, Broker of Record and Owner of Century 21 Premier Reality in Woodbury Heights NJ and his Sales Associate Jarrad Bradt who worked, pushed and tolerated my constant phone calls since May of 2009 and helped get this deal closed. Thanks, Paul for not dropping me. This to me was extremely significant because I brought the Buyer to Mr. Podgorski who agreed to a flat rate fee verses his customary sales percentage.
My third and biggest Thank You goes out to my wife Janet who lit the fuse on this whole thing when she posted the initial complaint. Without her effort we may have very well still been the owner of this property for quite some time (jewelery store here she comes).
So in closing this has become a happy ending to bad situation in a little more two weeks.

At 11:30 am I contacted Mr. Savitsky Office and left a message. At 1:17 this afternoon, a woman by the name of Robin returned our call and informed both my DH and I that Mr. Savitsky was in Court and that with the information that was given to her (name, addy of both parties) that she will see to it that when Mr. Savitsky returned he would have the information *Needed ...she ( Robin) also informed my DH that Mr. Joe xxxxx was no longer with Lend America and has not been there for 2-3 weeks, which is the time that WE were supposed to have been at the table signing on the dotted line, , although his *Supervisor never informed us about the exit of Mr.Joexxxx, nor did anyone in the office return any calls and I am sure that our pkg. was NOT the only one that was not given priority to settle.I would like to say that Mr. Savitsky office and time of call back was very efficent and professional and I am looking forward to having this problem resolved.

Also got caught in the Joe Giacobbe departure from Lend America.
Couldn't get a reply to phone calls or E-mails for 2 weeks before I called .
Finally got someone on the line who was going to check and get back to me in a couple of minutes. Been 3 days, 3 more phone calls. No response!
We were approved for an H4H loan and had a May closing.
Still waiting.
Had to hock my underwear to stall the auction on my house in July.
Out of time.
Out of assets to sell.
Ready to bail and let another liar and Thief, Saxon Mortgage, just have the SOB.

This happens often with Lend America, I have heard of many families closing their loans with Lend America and the loan will not be paid off for 4 weeks, causing the customers to be reported late on their mortgage and their credit report. This company is not a good company and needs to be stopped.

Lend America Non payment of Appraisal Fees

In 10 years of appraising real estate I have delt with alot of fraud and dishonesty, and with all the bank melt downs you would think that mortgage companies would have straighted up, This not the case with Lend America loan originater Michael O'Hara in Melville NY. After three months of phone calls and emails trying to get paid his supervisor explained that it was the owners responsibity to pay if things did not close and with the new laws the lender is not suppose to speak to the appraiser. Well he knows part of the law, the appraiser is also not suppose to except payment directely for the borrower. I find this interesting since I was contacted directly by Lend America and was instructed by Mr. Ohera to send him the bill.

Lend America poor customer service

Poor Customer Service
I contacted Jason Moonshine at Lend America and he took down my details for a refinance-stated he would call me back in one hour but never called back- After several weeks I called him and he stated he had misplaced my phone numberbut would call me back later on in the day. Well, days went into weeks without call from Mr. Monshine.
Finally I called Ivan and stated that I needed to talk to his executive. I immediately got a call from Mr Monshine with no acknowledgement that i needed to contact his bosses for him to call me or why there was such a lapse in him calling me-he was just business as usual--DOES HE REALLY THINK I WOULD DO BUSINES WITH HIM WHEN HE CANT CALL ME BACK!

I too have dealt with Jason Monshine. I spoke with him a few weeks ago and he told me also he would return my call. I then contacted the company again and they told me all I could do was be put through to his voice mail. A week later Im still waiting for his call and I think your right. My business does not seem important to him. I was actually surprised to see his name mentioned here and when I read the same experience Im having, it is confirmed that I wont be doing business with Jason.

Dear "Livingston": I, Jason Monshine, wish to personally respond to this complaint. I am fully aware of the customer this had happened to and I am fully at fault for what had happened, and apologize. When this person contacted me I took down all necessary information to qualify him for a mortgage. When I wrote the phone number I did in fact reverse 2 of the numbers and when I called back less then an hour later, the number was disconnected. I looked online to see if you could find the number using the name and address but was unsuccessful. Thankfully, this customer called our customer service department with the correct phone number and then I immediately called him back because the fact remains I was ready to present a terrific financial option. We are all human and a slight mistake when taking down the phone number was my only error. Again, I do apologize for what had happened; the financial option is still available if you see fit to better your mortgage situation. I remain at your service.

Mr. Primeau:

I am writing to let you know how very unhappy we are with the service received from your company while trying to obtain a loan. In late November 2008 I contacted your company concerning a loan to finish a new addition to our home. Etna Rosso, loan analyst took my call. I explained to her that we had started an addition to our home so we could make my three developmentally disabled relatives residing with us more comfortable and safe. We had enough money to do the framing and get it closed in, but we needed additional funds to complete the inside of the structure. She took my information and said we qualified, no problem. A few days later she called and said all was well and we could look at a closing date of 20 December, 2008. On the 19th I hadn’t heard anything so I called her. She informed me since we had already started construction we couldn’t do the type loan she had set up for us. She hadn’t bothered to call us at all. Had I not called I wonder when she was planning on letting us know. She then said we could do a renovation loan but we couldn’t get funding until we had all the plumbing, heating and electrical done. I told her we didn’t have the money to do this. That was the purpose of asking for the loan in the first place. She said, and I quote, “Couldn’t you just borrow the money from someone and pay it back when we fund the loan?” I told her I wasn’t trying to borrow from someone else! I asked if the time to finish those projects was going to be a problem, since it would take a while to complete. She said, again, no problem. We were already in the system and the paperwork would be put on hold; so we stretched and begged our workers to work without full pay so we could get that done. We called to let her know those projects done, then she said we had to have a Certificate of Occupancy…more money out of pocket and people we couldn’t pay, all believing as we did that it would only be a few weeks. We got the certificate. We called again. She then told us we had to send all the paperwork again because our initial file had been shredded since it had been so long and she was trying to protect us. We sent all the paperwork back in. She set up for an appraisal. The appraisal came back at $225, 000. Then she said we had some flooring, trimwork, paint and porches that had to be done before they would fund. By this time we were extremely frustrated, but had people we owed due to her inability to give us full information each time we talked to her. She kept telling us “this is the last thing and then we can fund this loan” every time we talked to her. We finished the work and the appraiser had to come out again (adding up to almost $1000 in fees). I called her a couple of days later to see if it was in and she told me it was perfect, all the paperwork was done and we could close end of the week, no problem. No contact after that. From that time on, she told us three separate times we had a closing date, the paperwork had been signed and everything was approved. We asked several times to talk to a supervisor to no avail. I finally had to call the complaint department several times to get responses. This dragged over more than a month’s time. We were supposed to close in May (three separate times, according to her, and yes we have copies of the e-mail traffic from her stating so). Because she lied to us repeatedly, we had payments come due on our mortgage and ended up having to pay those. Finally, we got to the closing date. When the closer started with the paperwork, the amount of the loan was $22, 000 lower than it was supposed to be. The appraisal amount was lower than the appraiser quoted. The interest rate was higher than we were quoted. It was a mess. We signed the papers because at this point we have to be able to pay the people we owe or we would have cancelled this loan. I called your complaint department this morning. They transferred me to Andreas Elestheriou, Etna’s supervisor. He acted as if he understood, but had no idea any of the changes had been made, or anything about all the lies Etna told us. He couldn’t tell me why the totals were different or why the appraisal was changed. Shouldn’t loan officers know about changes before they send anything forward and shouldn’t the client be informed? We have been totally coerced by your people, lied to, cheated and treated terribly. If your whole company conducts business like this, I can’t imagine how any of you sleep at night. There will be a copy of this letter sent to the Better Business Bureau and I am investigating whether there is any other authority I can report to. I thought my husband was going to have a heart attack trying to get through this process and we have had extremely hard times trying to make this work. We did our part and your company was very shoddy about doing their end of the process. We have been through several mortgage loan processes and have never had this much heartache or been treated so badly.
This was supposed to be a special year for my family. My two sisters and a niece who are developmentally disabled were supposed to have a better and safer place to live, my son was graduating this year and was planning a graduation trip (which had to be cancelled) and to give up much more he should have been able to enjoy for his senior year. We were supposed to finally get a mortgage that would give us more freedom to do the things we wanted to do. In an economy that is awful, we were going to be doing better and being more secure. That was what this loan was supposed to do. Instead, we have had to beg, borrow and scrape to do the things this loan was originally intended for. It was intended to finish this house….we had to do that ourselves, begging people to wait for their money, putting them off time after time because your workers couldn’t get their jobs done. What was supposed to be a good year for us turned into a total nightmare.
I don’t know if you really care about your company’s reputation, or if it’s just a money game to you, but I will do my best to let everyone know how we were treated. If you really do care, I hope you will look into this and try to fix it so your future clients don’t have to suffer through what we have. I would appreciate a response.

Lend America Refinancing-Not paying off old mtg loan

We refinanced our home with Lend America in Jan 2009, on May 22, 2009 our old loan company Wells Fargo had scheduled a lock out of our home. We had 20 minutes to gather belongings and get out. With four children and pets and I do not drive, my husband works in Baltimore, which is 2 hours away, I had to GET OUT. Come to find out, Lend America NEVER paid off our original loan. We have been paying them for 5 months, everything is in their computer system but all of our paperwork is supposedly been lost, gone. They at first admitted to their mistake and sent a check to Wells Fargo then turned around to put a stop payment on it. I am wondering if this is actually a scan, I am out. We do have a lawyer and we are trying to resolve the issue, but Lend America will not get back with us to let us know one way or the other. My children want their toys, their beds, their games. We were promised to get back in and we are not yet. This has been a nightmare, an embarrassment. Feelings of letting down my children, I cannot imagine how they are feeling. Something needs to be done with this company, they are supposed to be government backed, maybe the government should stop backing these rip offs. I do have to say though, Wells Fargo has bent over backwards to try to help, which they did not have to do. They too have been wronged, with promisory notes from Lend America. I do say thanks to Wells Fargo and their understanding staff, it is much appreciated and we know your hands are tied to an extend too. You are appreciated in this time. Thank you Wells Fargo.

Well. ... I came this site after seeing lend America on TV. I can already tell that this is an orgqanizarion that is ran haphazardly. I am no longer interested in doing business with them. many thanks to the couple that wrote in and saved the rest of us from similar torment.

This is obvious by your assuming the writter to be the husband!

This happens often at lend America and I do not understand how they are still able to do business. The lawyer Robert is on staff at Lend America and has to spend his days reading all negative press and trying to defend his company. It is a joke, in every complaint he starts with " I have been in contact with Lend America to investigate your allegations" he is in the same office with the same address. Please this company is full of smoke and mirrors and will be on Dateline sometime soon.

Lend America has never originated a loan for you or your wife, nor even taken a mortgage application or ran a credit report in your or your wife’s name. This has been confirmed by a search of Lend America’s mortgage database and through their outside credit vendor. While Lend America is sympathetic to your family’s situation, having been evicted by your mortgage bank, Lend America had absolutely no involvement in this matter.

Lend America No loan after receiving approval status-plus lend america officers rude and ignoring/deleting e-mails without being read

I started the loan process with Lend America in April of 2008, was approved and it was one stall after another, (supposedly, all my loan application and private information was lost, (which was completely unprofessional and I am not sure that I can believe that to begin with and if they did, they have allowed my private and confidential information to be assessible to anyone) (Thanks for that Lend America) another company bought out who they were getting the loans from, and then finally, when I kept calling and e-mailing the underwriter and the loan processor, Lisa Staab began deleting my e-mails without being read and Lisa and Ronny both ignoring my calls, it has been 9 months after the commercial said it would be 3 days if you were approved. Ha Ha Ha to that pack of lies and FALSE ADVERTISEMENT. The loan officer was Lisa Staab and the underwriter was Ronny Ojenski who are poor business people going by how I was treated.
I then got on line and contacted John Lavallo who is in the communications department at Lend America who acted as if he would look into it, which he did and e-mailed me back, and said they would be contacting me and taking care of things. Well, they did contact me to say they were sorry about the delay and that Him and Lisa would be getting my file and get going with it. Well, That was it. I have tried contacting them and all I receive is nothing.
If Lend America is not going to do what they say, then take your ads on the television and stop taking advantage of people who are well paying for your services in the amount they are charging for processing the loan to begin with.
Lend America is in my opinion from the way I was treated, ignored and strung along for 9 months is not a business to deal with, especially the rude employees that I had contact with.

I had all that happen plus my info was given to a third party mortgage mod lawyer. I have lodged complaints with the Attorney General of Iowa and New York, with the FHA and Ginnie Mae and am now working with the FTC and a Class action Attorney. Please contact the Attorney General of your state, and FHA and Ginnie Mae. That is the only way to put a stop to treatment like this!

Well, initially my experience was great. Mike Rawson was my loan officer, and he seemed to be on top of things wonderfully. It sounded like he worked very closely with the underwriter and his managers to make sure all files were all in order and complete and ready to go. I started this refinance in May 2009. The course of events were odd to me, but im a new parent, i just thought since i had that and my full time job that i was missing something. the couse of events follows...
1. apparantly you have to lock yourself into a rate, they wont do it for you. You sign all the documents that your percentage rate is as low as 5.0 but you get yelled at by your loan officer when you question what happened to the rate and how they gave you the impression you would be closing on that interest rate within 10 days. then your rate goes up and you cannot have it brought back down even though everything you signed for THAT loan says the lower rate.
2. expect to 'hurry up and wait'. you will be hounded for stuff they want, but when it comes to your pocket (if you really really need the refi) you wait for the 'legal dept'. if you hound them with your hectic schedule and the need to close soon, your loan officer will reprimand you that you should not only be patient, but you should have kept up to begin with.
3. expect to be told you will close that week and wait another week to find out when you MIGHT be able to close.
4. expect to be told over and over again not to worry about anything, you will close on this.
5. expect to be told they will max out the money to cash out at closing and theres nothing you can change about that, even if you cannot afford what it does to your monthly payment.
6. expect them to lie to you about the closing;
a. your file wont make it to underwriting because it will be stopped by a manager, especially if you have
questionable credit.
b. they will lie about this too, they will tell you that underwriting disapproved the loan when they never
even saw it.
c. expect them to lose your file. i know, i know, but ive kept in touch with my ex-loan officer, who was since
fired after MY loan was not approved, and he said that the staff will say this because they feel that you
are not entitled to a copy of your own file there., not even the appraisal.
7. at any point through this process, if you go with a lender-approved appraiser, expect them to tell you that if
you try and goto another bank, you will not get a copy of your appraisal and even if you do, the appraiser w
will not, ever, resign it to another lender (which if its requested, they are required to by law)
8. when you call and ask for reasons after your not approved, you will be lied to about the whole process.

I agree 100%! the employees were very rude. Numerous times I've tried contacting my agent(Seth Mckenna) as he helped me with a pre-approval and I kept getting his voicemail, left numerous messages/emails and no response. I've been hung up on and finally I got in touch with Seth and he didn't even know who I was! The sellers of the home we were looking to buy, wanted us to get another pre-approval from somewhere else because they had dealt with Lend America and they said their fees were astronomical and they were they reason for most foreclosures. They also said that Lend America were known for leaving homes pending on the market and then processing the loans which causes the sale to fall through! Thank goodness we didn't go any further with Lend America and we did not come out of pocket for anythng. I would definitely not recommend Lend America to anyone- If you see their ads or commercials please don't bother - you will very sorry you did!

We were selling our home to a couple that was going through Lend America! They told us numerous times that we were gonna close for us to pack up our home and everything! We signed a contract on September 22nd 2008 and yesterday January 5th 2009, the buyers got a call and said that the file was closed and that they were not going to do the loan! I have got over a hundred e mails from Kevin Blake at Lend America that said that everything was going good and that we should be closing soon and still nothing! I do not think that it is right for a company like Lend America to tell someone that they are approved and to also tell the sellers of the home that they are going to be able to close and that they can pack up their home.. I have got a family that I have got to think about and how could someone to that to someone and get away with it! I do not think that that is right and I think that someone should do something about it! The buyers of our home has got 2 kids that are devistated because they thought that they were finally getting their dream home and it has just all went down hill. I have contacted many people at Lend America tryig to explain the situation so that we could get our home sold and be happy. We ourselves had written another contract on a home and also paid $535.00 for an apprasial on that home and we lost all of that! I just do not think it is fair and I would really appreciate someone's attention on this because we sure did not get it from Lend America!

I too had such a run around with Lend America.
5 times my escrow was extended because they never got the paperwork done on time.
When we reached the last extension...they said my property tax would make my debt ratio too high...even
though they were basing it on the last person's taxes on the house from 3 years ago. They wanted me to run
around to the city and county to get an estimate of my taxes even though we told them according to CA law,
I'd be paying 1% of the purchase price.
I would never, NEVER, recommend these people

I REFINACED MY HOME IN SEPT. 2009 OR I THOUGHT I WAS GETING A REFINACE. IT WAS WITH LEND AMERICA. THEY NEVER PAID OFF MY MORGAGED. IT WENT ON FOR ABOUT 6 MONTHS. I WAS CONTACKED BY COMPANY. THAT LEND AMERICA HAD SOLD THEM MY LOAN THAT THEY NEVER PAID OFF. IM SAYING LEND AMERICA NEVER PAID OFF MY MORGAGED. THE MORGAGED WAS FINIALY PAID OFF ABOUT 8 MONTHS AFTER I FIRST DONE BUISNESS WITH LEND AMERICA. NOW IM ABOUT TO LOOSE MY HOME. BECAUES. THEY SAY I OWE THEM 3000.00 DOLLARS BACK PAYMENTS THAT I DIDN`T PAY I DID NOT PAY LEND AMERICA BUT ONE PAYMENT. WHEN I SAW THEY WAS CLOSEING THE COMPANY IN NEW YORK I DID NOT PAY THEM NOTHING. WAS NOT GOING TO PAY A COMPANY THAT HAD NOT PAID OFF MY MORGAGE. I CANT SEE HOW A MORGAGE COMP. CAN SALE YOUR MORGAGE. WHEN IT WAS NEVER PAY OFF. IF ANY BODY. We refied with Len America at 5.5 interest rate we were completely happy with how we thought that things were going... Lend Americas loans we taken away and placed with Loan Care... but not before Lend America completely screwed us over. As we all know with an FHA loans we are required to have an escrow account. They DID NOT pay my home owners insurance and it was cancelled, as soon as we were notified by the insurance company and not Lend America we purchased insurance ourselves. Even though it was their fault that the insurance was cancelled they put this over priced forced placed insurance on out account. They were sent coverage proof on several occasions and they are refusing to get out money back to us. They completely drained ou escrow account before Loan Care took over. Because of the negative balance in our excrow it has made our payments go up by almost $300 a month! That is a car payment to us and it has completely took away the wiggle room in our budget. If anyone has any info about a class action law suit against these theives please let us know!

I refinanced with lend america which lowered my interset rate from 10.5 to 6.5 but still have the same payments, they screwed up the paperwork and put some of it with both my husband and my name and some with only his name and sold the acct to gmac. My husband died and gmac is talking of foreclosing on me if i don't get the house switched to my name on the title. Well gmac I am current on my mortgage, my name is on the deed eventhough lend america screwed up the paperwork. I have a fixed rate but each month my mortgage payments are different. I KNOW IT SOUNDS CONFUSING. THESE MORTGAGE COMPANIES HAVE GONE CRAZY. I AM LOOKING TO FILE A LAWSUIT ON BOTH. Oh and lend america refinanced me borrowing an extra 17k which i never saw a dime of but am paying it back. Yes we had MI but was supposedly canceled in January over the phone with no paperwork or reciept and am still paying that insurance through the mortgage. I SAY ITS TIME TO STOP THIS TYPE OF ABUSE FROM MORTGAGE COMPANIES NOW.

I too had a bad experience with Lend America. I was referred to Lend America by my mortgage company, Kondaur Capital. I was in foreclosure and I was told by my mortgage company that Lend America could help me refinance and get my payments where I could afford. I work with Lend America for four months. My house was scheduled for sale on April 1, 2009. I did not hear from anyone from Lend America so I was forced to file Chapter 13 to save my house. In the meantime, Lend America told me that I had the loan and that my Chapter 13 could be dismissed. Lend America even went as far as to have all of my escrow information transferred to them. They were listed as the mortgagor on my home owner's insurance policy. After several phone calls to my contact (Igor Lipkin), no response. I finally called the office on a Saturday and as luck had it I spoke with Tim Messiner only to learn that my loan was not approved. Now I am paying $1, 300 for my Chapter 13 and $2, 500 for my mortgage. I could very well lose my home. Thanks Lend America.

On December 1, 2009, we were notified by Lend America that HUD and FHA, has pulled their license and they (Lend America) could no longer originate loans, everything was just stopped cold. We were suppose to close on a property in McDonough, Georgia. We have all
our things packed, we had ordered a moving van, we gave away furniture, , as we were on
several occasions told we were ready to close. We are now struggling to have the Realtor return our earnest money. We were not in default. If anyone knows of a class action suit, please contact me at. blackdaffodil49@yahoo.com. Also, if anyone knows of a office or program that helps to mediate when there is a conflict, please contact me right away. There should be a suit against Lend America, they were dishonest and that hurt a lot of people.
