Our house is a mess they sent a plumber for a leak and they cut holes every where and noone has fixed them call hector gonzalez or any attorney of your choice if you are not in texas

As to all of the questions asked yes there are alot of defectives in my home and they are being fixed as we speak by a company that has been in buisness for many years and stand behind their work, all the defects of all the engineers are being looked at and fixed if not then they will be, I went to have a home built and it had defects so they are being fixed I still have a mortgage and I have monthly payments higher than anyone elses
I did not walk into that business and say build me a house and I want it for free
So they are fixing it and I will sontinue to pay payments until it is paid for
As to receiving any cash that is upsurd we are not receiving any money just our home fixed and a chance to get back on track and pay the payments for what we are supposed to pay

In april of 09 a man from jim walter homes and companies flew to my house from tampa to look at my house where I had made many calls about all the defects in my home and yes there are many defects in my home he wrote up two pages of defects and they offered to make those repairs during this time something went wrong and paperwork didnt make it here in proper form so angry once again when my neighbor found an attorney I thought it was a great idea, but after long months of seeing the other side of things I knew the right choice for me and my family was to get our home repaired
Walter energy is fixing my home with the punch list that mr reeber first stated they would fix as well as all the other things wrong with my house that the engineer found while inspecting my home the winstorm issues are being fixed to meet windstorm
Mr reeber is personally on the site overseeing everything
I am not being paid to get on line and ask anyone to do anything it is each homeowners choice I am just stating that for my family this is the right way to go
It is well and good that so many people were able to get a free house well I was raised to work and pay for what I buy
As for me getting half a million dollars that is so stupid to me
I have a 128 thousand dollar house no this company did not offer me any money
What I do have is a piece of mind and can sleep at night knowing that for me the nightmare is over
All I wanted was my home fixed right and up to the standards it should be and the walter energy and jim walter home companies are doing that
I chose to drop out of the lawsuit for personal reasons and I am not on here trying to talk bad about anyone or thier choice's all I ask is that me and my family be left alone
We arent on here bad mouthing anyone or stating what anyone should do and only ask the same in return
All I can say is this I knew I would have house payments when I had my house built I knew that it was affordable housing not custom housing I wanted it to look like the model I saw but didnt read the fine print that says illusions to what home could look like
So is that anyones fault but mine no it isnt

Who is representing the Law Firm of Hector P. Gonzales? What are their contact numbers? There are no working numbers for his law firm and his assistant Roshanda Cotton has changed all her information as well! I would like to know what is happening with my case I filed in 2012 and it is now 2020 and haven’t heard about my case in about 3 yrs!

I don't know if any one still looks at these complaints but it would be nice if someone (attorney) would help those of us that are still paying on mortgage to these lying thieves. It is strange how they can file bankruptcy and get a license to start a brand new business doing the same shoty work as they did under the original name of JIM WALTER HOMES. They file bankruptcy, another company takes the notes and files bankruptcy and now a third company DITECH that has taken over the notes has filed bankruptcy. But still no relief from any attorney or the lender in getting this falling down two story house fixed. I have contacted this Hector Gonzalez several times and apparently he no longer takes JWH cased because he has never returned any messages we left. BUT I promise you if we stopped sending those monthly payments to these broken down lenders they would be out there within a month to evict us..AND would probably NEVER look at defective house. We have original blueprint-MANY pictures and even the letter stating that OSB should NOT BE USED ON TWO STORY HOMES..apparently contractor did not read that part. We complained everytime the "super" would come out and look at construction...but he would laugh and say "OSB is the best on the market for building". When asked why did plans say not to use the OSB he claimed it was typo..We are not looking for any money. All we want is for the lien to be satisfied or written off and we will not have to make any more payments to CROOKS! Attorney fees is all we look to get out of this and our monthly mortgage payment GONE!

We have been in our two story JWH for 12 years and live in fear everyday the second story will come crashing in. We are now on our 3rd lender since first signing contract with JWH. We have the original blueprint and the building instructions saying a two story house should NOT use OSB due to not being strong enough to hold up flooring. They used OSB when building-we did not sign off on that. The roofing was done by folks that had no idea how to do-did not sign off on roof. The corners of the pier and beam house has shimmies to try and make level-which after house was being built shims were of no good-porch does not sit on blocks and house has been leveled twice since being built in 2006. We are located in Texas and have tried to get something done to no avail. We have pictures of house being built and copy of the final walk thru. Even though JWH is in bankruptcy they are still operating under different entities and it is not right. Make my loan right by signing off on it and giving me the satisfaction of not making any more payments to the crooks. If there are any attorneys willing to look into all these complaints please feel free to contact us!

I am not sure if anyone is still on this forum, but I happened to look up complaints on Jim Walter Homes. We have been in our home 11 years come July. Our problems with Jim Walters started before our home was even built. We were approved for a Jim Walter home and thought it was awesome. We were moving out of our trailer into a nice stick built, sturdy home, or so we thought. We had several acres of land and the crew knee exactly where we wanted to put our home. We had that area graded off and ready for them to show up to start the foundation process. $3, 500 later, they show up and say they could not put it there. That it would have to be put lower. We explained how much money we had spent and asked why they did not tell us this beforehand. Of course they shrugged it off. While choosing the only spot (they chose) to put the house, they had a piece of equipment that ran over our septic tank. They did not want to fix it and put the blame on us. We have to have a special septic tank because of the soil in our area. They wanted to go with a cheaper tank, and finally agreed to put one in like the one we had (which was only a couple years old). First thing when building the house, they put the wrong color of siding up, but it was to late. By the time we saw it, it was almost finished, so we settled with it. When the house was finished, they had to come back because of things they did wrong, or things that were not finished. They never did install the gutters, which should have been a part of the building process. Now almost 11 years later, we have water damage under our house. There are springs in the mountain behind us. This is one of the reasons we wanted the house built where we began grading. Up on the hill. Now our foundation is settling, There is mold under the house and mold that comes in our bedroom closets from the moisture. Also our septic tank bubbles out in the yard. My husband has spent a fortune trying to fix the seepage around the house and the septic, to which no avail has been fixed. I just wonder now what type of septic tank they did end up putting in. Also our shingles and starting to sag on areas. I could understand some of this if we had the house a while, but it is only almost 11 yrs old. We should not have this many problems already. It makes me dread the work as the house gets older. We have 4 kids and wanted to enjoy our new home. Not have to deal with problems right off the bat. I live in WV. If anyone knows of someone I can reach out to for help on our situation, please let me know. Thank you for any help. Its greatly appreciated!

Does anyone know an attorney in Louisiana who has handled these cases and won? My home is 3 years old and i tried getting the contractors to finish/fix my problems before they were finished building it. They never really "finished" my house. My husband did out of our own pockets. I do not want my house falling apart in 5 years but still making the payments and having to pay the repairs myself. So frustrating! I have 4 kids to support so we can't just go stay somewhere else when our home is falling apart. Any help is appreciated!

I also built a Jim Walter home for my Elderly Mother in 1999 and financed it with Walter Mortgage. Not only is the house shabbily constructed, but the financing is a ripoff. I'd like someone to help me make Jim Walters legally accountable! [protected]

Dear Consumers:

I was the first Jim Walter client of Mr. Gonzalez. My husband and I had contracted with Jim Walters to build us a house. The house was full of defects and no matter how many times we complained we were totally ignored. As many of you have found out, lawyers normally do not take cases against home builders unless they are paid up front. We did not have the money to hire an attorney but we knew Mr. Hector Gonzalez.

Mr. Gonzalez had represented my husband on a motor vehicle accident where my husband and his closest friend while drunk went and hit another car from behind. Mr. Gonzalez took the case and after a lot of work was able to get my husband some money. My husband and I figured that if he could get him money when they had hit the other car from behind while intoxicated, we thought he would be perfect to take on Jim Walters.

We went to his office and asked for his help. He agreed to help us on a contingency fee basis. If we didn’t win, we didn’t have to pay him anything. As soon as the people in the area discovered there was a lawyer willing to take on Jim Walters on a contingency basis, many people went and hired him. After several years, my case and the cases of the rest of the people were resolved. I and over 140 more people got their house free and clear plus money. I was very happy with the results. I have recommended him for over 20 years.

Don't bother. I don't know how she got her house paid off if everyone in that class action lawsuit had to end up refinancing their home. I'm actually looking for documents about that case and haven't found anything. He took the money and ran..

Hello there! I would like to know more about your case because I have a pending lawsuit since 2012 and it seems that they disappeared from the cases. Roshanda Cotton has changed all her info as well, seems suspect! I will pay to find them.

To Teresa and Raymond Holton
In light of everything that you appeared to change from a pissed off consumer to a company man, I would like you to answer the following question:
1. Isn’t it true that when you when to go have the house built by JWH, you had seven acres of land.
2. Isn’t it true you only wanted to mortgage only 2 acres but that JWH took the whole seven acre?
3. Isn’t it true that JWH delivered the materials that were to be used to build your house that they dumped them in the yard and they were exposed to the rain for days?
4. Isn’t it true that they did not put enough piers underneath your house?
5. Isn’t it true that the piers were not installed in accordance with the sealed engineer drawings that formed part of your building plan?
6. Isn’t it true that two foundation experts and one engineer have recommended that all the piers underneath your house be dug out, removed and replaced?
7. Isn’t it true that one foundation company has advised you that the framing of the house was so badly done, that if you lifted the house, it would crack in different places.
8. Isn’t it true that most of the floor joists are not properly nailed and that not all of the beams set squarely on the piers.
9. Isn’t it true that the insulation underneath the floor of your house was not properly installed?
10. Isn’t it true that OSB board was used as your subflooring rather than the plywood you were told was going to be used.
11. Isn’t it true that OSB board used for the flooring was not properly nailed?
12. Isn’t it true that the exterior studs that were used are warped and bowed?
13. Isn’t it true that that the siding was not installed on accordance with the manufactured installation guidelines?
14. Isn’t it true that the sheetrock was not installed properly and that there are cracks throughout the sheetrock in the house.
15. Isn’t it true that the windows were not installed in accordance with the State law?
16. Isn’t it true that you have claimed that the steps from the first floor to the second floor to your house were so defectively built that you slipped on them and fell, injuring your back?
17. Isn’t it true that you have claimed that the porch steps railing were so defectively done that it caused your mother-in-law to slip and fall injuring her back and hip.
18. Isn’t it true that the roof was not installed accordance to State law?
19. Isn’t it true that the shingles put on your roof were not installed in accordance with State law?
20. Isn’t it true that you had electrical problems in your home and electricians have told you that your house was not wired properly?
21. Isn’t it true that you had plumbing problems in your house and plumbers have told you that plumbing work was not done properly?
22. it true that you have been told by an engineer that the air condition system was not properly installed?
23. Isn’t it true that you have not made payments on your house for almost a year and that JWH has not foreclosed?
24. Isn’t it true that you are over $12, 000.00 behind on your payment with JWH and they have not foreclosed?
25. Isn’t it true that you have worked out a deal with Jim Walter Homes and Walter Mortgage Company?
26. Isn’t it true that part of the deal is you are supposed to get in the internet to try to convince people not to bring claims against Jim Walter Homes but to throw themselves at the mercy or Jim Walter Homes.
27. Isn’t it true that you are receiving half a million dollars from Jim Walter Homes to turn against the people you were trying to help?
28. These are the questions I want answered Raymond and Teresa.

I also have a Jim Walter home. They are horrible! From day one our master bath leaked into our master closet and our kitchen. We called them out here 6 times in the first year and it was never fixed. We are now trying to install a whirlpool tub in the master bath since we have not been able to use the shower in the two years we have had the house, and are having problems because the floor they installed is not level. Not only that, but the drain pipe that was under the shower is about 4 1/2 inches in diameter and the hole they cut around it is about a foot by a foot and not even either. That is why our master bath is always about 15 degrees colder than the rest of the house. All windows and doors are not sealed, everything that was installed is crooked. The kitchen floor as well as a spot in the living area are buckling whenever you walk on it. Behind the shower, one of the studs was just leaning against another board, it was not supporting the weight of the walls at all. All sinks leak. What a ripoff! I hate this company! And I filed a complaint with the Better Business Bureau and Jim Walters told them they came and fixed everything so they said it had "been resolved". Not at all, we just gave up and spent more money and time fixing it ourselves.
