HomeComings Financial Will not refinance home when due without 10 to 11 thousand dollars!

My husband and I purchased our first home together through homecomings financial, after paying 24 thousand in interest over a two year period it came time to refinance, when i spoke with a representative at homecomings they said that we would have to come up with 10 to 11 thousand dollars for a down payment before they would refinance. We had to suddenly try to purchase my parents home due to an medical emergency on my parents behalf so we had put our home through homecomings on a land contract with buyers so they could carry our payment, stockton mortgage said that our payment on our home would go down when we finance, but was I in for a surprise when I contacted homecomings. Now our buyers have backed out and we are faced with bankruptcy or foreclosure on that home which is totally going to destroy our credit that we have worked so hard to rebuild. We need some good sound advice.

I can fully understand every complaint I have read as my husband and I have gone through almost every one of the complaints I have read, for the past 2 years with HomeComings Financial. We have reported to them in the fall of 2005 they were reporting us being late for 6 months on our payments. We didn't even know until we applied for a temporary loan to help us out when my husband lost his job and we had to move to Nevada for his new job. I had to quit my 10 year job and sell everything before we moved to the Las Veagas area. It took over a year for me to find a job as there is no industry in my field of work in that God for Saken place. I spent many months calling HomeComings explaining our situation and could we refinance with a lower rate so we could at least make the payments while I searched for a job. The answer was "no" because we were late on one payment. Even though we had excellent credit with them and were never late until the month we tried to refinance. We had the baloon note and they definitely didn't want to let that go, even though they knew we couldn't make payments on time. They have ruined our credit now for 2 years while we have made repayment plans several times now. Last spring we were able to move to Houston, TX where my husband has a great job and I have a job that pays twice what was in Las Vegas. I called HomeComings last summer to work out another repayment plan so we didn't foreclose. The first month they said was for legal and attorney fees, just so they wouldn't continue to foreclose. It would not apply to the house. I have tried for 3 months to talk to the lady that was assigned to us and she never returns my calls. The only way I know I get through to her is by faxing letters and getting a confirmation that it went through. I've asked for an email, but other people there will not give it to me. When I call they tell me I haven't made any payments since last March. I told her she didn't know what she was talking about because I have proof I have made payments all year. We have contacted a lawyer and are ready to sue for total neglegence and freud. The house is on a "short sell" and we've had a buyer for over a week now and they will not respond to the offer. It's 10 thousand over what we owe. What's that all about? I sympathise with anyone who has dealt with this company. They should not be allowed to have a business and GMAC should also be sued along with them.

My sister is having a MAJOR problem with Homecomings Financial a Company of GMAC... They have her SS# wrong in there system and will not send her any statements by mail... they can not even give her a correct account number due to there computer error... she has been making payments to Homecomings for 12 months now and they show 11 payments made. They are messing up her credit... and bank account... they informed her that they show several months as being late and that it may have been reported to the credit bureau... when she mails the check in on time! She was asked to double pay to "catch up" according to what Homecomings says... they have requested for her stop payment on the check that was mailed... pay by phone with a 12.00 phone fee and late fee... then the check that was already mailed out was cashed by HOMECOMINGS! Then her bank account went negative and she has and continues to pay MAJOR money because they can not get it together! Someone please respond! My sister has 5 kids and no time to deal with this mess! Buying a home is suppose to be "THE AMERICAN DREAM" right? Class Action Anyone?

I have horrible experience with homecomings financial everytime i called they put you on hold almost 1 hour. Also the costumer care need to be trained well mostly they are rude and no manners when i am asking them my issue i always can't get the right answer.

I can not even get someone to speak with on the phone. Being on hold for over an hour THREE TIMES really frustrates me. We are also in an arm that is due in June 2007 and I can not get a rep on the phone to discuss our situation.

HomeComings Financial Cheating people out of their homes!

Homecomings Financial seems to be in the 'business' of CHEATING people OUT of their homes based on everything I've seen written online... Scared me so much a couple of weeks age that I posted my complaint on a class action site and now have a law firm in NY interested in a class action suit against Homecomings. They are GREAT people at the law firm helping me personally so I won't (hopefully) lose my home to this FRAUDULENT company.

If any of you out there have any suggestions for help or know anyone who has/had problems with Homecomings. PLEASE have them post and/or email me ASAP, The law firm, Wolf Popper, NY is looking into CLASS ACTION SUIT against Homecomings Financial. You may contact me by using the rebuttal box below.

A CLASS ACTION SUIT will bring JUSTICE for those of us devastated by this company's underhanded fraudulent practices! Thanks for any help!

Homecomings Financial is a rip off. My home has went into foreclosure and of course they were willing to help. They gave me these outrageous fees (attorney fees, administration fees, etc,) in addition to the fees to catch up the mortgage. They did a worksheet and they are charging outrageous fees in order forme to keep my home! These people are crooks, not to mention my mortgage has more than doubles since I bough the home about three years ago. I only see myself sinkng deeper and deeper with these people! Is there anyone out there who can help me? I don't want to lose my home, but I don't know what to do?

10+ years as a customer until 2004 when I began to have problems (I lost my job). They were nice to help (help? you don't have a job and what do they do: don't stop the late fees, don't stop the monthly inspections fee, and others... on top, they add the catch up payments, so you ending paying about 50% extra a month... remember, no job).

Then, I when back to full time at the end of 2006, but I was behind payments so now, no more negotiations, even though I have a good salary and I am willing to abide to their requirements. The problem is that they refuse to negotiate. In the meantime, they tell you that they are "checking" the requirements when in reality they were planning the foreclosure. As a result, I have a foreclosure date of December 4, 2007 given to the North Texas Housing Coalition on November 9 (Christmas present!).

I don't understand why they don't want to negotiate (well, kind of, the balance of the house is $90K, the market value is $150K, 11 years at 10% ARM, they already got the money for this house, so they don't care about foreclosure, makes sense). Yes, my credit report shows $0 balance and probably it will screw up my credit as soon as they insert the "foreclosure" on it.

I wish they could be more open to talk, at least now that I have a full time. They could answer the calls and tell you and don't play the game that they are "checking" when in reality they are proceeding with the foreclosure. Bad deal GMAC/Homecomings Financial. Not for Texans. No more.

I made payment under Repayment Plan one day after the ten day grace period via Western Union Quick Collect on May 31, '07. Homecomings returned payment to Western Union June 3, summarily had their foreclosure trustee hold sale June 6, I was not advised that they were returning payment until the end of June, they kept sending me repayment plan worksheets, telling me that the property was not being sold (after they bought it at the sale!), calls to their Foreclosure trustee confirmed that no sale was scheduled before and after it was sold. Both firms lied for months, I finally got suspicious and confirmed that it had been sold despite having my payment in their hands! When I set the failed Repayment Plan up months before, they attempted to charge me thousands in attorney and foreclosure fees that exceeded the statutory limitations set forth in California Code. When I pointed this out to them they quickly removed all charges, but anyone who doesn't read the fine print in the code is fresh meat for Homecomings game and I'm sure they've made millions bilking people with their repayment plans, then SNEAKING in an unannounced foreclosure sale, recovering the property (that was the last thing they wanted to do, they wanted to "work things out"). They sent me repayment plans and contacted me after the sale in June until October. They acted like no sale had occurred, even when I informed them that it had and that a Repayment Plan was not an option, they said they could still do it! They were just trying to see if I'd be stupid enough to send them more money and still wind up with nothing. They will be serving eviction papers any day now, but I'm going to continue to fight. If you did a plan with them but had to pay attorney's fees pursuant to foreclosure for the privilege, make sure that what you paid was legal. I can tell you what applies in CA and most states have their codes posted on the Web. I'd be glad to lend support to any legal action against these pirates.

Homecomings Financial financed my loan for my home in 2005. I have noticed on several occasions that my statements received from Homecomings do not reflect the amount of money that I pay each month. When I call to discuss the payments made they can't tell me where or how my payments are being apply. I have ask to speak with someone in charge to have the issue investigated and they act as though they are going to transfer the call and then I'm disconnected from the call. Please help with this dispute. I'm in a situation where I can't afford to lose my home. My husband and I work very hard and we are trying to get caught up on the mortgage. However, Homecomings is taking money from the payments that we are sending in and we will never get caught up if this continues.

Yet no one wants to put a stop to these crooks and their unethical, predatory lending and shady dealings.

I have been dealing with them for almost 6 years and have been foreclosed on twice... or they tried to foreclose.

The only way to stop them was to go into a chapter 13 while trying to resolve the problems.

I have sent them thousands of dollars besides my monthly payments.

They have ruined my credit so I cannot refinance and get away from them.

They add ridiculous charges to my account.

So I figured I would sell out... well I get a letter from them and they are asking for over $8,000.00 more for our payoff... well I am back to where I started 6 years ago and thousands of dollars ago.

Stay away from Homecomings Financial they are SHARKS out to rip you off and you will always lose, because everyones afraid of them!

I have 2 files of documentation on this company and proof of everything I am claiming.

My husband and I fell behind three months on our mortgage due to two emergency surgeries and our daughter being hospitalized due to an accident. This mortgage company is putting us through the foreclosure process and denying any payments we are willing to make.
I recently made a payment to them that was returned to my account three days later because it was $3.23 short from the amount they wanted. Mind you I made the payment over the phone to them with no problem.
My husband and I are very deligent @ staying in contact with them at least once a week, and in more recent weeks have been on hold for up to 1.5 hours just to speak with a live person. A week agao we attempted to contact them @ 1p PST and they were already closed with no reason on the voicemail and no holiday on the calendar.
This has been the worst mortgage company I have ever dealt with and recomend them to NOBODY.

In the month of june 2007, i request a re-finance payoff with a sema (transfer of re taxes) which would have saved me thousands of dollars n my closing n monthly payment would have been less, homecomings financial (gmac group) gave the payoff figure by did not produce the re taxes transfer. My broker called, my attorney, the new bank called for a period of three months 3-4x a week with no results.than they notified me there will be a fee of $600.00, i sent it to them still no transfer. This went on for 4 months until the re-finance bank said lets go without it. They re-ran my credit n homecomings had made my account delinquent for those 3-4 months. It was never delinquent prior to this transaction. When i spoke with them about the fee i asked should i still make my monthly payments, they told me no, because i'm refinancing. Well on my credit report shows payment 3 months delinquent and they will no change it after i found this out i immediately paid them by it's still on my credit report n now i cannot refin to get away from them. Also around this same time they sent me foreclosure documents which i took to my attorney he said these people are unbelievable and should be held accountable. Once i cancelled the sema transaction n asked for my $600.00 to be returned to me i received a check in i yes i week,i copied it for proof n have a written request of the letter as proof. I also sent them a letter stating that i feel this account was intentionally sabotaged. Please someone sue these people n hold them accountable 4 there unlawful actions. How many others are out there that cannot pay like this and don't know what to do. The banking comm n the housing govt should be notified asap...

The company kept taking up my monthly payment and charged my for insurance even though I had insurance and the company even faxed over all the information on my homeowners policy. They then took my home with my items still int in it and they took my belongings to a dump. I was given no notice. they apprasied my house at 70,000 and I have come to find out it is worth 22,800. Rip off artists

Back in 2006 I refinanced my house located in IL. The lender was Decision One Mortgage (now out of business) Subsequently the mortgage was sold to Homecomings Financial (GMAC) who now services the loan.

My question arose because when I tried to refinance recently I realized there was a 5% prepayment penalty on my current ARM loan for a period of 3 years. As I delved into this issue more, I discovered the Illinois interest Act that states a prepayment penalty cannot be charged on a mortgage that has an interest rate over 8% (mine is 8.59%). And as of July ’03 that included ARM loans.

If in fact the prepayment is not allowed, I will be able to refinance my house and increase my chance of affording the payments (I am not currently in default, however it is getting harder to afford). My mortgage broker can get me into a high 5% interest rate if it weren’t for this prepayment penalty.

I have contacted Homecomings by phone, fax (at their request I faxed the test of the Illinois Interest Act to their attention since they claim to never have heard of it) and email and they are not communicating back with me. I have contacted the OBRE in IL but it takes them 45 days to respond. HELP!
