Heritage Pacific Financial Improper collection practices

Heritage Pacific is a company that preys on people who have already lost their home. As far as I can tell, they call you based on public records that show you have had your home foreclosed on. They call you and harass you 5-10 times a day with an automated phone system saying that you owe them a debt.

They try to get you to call a toll-free number so that they can get your information and your payment for the debt they say they have with you.

Don’t give them any information. They don’t have any legal rights to harass you this way or to try to collect on the debt they say they have with you. Please call them at the toll-free number, [protected], and tell them what you think about their fraudulent collection practices. If enough people call and complain about their fraudulent collection practices, then maybe we can shut them down. They even boast on their website that “our partners have been enjoying returns of 200-300% or more in a matter of months.”

These “partners” are the ### people who invest in Heritage Pacific to try to collect on these fraudulent debt collections.

This company is based in Texas and calls from a San Fran #. Ask them to fax you information on how he purchased your debt. If your home was forclosed on in California and it was only purchase money then 580B is a law you should check into. Ask for all documentation pertaining to your home and who they purchased it from, sure they won't send a thing. Ask for their company licensing to do business in California. Sure the Attorney Generals office would like the information.

Listen People my mother lost her building in 2008 she just got a letter fro HPF in August of 2011 telling her she needs to payoff her second mortgage they give her to options of payments. But, we are in Illinois and we talk to several attorney's and what they say is that HPF is a collection agency and they want there money. But, because my mother is a senior citizen 69 years old and she is on social security and doesn't have a job doesn't have a house anymore or a car she doesn't have anything anymore she lives with me... The several attorney's told us that they can not do anything to my mother and IF! they tried to go after her social security in Illinois it is against the law they can not garnish her social security at all. We have two options we can file for bankruptcy and pay the lawyers about $2, 000.00 or just leave it alone they can't do anything. I would love for them to try to do something with her social security we will SUE the BUTTS OFF! and there will be no more HPF.. And the most important thing there has not been a deficiency judgement in Illinois in three years they have stop it because there are so many people loosing there homes. So don't be scare of these people talk to several attorney's and stand your ground they are just big BULLIES!

In my situation I settled out of court. It seems to me that they go after people who have just enough to settle and not afford the high cost of attorney fees. Trust me had I had the money, I would have counter sued them. But I did not. I settled for what I would have paid my attorney to fight PHF.

It's a shame. But...I really believe that PHF and their attorneys will get there's.

Your claim that they are legitimate is borne of ignorance, and HPF are trying to circumvent laws that were created specifically to protect consumers like you from sick predators like these. If they are showing you what you believe to be proof, you are probably wrong, and it is something that anyone with any mortgage industry experience can shoot down without a second thought. You should stop paying and start suing now. is it not bad enough that you lost your home in this horrendous economy? 2nd mortgage lenders went out on a limb and made irresponsible lending lending decisions in an artificially inflated market. The losses that they are incurring are primarily because of THEIR OWN POLICIES. They are the ones that chose to lend you, an honest consumer, money in a market on the verge of collapse and wound up without equity in the collateral to cover their money. If you didn't lie, you did not commit fraud... Get over your over active sense of social responsibility and sue these ###. THAT'S the socially responsible thing to do.

California Law states that second mortgages used as purchase money are not recoverable outside of the foreclosure process. After your home is foreclosed on, sold at auction, etc., purchase money second loan debt can only be written off, and can NOT be collected on. HPF is buying these 'dead' seconds and trying to get around this California law by suing based on the idea that the borrower committed FRAUD in securing the loan, which would then make them liable for the debt anyway. However, as they did not MAKE the loan, they have not been defrauded. It is a NO WIN case in California for them. There is not a superior court judge in California that will not immediately dismiss the case at the first sniff. BEWARE of them. They have begun resorting to illegal practices in suing as well, including filing fraudulent proofs-of-service in complaints and going through the entire legal process with the appearance that they have a 'deadbeat' defendant and securing a default judgment wherein the defendant has no idea he has ever been sued. He was able to dismiss a case against HPF and now have a pending counter lawsuit against HPF. He is also working on a class-action lawsuit against HPF.

Is this the answer against these crooks at HPF and why they don't have the standing to sue. http://www.foreclosurefish.com/blog/index.php?id=531 Quoting the site: The companies that invested in these mortgage securities were not parties to the original transaction -- they never participated directly in the origination of the mortgage nor its subsequent sale. Investors are merely assigned to particular mortgages after the fact, and there was no true sale of the security to the investors, which is an element of a valid securities sale. Investors and banks, it seems, can not prove the own the mortgages, can not prove that they were assigned a particular mortgage that they are now suffering damage from its default, and can not show that they even bought a legitimate security.

Heritage Pacific Financial is a bootleg collection agency. Not only do THEY owe money to other firms, they just recently got an LLC, they claim to be a nationally recognized company...They sent some BS letter to my boss stating that he owed around 20k for a forclosed property. I asked them to provide the documentation for 2 months...its in the warehouse they say...from the looks of their little office they dont have a warehouse...maybe a storage unit or someone's basement. Chris Ganter is the president and I know of two lawsuits that have been filed against him and HPFand another one that will be filed by the end of this week. I would not trust anything this company does or says...If they do try to put something on your credit report, chances are if you dispute it, it will be removed.

Actually not a collection company. They are collecting on a debt that was left over from the forelcosure. I think they called it "defincency". I did request proof of ownership and they provided a copy of the note and loan application along with the allonge. I owed the debt so I'm making a payments to them. I did purchase the home in good faith and didnt do anything wrong but I dont want to be a dead beat or get sued. I think instead of complaining about what you owe you should pay your debts as most contributing members of society do.

Heritage Pacific Financial This company is not to be trusted!

We conducted some work for this so called collection company. They wanted us to track down for them hundreds of past clients that owed them money. We did the work for them and after we completed the work, they refused to pay us. The dumb thing is, is that we have a signed contract stating our agreement. I guess they thought because we are thousands of miles away that they could just dismiss us. Well, we filed suit against them and we will not tolerate this. Beware of this company!

Also, they claim to be this huge national company but we found it odd that this huge company is not even incorporated or an LLC. Chris Ganter is the President and is named in our lawsuit. Don't piss off a private investigation company, we will find you!

All I can say is C.G. & his fellow H.P. crooks are all worthless P.O.S. that hid behind the laws and even religion to take what they could from anyone that trusted them. They, took a lot of money from a lot of people then went bankrupt, which C.G. is very well seasoned at doing, as I found out. I've spent years trying to come back from their BS. Invest in Russia before you do so with anyone associated with the C.G. cartel. At least you know right off the bat that you're being robbed with them.

Chris Ganter is also the owner of Grover’s Grill and Bar in Frisco. They have a reputation for paying employees with hot checks and refusing to pay contractors for their services once they are done with a job. Let it be a warning to all vendors and contractors that provide them goods or services; they are changing their name this month and planning to leave all debt from the previous name unpaid.
Chris Ganter knows the law and uses it to avoid any and all consequences. He finds a way to separate himself personally from his debts from the access he has through his shell companies. He’s charming and persuasive, but make no mistake, he is a con artist that commits fraud on a very regular basis.

Wow very interesting and I thank you so much for sharing this I formation with all if us. It was very helpful. So what can us customers/hard working people do when they repo for there own lies, commit fraud on us, harrass us, tamper our rights, and much more? There a joke and so nice to know there criminals and committed fraud and stole money. Alit if there customers are unsatisfied with them and there lack of respectful business. I've been looking/ investigating myself and learning what to do all around. Thanks

Unfortunately they are wealthy enough to take your case to the end. Either you pay them or your own attorney. Sad what America has come to. The Politicians are hiding, the press doesn't care, and lay people are just getting stomped on.

Chris Ganter and his sham of a company at Ganter Development were involved in the development of a property at Cedar Creek Lake where they hired a series of consultants who all invested hundreds of thousands of dollars of their own time and money in producing construction documents and on-site investigations ... all to be screwed in the end by a dead beat client who bailed on the project and ignored all of their invoices. All small business' who are hurting significantly because this [censored] of a human being has decided that funneling tons of his crap companies money into producing (and failing) a "Flip This House" type TV show was a better idea than paying the bills of the consultants who were working for him.
This guy should be in jail, no question.

Christopher David Ganter (Chris Ganter) has started a company where you buy bad debt from them...how interesting. I'm sure he and his brother, Ben, don't have to look far to find bad debt! They can start by going after all the fraudulent loans they facilitated!
