Advertised as a free help kit that will get you debt. There is 2 pamphlets that give you the same information as available from your credit card companies or anywhere on the internet. Charges $80.00 monthly to the card that you paid the shipping cost to. They told me to send it back after the first charge and said they would stop billing me. They have kept on charging the $80.00 every month, even though I returned it. They say they will call you back when you call to complain and never do.

Herb Kay not only scammed his customers, he also scammed his investors by committing numerous counts of fraud. In May 2015, Herb Kay pled guilty and was sentenced to 5 years in prison (Arizona) followed by 7 years of probation.

I order this learning kit back in september of 2010. the postal service indicated that it was delivered on 9-17-11 they put it on my front porch however I never received it. When I informed Herb Kay of this they immediately charged my account and indicated to me that I owed this. I informed them that I was not going to pay for something that I did not receive. However I've taken this up with my bank. This company is a fraud and is only out to take your money.

This complaint is totally true (above) we have an unopened package and were charged $349, they won't take the Kit back b/c its a few weeks past 30 days. We were away when it came and it got pushed aside and we never even opened it and suddenly we have a $349 charge on our credit card! There is "FINE PRINT" on the back of the shipping label only telling us that there was a 30 day window. The HERB KAY people who wrote the justification above are just lying. Its a total scam. You don't advertise something as FREE and then charge $349 to a credit card. (PERIOD! That should be all I need to say.) And, they charge 45 days later so you are so far past the 30 day window so they can try to keep your money. They should be ashamed! They say they are helping people and they are just trying to scam money. If they were so sure of their product they wouldn't need to defraud people. We are filing complaints with the BBB and making sure everyone knows just what a scam this is.

Herb Kay is biggest scam I've ever been taken in by...definitely a learning experience. It was advertised as a "free" system to help people get out of debt. And all because Herb Kay is on a mission to "help" the consumer. Apparently, Herb Kay, was on another kind of mission. When I saw the first charge for $349 I called the company to complain...I was told I could not get a refund because it was past 30 days. When I accused them of defrauding the consumer, they responded by saying, "Well, didn't you read the shipping label on your package when it arrived?" (Who reads the shipping label on a "free" package...I ordered it I got it, why would I read the shipping label.) Then they claimed that I was told about the $349 charge when I called to order and that they had a recording of my call. When I challenged them by asking to listen to it...they said, "Oh, we can't let you listen to the call because it has personal info (referring to my credit card number). When I pointed out to them that it was MY "personal information" and I had every right to listen to it, they still claimed that it was illegal for them to let me listen to my own call. At this point, the company's efforts to defraud became glaringly obvious. The conversation when downhill from there, and I could quickly see what their game was. My next step was to call my bank credit card department to file a dispute on the charge which led to them investigating and after 2 weeks crediting my account for the charge. I assume that the fraudulent practice of the company became apparent to my bank as well.

Well, in the past 12 months we have spoken to over 75, 000 people and it is only natural that a few slip through the cracks. We at Herb Kay SOS have an A+ BBB rating for a reason; we bend over backwards to keep our customers happy. We have a full time customer service team that resolves complaints, and it is very rare that we are unsuccessful. That said, the enemy of good is perfect and we don't claim to be. We just try. So call the 800 number if there is a dispute and we will resolve. However, we won't lie down. In most instances we find that, amazingly enough, folks are not always truthful. As we record each and every call digitally, disclose the return policy and have each customer confirm that they understand the procedure, then put it in huge bold letters in fluorescent orange on the package when we ship, and then have it pop up again when a new customer first signs on to the website, it is pretty hard to miss! So, after all of that, it is usually the case that despite protests of innocence, most folks who complain just do so because they ignored every instruction and are trying to, for lack of a better term, wiggle out of the transaction. We are a business, we charge nominally for our service, usually less than 5% of what our competitors charge, and make no apologies. We deal with people in financial trouble. In our experience 80% of those folks are victims of the economy and circumstance and truly want help. But there is a substantial number who are always trying to find the easy way out, want to make no effort, and play the victim. Essentially it is our experience that when these folks get the kit, realize that it is designed as a partnership with them making an effort and us helping every step of the way, that effort is too much. They want magic. So, they return the system. If they do it within the 30 day free examination period and follow really simple directions, we are happy to comply. Also, in all cases the initial charge is only a few dollars for shipping. The payment for the plan is not charged until 45 days after purchase, a full two weeks after the 30 grace period, so if you see a complain involving more than a few dollars, you can be assured that this person ignored every possible instruction, three times at a minimum, and now wants to get their money, often after using the system and getting the results. It's kind of like buying a new suit, wearing it to a wedding, and then trying to return it. The bottom line is we resolve every complaint but we are not fools. Truth cuts two ways.

My husband and I had ordered the SOS system back at the beginning of August. We sent it back even before our 30 days. We had our RMA number and everything. We were told there would be no more charges. The only thing that we were origionally charged for was just the shipping. We were fine with that. Then on the 24th of Sept. we were charged a $7.96 charge. I called and asked for a refund. They gave me the run around. I gave them till the following Monday, the money was not there. I gave them 2 weeks, the money was still not there, so I called them back. They gave me the run around again. I told them that I wanted a call from someone in there corprate office, since that is who they are sending the fax to. I never recieved a call on Friday, so I called them back today, and still the run around. I just filed a complaint with the BBB. We will see now if I receive a refund.

call [protected] tell them you were charged they will cancel THE ADDITIONAL SERVICE you are unaware u are enrolled in and being charged for MONTHLY! they will also refund the charge. I was transferred to a live adviser and the matter was resolved in a matter of minutes hope this helps. forward to all you know with the same problem.
