Hayt, Hayt & Landau practice Unfair Collection Practies. I can't even get proof of the debt. They took me to small claims court after telling them I did not know anything about this credit card from Capital One bank that they had the wrong person. I went to court showed them my drivers licence and social security card they took a copy we then went into the court room the lawyer told the judge that I showed proof I was not this person. The judge told me I could go. Meantime these crooks have changed the name to my name. sent me letters showing the judge signed them but they do not look leagle. they want me to fill out a FORM7.343 FACT INFORMATION SHEET with all my personal information. Then mail it to the Plantiff. Also says not to file the form in public records. They also changed the credit card name from Capital One Bank to Capital One Bank (USA) NA This was dismissed on November 20, 2008 Then I get this final judgement paper mailed from Hayt, Hayt & Landau, not from the court supposed to have been ordered on November 26, 2008.

This Law firm is a black eye in the law community. Their practice is shanty, bullyish, and completely unreliable and unprofessional. I had entered into a payment plan for a debt. I attempted on multiple occasions to contact them. I finally did and when I spoke with the "account manager" I entered into ANOTHER payment plan and he stated he would send me documents to stipulate a court order satisfying WHATEVER. I never received any documents. I then contacted one of their attorneys Jason Dragustsky and informed him via email of exactly their unreliability. Two months later I would come to the realization that they had garnished my bank account without notice and without word. As if I had not attempted to pay back my debt or satisfy.it. I never once delayed or detracted from paying them and now for their lack of knowledge and contacting me or serving me any documents as discussed with Guillermo Gutierrez they froze my bank account. I contacted HAYT HAYT and LANDAU and spoke with Maria Torres. Consequently, Maria Torres, ( I would later learn )their Collection Manager who extremely rude, sarcastic, disparaging, arrogant, ghetto, and unprofessional did not care of any details related to THEIR DELAY OR UNRELIABILITY...they simply wanted their money and didn't care about each and every account that would not get paid including but not limited to my mortgage FPL water and sewer and car note. THEY WILL HEAR FROM ME AND MARIA TORRES YOU ARE THE WORST MOST UNETHICAL PIECOF HUMAN WASTE. But then again, that who these people hire to get their money via strong rm and shakedowns...get ghetto girls who don't have an education and give the a title and they think they are important.They follow a script given to them by some measley attorneys and think that those words can compensate for their lack of I.Q.

A summons from Miami to Orlando in Orange County which I do not reside and have not resided since 1995.
Un fair credit collection practices. LLP company, portraying to be attorneys, collections of debts by scare tactics, court summons etc.
Contacted Attorney General in Florida.

I just got a letter from my bank, that they put a levy on my account. The account didnt have any money in it. But they have a court document, showing that they can levy property etc. They got a court judgement in 2006, I never received anything from them it was going to old addresses. They are saying I owe them 6000 now I feel they are going to try to garnish my wages here in GA this is Crazy I have a Full House to take care of by my self Bills and Rent all me.

I too have the same problem as some of the people here. I had a Capital one balance went to arbitration agreed to pay for $2000.00 balance i owed and agreed on, i requested print out from them. My records show only owe $400.00 more. They are trying to say i owe $1500.00 more. They haven't sent me the requested paperwork and if you can get them on the phone they are rude and disrespectful. God help anyone having to deal with them! ### of the earth!

Let me tell you about how unethical these pieces of ### are. Their process server physically assaulted me. Then I was actually prevented from appearing before the judge for the hearing. I was there. I checked in with the bailiff. Every other case was called - somehow I was kept out of it. Then they froze my bank account, demanding a money order to unfreeze it. I sent it, had proof it was received but they "lost" it to try and get more money out of me. I ended up disabled and unable to work. I had an agreement to pay what I could and as long as I kept in contact, they wouldn't take action. Well, when the SUPERVISOR that had this agreement with me left, they somehow decided it didn't count. Without a call or a letter, they froze my bank account. Well, I'm unemployed. There was $37 in there. When I didn't react (why work with them when they nabbed $37 and put the account into negative numbers), they seized hold of my mother's safe deposit box because I'm a signor on it. They know I'm on public assistance and going to get disability (both exempt from their grasp), these people are the worst kinds of ###. I am considering reporting them to the state bar. I am considering a class action suit. My 70 year old mother is upset because if these people.

This law firm place a judgment and garnish my husbands wages, we went to court on feb 4, 2014 and won against them. Still after the judge order them to stop both thing they are still garnishing my husbands wages. The debt didn't belong to my husband, the only information they had right was his social security, the rest of the information was wrong. Now waiting on tour lawyer to begging the lawsuit against them.

Yes, your wages can be garnished in Florida once they have a judgement against you. Protect yourself against the law firm, they are aggressive and WILL take you to court. Do not ignore any correspondence from them, show up in court if asked to, file your exemption paperwork if eligible. They continued to garnish my wages even after a judge agreed with my exemption (I support four minors) . They are slimey people, so if you decide to settle with them, ask for the agreement in writing, DO NOT give them bank account info or verbally agree to bank withdrawals without written agreement in hand! Protect yourself. I was being sued for a credit card I didn't sign for (apparently my ex-husband signed for me, lovely) . Now I have to fight to get my wages back. Do your research before coming to an agreement, and try to settle for pennies on the dollar, they did.

I completely agree with all the comments. This firm is horrible. I started with a debt of $4500 on the court judgment and after paying $50 a month for almost 8 years, I am supposed to be finishing paying off the debt, but they keep telling me that I owe them still $5600. :S Now I owe more than what I was supposed to pay? on the judgement it already included "attorney fees", court fees and interest fees, and it seems they want to continue collecting. As soon as I finish fully paying the $4500 i am not going to let them take more out of my account and I am going to hire an attorney to get this resolved. It's crazy how these people are allowed to practice like this.

well we just received a judgement to garnish my husbands wages for a debt that happened in 1993 over 19 years ago, it was for a car that we used as collateral for a loan, we dont even have the car anymore. it went up in flames along time ago

Somethings is wrong with the legal system in Florida. The Judge told me to pay my Capital One bill by a certain date and my Attorney fee would be waved I called Hayt, Hayt & Landau to make sure the amount was right I added up my credit card and late fees do to fact I disagreed and they told me to send the check to them. I did they did not cash the check so I sent it to Capital One and it was cashed. I tried to buy a car in a fee months later my credit was bad. Capital One was called by me and they said your credit is clear with us and sent me a pre-approved loan for $30, 000.00 to purchases a vehicle. Yet I could not get a pre-approved credit card and Hayt, Hayt & Landua still have me owe them lawyers fee. They called me over and over and all I wanted to know what more do I owe they would not say intil a year later ith interest combined more than my orginal credit card debt. The stay poor and rich gets richer.

They are unbelievably aggressive. Speaking to an attorney is pretty much the only way to have a thorough understanding of your rights and all that you should or shouldn't expect.

I defaulted on a credit card from 11 years ago. The cc limit was only $500. I've made arrangements, I've paid about $800 or so in the last 11 years but they still filed a judgment against me in the courthouse. It's on my credit report and public record searches as a judgment in small claims. The amount is now well over $2500 and they aggressively pursue me every couple of months. They send wage garnishments to old bank accounts, call me night and day and mail court summons to old addresses and I end up not receiving them until after the date.

They can't provide proof of this debt yet they can pursue me so aggressively? Something isn't right here and it's not fair how this can be legal.

I am in the process of hiring an attorney to represent me against these lawyers. I have read up on their practices as a Law Firm and I am choosing to hire an attorney to deal with this. They never provided me with any proof of the account or what is referred to as a "Statement of Last Activity" which provides proof of ownership of the alleged debt, the timeframe of which the account was active or open as well as it identifies who the original owners of the alleged debt is with. Who sold the account to Hayt, Hayt & Landau or who are they claiming ro represent. They are a legitimit law firm and as such they have rules to follow.

How did they get a summons for you to go to Orlando when you live in Miami? If they file a lawsuit they are suppose to file in the county in which you live!
Did you appear in court? Did you go to a law firm, collection agency, or what? What was the outcome? Are you still dealing with them?
My husband is dealing with these $$$$ people now. They are tricksters and liars.

My husband is dealing with these $&#&$ now. I would like to ask a question. How did they get a summons for you to go to Orlando when you live in Miami? Where did you have to go in Orange County and what was the purpose? Did you go to court? Did you go to a law office, debt collection agency or what?

If they take you to court, they are suppose to file in the county in which you live.

What was the outcome?

these jerks have piled up interest on a debt i have w/capitol one and have paid $100 mo for two years their collector sounds like something from the sopranos i have asked twice for a statement of for my acct but they ignore me so i refuse to pay them anymore they are a rip-off
