Ditech Financial / Green Tree Servicing Fraud alert

With the current economic crisis hitting so many Americans across the nation, this company lacks sensitivity when dealing with its customers and their issues. Unlike other mortgage lenders this bank is unwilling to work with the customer to assist in meeting the customer's need and ensuring a good business relationship. For a payment made on the 30th day this bank refused to not report to the credit agencies although the reason for the delay was explained and the payment history has never reflected a late payment. In times like these companies like Green Tree make consumers feel even more miserable about their situations and zaps away any good faith efforts made or motivation to making things work. This company only cares about the money they collect and not the people they serve!

In 2004 I had to claim a chapter 7 bankrupsy due to marital issues and exempted my lhome of course as it was a newer loan. The original bank sold my loan 2 years later to Green Tree and now 8 years later they claim that I put my house under the bankrupsy. My credit since they claim that zero payments have been made (I have not missed one in 12 years) is total crap and they claim the house is under a bankrupsy. (From over 7 years ago in which it was exempt) I have found that from searching all of the bad info on green tree that they are keeping peoples credit low so they can not refinance or build new and get out from under the massive intrest rates by (A) not reporting payments to the credit beuru and (B) in my case stating that my house is under a 7 year old bankrupsy that the house was exempt from. Under my circumstances and due to my 17% debt to income ratio, perfect payments, cash in bank, stocks, etc etc... I should have a 700+ credit score but am at 580 due to their trash... I have spent years trying to build credit. I am sure they will come up with a nasty response but the fact is that I have alredy consulted an attournry and they are in the wrong... They are a give to the rich and take from the poor... Or in my case I have increased my pay to over 60k a year (Cmon it is not that bad) and they still keep my credit so low that I can not get a credit card. I make 60k... My payment is $550.00... I have no debt... I bought a car and not only paid it off but 2 years early in cash... The only reason my credit is so bad is that Green tree claims my house is under a bankrupsy from almost 8 years ago and I have not made any payments... I have bank statements, insurance, property taxes, appraisals, and the original chapter 7 documents from 2004 that say otherwise... You be the judge.

On February 26th. 2010 my mobile home was destroyed in a wind storm when two trees fell on it. I notified Statefarm, my insurance company. Three days later, the adjuster came. He totaled the home saying it hit 80% of the NADA value. I asked him about removing the home from the mobile home park so that I wasn't going to be charged the park rent of $465 a month. He said that they would take care of removing the home. Well it turned out that the NADA value was only around $29, 000 for my home that I still owed $50, 000 on. I couldn't believe that they could have depreciated my mobile home by half. About 2 weeks later, the adjuster said that he was mistaken and that I would have to remove the home from the property as there were no titling issues in New Hampshire. I am not sure what he meant by that. If he had told me that 2 weeks earlier I could have gotten a estimate. I got a estimate finally of $8, 500 to have it demolished and removed from the park. He gave me a check for $27, 767.34 I looked at it and said I thought you said the NADA value was $29, 000 and also, I have to use $8, 500 out of this to have the home removed? There was also $1, 500 that was being paid to me and my friends for removing the trees from the mobile home and hauling away the debris. That would leave only $17, 767.34 going to Green Tree to be applied to the mortgage. I was very angry and went to the New Hampshire Insurance Department and filed a complaint against Statefarm. A few days later, the adjuster called me and said he misunderstood his supervisor on how this claim was to be paid. I met with him the next day and he gave me a revised settlement and a check for another $11, 705.70 leaving me with two checks totaling $39, 473.04 which was better, but still not what I had in mind. I sent the settlement paperwork and the checks to Green Tree. A few days later, I called Green Tree to find out how to go about getting the $8, 500 to have the home removed. Green Tree said that the settlement says nothing about the home being totaled, and that they would not release the $8, 500 when there was still a balance on the mortgage. I said, so you are not going to honor the settlement with my insurance company when it is written right there in the settlement? He said they would not do that and that my insurance company should be covering me for the full $68, 800 that was on my insurance declaration page. I told him I was not replacing the home so they pay it as actual cash value minus depreciation. He said it doesn't matter, a lot of people don't replace the home and that I should still get the full $68, 800. Well if things worked that way, I would have been a lot better off, but unfortunately that is not the way it works. Well just to keep things straight, I called Statefarm in Jacksonville FL. and talked with a gentleman named Fred. I told him that Green Tree was not going to honor the settlement and pay to have the home removed, and that Green Tree told me that Statefarm should have paid me the full $68, 000 and also that Green Tree said that the settlement doesn't say the home was totaled. Fred said that there were a lot of discrepancies in the settlement. The adjuster had said that it has to hit 80% of the value of the home to be totaled, but it looks like he based the 80% on the wrong value. He based it on the NADA value of $29, 000 and it should have been based on the declaration value of $68, 800. Well needless to say, the home has received a lot more water and wind damage since the night it was destroyed. Statefarm is supposed to get back to me after they figure out the mess. The adjuster was sent up from Ohio because of all the damage there was in the state that night. He has since been discharged and sent back to Ohio. Every time I called Green Tree, I get someone different and have to rehash the whole thing with them and it seems they all have their own opinion as to how it should be handled. In the mean time, I am left in no mans land and just wish Statefarm and Green Tree would come to some kind of a agreement and clue me in later. My bills are piling up over this whole thing and I can't pay them. Oh and to make matters worse, the home was vandalized and the insurance company had already closed my home owners policy. What should be happening here is that the home should be removed from the park for $8, 500 and they can keep the $1, 500 that was to be paid to me and apply it toward the mortgage so that they will have $30, 973.04 in total to apply toward the mortgage and then we can come to some type of settlement for the other roughly $19, 000 that I will still owe. I know one thing, I will never buy another mobile home.

My mother and I moved to Oregon in 98' and went to a mobile home dealer in the area called BUY-RITE and it was because we we two women desperate to find a place because we were staying with my mom's best friend at the time and we had a dog and the apartment complex's around all had issue's with a large dog we had a thousand dollars to put down on a place and it was late afternoon on a friday when the two men running BUY-RITE mobile home sales started to assist us they looked over a list of repo's and decided to show us one that was in a park now it was already getting dusk out and the power inside the mobile was shut off so we couldn't take a close look but it didn't seem to be to bad, we had be approved by the park which we had only just peeked in the park's office and asked for the application which was going to take atleast a week to be processed and approved the woman told us. We left and went back to BUY- RITE to discuss the place since it was late we couldn't look at any more places and asked if the gentelman could show us around more the following day but he made an excuse and offered to see if the lending agent they used could even grant us approval on the amount of the repo since we didn't have great credit and just moved there so neither of us were working yet. He asked for a good faith payment to hold the place and he would submit some paperwork to GREENTREE LENDING and we would know something come monday well I was to be a co-signer for my mother and they were asking $19, 000 for the repo mobile home. On that saterday morning we stopped in at another mobile home sales office and talked with their sales manager and ended up talking about the repo we had barely got to look at the night before he said he knew the place and asked if we wanted to get a look in daylight at it so we did and saw that the electric wires were hanging out of the outlets there was bad mold damage in the walls and the roof was caving in thru the kitchen cabinets and I about fell thru the bathroom floor I assumed water damage there too. Well first thing after seeing how bad the place was and that it was not even liveable my mother canceled the $500 good faith check and the $1, 000 check to GREENTREE LENDING as well, That monday morning the salesmen from BUY-RITE were harassing us screaming at my mother until she was in tears for canceling the check even after trying to explain and even ask both BUY-RITE and GREENTREE if the lemon law or 72hr law applied? exspecially since we never had park approval and never steped in the place other than to see how bad of shape it was really in. GREENTREE was just as rude and didn't care they might have if I would of got a laywer at the time. Now my mother has filed bankrupsy back in 99' because they wouldn't let her out of it and now it's been almost twelve years and they are still after me relentlesly to collect since I was the co-signer on the repo I can't afford a lawyer or to file bankrupsy myself how can this insane place stay in business I am sure we are not the only ones they have swendled! is there anything I can do now? I have tired to get s ome help with our home with Greentree and they claim that they have no modification plan. My payments have gone up, and we are having a hard time paying the payments, and I have tried getting help and greentree does not want to give me any kind of help. we live on a fixed income and what job s I have had are hard to come by.

Ditech Financial / Green Tree Servicing mortgage not going down rude when I fell behind threatning phone calls

I fell behind on mortgage due to hardship and unemployed. Greentree called after a problem incurred with bank not depositing my unemployment check and NCF charge came through. I tried to explain that I had made calls to the bank to try resolve the issue and was in process of getting it taken care of. The customer service rep was rude and yelled at me called me a liar also called my wife stupid. I called the HOPE hotline and a lady there called them while I was on the phone. She was treated in the same manner that I was, but she wouldn't allow them to cut her down and remained calm. The rep at Greentree lied about everything of course but told her if I could get someone elses bank account and call it in by 7:00 pm they would take 1 1/2 payments from me at the end of month and I would not have a bill for 3 months. I did just that, but the rep at Greentree had left for the day and I had to leave a voicemail with my mothers bank info. The next day I called to make sure everything was ok and that they had what they needed. Another lady answered phone and of course they were backpedeling saying that I may not even qualify for the program. She said she needed to call my mother to see if it was ok to debit that amount, which is understandable. She didn't have time to talk about it because she said she had been working 12hr days and it was time to go home, but she gave me until 11:00 the next day to have my mom call. Of course they were calling at 8:59am the next morning every 5 min. I finally answered phone and the rep that was very rude to me called, I asked him why do I have to qualify for the program. He said basically I had already been aproved for the program. I said if I paid the $468.00 by the 31st of July, then I wouldn't have any payments until October right. He said well Sept. or Oct. I'm not sure yet. I advised him that Greentree had several complaints on the internet just like what had been happening to me, and was afraid to give my mother and fathers bank account info to them because my dad has kidney cancer and I don't want any problems for them. He started to get rude with me telling me I was stauling him. So, I interupted him and told him he has just sucked the life out of us these past few days. We can't eat, sleep, and our stomachs are in knots and we are not doing that today because I am hanging up. I then hung up the phone and called Greenpath back. advised her of what was going on and she suggested that I call Greentree and ask for mitigation dept. I also requested that she look into a place to complain to because Greentree is on the list for the Home Loan Modification. She is going to call on Monday with that info. This company scams people and they had no intention of doing a modification with me to begin with they just wanted to collect the past due amount regardless of my situation.

I talked to Green tree for several months to get two deferrals, because of property tax I had to pay, now they are threatening me with note acceleration papers, because they only show one deferral, and they are very very rude on the phone, I keep telling them to look at the phone recordings and paper work, and they would see the that it is there mistake, but they don't listen, they just keep threatening me. They are a bunch of ###s.

Green Tree employees and business practices are ###. My payment is due on the 1st, with a 15 day grace period. My bank, JP Morgan Chase, is configured to mail them a check on the 3rd of every month. It takes up to 5 business days to arrive at the destination according to Chase's bill pay agreement. Green Tree calls me EVERY single month to harass me for my payment BEFORE it's even late. They call on the 10th, 11th, 12th... EVERY SINGLE MONTH. I ask them, EVERY SINGLE MONTH -- do you see my payment history? Except for weekends and holidays, it arrives at the same time, EVERY SINGLE MONTH! And yet they can't wait to harass me, EVERY SINGLE MONTH for when my payment will come. This last month, I was explaining to the caller that I have auto payments setup through Chase and the woman was so rude that she cut me off in the middle of speaking with some rude drivel and called me a deadbeat... even though I was not late. This company is a disgrace to mortgage servicing companies.

It is really discussing reading all the complaints about Greentree mortgage servicing company. I have had a mortgage with GMAC for 12 years and have not had any deliquent payments. I recently had a hardship and went thru a modification with GMAC. I made my first trial modifcation in Feb to GMAC and then I was told my loan is being transferred to GreenTree. I made 3 more trial modication payments to GreenTree. When I checked with my HUD advisor I was told the permanent modification was in the process. After several conversations with GreenTree and advising them my paymemts were being processed even after they had cashed my checks, I was told GT is far behind since all these loans were transferred to them by GMAC. After 5 months I recieved my permanent modification papers, my payment went from 1681.00 to over 2400.00 per month. What kind of modification of the Affordable Housing Act is that? I am so frustrated with the government, the mortgage servicers. How do they proclaim to say they will help the consumer when they are increase my debt instead of working with the 31% of my monthly gross income? I top of all of this I just had a 6% decrease in salary. When does this ever end? I am a single mom of 3 teenagers, work 2 jobs and still cant make ends meet. It seems like everthing is going up in rates accept my paycheck. What is left for me to do now?

I received a phone call from "Yvette" today (Saturday afternoon), and my Caller ID showed that the call was from Green Tree Services. Yvette was calling about my neighbors across the street! She said that was "a friend" and she "does business" with them, and she had been unable to reach them at their phone numbers. Yvette wanted to know if I would walk across the street and give them her phone number, since she hadn't been able to reach them. She began to give me a 1-800 number and explained that she was "at work, " and I stopped her. When I asked her what kind of "business" she did with them, she said that was personal and private information and she couldn't share that with me. I was FURIOUS! I told her that I didn't believe her, that I suspected she was from a colllections agency, and that I was appalled that she would look up MY phone number to do her leg work for her! After doing some research online, I discover my gut reaction was spot on. I will be contacting my Attorney General's office to report this incredibly unprofessional behavior. I am completely disgusted by this tactic - IMAGINE - calling neighbors to pressure people and collect bills! My post here is just the beginning of my efforts to make sure this never happens again...

So we have the same problem with greentree. Same song and story as everyone else. I would say the best way to deal with it is to take to the news stations local and national because apparently nobody really knows what is going on with this company. They told us we are liars and we dont take care of our 2 children. To me, thats not the best way to get a payment out of someone. Its childish and ignorant. This company needs to be shut down...for good.

My wife, 6 children, and myself live under the tyrany of GreenTree everyday.
Back in July of 2009 I ran out of work for my small flooring and tile company.
My wife called and arranged a 3 month forebearance with GreenTree.
This was settled and we qualified.
No payment due until Sept. 2009.
My wife was working and we thought doing well at her job.
In July, August and Sept we had electric bills exceeding $500.00 per month.
We were unable to put any money back and I still wasn't picking up any work.
I had to close the doors on my company due to not being able to compete with every out of work "Joe that owns a hammer" in South Carolina underbidding me on every job.
We let my work truck go back to the lot, cut off our cable tv, cut off our cellphones, Did everything we could think of to have the money to make the payment to GreenTree.
We fell $42.50 short. We figured, they won't make a big stink about $42.50.
Boy were we WRONG.
After a constant stream of phone calls (5) per day from different numbers each time.
I decided to see if I could work this out with them. I answered a call from (Jeff) on Monday and made arrangements t make the full payment as well as the $42.50 + 2.50 late fee + $12.00 payment by phone on the 12th of November.
The next day we get another call from GreenTree (Michelle) I explained to her that I had made arrangements the previous day with (Jeff.)
She types on her computer for a minute and comes back to me with.
"Well you do realize there will be a $30.00 charge for you payment being late over 30 days".
At this point I didn't want to get upset so I didn't argue with her.
She got off the phone and all was well.
2 weeks roll by with no further calls from GreenTree.
On Nov. 8, my wife lost her job due to state cut backs.
Severance pay forthcoming.
My elderly disabled mother gets a call from GreenTree on Nov. 10th, 2 full days before our arrangement is due to be paid.
(John) proceeds to berate her about our payments being late and "They are taking our crap" anymore. My mother hung up on the jerk and called me with the number he called from.
My wife calls and attempts to talk rationally with (John) telling him that she will have the full payment as agreed available on the 12 as agreed.
This guy loses it.
I mean he is cursing at my wife, berating her and calling her names.
I yank the phone from her and start in on him.
Being in business myself and having had to do the exact job he is doing in the past has given me some knowledge of dealing with people.
Needless to say, I didn't stand a chance.
He stated to me "We (GreenTree) aren't going to let you people that can't afford your home to continue to live in our property and run it down and destroy it."
(I was shocked! I'm a contractor, there is no damage to this home.
I have remodeled both bathrooms with walk in tile showers, ripped out all the floors and replaced them with 1 1/2" of solid plywood. Torn out the crap 3/8" drywall and replaced it with 1/2" drywall to code. Replaced all of the under/over insulation improving the R value by 30%. To put it plainly, I've done enough work to this place to have built a 2000 sq ft home. Around $40, 000 worth of work.)
Finally I had enpugh and demanded to speak with his supervisor.
I was "ORDERED" not to hang up and put on hold.
3 minutes and (Richard) comes on the line, he sounded pleasant enough so I handed the phone off to my wife.
Sure enough, he starts making demands the she make payment "Today".
She explains to him that she won't be getting her pay until the 12th and she would be happy for them to take a phone check on that day.
He agreed and we thought all was good.
He has her check information now and we are stuck.
He starts berating her that our December payment BETTER be in their office by 5 pm on 12/10/2009 or they would be out here to get the home on 12/11/2009.
Naturally being my wife and who she is told him in these exact words.
"If I don't have your payment in your office by 5 p.m. on 12/10/2009 you can be assured to find the house burned to the ground on 12/11/2009 when you get here to haul it away!"

They may be a nasty bunch, they may take our money and our hope, they may take our home and we may have to live in tents. But they will never take the love and pride I have for my darling wife!

We have a second mortgage that was just sold to Green Tree. No one infoprmed us, the homeowners. For a month we were getting calls---as per caller ID--from Green Tree. Not knowinbg that out loan had been sold I did not answer the calls. A couple days ago I got a mortgage statement in the mail from GFreen Tree, which was my first information that they were the new lienholder. So I took a call from them when they called. They were calling because they said I was late on the payment lasty month. I had paID THE PREVIOUS LIENHOLDER BECAUSE i WAS UNAWARE THERE WAS A new lienholder. I explained that to them and asked them to stop calling me. They haVE NOT STOPPED! Today I get a call from them and they wanted to know all about my first mortgage. I said that was none of theior business and she accused me of being sarcastic. This does not look promising. My hunch is they are predators and just want to fopreclose and see if they can make a buck. They probabaly bought the note for pennies on the dollar. We are currnet on the note ---my hunch is the original lienholder is in trouble and needed to unload some debt and did it cheaply for ther buyer.

My fiance and I are going through the same B.S. with greentree our payments are only $436 a month and I lost my job for a few months so we got two payments behind and ofcourse they started calling every 3 minutes on the dot to not only our cell phones but they went so far as to google her work number because all she told them was that she worked at a hardware store in our town, so they preceded to do the same to her work number witch led to her manager telling them that they where harrassing and hindering not only her but all the other employee's that have to answer the phones so he politey asked them not to call anymore but greentrees rep said it is not harrassment and that they can call any number any amount of times in a day that they want, so thirty or more calls later her manager finally got ignorant with them but that still didn't help they continued to call witch has led to her being put on probation at work. My fiance finally found a generic letter that basically says that any bill collector can not call her work and she had to send it certified so greentree would have to sign for it. But we have sent over $600 a month for four months and for some reason they feel as though we are still not up to date, now I know I am not the smartest person in the world but to me it is just simple math not only should we be caught up but we should be ahead of our payments, But can you guess, greentree is sill calling every day and threatening foreclosure SOOOOOOOOOOOOO if anybody has some info on how to get away from these blumbaling ###s please help us for you see we have two beautiful daughters that according to the greentree reps do not need milk or formula or electric for our kids but our kids also don't need to go to daycare so my fiance and I can go to work to make the money that greentree so desperately needs. Hell the ignorant person who's name is nikki said that we shouldn't even make the truck payment which is the only transportation that takes my fiance to work and without her going to work we cannot and will not make payments.

Unfortunately, it appears that Greentree/Conseco didn't receive any Obama bailout money and therefor can run high and wild on their clients with no reason to fear the government or the law.

There is no talking to these people - they are paid to be nasty and rude. My brother-in-law runs a company in the same vein (sorry, that just slipped) and they get paid for any funds they collect.

It's the system for which they work and they hire only the nastiest and harshest people to run their calls and collection processes.

The phone calls we make all seem to be routed to the same nasty woman no matter which number we call. She won't talk to me when I told her I record every call for quality control purposes. They say they record for the same reasons - sometimes - and if they do, then I can record without their consent in California and have done so.

Let them have the house as the fees/penalties far exceed the value of the home in the first place.

Comps in the area for newer and more-appointed units are in the $12, 000.00 range and yet we owe over $60, 000 even after paying since 1999. There has been no equity paid - it's all interest.

The loan was fraudulent and an attorney gave me a reading of it, saying so. There are legal grounds for rescission if we want.

The park where this mobile is located has been collecting space rent and maintenance fees on abandoned homes - which this one will soon become - that will far exceed the payment we made, and the park can legally seize the unit after 120 days of failure to make those payments by Greentree. It's a city code for abandoned homes.

Since the "agent" has told us that they are foreclosing and slammed the phone down, I figure that this is their intentions - so let them have it.

Ditech Financial / Green Tree Servicing Mortgage Delays

I previously applied for a mortgage with DiTech in 2006 and had no issues. I applied again with them in 2009. They assured me that they could close on my property within 30 days assuming I supplied them with all the necessary documentation. It has now been almost 45 days and we still have yet to close. They continuously ask me for the same documents that were already sent to them weeks ago (apparently they can't locate them). They scheduled an appraisal on my property which for some reason, did not get completed, and were not aware that their appraiser didn't complete it until I called 8 days later to check on the report. They then order it again and tell me it will be expedited (24 hours). 4 Four days later and it finally gets back to them. Today they call again and tell me they are "missing" documents and need me to resend to them which I do immediately. I rented my home out assuming that DiTech could close on the property within the 30 days. My tenant moved in after 42 days and I am now stuck living in a hotel waiting for these people to close on the property. When you call, you can never get an answer. The file is always being reviewed by someone.

Damage Resulting
My family and I have had to place our items in storage ($300), have had to stay in a motel now for more than 2 weeks ($2, 000) and will have to pay the moving company to pick up stuff from storage ($600). Every passing day, the economic consequences grow.

It appears that you made the decision to incur these expenses before your loan actually closed. Never a wise idea, nothing is guaranteed and you do not actually have a loan until the money is in your account.

Ditech Financial / Green Tree Servicing Glenda Turner

I started renting this house on a rent to own basis in October, 2007. I started paying the owners of the house and then in March, 2008 I started paying their mortgage payments directly to Green Tree Financial. They brought me foreclosure papers in the owners name and then Green Tree told me that if I paid 4000.00 they would stop the forclosure and promised me that they would put the paperwork in my name. I gave them permission to automatically withdraw my payments .They also told me there were back taxes owed on the house and that I was responsible. So I agreed to pay a little extra on my payments to start paying the taxes. Then at the end of 2008 they took double payments out for 3 months straight saying that I was delinquent. So I cancelled the automatic withdraw and they accepted 3 months and then retuned the next 2 months. Now the house is back up for a trustee sale in the owners name. They also told me that if I paid them another 4000.00 they would stop the sale again. I have paid over 16000.00 in the last 18 months and that isn't including the foreclosure or back tax payments. They have harrassed, threatened and made me have a nervous breakdown.. I am a 70 year old woman on a fixed income that is guaranteed every month, never been delinquent on my payments and I have tried everything to work with these people and they wont cooperate.

Ditech Financial / Green Tree Servicing Awful experience

We will be in court soon. They came to my boyfriends house broke in pulled my dog out with a catch pole chased my cats, and said they all were going to the pound to be put down. Thank God I showed up, but the sheriff said I had 1/2 an hour to get what I could then I would be locked out, and I could call Kriss wade to get the rest of my things. Well this all happened on 3-9-09 I'm still waiting now we are going to court to get our things. They ransacked our home took pictures of our things and violated our 4th and 14 th amendment rights plus they won't let me get my fish out so they will be charged with animal crulety also. We have had it with all there accounting games.They can have the house we do not want it we just want them to quit holding our things hostage and get out of our lives.People you need to stand up to them and hold your ground~!

Steven Kirby is an account representative with Greentree Financial Corp. He calls when the payment is 2 DAYS late! It seems He has a personal vendetta against anyone who WILL at least pay their bill every month and will NOT take NO for an answer.They feel they have the right to call you when you are 1 day late. If you have got a loan from these guys you need to REFINANCE WITH SOMEONE ELSE AND GET OUT NOW ! They are the worst Financial Institution out there. Maybe we can HARASS HIM ? His employee reference number is 64309 and his Direct number is [protected]. Pease call repeatedly as he likes HARASSMENT. I wonder how he even managed to get a job with his nasty attitude toward people even though we might be 2 days or maybe even 10 days late or even more, we are their customers and deserve decent treatment. I drive a truck at night and DO NOT LIKE BEING WOKE UP EVERY HOUR! His boss is named Nick and pretty much condones this attitude of condescension towards customers. It would be outstanding if their boss, or maybe the head of the company knew what is REALLY being said to their customers.( It is supposedly on tape somewhere?)

I had a home equity line of credit with Ditech since 2004. In that time I have never been late or missed a payment. I currently owe them $7, 000 from a $25, 000 credit line. After sending them my March payment of $1, 000 I received a letter stating my account was suspended. After contacting them they had said we missed a Feb. payment, which is an absolute lie. We sent the payment! After questioning them why they would cancel an account that has never been late or delinquent before they basically said because it's their right to do so. Needless to say I took this up with a supervisor, who finally admitted that it wasn't really about missing a payment but instead it was because of the country's current mortgage situation. It was completely observed that you would cut off the credit line to the people who actually pay their bills. As far as I know, they probably held the Feb. check or destroyed it so they had the excuse to cancel my credit line. I told them this is why GM/GMAC and anything affiliated with them is slowly dieing. Do yourselves a favor - stay away from these ###s. If this is the way the GM organization does business I can understand why they keep begging for federal bail out funds, like the street tramps they are, rattling their tin cups for a hand out. Go with reputable banks, IF you can find one. This is my entire opinion of this organization, and I hope by reading this it will save you some aggravation.

My home loan has been paid off and overpaid by $54500.00 I have contacted them numerous times and all they say is they are researching why the money has not been refunded. It has been forty days since they have received my money. They will not return calls and are not understanding at all. If I would have been this late on a loan payment they would have evicted me and reported me to the credit bureau. This is the worst company I have ever seen, do not get a loan from them. My original loan was with Bank Of America and they sold the loan to guarantee. If your mortgage company sells your loan to this company. Call them immediately and refuse the transfer due to this companies reputation. Greentree takes advantage of people and should be stopped.

I have been paying on this loan of $34000.00 for 18 years and i still owe principal balance of $22491.86 . They have been very rude and harrassing . I feel they are taking way more of my money than they should i feel i am being ripped off i have paid them well over 60000.00 . I do not know how to get proof of how much i have paid and what it has all been for i would like to know how to find out. And i don't have insurance with them anymore but they are still charging me for insurance . PLEASE HELP

Ditech Financial / Green Tree Servicing Fraud

I notified Green Tree that my husband was in a car wreck in Sept. I told them that he is working, but not full time due to his injuries. They gave me a number to call and I can not get thru to a human to see if he took out insurance in case of an accident.
We are trying to keep our payments up, but we're slow because of his hours being cut. They are now calling us 3 to 4 times a week and on the weekends.
Isn't this called harrassment?
Sure could use some help. We have a lawsuit going against the company that the person was insured thru, but this takes time.

last month bank of america sold our 2nd loan on our house. paid my first payment, then this month called my husband at work being extremely rude and saying we were very late hahahaha! NOT ! I paid on the 8th my grace period gives me to the 16th . i have never recieved a phone call from boa 5 years that we have had the loan until these people took the loan . my credit is great to possibly excellent. I am soooo pissed off ... never in my life . i called and talked to 2 people both being rude up until they seen i have good paying history ohhhhh then they tried to say they didnt say this and that ... well i told them they better hit the rewind button on the recorded phone call cause i know exactly what they said... luckily i will be trying to refinance away from these crooks . i will help with whatever anyone wants as far as a statement on this companies rude horible ethics... this company needs to be shut down ...

I know what you mean. Green Tree has been harrassing my Mom and Dad for years and it pisses me off! I have read where 100's of people have complained and this company is still allowed to do this?! Ditech Financial / Green Tree Servicing Re-fi loan 60 days in no closing yet!

I stared a re-fi process will GMAC/ Ditech in the beginning of January. My loan agent was great but the processor and her boss both lacked some serious customer service skills. At the end od January after leaving repeated messages for processor and boss I got so frustrated and called my agent back. She apologized for the trouble and found the info I was requesting. Needless to say it is March 20 to date and I am just speaking with the boss of the processor. I agree with everyone else's complaints. There is no follow-up and the different departments don't know what the other is doing. I had been told my loan was in underwriting since February 15 and every week they need something else. Now, the last piece of info needed is something about the appraisal. They didn't even contact the manager of that department until she was on the phone with me. Why should I have to call for them to do their jobs! Lesson learned for me.

Ditech Financial / Green Tree Servicing holding check

On the 24 Febuary 2009 I sent green tree a check for final payoff.
On the 9 march I checked the webb site to find out if any action had been taken and to my surprise none.
I called the company aprroximately 6 pm on the 9th. Their service representative STEVE said that they received the payment on the 6th.
I requested too talk too the supervisor because he became really obnoxious. He refused to get the supervisor, I hung up and called again and spoke too Crystal. Crystal told me the same thing, that the check was received on the 6th. I find this very strange even though the mail service is sloww it's not that slow. When I asked why it was so slow to be posted her answer was that payoffs went to another address, which it is.
My complaint is that it appears that Green Tree is sitting on the payoff checks to receive more interest money from thier customers.
Greeen Tree stated that I owed another 97 cents but they would write this amount off. If they had posted the check in a timely manner then it would never have been an issue.

I have not received a statement from Greentree in over a year, I cant get anyone to tell me what my pay off is, or anything. I tried for a bill consolidation loan and GreenTree stop it, as soon as they found out about it, they jacked me pay off up to 2000 dollars over the amount I could borrow...I hate them, and the biggest thing is that I didn't even take out a loan with them. The company that I did take my original loan out with went bankrupt and GreenTree bought my loan I HATE THEM

We finally managed to pay GreenTree to stop foreclosure...The courts dismissed the case.
We started making our payments...as they were.
Today we where threatened by Tamika ( a rep) that they were sending our payments back because they weren't two times (2x) more than we had agreed on.
No papers have been sent to this agreement, only Tamika telling us payment would be sent back. Although, yesterday my husband spoke to an intelligent agent saying we needed to pay the insurance...okay.
This Tamika has badgered us, threatened us. Their attorney's don't return calls.
Maybe as a collective of people we have such damning reports should consider a class action suit. Call the BBB in your area, talk to an attorney to stop these "people" from taking more and more money out of our pockets and keep people like Tamika from calling with an attitude of hostile intent and threating nature!

I want to start out with asking anyone would they like to come in with me and form a group and file a lawsuit against Greentree? I am over a very large group of people around the nation that are fighting the oil and gas companies, the way they do business, and I sure don't mind taking on Greentree.

I am not an attorney, just an average person who is sick and tired of big business' and corporations who treat people like they are beneath them and are lower than dirt. Who do they think they are?

I aree with u all. We need to do something. I need help i don't really know where to start. I was doing so research about mortgage frauding. It was stated that the 1st thing you would need to do is contact the state attorney general's office at oag.State.Tx.Us. We're under greentree also. We deal with the reps in san antonio, tx. And they're very rude and nasty. They don't know how to talk to you. On our statement it's all wrong. The balance is wrong, they late fees which are not true. I'm trying so hard to keep our home. My husband is disable, i've tried several time to get a mod. But it never happens. I've faxed paperwork several times but it always get lost. Hello Dan, DavisD, and other violated Green Tree customers;

While I am sorry for the abuse that you ALL have suffered at the hands of Green Tree Servicing, it is not surprising as we have the unfortunate pleasure of dealing with Green Tree on a daily basis for our clients that have experienced the same or similar current or delinquent mortgage servicing abuses that you have stated in your valid complaints to include CFPB violations for payments not being promptly and properly credited, restricted dual-tracking, fair review process, no runarounds, notification of foreclosure alternatives, refusal to provide payoffs and most importantly; unfair, deceptive and abusive acts and practices (UDAAP). Can I say that there are multiple consumer rights (and constitutional rights) violations under Federal law that I found in all of your complaints and I am on a mission to educate consumers on their consumer and constitutional rights.

I routinely look for posts to answer in hopes that it will not only bring optimism to those homeowners and borrowers in distress but also some basic information to assist in fighting the banks that are "too big to fail" but yet don't appreciate the bailout that we provided in their time of need. The debt collectors like SPS, SLS, Green Tree, Ocwen and Nationstar are simply just piranhas but they can be beat at their own game too just like the big banks can be defeated. You CAN win this fight!

It pains me that you all (including Don and DavidD) have fallen victim to the illegal, unfair, deceptive and abusive acts and practices of Green Tree, but I also commend you for seeking help; too often homeowners do not fight for their consumer and constitutional rights. Green Tree, like may of the large mortgage servicers, are under greater and heightened scrutiny now per the reported wrongdoing this year and in the past so this is an excellent time to assert your consumer and constitutional rights!

With that said, you have overlooked a key aspect to your fight, which is putting your valid objections and servicing abuses in writing in the form of a proper QWR and attaching proof your consumer and Constitutional rights; they have certainly been violated in this case as I see it. All of the mortgage lending and debt collection companies, including Green Tree Servicing, MUST answer your Qualified Written Requests (QWR) and if they refuse to then you take your fight to all the regulatory agencies outside of Green Tree that assist in fighting for your rights like the CFPB; it’s a shame that these more than profitable and previously bailed-out companies engage in this type of consumer abuse.

My loan was also sold to GT from BOA. I have been with BOA for 7 years and have had no real issues with them. Ever since GT has taken over my loan it has been one thing after another. I went thru a layoff with my job and was in a tight situation for roughly 3 months. I did what I could to keep the bills paid. GT acted as if they were willing to help me thru this so they did a modification and raised my mortgage from $1, 100 to $1, 200 a month. I was back to work by this time so I didn't really mind as long as I wasn't gonna lose my farm. Well I paid the $1, 200 without a hitch for about 4 or 5 months and then I received a check in the amount of $1, 200 from GT. I wasn't sure why so I tried calling them. They returned my call the next day stating that a paper from the modification was turned in too late so it was being denied. So my question to her was so what do I do now. She is wanting me to deed it to them in lue of foreclosure. I was like hell no I'm not giving up my farm. She said they have no other choice but to start the foreclosure process. I was at a lose of words, completely devastated. Now that I have a new job and have had that layoff that made me fall behind I can't see another bank that would be willing to refinance me. I'm in total shock of all this. I completely feel like they have the power to do whatever they want no matter what. I have put so much money in this property and now they can come take it from me. The price of land is very high in my county due to the gas rights, I have a funny feeling that they had this planned all along. They could get rid of me and turn around and sell it for probably double. I can't see how they are able to continue to do this to people and get away from it.

It's such a shame Timothy McVeigh blew up the Federal Building years ago and killed all those innocent people. If he did the same to Green tree Mortgage his efforts would be applauded. Especially by me. I have been harassed and threatened to know end. I even changed my phone number twice to attempt to stop this. Now when I pay by calling them I am a nasty son of a ### and curse them as they desperately need to be. I have a nasty hateful attitude before I call. That way I am already prepared for their B.S. It's always a different piece of human feces. I am actually starting to enjoy treating them as they do myself.

I HAD a 2nd with Green Tree, they have been nothing but harassers and CROOKS.
On 5/7/14 I closed a refinance loan with Wells Fargo to be rid of this company. If you know how escrow closing works, you know the balance due is calculated to the last day and funds transferred (electronically, not by sending a check in the mail) to the lender. NORMALLY the lender applies the funds ASAP, NOT Green Tree. I checked today 5/9/14 to make sure the loan was closed and an auto payment would not come out on the 12th. (Unfortunately I was too late in a stop payment) Guess what... When I talked to a "customer service" rep, they said, they have not received the funds... ###. What they are trying to do, is take their time in applying the funds so they can charge me extra interest and not get the loan closed out; because there will be money due. I have bought and sold and refinanced many homes through the years and have never encounter such a bunch of crooks. My advice to anyone with a loan or whatever from them is to GET OUT, ASAP. I did not choose Green Tree, BOA screwed me by sending my loan to them. And if you think they are there to handle dead beats, doesn't matter; my score is in the high 800's.

I am now having the same problems with GreenTree. I sent the payoff balance last month and they said it was sent to a different address and they suspended the funds. Still a month later they are dragging their feet. I finally told them that I am contacting the FTC and the BBB if its not resolved within the next week. Waiting to see what happens now. And will never have nothing to do with these crooks again!

Ditech Financial / Green Tree Servicing awful company

I'm going to try to be brief because I have just finished writing a long letter to them...now trying to find the names of their executives online is proving frustrating, but I'll get there.

It started with me sending a fax of my proof of insurance. Someone must have misplaced my paperwork and that's where the snowball begins. Since that day in August, I have spoken with approximately 4 people, received an e-mail reply from 1, received more letters and analyzes than I can count and they have taken money out, put it back in, sent me disbursement checks, reanalyzed my account, but it appears that no one knows what they are doing. One person tells me the problem is fixed, then I get more letters, and a call from collections, so obviously the problem is not fixed.

The point is, rather than be nice and put my account back to where it was before one of their employees misplaced my paperwork, they continue to move things around, and the end result is that even though my taxes went down my a few hundred dollars, and I was promised my payment would go down $20 a month, I now receive a letter that all those 'overage' disbursement checks they sent me have now created a 'SHORTAGE' and I now will have to make payments of $14 more than what I originally started with. I think the workers are inept and I am tired of being punished for their numerous mishandling of my account.

Ditech needs a ahake out of their loan representative employees. I have had a situation for two years where ditech owed me 2166. to 2500.00 for a loan payment however, I would contact a representative who would take the time and find the error, however, it was never credited against my mortgage payment. this happened numberous times through out the two years. I finally thought a month ago, I would received the credit against my mortgage payment. a loan representartive and I had went though the account h and she found there was error where I was owed this credit against my loan she had adv ised the mortgage department and I was suppose to receive forms for the error t. I never received these forms. I called a few days back to check on the credit and forms the loan representative who answered my call was rude I advised her that this loansales representative had advised the mortgage department of an error on my account. this rude representative had advised me that this special caring customer representative has resinded her complaint and the rude person stated I was the only one who found the errorr one would suspect this caring person was preasured to change her commitment to a customer further k I requsted the account records to for march 2016, april 2016 may 2016 andjune 2016 send me by email the four statement in
Question. after reviewing these statement, to my dismay, there was the error in the
March statement 2166. this 2166. was paid in march 4, 2016, with a different account number and these funds were placed in march 15 to april 15 2016 under funds in suspense. however the statement from april 15 to may 15 2016 the 2166.68 disappeared

Answered Ditech TV ad. Wanted consolidate our debt in a mortgage. Instead of our credit card debt in the mortgage, put it all on a Ditech MCcard. The interest rate started at 7.9%. After the first year it exploded to 35%. Add the recession and work cutback and we are losing everything. We had perfect credit scores for twenty years. That got us paying 2 points more than advertised rate and no consolidation. All credit card debt still in credit card. $8000.00 to refinance rolled in. We also have 2, yes 2 contracts. The we started with and the one we ended up in. We bit, they switched. By the time we realized how different it was, it was to late to cancel. We could not afford to refinance again. We are now losing everything. Our home of twenty years and all our eggs.

I agree totally, the story is too long but it is four months now into a refi, and they keep changing what they are looking for and change underwriters who say different things from title an different from loan officer. It is intolerable. If you get admin name and addresses let me know. Impossible to go up the ladder there.

Here it is nearly a year later and Ditech is no better off. I applied for a refinance over six months ago. Calls have gone unanswered yet a week ago they charged my bank account $370 for the appraisal. When I finally heard from someone I was told it was a mistake and they would take care of it. They also told me my loan was not approved and blamed it on my HOA for not sending back paperwork. My HOA claims to have never heard from them so when I asked Ditech for the FED EX tracking info I have been met with silence once again. And have the charges been reversed? No. DO NOT DO BUSINESS WITH THEM. They are incompetent.

Yes, it looks like there may be an internal interdepartmental communication problem going on there. The people you were talking to may have been from different departments and if they are not documenting the comments properly on the computer, may not know what the other department told you. I would suggest to get a handle on the situation, request a copy of your full history statement be sent to you. A full history statement will include everything from the beginning of the loan to present. When you receive it you will have a history of all transactions on your account that has ever been made. This way you can see when the problem started. Now when you call them back, ask them to bring up the history on their computer and now you have an equal playing field to follow along as they explain the various transactions in the problem months. I know that you are frustrated, but when you call back, try to have a calm voice and be nice. Usually the first person that you get is the customer service rep. They are verbally abused all day every day and to have a kind voice may be just what they need to go out of their way to help you.

Hello my fellow abused citizens of these great U.S. of America, I have been, threatened, degraded, humiliated, demoralized, and abused just like so many obviously. I can not figure why in this world a company as unstable as Greentree/ Conseco/ Greenpoint and how many other names it has had, can be so NASTY to people and not lose all of their business.

I also do not know why these people, (yes, 'these people', not 'this Co.'), are allowed to be so MEAN to others and get away with it. Who do we 'the people' need to contact? Where does this VICIOUS cycle end? HELP, someone, please!

I have been given 5 days to 'GET OUT', with 3 kids and nowhere to go. I work full-time, go to college full-time and try to do the best I can. Times are tough, but they don't care! They call me 'LAZY', that BI#@* does not know what she's talking about. She also says that I 'don't care about my kids, because you can't provide them with a roof over their head'. I am 2 months behind and have no other options according to Greentree representatives. I hope that Karma kicks her a**!

Everyone who has a complaint needs to send in a consumer complaint to the FTC and their states Attorney General. I just sent in my complaint. The more of us who show the pattern this company has the better chance that someone might finally take notice and do something about it. And you debt collectors who are posting on here blaming the home owners you need to go look in the mirror and honestly ask yourself if you would want to be treated the way you treat others?! My story is below and its a nightmare. I will be contacting a lawyer about it soon unless I get answers.
My husband was in the Navy and due to retire in 1998 so we decided to purchase a mobile home and the lender on the home was Green tree Servicing LLC. We purchased land through a separate lender (SilexII). After my husband retired from the Navy and was searching for new employment we fell behind on our payments. Green tree was calling constantly telling us they were going to foreclose if we didn't make payment by phone right then. They kept adding fees and we could not catch up and a man named Benjamin Henry sent us mail (in 2000) one day and said he could get us a refinance and lower our payment if we combined the home and land. I called him and he said he was with a company called Conseco and said he would take care of everything and not to worry. A few days later I decided to call him and see what was going on and if he was able to do the refinance and he said yes he just needed some time to get all the paper work completed and would call when it was time to sign. Time passed and he called around 9:00pm in the evening and said we could come to his office and sign. We went into his office and signed the papers and while sitting there I mentioned I was so happy to be getting the mortgage out of Green trees hands. He laughed and said yes I get a lot of complaints about them. He informed us he had 2 appraisals done on the property and would show it to us once we signed the papers and that he was not obligated to show us since he paid for them. One appraisal came in at 110, 000.00 the other at 109, 000.00. I'm sure the appraisal was false since its a mobile home and they depreciate and the home was originally only 58, 000.00 and land was 19, 500.00. I recalled seeing the name Green tree on the paper work we signed but figured it was because they were the other lender so it would be on the papers. Well my husband and I were devastated to say the least when we realized what happened the papers we signed was a modification with the same lender under a different name. Conseco went bankrupt in 2002 and we started getting our bill statements from Green tree again. We ended up going bankrupt because they will not in no way work with customers. We feel they targeted us because the lender silexII (owned the note to our land) was heading into bankruptcy at the time Conseco came into the picture (Green tree in disguised) and wanted the land and home. We kept the home in the bankruptcy and have been on time since and have excellent credit and want to refinance our loan and ended up running into a problem. We searched all records in the county here and the records are so messed up even the people who worr at the county clerks office couldn't understand what happened. We can't find anywhere on any paperwork where Green Tree holds any paperwork on the land itself. They only come up on the DMV as the lender on the home back in 1997 (the original purchase). We have done a lot of research on this company and its many aliases and there seems to be a pattern with them that seems predatory. When we were in the county clerks office we found where the city here sued them back in 2003 for allowing so many foreclosures and leaving the property empty and turning neighborhoods into less then desirable.I read all the complaints about them and its really sad that they are allowed to treat customers as if they are less then human at times. We worked hard to do the right thing and pay what we owe but at this point we still owe 76, 000.00 ( 12, 000.00 was for closing cost when we signed the papers for the refinance) on the home and its 1, 000.00 over the original cost brand new what we owed when we bought it 15 yrs ago. Our interest rate is over 10% and we asked last year if they would refinance and I was told no they do not offer that service at this time. I would like to know who has the note on my home. I do not want to pay it off and never know if I will have the documents saying its mine free and clear. I want to keep the home but this lender/servicer makes it difficult.
I'm not trying to get out of paying my bill but I don't like being taken advantage of. If anyone has any advice on what our options are please feel free to comment. thank you for reading my comment and if it helps one person to avoid doing business with Green Tree or any of their aliases it will be worth it!

Well to dear bernice you and Green tree/green point are full of crap! I have paid my mortgage Faithfully and on time for 14 yrs and they not only "sold" my mortgage to these group of collective idiots but ever since they are ringing all day and calling people they think are related to me and threatening me on the 15th of each month when its due on the 13th while it sits on someones desk waiting to be cashed... again are you just as stupid as they are? these people are crooked! they are STILL after 14 yrs taking 90% interest as the principal sits there un-changed. There is hope a law is in effect if by a certain allotted time they do not produce the original agreement then you don't owe them ANYTHING ad they must send you the title soooooooo i'll let you know when i get it :)

Yeah Greentree people are not smart. They charge for misc fees for no reason and send a repo man after 2 or 3 months. which is not fair. Everybody else gets a scare and we get the actual thing. They add fees on top of our payment and dont explain what the fees are. Can't believe they can do this and no one can really do anything about them. its the worst company ever with bad customer service. they also keep your payments and put it aside and still claim they didnt receive a payment.

We also have a our second mortgage with Green Tree, we are self employed, and due to the economy, we are late on our monthly payments with them, not quit 30 days late, but late so we do have some late fees that have been added on, but anyways, they call both the home, and husbands phone every 20 min. of the day, and evening, we don't answer because of how rude. nasty, and how they lie. I just got off the phone with our rep (that's what they call her) Rebecca is her name, and she said if I don't get up to date today she was not accepting my monthly payment (which is all I can afford right now) and she kindly hung up on me, I called back, and told the receptionist I want to make a payment but not with our rep. she sends me through to our rep again, and the rep said we need to get update and get our crap together ! I could not believe she talked to me that way! We have many bills, and a first mortgage that needs to be paid, we do the best we can. I just feel bad for all the many customers, that Green Tree has belittled, and talked nasty too. A question though can they legally say our loan is going into default even though we haven't been 30 days late?

Green Tree has 800, 000 customers. Repossessions & Voluntary Surrenders don't cost the company anything. Thats chump change just like the $450 monthly payment your paying. By law Green Tree cannot over-charge you on escrow. You signed a legal and binding contract to have an escrow account, otherwise you wouldn't have it. 100% of escrow is property taxes & PMI (private mortgage insurance). You must pay PMI until your loan balance is less than 30%. This protects the lender. Green Tree didn't come knocking on your door asking you if you wanna buy a home. Any loan that was transferred to Green Tree was transferred for a reason. Green Tree specializes in LOW DELINQUENCY & GMAC, Country Wide, Irwin Home Equity, Bank of America, Fannie Mae, Freddie Mac, GTA, Green Point, Conseco and HELOC hired Green Tree Servicing company to "service" your loan. Your loan is classified as "high risk" and the whole entire reason it was transferred is because it's constantly PAST DUE. Green Tree doesn't own 1/2 the loans they service, the original lenders do. Not much of a liability to Green Tree. I suggest you make you payments & if you can't, then call and make arrangements. You can't live in a home for free, even if you are going through financial difficulties. & If your loan is more than 10 days past due, I suggest you don't mail it. US POSTAL SERVICE takes an additional 10 days to send your payment making your loan an additional 10 days past due. Most loans have a per diem charge, per day. If you go more than 30 days between your payments you will be charged this daily per diem, every day your late & that's not Green Tree, that's YOUR loan.

I have read a great deal of Green Tree Servicing complaints. I could believe what is being said about them. I am a business owner and recently done a flood damage for them. It took forever to get my money from these people and on top of that I got allot of run a rounds. Also on they paying thing, I sent out an invoice balance stating what was owed to me. They sent a check to me and it was $800.00 dollars short of what was owed. Then I sent another invoice of the remaining balance plus late fees they sent my money but not the late fees. You are all right about them I believe so keep up with your paper work and make sure you really understand the agreements.

Here's a good one for you guys! They are suing me for a mortgage I never took out! Yes, you heard me right. Don't even have a signature on one paper yet they maintain I am responsible. Here's how I got involved in this mess. A man, who coincidentally shares the same first and last name as my ex-husband, took out a loan on a property that he has since defaulted on and the property is currently in foreclosure. Yep, that's it. They are suing me for a mortgage taken out by a man I don't know. When I called them to explain things they were so rude, wouldn't listen and even said they would see m e in "mortgage Hell." ALL FOR A LOAN THAT MY NAME IS NOT ON! I am contacting an attorney tomorrow and plan on filing suit.

I just paid off my loan about two months ago after I refinaced and they have not returned my money! If it was the other way around they would be calling me daily and reporting me to the all credit companies. You can file a complaint with the dept of corperations in each state. I did!

For all those people who are behind on mortgage payments and are facing foreclosure don't let your lender scare you into leaving your property earlier than you have to. Most foreclosures are taking over 2 years or longer from the time that you missed your first payment. So if you are only 2-3 months behind you still should have plenty of time. These lenders are so overwhelmed with the number of foreclosues that they are not moving quickly. Again don't let them make you move until you know the foreclosure sale is coming. You can find the sale date of your property at the Clerk of the Court, the County Commissioner or other governemnt office that handles foreclosures.

Ditech Financial / Green Tree Servicing Earnest money

I have recently relocated to New Mexico. While searching for homes for sale I came across the 1979 double wide mobile home located at 76 Road 5285 Bloomfield, NM 87413. It is listed with Fleming Realty, Liz Tafoya in Farmington, NM [protected]) for $110, 000. The home as listed by Fleming is available for a conventional, FHA, or VA loan. I made an offer of $105, 000 which was accepted and we entered in to contract. The home is a reposession, being sold "as is" and was in some obvious disrepair: light fixtures missing, counters and cabinets removed from kitchen, trash everywhere, fence falling down, back porch steps falling apart, front porch leaking, rotting food left in refrigerator, carpet stained and needing replaced. I was willing to repair/replace all of these problems. However, as per my contract, I desired to perform inspections of the plumbing, electric, foundation etc. Those dates were set in the contract which Tom C'deBaca from Green Tree signed and agreed to. Here is where the problem begins. When we went out to do the inspection, we found all of the utilities were turned off so the inspection could not be performed. Our realtor from Century 21 contacted Liz Tafoya at Fleming and requested the utilities be turned on, including the installation of a propane tank which is the source of heat for the house and water heater. Ms. Tafoya informed us that Green Tree would not install the propane tank and suggested we do it ourselves. We refused to do so because we have no legal right to request service at a property that does not belong to us. After 10 days of back and forth, Ms. Tafoya informed us that she installed the tank on her own and that we could perform the inspection. When we arrived, there was no electricity to the property. There was water rushing underneath the trailer because there had been 7 or more days of below freezing temperatures and all of the pipes had frozen and broken. We requested that the electricity be turned on and the plumbing be repaired. After 3 days, we went out to the property again. There was obviously some work done, or attempted on the plumbing, but once again the electricity was off and water was rushing underneath the trailer. We filed our objections to the inspection by our deadline and requested that all the plumbing problems be repaired by a certified plumber and that all utilities remain on until the closing date so that the problem would not reoccur. We did not recieve anything in writing but were told by our realtor that Greentree said they had back up offers and we could "take it or leave it." We chose to leave it and filed a termination of the contract with our realtor based on the inspection and plumbing problems. I received a phone call a few days later from my realtor at Century 21 and was told that Liz Tafoya had called and Green Tree wanted to know if we would take the property if they repaired the plumbing. I said we would have to think about it and I would let her know but we were already interested in another property. I was told at that time that Liz Tafoya said that we would not get out earnest money of $500 back because they had incurred so much cost from the property. My contract states in section B page six of RANM Form [protected]) "Seller and Broker strongly recommend that Buyer satisfy any concerns that Buyer may have about the physical condition of the Property. To accomplish this, the parties are encouraged to employ competent and where appropriate, licensed) professionals to perform inspections of all conditions of the Property. Buyer has the right to have performed the inspections... Seller will be responsible for paying any charges required by the utility company to have utilities turned on for inspection purposes, but in no event will Buyer be responsible for charges to repair the property, to bring it up to code, to pay unpaid bills, or for anything other than a turn-on fee."

My loan was sold to Greentree from Conseco about 6.5 years ago and since then it has been a nightmare to deal with these people. If you are behind they will use every tactic in the book to try to embarrass or getting a hold of you. They have called neighbors and other people i work with. The have called and threaten my parents and they have called my ex wife's family (2 years after I divorced her and she was never on the loan). I have attempted to pay off chunks of my principle (one payment was 10K) only to have it applied to interest. I finally decided on October 1st that I was going to try to work with HUD and see if I could refinance through the program that Bush signed into law on June 30 2008. HUD was very helpful but GreenTree was not. Since the program is voluntary by the lender they decided to do their own loan mod which would allow me to rent my own house from them for a year, but it would reduce the payments by more than half (4100 to 1800...yes i know it is a lot). They would not send paperwork and asked for 3000.00 before they did anything to my loan. I refused and decided it was at that time i decided to get a lawyer involved. So I hired a real estate lawyer and a general lawyer to fight them. I also decided that i could no longer could afford my home and stopped paying greentree anything. Since I have done this and since my lawyer has contacted them they have become unreachable via email or phone. My legal team has sent notices to the Michigan Attorney General and submitted a request for an investigation to the FHA and HUD into GreenTree's practices. I would also recommend to anyone that gets harrassing phone calls from them to record your conversations with them from now on. Tell them you are recording them and see how their attitude will change. I would recommend that if you are going to go head to head with them you retain legal advice and record every conversation and save every email.

My mortgage was sold to green tree from bank of america not that they are good. ever since i spoke to some of the custermer service dept they are very nasty one girl told me why have a mortgage with us if u can pay on time we dont appreciate what your doing how much you get payed a week you better pay the late fees and so on they need to be shut down for investigation something has to be done very nasty people we should call the press put them on tv.

OMG! My loan has just been sold to Green tree and trying to talk to this jerk Joaquin (if that's his real name)was a nightmare. National Mortgage sold my loan to green tree and didn't forward my payment. I'm not late on my morgtgage! Joaquin was rude and nasty, he talked down to me as if I was the worst paying customer. He said " You need to take this matter seriously" and hung up on me. I called back and got the same Jerk on the phone. Everybody join me in sending a complaint letter to Keith Weiskittle Senior Vice President General Manager, Customer Service P.O. Box 6172 Rapid City, Sd [protected] volume may spark an investigation into their Customer Service Dept. worth a try. meanwhile I will look for another bank to take my loan...

In my 35 yrs of buying and selling property I have never had anyone talked down to me like that... :(

Ditech Financial / Green Tree Servicing Do not EVER work with you

My husband and I have had a loan through Green Tree for a little over 6 years now. We have NEVER been behind. About 5 months ago, not sure when, we had gotten a month behind. I called and made payment arrangements with NO PROBLEM! I was told that as long as I call them and tell them what is going on with us, that they will ALWAYS work with us...We have fallen into this economic land slide because my husband is in the construction industry. We have fallen 2 months behind and when I called to try to work a payment out with them, they refuse to talk to me unless I give them a check number and make payment arrangements. I have sent out one check for October just a little over 30 days late. I attempted to pay over he phone and it sent me through this loop and wouldn't let me and no one would pick up my call. So I just mailed it. All of the other checks I sent with the same batch to my credit cards have received theirs and cashed them. Then we are 9 days behind for November and they have already started foreclosure on our trailer, not the property, its not ours. They had a collector call me who called me pretty much a liar and said that I am 3 months behind, so they are preceding forward. Its not december 20th yet, so how do they get to do that? I think they are taking advantage of the economic crunch and they know that they ripped us off and this place isn't worth the money we financed, so they think they are going to jerk it out from under us and resale it and make some more money. The funny thing is that it cant be moved again, it fell apart when we moved it here...it took 15, 000 to get it fixed but we were told NEVER TO MOVE IT AGAIN! I would think they would be wanting to work with the people who usually pay their bills, not try discourage them into leaving it.

Ditech Financial / Green Tree Servicing Unethical business practices; Illegal collection activities

As of this entry, I am currently a customer (victim of) Green Tree Servicing, LLC. Here's my breif "Green Tree Story". In 1999, my young family of 3 (myself, wife & small child) found what we believed to be a home that we could afford on what little income we had. We purchased a 16 x 80 mobile home financed by Green Point Credit. After moving it to land of our own - we began to make monthly payments as agreed. At the time of purchase we aquired home owners insurance acceptable to Green Point. A few months later - we recieved a letter that what was previously acceptable was now not acceptable and that we would have to acquire additional or Green Point would place their own high cost insurance on the home. When I objected - I received letters threatening repossession. While considering our options - Green Point billed us an additional $59.79 per month over the original mortgage payment for their own insurance. Frequent call's, faxing of our own policy etc. did not change the fact that they were determined to force their insurance on us and continued to add it to our mortgage payments. Customer Service of course was excellent prior to the sell and then became horrible immediately after the sale. Fast forward several years later we began to receive bill's with Green Tree Servicing on it in place of Green Point Credit; same people, same horrible customer service, same unethical business practices. We simply continued to send our mortgage to what ever bill showed up with our address on it unsure of how many name changes this company was going to have. Once sued - they change their name and their back in business again with a new name but same unethical, illegal activities. As the years went by - we would have an occasional decrease in house hold income and fall behind a payment or 2. In a good faith effort - we would call Green Tree (no) customer service at [protected] and the call would be forwarded to a Jacksonville, FL. Green Tree office at P.O. Box 19649; Jacksonville, FL. [protected]. Individuals by the name (or aliases) of "Chauncey" and a "Ms. Smalls" would answer and inquire as to what time "today" the full payment would be made. If informed that a payment could not be made "today" but could be made on a near future date - threats of mobile home repossession "today" would immediately be made by both Chauncey and Smalls. Smalls would make threats of suing and immediate obtainment of court orders stating that "she " would file in court clearly crossing the line mis-representing her self as an attorney. At one point - she lost it and threatened to contact local law enforcement if I returned to my home and stated that "she" would file in court to block me from returning to my land and home. This after she was informed that Green Tree owns the home but not the land that the mobile home sit's on - I own the land! When I would LOL - these calls would end abruptly with no workable solution (payment "today" is the only acceptable answer). Later - Chauncey would proceed to ring my home, cell & work numbers repeatedly. I had no option but to issue a "cease and desist" order in accordance with Title 15, Chapter 41, Subchapter V, Sec. 1692c, Paragraph (c) "Ceasing Communications". This along with a clear threat of Attorney Action - works. No more calls from Green Tree Servicing, LLC. At some point - Green Tree Serving's mis-handling of these issues literally becomes far worse than going through the actual mobile home repossession process. It is my hope that by sharing this story with others that potential customers (victims) will think twice prior to conducting any future business with Green Tree Servicing, LLC.

For nearly 1 1/2 months now, I have been trying to get Green Tree to make my homeowners insurance payment from my escrow account, and they absolutely refuse to release any of my money being held in escrow to pay the bill.

They're contractually obligated to make those payments, but they refuse to do it.

I'm am approx. 12 years ahead of schedule on my Payments, and have never been late making a payment. I send extra principal Payments each and every single time I make a payment to my mortgage.

I have called them 3 - 4 times a week for the past 6 weeks and they just won't make the escrow payment.

They just laugh in your face, and insult you over the phone. They just refuse to pay the bill.

I don't know what to do anymore. They're either committing Insurance fraud on a massive scale, or they are trying to have leans placed against the property.

They're criminals.

How do you protect yourself from a bank that wants to steal your home from you?

What can I do to Protect myself and my family from these Predators?

Does anybody have any ideas as far as what I can do to keep them from stealing my home?

Please, any help at all.

I currently have a trailer house on my land that was left by the owner of the mobile home that is financed threw Green Tree over a year ago... Well the owner has not made any payments on the house for the last 3-5 months and now they are calling me wanting his number. I would not give it to them and told them that there is a 16, 000.00 lien against the house for unpaid lot rent and 6 thousand of which is a mechanics lien do to the fact I had put money into the mobile home and even more to keep it from falling apart all over my property. She kept asking me if I was are anybody else currently living in the mobile home and I told her I stay there from time to time as well as friends and family when they come to visit me, and that I have a lot of my own property in the home. I know I cannot hold it for the storage of the home but I do believe I can hold it for the mechanics lien, if not I will remove all my hard work leaving it a shell. I had to replace windows because they had been broken out, the central A/C because the old one was completely shot, flooring, light fixtures, etc... I even had to install a ADT security system in the home to keep people from tearing it up. Also there is no way it can be removed without damaging my property mainly my entry way that I have around 7k investing in it, not to mention all my trees around the home. They do not have a contract with me that they can destroy any private property because the owner moved it on my land without their knowledge which he could have been thrown in jail for from my understanding, but they will have to pay for any damage in removing the property for sure. After I built the entry way I made it shorter and about 12' narrower, they just managed to get it in there before, so there is no way out the gate. The neighbors are not going to let them cut the fences and take it across their property so it is pretty much stuck there, I could not get it out if I wanted to without tearing up a lot of my property, which is another reason I put money into it, I did not want a big piece of junk on my land and figured they would just leave it and write it off it is was nothing but junk. But I do not know what else to do...

Amazing beond belief green tree can not change original contract the bought from other lenders when u take out a lien on mobile home or mortage u can get copies at your local court house if they are not living up to the deal u can file a civil complaint at your courthouse and they will have to appear if they do not appear or otherwise ignor your complaint you can then file civil suit and have your state attorney or district attorney file a criminal complaint beleive they will settel with you

We too have been harassed by green tree. Their "Customer Service" are rude, granted they have a select few who are polite. Our latest interaction Green Tree, I had scheduled an auto-pay for the 15th. I knew my husband would be getting paid. They took it upon themselves to take the payment out on the 12th. Clearly they made an error... And wouldn't that be considered theft? I called them. I was extremely upset, because it had put my bank account in the negative and also caused me what I thought was an overdraft fee. Thankfully my bank kicked it back as I had other bills scheduled to come out. I spoke to two people that evening. Each telling me I had to get documents together, fax them and then wait for 2-3 business days. I was furious. After a couple of days I was able to get all the things they needed. I had to have my bank print up things and write a note stating I wanted it refunded. I was freaking out because I was afraid they'd take it out again... On the date they were actually supposed to. The customer service manager assured me, that would not happen. There was nothing scheduled, but what she didn't tell me was oh yes we will try to pull out another payment in a few days...even though it shows nothing is set up now for the 15th. I was furious when I looked at my bank statement and saw sure enough they tried to pull he payment on the 16th. Let me be clear, I just wanted to fix the landslide they had created in my bank account, and that required them refunding the money. I received a voicemail from customer service manager stating the paperwork I sent was not good enough and she was having trouble reading the required note. I am not stupid, I recognize a game when I see it. I was so frustrated on the verge of tears. I called spoke to one girl who hung up on me when I. Explained the situation, then called back spoke to another woman who passed me off to a supervisor who didn't care what I had to say. The most ironic thing of this is how each of them told me they had protocol to follow apparently taking the payment out on huge day they were supposed not before wasn't part of their protocol. I am so frustrated with these people. It's not the first issue we've had, prior to this fiasco we had a customer service rep who was harassing and when I told her we didn't have the money then and there, I actually had other bills and 4 children to feed... She actually says oh I see so paying your bills having a roof over your head isn't a priority. We can foreclose on your property you know.

had gmac mtg amd they asked me what date i would like to pay my mtg--i picked the elevence of the month--was ok'd and no late notices and no late fees--mtg was bought by greentree and now i get double payments, but no late fees--i called and questioned why, and i was told the mtg is due on the first, but you have to the 15th--but if it doesn't come on the first we ( greentre ) double bills---i am in the prossess of contacting the attorney general, dept. of real estate and the dept. of finance to find out if what greentree is correct even though they bought my mtg fron gmac --which is a binding contract--i also found out that grenttee's invoice date is the 8th of the month--does all mtg's that are recieved befor the 8th are also double billed--espsecialy the ones that are recieved after the 8th--i;m sure that when i ask this info from them--they will say that that info is not available---likely story--if i find out that what they are doing is illeagle i will sue--and everybody that gets threatening calls from greentre, just has to say--i have heard what you have told me--do not call again or i will sue for harrassment--it works every time--also record the conversation and get the name of the oerson your talking with and the supervisors name--they have t give it to you

To whom it may concern,

This is a long story, so please bear with me. This is a complaint about two different mortgage servicers, and I am filing a separate complaint against each. As with both I am facing essentially the same situation, they may appear repetitive. Both, however, are doing the same things.

In 2005, I took out a now illegal 80/20 home mortgage and was not told about a number of issues, among them the securitization of the mortages and the destruction of my chain of title, the fact it was designed to fail, and a number of other lender frauds found by an attorney during a mortgage audit. I did not give my consent nor approval to any of this, nor was it disclosed to me just want an ARM really does.

Furthermore, I specifically asked months prior if my monthly mortgage expense could stay at around 700.00 as I knew I could afford that, and I was told that was doable. Yet, at closing I was presented with two mortgages and threatened I had to sign or I could face legal issues and told I could always refinance, totaling 957.00 per month, and that did not even include taxes and insurance.

The realtor has since been barred from selling real estate, the mortgage company is closed and the broker as far as I can tell is out of the business.

The mortgages were originated by Countrywide Home Loans, which should say a lot in itself.

As I discovered more issues, I asked for the mortgages to be restructured so they would be fair and I could live in peace knowing my payments would not adjust to some outrageous amount I would not be able to pay. The mortgage companies (the 20% was sold to Litton Loan Servicing and the 80% was taken over by Bank of America when Countrywide folded) refused.

Being as how these entities bought the business, is it not their responsibility to fix it? If you or I bought a business and an issue came up, it would certainly be our responsibility to fix it. That the business is in this case an asset does not change the burden of correcting a situation one bit.

In 2009 I was forced to file for Chapter 7 bankruptcy, and tried the entire time of the bankruptcy proceedings to get the mortgage companies to restructure the loans so I could reaffirm them, but they refused. According to my attorney, the mortgages as they stood would never be reaffirmed because the judge would not allow it so long as the mortgages were unfair to me or placed an undue financial burden upon me. Further, my attorney advised me that without the reaffirmation, the mortgage companies could foreclose even if I was paying the mortgages timely, which I was. So, despite my best efforts, the mortgages were not reaffirmed.

After the bankruptcy discharge, I continued to fight for new mortgages, as I knew the situation I was in was wrong and I wanted it made right.

On April 19, 2012, the house caught fire and was a total loss. Before the fire, the 20% mortgage was sold to Ocwen Loan Servicing and the 80% to Green Tree Servicing on 09/19/12, yes, after the fire that mortgage was sold to Green Tree.

After the fire, I received my payoff quotes from the mortgage companies. Imagine my outrage when Green Tree demanded over 100k for what was originally an 88k note and Ocwen demanded 27k for what originally was a 22k note. And this in spite of the payments I made during the course of the loan, despite the lender fraud uncovered, despite the securitization of the loans ruining the chain of title to what was left of the property (now an empty lot), and despite the fact neither lender has been able to provide a signed in ink original note signed by me. And, let's not forget the bankruptcy, where the attorney himself said the loans were unfair, burdensome and even deceptive and fraudulent in letter and practice on the parts of the lender and the people working for the lender. Furthermore, the case Bellistri v. Ocwen (Eastern District of Missouri) held that once a mortgage and the corresponding note are separated, they cannot be put back together, essentially nullifying the mortgage (how do I know who really owns it?).

As it now stands, it has been about a year and a half since the fire. Both lenders have refused to arrive at a fair settlement of either mortgage. In fact, Green Tree, according to their own paperwork, is adding fees to the balance despite the fact I am no longer even responsible for paying this debt! The fire is as fresh as yesterday because of this. The stress has blasted my blood pressure through the roof and caused other deterioration of my health. I have already instructed anyone acting as executor of my estate to sue for wrongful death if I die because of this situation and the effect it has had on my health, as in a case in Florida, Green Tree is already facing a wrongful death lawsuit.

Just as an aside, might I suggest you have a look around the consumer websites regarding both Green Tree and Ocwen. Their reputations are horrible, and they have a nasty habit of abusing borrowers in many of the same ways they are abusing me.

Greentree has a poor website. It would be good if their website provided more information about a person's mortgage. I believe they have it this way because they do not want the customer to be wholly informed about their mortgage account. This way, they can say what they want. You have to keep good records yourself.

We have had many many problems with Green Tree. We tried to short sell our home for 2 years, did everything they asked us to do, jumped through every hoop, and still they refused to approve the sale. They were the 2nd mortgage and Chase holds the first. Chase approved the sale, yet Green Tree refused and the home went to auction! They are the most nasty, vile, disrespectful people I have ever come in contact with. Has anyone had Green Tree come after them for deficiency balances?

I have my own horrible experiences with GreenTree . They have sent me text messages, yes text me that " I needed to vacate the premisses ASAP. . then fhe calling evey ten minutes from different numbers... ive had my home since 2001 and they have harrassed me, called my mother and my uncle for a payment . They have left me ugly notes to be out of my Mhome or they would come to take it, and the note was written on the back of an enelope with nothing about GreenTree and wasn't at all in a proffesional manner. I called the number from the note and it was the people that reposse SUPOSEDLY ...Lol. The lady talked so ugly to me and was yelling at me that my dad got on the other line and heard her she began to cuss him out and tell him she would call the law . Everytime i pay more money the payoff never changes ! It's really gotten me down...it just gets worse ...HELP ! it is great that i'm not the only person

I suggest getting an Attorney to help this company go belly up! I had a mortgage with Conseco in the begining and Greentree took over. Now I asked them for the orginal paper work. They too 2 months to send me a fake copy of my documents. My documents were not signed as Greentree. They changed info to help themselves. I don't believe it will stand up in court. I'll let you know how I make out. Once I go and stand up for my rights. I too, bought a foreclosed double wide and owe the same amt as when I purchased it. With the new Gov't modifications going on try to correct it now. My intrest rate is almost 12%, the home is not worth what I owe. I will keep intouch and do updates. I would like to help everyone that I can.

Ditech Financial / Green Tree Servicing Rip off

We bought our doublewide in July 1997, making this year 11 years we have had our home. It was financed through Green Tree at that time, payments were $448.80. In 1998, we refinanced at $68, 400, making the payment $679.97 through Southern Atlantic then sold to Conseco, then a few years later sold back to Green Tree. Now our payments are $705.60.

We have had our problems, same as everyone else. My husband became Diabetic and in the hospital for a while on and off since 2002. Just recently we have became 2 months behind on our home. Green Tree had called every day and I do not and ill not answer their calls, because I have been called a liar, they have literally called my husband a dog and I refuse to talk to them anymore. They have called our neighbors, people down the street that do not even know us, and our family members. They have even scared my 15 year old niece *at the time* one day when she was babysitting for me, they called and told her they were coming to this house to get it while she was in it. That was ridiculous. Who sounds childish?

My husband talked to them on the 30th of June and told them he would have the money on July 3rd, well, wasn't good enough. She took the bank info and told my husband she was taking it out on that day, June 30th and then july 24th. Needless to say it bounced on July 1st. The same day my husband talked to the company, they sent us a default letter dated the same day June 30th.

We received yet another letter from Green Tree of a 'Notice of receipt of partial payment' that was dated July 1st, *they didn't actually get that payment, it bounced* saying 'Thank you for your payment of $705.20, .40 cents less then they said they were taking out, which was received in our office on 06/30/2008. Please be advised that we have started to take the necessary steps required by law to gain possession of the creditor's collateral.( Does this mean they are already starting repossession?) We have already sent you a 'Notice of Default and right to Cure Default Notice' advising the amount of default. that notice is still in effect, and we will proceed as outlined in the Notice unless we receive $894.63 before the due date set forth in the Notice. This is simply to notify you of the terms acceptable to green tree to forbear from pursuing its rights to the collateral. YOU ARE UNDER NO PERSONAL OBLIGATION TO MAKE PAYMENT AND ANY AMOUNT YOU DO PAY GREEN TREE ARE AT YOUR DISCRETION.' But yet we have been paying on *their* home from Nov. 2005 to 2 months ago without any knowledge of the home being in the Bankruptcy. Not including the insurance we were paying to them for them, that we thought *WE* had.

Well, I just recently got my husbands credit report and it showed Green Tree 'Included in Bankruptcy', Secure Loan, closed account, with the same account number. $0.00 Balance. It wasn't listed once, but twice. I was in shock.

We did file Bankruptcy in August 2005 and wanted to keep the home. I called the US bankruptcy Court and found out that our home was filed bankruptcy on and that we DID NOT sign an re-affirmation. As soon as I heard this, it felt like a huge burden had been lifted. I quickly raced to the bank and took out all the money we did have. Green Tree has not mentioned anything about the bankruptcy on the home. I guess just a way to keep money rolling in.

We have gotten so tired of all the harassment they have given us over the past 11 years. We have decided to walk away from the home that will never be ours now. They are not worth it. And I don't think they will be getting what they want out of this place. Doors falling off hinges, bathroom floor is coming apart, light switches needs replacing. I guess thats what you get when you get a crappy home from a crappy company. I will miss the fact that the kids were raised in this home and we were secluded from the neighborhood, but thats about all I will miss. I would not recommend anyone to Green Tree.

These people are complete idiots, they have been calling my home almost daily for weeks. I have repeatedly explained to them that the person they are looking for[my ex-wife] has not lived at this address for more than 11 years and tried to give them her current address and repeatedly asked that they quit calling my home and they apologize and say they removed my phone number from their list and another 'agent' calls the very next day! My final solution was to block their number, hopefully this will solve the problem. This has been a big pain in my a**, I feel for the folks who actually have accounts with this so-called company. It amazes me how our government allows this kind of mistreatment to go on. Good luck to those who have loans with these idiots!

I told them to stop a ach payment they said they would. I told them I did not have the money in the bank due to my husbands wallet being stolen. They still ran it without my permission caused nsf on my account.

I have been harassed numerous times because I owe them one months payment. I was forced to pay $12.00 for the speed pay to make my monthly payment because I was behind.
I was screamed and argued with by an account representative numerous times in. I was also told I was living a lifestyle I could not afford. They would call me three times a day even after would have had a conversation with them earlier in the day or the day before.
I told the representative that I can not deal with the yelling and that I owed more money to other debtors than I owe GT and was treated with respect from them, unlike the way GT treated me. They have no respect for their clients.

Green tree is a rip off a lady name Debbie told my husband to send papers to her house for loan
modification but the papers never got to the modification. we lost our home. She played my
husband right to the through the rock bottom. I am his wife; but I could not talk because my name
was not on the loan. But it was on the deed. So I told my husband that the lady was playing a game.
At the end they wanted me to talk; I did not play games like that. Country Wide played Us., Bank America also. They kept 9000.00 of my husband Insurance Money from the Hurricane. Then they
turn it over to Green Tree. They All Rip us off. We are homeless. Debbie, Country Wide, And Bank Of America God is very Much Alive the way you all did us. They (Green Tree Lawyers wanted to sue me
if I did not get out of the house. They did Us BAD.

Green Tree has discouraged me and frustrated me more than words can fully express. They took out an unauthorized payment on November 22 from our personal checking and caused us to have several over-drafts, along with those fees. I immediately contacted them upon this realization, on November 23. They admitted they took out an unauthorized payment and stated that they could consider a refund if we could fax them a statement from our bank showing proof, along w/ NSF fees. I immediately did this that day. This has put my family in a worse bind than what we were already in. We have even applied for the loan modification or deferment and have show proof to them. They've turned us down. (?) I have contacted them again today and I'm now being given a run-around. I've filed a complaint with the FTC and the BBB. I don't know what else to do.

You can easily copy and paste what you have written here on the BBB website to create a case and log a complaint with them. I've had great success in getting matters resolved that way recently. Thank goodness for the recent consumer protections law passed by the Democrats recently, this stuff is illegal and they will be forced to resolve it.

Green Tee is a nightmare. They took over my lan from a previous company that had me on a forbearnce plan, told me they were going to work with mem to see if I can qualify for the new modification. While thisprocess was going on th only asked for 2 payments I called every month and asked them if fthey needed a payment they refused saying that he modification was in process. 5 onts laterwhen they came up with one, it was to slam all they oney I owed to te ack of the loan...okay...But then it raised my mortage payment about 3 hundred dollars a month. y house after the mortgage crisis dropped 30, 000 n value, and now they want to to pay more for a ouse I can not even gain equity on. When we told tem ewanted to gt a lawyer to review the modificaton (Which they ever sent, this is all over the phone) Theywere upset and said fine, when we finally decided we would just agree to do the modification in hopes of refinancing with another company. The told me that my loan was transferred out of loss mitigation and they are no longer offering me the modiication because Iold them "No." I never told them no, it was a battle, I had lawyers and HUD counseling call them and they simplysaid "No." I owed them $18, 000, which had to be paid or else face forclosure, my husband had to go work on the west coast for a mont, we paid them 2 payments of $6850, and then asked them if hey could work with us and wait one more weekor me to get paid to get the est of the money they said "No" the lady was useand told me I could no aord y house so move out. I told them I paid triple my mortgage the past 2 months, and because I asked for a week yu ar telling me I cant afford my hous, I simply asked her could she afford what I just paid in two months, she laughed and transferred meto someone else. This resulted in my husband having to borrow moey from two people to pay this mortgage, by the I was in tears. I am going to report them to the better business bureau and I am glad I am not alone.

I have never in my life ever been spoken to as rudely as I have by the Green Tree staff. This is the most horrific mortgage lender my husband and I have ever had to deal with. Today, after repeated calls every single day and on weekends, they demanded a payment of $56K TODAY! The man I spoke to on the phone refused to give me his last name or ID number. His name is Brett. Our home has been in short sale since last year and NOW they claim they have no record of that. We lost a full sale due to their ignorance. I'd rather file bankruptcy than to give this simpleton company a dime!

My husband & I have had the same problems with Green Tree taking money out of our checking account even after we have called and told them not to, which resulted in $75 of fees last month due to insufficient funds being in our account. My husband also works in the construciton industry which has slowed and put us behind in our payments. Even if we are 5 days late, they call our house sometimes 4 or 5 times a day. They are so rude and threaten to take us to court which will result in us paying legal fees. Also. they have told us that if they resale the home and don't get what we owe, we'll be responsible for that too. There's no way they'll ever get what we owe, that's a joke, lol! I'm so tired of being harrassed that I'm tempted to just tell them to come and get the home. I would never advise anyone to do business with them. It has been a total nightmare for us.
