Ditech Financial / Green Tree Servicing 2nd mortgage nightmare

I used to have a second mortgage with Ditech which was never a problem but it has become a nightmare since it was taken over by Green Tree, about a year ago. I never received correct information of the transfer until after a month it occured for which I complaint. According to their records I have been a month behind on my payments ever since. I no longer have a home phone number so now they have started to harass me at work.

I received a message from them yesterday 5/4/11 urgently requesting my belated payment that was due on 5/1/11.When I call to complain and tried to fix the problem they stated that my loan was on collection and proceeded to chew me up and demand payment. Not to mention they already tried to add make me buty their home insurance and jack up my monthly even though I already have insurance. I cant stand doing busines with them and I know they are just hurting me.

Ditech Financial / Green Tree Servicing They will not refinance our home and we can't get anyone else now to finance us

This individual has called our home constantly. One day he called 3 time within 5 mins. time. He has been harassing us about our house payment, even though they have been mailed to him. I have ever sent them like 6 mos of post dated checks and we will get a call anyway regarding our "late" payments. We have had our house for 11 yrs and it appears that we are not making any head way with our balance. We have questioned them about it and they always have an excuse. They did send us an entire payment history, but you can make heads or tails of it. This has been an on going problem of harassment, but in the last year they move out account to another regional office and that is when it go worse.

Just yesterday, I told this man that I had mailed another set of checks to him and he became furious with me and said that is would not do. He wanted a check over the phone. When I told him that I would not do that since checks were already mailed, he claimed I was refusing to make payment. I explained that I was not saying that and he said that since he didn't have control of the conversation, he was ending the call. He then hung up and me, and now has forwarded out account to their legal dept. This bunch is nothing but a bunch of crooks and no one should trust what they tell you. To top this story off, Mr. Marshall has also been calling my sister's house and cell phone, while she is at work and very early hours of the morning wanting to talk to me. He has been told not to call her and yet he continues. I would very much like to be done with this bunch and the company.

The draw back is, they will not refinance our home and we can't get anyone else now to finance us.

Ditech Financial / Green Tree Servicing 6 calls a day

We have been in our home since 1998, we orriginally were with Bank Of America and they sold our account to Green Tree. My husband is disabled and I am unemloyed at this time. We have fallen behind on our payments and are now facing foreclosure. I have had several people calling me atleast 6 times a day if not more and these people are so heartless. I was asked would I rather pay the overdraft fee from my checking account or be on the street. I was told that they would keep calling until I gave them a check number. They said that they are coming out to my house to secure the property and put my stuff on the lawn. The lady and I put that lightly that i just talked to on [protected] had me so upset that I was crying and she said dont cry thats not going tp pay your bill. They have me and my husband so scared that we are going to become homeless over this. They told us that would defer our payments until June 16th and then they called and said oh we made a mistake Go figure. It is sad that when people are down on their luck that a company will just keep kicking them.

Why do you believe that if you can't pay for something that you should still have it? Why do you believe that you are entitled to live in a house you can't pay for?, if you see something in the store and can't afford it, do you still take it because your husband is disabled and you are unemployed? Do you think the banks should let you live there for free because your husband is disabled and you are unemployed? Did you teach your kids that if you can't afford something that you are entitled to it anyway?

Ditech Financial / Green Tree Servicing Don't use this loan company

Over the 20 years we have been dealing with this company- we have had nothing but rude and very unhelpful people when trying to resolve issues with this company. We had a loan with them for our mobile home and it was complete in August of 2009- however- we were sent a notice that our loan was in default because we still owed over 5, 000. When I contacted them- at first they couldn't tell me WHY we still owed that much money-even though I had the contract in front of me and NOWHERE on any of the statements did it ever say anything on anyone of them about fees or anything else...they claimed it was interest on late payment fees or something. We tried and tried to resolve it- even coming up with a

proposal for a settlement- which they denied. I called today for a payoff amount and the VERY rude person- took ALL my information-including my husband’s social security number and then would NOT give me the pay off amount- saying he would only speak to my husband. What kind of company is this? They are very underhanded in the way they conduct business and I will never ever recommend them or sue them again. I have made countless calls to this company, talked to many different people and it always the same thing- very rude, nonhelpful, disrespectful people. What kind of comapny is this that would hire such rude people. DO NOT USE THIS LOAN COMPANY- you will be as sorry as we are.

I am trying to refinance and need payoff information from Greentree. They have not produced the information and it has been about 3 weeks. The lending company I am refinancing with has contacted them. The closing agent has and I have called several times and faxed my request. This company is very unprofessional and regulators should shut them down. I hope I can sue as I am planning to go to a lawyer if this ends up costing me money.

Ditech Financial / Green Tree Servicing They did not honor Draw Period Agreement

Green Tree did not send me the cancellation notice to cancel my draw period as described in the original contract. As a result of that my draw period should automatically renew and my payments should not change. Not only they did not mail me the cancellation, but they made one up, and said they gave it to my Lawyer, which my lawyer said they never did. Now I have to pay double the amount of my payment, and i know at this point I need legal help to make this right.
Like the others my loan was also transferred from BOA.

Ditech Financial / Green Tree Servicing Green Tree Financial - Incompetant

Green Tree Financial is a complete joke and a very unprofessional organization. After reading the comments on this complaint board, I had to put my experiences in writing. In August 2011, I had a hysterectomy, a major surgery. Through my employer, I was to receive Short Term Disability. To make a long story short, Paperwork internally at my employer got screwed up, which after being given the go ahead for the surgery in July by my employer I scheduled the surgery. The day when I got home from the hospital, I got the news that there was a screw up and they were not allowing my short term disability. After numerous phone calls and the providing of my own documentation, the determination was turned around and short term disability was allowed. Now I was just waiting for the check. Well, I did the responsible thing, I contacted all of my creditors to make them aware of the situation I was in and most were very accommodating, except Green Tree Financial. Like many of the other people on this complant board, I received endless phone calls, 4, 5, 6 times per day to my home phone as well as to m cell phone up till about 9:30 p.m.. They were relentless. I ended up being 2 months behind in my payments but did not receive my short term disability check until today, October 31, 2011. I went from August till almost November without any income. Not only was I stressing from trying to heal from major surgery, but also having to deal with work to get everything straightened around (I have learned... make copies of everything - even everything you receive from your employer as it might just save you, which in my case it did). I made several calls to Green Tree to keep them informed of my situation, sometimes I would get a nice person (which is like trying to find a needle in a haystack), that seemed to be compassionate and did not stoop so low as to tell me I was unworthy, etc. Most of the time, however, I got what I call the latest "Flunky" who would resort to nastiness. I would end up taking control of the conversation and not really alow them to speak because I was tired of their BS. Last week I received the good news that my check was being cut and they were mailing it out on October 27th and it would be mailed regular mail from Memphis, Tennessee. Just last week alone, I received 21 voicemail messages from Green Tree Financial's Flunkies and that was just on my home phone and the messages have been saved. On Thursday, October 27th, I contacted Green Tree and told them I should be receiving my check to keep them again apprised of the situation as I have done so many times in the past few month's. I was told they needed to have their check by October 31st (today). I told the gentleman that I was NOT going to pay over the phone because of the additional fee and I would mail them the check as soon as I received it. I was hoping to receive it on Friday or Saturday, neither of which happened so I could not mail them the check. Today I got a nastygram phone call from Andy, who is a Manager in Minnesota. I immediately called him back after receipt of his message and right off the get go, he was being nasty to me, telling me that they had not received my payment that "I said I was going to mail and get to them by today - October 31, 2011". I indicated to him that I told the gentleman that provided I received my check on Friday or Saturday, even if I had to FedEx it overnight to them I would do it. So I indicated to "Andy" I did not receive the check and I cant send them a check when I don't have the money to give them (I just started back to work a week ago). He said "He has my file on his desk, ready to proceed" I could only assume that he was speaking about foreclosure, which in my case, I live in a manufactured home. I told him that i had already checked my mail at Noon today and the check was not there, but told him that he was harrassing me with all the phone calls I received, i would be contacting an attorney. Further I indicated that if my living here for 16 years and being behind for 2 months, due to something out of my range of control, if he needed to foreclose to go for it, to do what he needed to do because I was tired of dealing with the company he represents (in not so nice words but that was the jist of it). I told him that if I received my check today i would call him back and let him know and I would make a payment over the phone although against my better judgement and I ended up hanging up the phone on him as I was not going to allow him to intimidate me. HE WAS A JERK!. Needless to say, I did get my check today and I called back and spoke with a lady by the name of Nancy and of course, she was nice. I told her how much to take out which was my two payments and the $ 12.00 additional fee to take the money out of my account. I said a total of $ 650.00. Although she was nice, she still was dumber than a box of rocks. She said okay the charges to your account will be $ 662.00. I said, "No, I am authorizing, this one time withdrawal on my account for a total of $ 650.00 which includes the $ 12.00 fee. (the call was being recorded- so I wanted to make sure I said one time only withdrawal on my account and previously I had forewarned my credit union to make them aware one time only). Then I told her to go throw the information on Andy the ### desk because I am a woman of my word. She apologized for his behavior. I explained to her I have 4 years left on my loan (which my loan as well was sold to Greentree Financial) and I can't wait to stop dealing with this company and I would tell everyone I know NOT TO DEAL WITH THEM. I also told her my hands we're shaking from nerves from having to deal with these unprofessional poor excuses of human beings (in not so many words and not verbatum). I told her I believe that I have an ulcer now from their daily calls several times a day and that my attorney would be contacting them. I asked what the address was in which my attorney would send the letter regarding their harrassment and it is as follows: Green Tree Servicing, 1160 Center Point Drive, Suite 7, Mendota Heights, Minnesota 55120, to the attention of Mike Theissen who is the Operations Manager. I will contact my attorney with this information tomorrow in hopes that due to my specific case, which was beyond my control, I can sue for mental anguish or something in that line. The best part of this was that all along, I offerred to send them documents that supported what I was telling them to be the truth but they didn't want it. I am gong to try to contact Minnesota's BBB and everyone I can contact in regards to the treatment I received. Any other suggestions are welcomed if you have any.

GreenTree Financial BAD EXPERIENCE, Erie, Michigan
I have lived in my manufactured home for 16 plus years and maybe once or twice been late (within 10 days) on my mortgage loan. I have always been responsible and contacted them to let them know, because that is the way I was taught. In August I had a hysterectomy that took me away from work for several weeks. I was supposed to receive my short term disability check the following week after my surgery, but due to an internal error on my employers part, as of today, October 31, 2011, I still have not received the check, although it has been approved and is being processed. Throughout this whole time I have kept in contact with Greentree, as well as trying to heal. They have called me non-stop, several times daily leaving messages, which from a business perspective I can understand they are doing their job. I have explained that I have NOT had an income in over 10 - 12 weeks, I mean what else am I left to do? Can anone go that long without any income? I explained to the last "FLUNKY" i spoke to from their organization that apparently the check was cut on October 27, 2011 and I should be expecting it and if I would have received it on Friday, October 28th I would mail them their check for the two months that I am behind. I did not receive the check Friday or Saturday and here it is Monday, October 31st and still no check. They leave threatening voicemails telling me they are going to "Process my File". I called them back and spoke to a Manager by the name of Andy. He of course says "we havent received your check that You said you were going to mail last week" I said, I havent received my short term disability check yet and told him I had gone down to my mailbox and checked and still no mail. I further indicated that I had told the previous "flunky" I would mail the check "If I had received the check". I am so friggen tired of dealing with this loan provider and am going to change my phone numbers because they contact me at home and on my cell phone non-stop daily to the point where i have unplugged my answering machine. I also instructed the Manager, "Andy" to do what he needed to do, if he needed to foreclose, then do so and that is how the conversation ended as I hung up the phone after telling him they are harrassing me. The old saying goes have a good experience, you tell 10 people, but have a BAD experience, tell everyone you know and I will do exactly that. DO NOT USE GREENTREE FINANCIAL! I am also going to contact an attorney, because these people have harrassed me so much that I am stressed out and I am physically shaking from their harrassing calls. I could see this behavior, if I was a person who didn't make the initial contact, or didn't contact them at all when they called, or was constantly late on my payments, but I am not. I haven't made two payments because of having major surgery and unfortunately a problem arose internally at work, something that I was not involved in and it took awhile to get it straightened out, after explaining until I am blue in the face, they still act like jerks. The worst part about it, is that since the week of August 15th, I have contacted them on my own at least 5 times to keep them apprised of the situation and also said I would provide them with documentation. So with their treatment of me, I pity the person who doesn't contact them at all, the WRATH of GREENTREE awaits you, they will bombard or light up your phone, until almost 9:30 p.m. several times per day, every day.

Ditech Financial / Green Tree Servicing Terrible Response Times

Green Tree customer service is run on the basis of: "if we provide unrealistic response times then no one will bother us". Of course I gest in this statement, but read the following email response, from Green Tree, after I sent an email inquiry:

"Thank you for contacting Green Tree Customer Service. This message is to
confirm the receipt of your email request. You will receive a response from
our Customer Service department within three to five business days. Please
do not reply to this message as this is an outgoing mailbox only.

Sincerely,

Green Tree Customer Service Department"

This is sad...probably a good way to keep labor costs down and margins up...sad to see! I wish they could set there sights to emulate companies like USAA or Schwab...but then only results oriented companies would do that and this is where I think Green Tree differs. Just my two cents; I feel sorry for the front line staff that has to respond to customer complaints due to poor management directive / decisions.

Ditech Financial / Green Tree Servicing Stay away

Please, if you are being harassed by this company or any other, go to:

http://www.ftc.gov/os/statutes/fdcpajump.shtm

There is plenty of information there to assist you in your rights. For starters, The Fair Debt Collection Practices Act, clause 805 in particular tells the consumer to send a “certified letter” to the company telling them to cease and desist all communications about the debt with the consumer. If they do not comply, you have a legal complaint. Another clause in this Act specifies threats of foreclosure, calling of third parties, additional fees, etc…

Please know your rights, this company treats us like this because they know that no one will actually use the laws that are available to protect from this treatment. I'd like to add that it is very important to keep all documentation from Green Tree, document the time and person in every conversation (you can even record the calls), and be sure to visit as many sites as possible to leave complaints. We, and the government, may not be able to shut them down, but we can and it is our duty to, stop them from receiving any more business outside of what they have. We consumers need to inform other prospective customers of the tribulations that go with this company. This company is a classic "predatory lender" - they chose to lend to "high risk" borrowers just so they can collect more interest.

My story went like this:

I am an employee of the federal government and I make very good money, my mortgage was sold to Green Tree by National City Mortgage. I am not experiencing any hardship, yet they insist on treating me as if I am a habitual offender and a child.

Green Tree Servicing calls repeatedly (at least once a day) concerning my mortgage payment, a debt that is not delinquent. When they call they are very insulting and at times resort to yelling at me and treating me like I have done something wrong. I have a legal mortgage "note" from the original mortgage lender (National City Mortgage) which states that my mortgage is due on the 1st of the month and that I will not be assessed a late fee until the 16th of the month. If this company doesn't have payment on the 1st of the month, they will not stop calling and harassing until it is received. I have explained to them that my payment comes from my bank and that my pay periods do not always fall into the schedule to have it delivered on or before the 1st. I have showed them that I have never been late (after the 16th) and never missed a payment. Instead of leaving it at that, they resort to insults and name calling insisting that I make my payments immediately and start doing it by the 1st if I want them to stop calling. This treatment is becoming very stressful and I have experienced much anxiety over these calls. I've never missed a payment or been late (after the 15th).

Ditech Financial / Green Tree Servicing Thieves, Con Artists and [censored]bags

Green Tree Servicing and its many subsidiaries are a ### sucking, low life, bottom feeding company. Their executives are based in MN who sold their soul to devil many years ago. Their employees are ex-cons and people who have been trained in psychological warfare. In a word - do not do any business with them if possible. If your loan has been sold to them, find an attorney and rid yourselves of this CANCER of a company.

Best of luck,

Ditech Financial / Green Tree Servicing late payment

I have 2 accounts with Green Tree not because I chose them to be through them, but because they bought out the companies that had the existing notes. I have been paying on these notes for approx 12 years now and have had approx 4 instances where i got behind 1 to 2 months. well they call continually, but today was the tipping point. I answered one of the calls, and got a rude agent. I know that the note was behind2 months and i tried to tell him the situation, and after a 2nd call to the agent, he went postal on me. he didn't even give me the appropriate information that i needed to pay quickly, he just went off on how i haven't answered the messages he sent, then threatened foreclosure, and then, started quoting contract obligations to me. he was so beligerent, i sat and listened for a moment and said nothing because i did not want to regret what i said . i finally hung up on him and called back and lodged a formal complaint in which i am not thru with. i then was able to receive information to speedily pay the bill. i guess someone is teaching these idiots how to abuse people into paying their bill.

Ditech Financial / Green Tree Servicing Harassment

I have a 2nd Mortgage, serviced by Bank of America Home Loans (they obtained it when BoA bought Countrywide). Bank of America has moved the loan to another subsidiary, called Green Tree Servicing as of March 1, 2011. (How many subsidiaries does a bank need to manipulate money?)

A letter from Bank of America, Feb 7, 2011; informing me of this did not include a new loan number and said Green Tree will be contacting me with new information.

The payment was due on March 1... I had yet to receive a statement from Green Tree. I called an 800 number around March 10; the representative said the loan was still in transition between the 2 banks; and not to make a payment until I received a statement and letter from Green Tree. I was also told not to worry about any late charges for the first 60 days as they understand the confusion that can be caused by transferring loans. And when I receive a statement, it would have both March and April totals due.

I finally received a letter from Green Tree dated March 13 2011; with some information about the transfer and a statement will arrive within the next 25 days.

I finally got not 1, but 2 statements. One for March with the amount due and the second statement with combination of March and April, just like the person told me. I though great, I'll make the one payment in April.

I have now been getting harassing phone calls from Green Tree on the March payment being late.. When I talked to the representative from Green Tree and told her what took place and I had talked to another representative, she was rude and obnoxious about me not making my payments (I’ve never have missed a payment). I told her to stop the harassment and she respond “so you like yelling at people?”.

I did not ask for my loan to be moved. Bank of America chose to do it. I do not appreciate the untimely communications from this entity; and harassing me because of their slowness to properly bill in a timely matter.
If you deal with Green Tree … RUN

Ditech Financial / Green Tree Servicing Incompetent

The second mortgage on our home has been sold three times to different banks. Never before have we had to fill out a new automatic deduction form. I received a letter saying GreenTree was now servicing our loan 15 days before the payment was due. 5 days after the payment was due we started receiving phone calls from debt collectors saying the payment was never received. When I spoke to a GreenTree rep they said they had mailed a packet that required us to re-fill out the auto payments. I had never received the packet, the rep then said it probably did not get to me yet. Think about it, they have debt collectors call me before they send me the packet to pay the loan. Kind of backwards if you ask me. Now they are charging $12 per month to automatically deduct the payments. They never let me know I would receive these fees. GreenTree sucks. Never use them. If I could do anything to get away from using them, I would. Unfortunately the financial system is foobar and I have no option.

Ditech Financial / Green Tree Servicing Sold my loan

I have excellent credit. After my husband passed away, it took me ten (10)
years to get the credit that I have today. I had BAC Home Loans, a division of Bank of America for my equity loan. Before BAC Home Loans, Bank
of America held the loan. They received it from LaSalle Bank. In late April, 2011 I received a letter from BAC Home
Loans and Bank of America telling me that my loan, yet again, is being transferred to one of its other Bank of
America divisions, GREENTREE SERVICING, LLC. As I pay my loan ahead in order to accelerate the payoff, I immediately felt a pang of doom. The last two times my loan was given over to another servicing agency I literally lost thousands of dollars because I pay ahead and the ###s did not, could not

see their errors when transferring my
loan. Although I took the time to WRITE a complaint to the Office of the Comptroller whose job it is to go after the banks on the consumer's behalf, the Office of the Comptroller did NOTHING but tell me to continue to work it out
with the bank! (This country and its banking systems have gone to pot!)At least with BAC Home Loans I was able to go into my local Bank of America to pay my loan in person. I have been told that although Greentree is a division of Bank of America, I no longer can do
this. I received another letter yesterday, April 22, 2011 from Greentree. They do NOT have my correct
balance! They tell you NOT to pay Bank
of America, but they don't give you a

statement or coupon book to pay your loan! They tell you that if your payment is due AFTER 4/30/11 (aren't
most home loans due the first of the month?) to just send in your check with their new account number. I went
online to see if I could pay online because I pay EXACTLY every two weeks, but it is not bi-weekly, I make a FULL
payment each week, again to pay off the
loan quicker. There online server is

BROKEN! Additionally, if I want to pay
online, Greentree charges a fee of $12! Are they for real? I pay ALL
my bills online and there is NOT A ONE
company that charges for online payments! Lastly, I went into my local Bank of America and spoke with the
manager there who knows me. She did not
know a thing about Greentree! I spent
45 minutes with her while she made several calls to Bank of America loan
servicing reps. One hung up on her! Another said he knew nothing. Then she
called Greentree and they would not talk
with her, told her to tell me to call!
And this is a manager from Bank of America calling--what will they do to me? I have to figure out how long it

will take for Greentree to receive, then
post my payment or my account is going
to go to hell in a handbasket. Reading
up online, I hear terrible things about
Greentree including the fact that loans
are given over to them by default or bad
risk borrowers. I AM IN NO WAY IN DEFAULT OR A BAD RISK BORROWER--I HAVE
AN 880 FICO SCORE AND AM AFRAID GREENTREE WILL RUIN IT. I told the Bank

of America manager that I am sick and tired of having my loans changed out every few months and that the customer
should have a say in all of this. She

nodded her head. What else can she say?
Why is Bank of America sending loans
from excellent borrowers to a bad risk
servicing agent? This will look very
bad on my credit report. Thanks for
nothing Bank of America. I am so disgusted. I pay my bills and get
literally screwed. Others don't care, don't pay, and nothing happens to them.
This is indeed, America.

Ditech Financial / Green Tree Servicing I need an explanation.....

I'm getting telephone calls from a company at different numbers questioning family members about me. Initially a "Tiffany" called from [protected] and asked my father alot of questions about me. She asked that I call back [protected] or [protected]. When I called back to [protected], I spoke to a "Charles" whom asked my name and telephone number-he then informed me that Greentree was a servicing company then rushed me off the phone. So I called [protected], and spoke to "Wayne" who was very unhelpful and unprofessional. "Wayne" transferred me to someone who just said they were with Greentree and they could not give me a name or location. I told this unknown person what was going on and they transferred me to "Tiffany"'s extension 65516 where a guy named "Loni" answered. I explained to "Loni" that I do not have an account number and what was going on. He demanded to know my social security number. When questioned why I would give him that-he said well someone was probably just trying to reach someone that you might know. I explained to him that that was not an acceptable excuse. Noone in my family has an account with Greentree. Then, he said he would leave "Tiffany" an e-mail to return my returned call. He ensured me she would receive the message "first thing in the morning". I have received no call from "Tiffany". I left a message at her extention around 9:30pm (4/21/2011). Her message on the voicemail identifies her as "Tiffany" but then she leaves instructions about giving a payment. I left a voicemail saying I needed an answer as to why I'm receiving calls. When I do a search on the internet on Greentree, there are alot of negative statements about Greentree and the commpany is not BBB accredited. "Tiffany" from Greentree called 4/30/11 at 1:40PM from number [protected] asking to speak to me, then my father and then my wife. I asked her what she wanted and what was the purpose of her asking all these personal questions. She gave no reason. Then she asked to speak to my brother and his wife. I told her that she was not allowed to call here and then she hung up the phone. I called her back and told her that she hung up on me and that she was not allowed to call my telephone number [protected]. I feel that this company owes me an acceptable explanation-my calls and e-mails questioning their motives continue to go unanswered. My number is on the Do Not Call list.

Ditech Financial / Green Tree Servicing Unethical business practices

We had a second with Bank of America that originated with Country Wide. In the first week of Feb 2011 we were advised that "Green Tree" would be servicing the account, but Bank of America would still own it? Since our payment was due on the 1st of March and late after the 15th we anticipated a communication from the new loan servicing company "Green Tree" prior to the 1st. We did not, in fact we did not receive any communication until the 14th which left us less than 24 hours to make the payment before our credit was affected by a late payment. To add insult to injury, we went to the "Green Tree" web site hoping to make a payment, and we were surprised we had to pay an additional 12.00 to do so. With no other alternative, and feeling exploited under the circumstances we paid using the service and sent a EM requesting the 12.00 fee be waived. We have not heard back, but did notice the amount debited from our checking account. (makes me wonder how many others were duped into paying this fee) Today is March 18th and we just received a statement from "Green Tree" dated Feb 28th and demanding payment by March 1st, kinda late don't you think? Based upon other complaints seen and our own first impression, there has to be some truth to these complaints and hope everyone will follow suit and file complaints with the FTC (Federal Trade Commission) the local State Attorney Generals Office, and your local Congressman. These corrupt ### have to be put in their place, and an end has to come from this kind of profiteering at the expense of the consumer.

I HAD a 2nd with Green Tree, they have been nothing but harassers and CROOKS.
On 5/7/14 I closed a refinance loan with Wells Fargo to be rid of this company. If you know how escrow closing works, you know the balance due is calculated to the last day and funds transferred (electronically, not by sending a check in the mail) to the lender. NORMALLY the lender applies the funds ASAP, NOT Green Tree. I checked today 5/9/14 to make sure the loan was closed and an auto payment would not come out on the 12th. (Unfortunately I was too late in a stop payment) Guess what... When I talked to a "customer service" rep, they said, they have not received the funds... ###. What they are trying to do, is take their time in applying the funds so they can charge me extra interest and not get the loan closed out; because there will be money due. I have bought and sold and refinanced many homes through the years and have never encounter such a bunch of crooks. My advice to anyone with a loan or whatever from them is to GET OUT, ASAP. I did not choose Green Tree, BOA screwed me by sending my loan to them. And if you think they are there to handle dead beats, doesn't matter; my score is in the high 800's.

December 26, 2012. I just had my neighbor come to my door. Apparently Green Tree is bound to involve anybody they can in squeezing money out of me. Not content with calling me 4 times a day, from eight in the morning til eight at night, they are now attempting to embarrass me in front of my neighbors.

Sample Lender Complaint Letter

Mortgage and Lender Complaints: Federal and State Regulatory Agencies

lender complaints letter respa

Should you have a grievance with your lender, you may use this sample lender complaint letter to help you present the lender with a "qualified written request" under Section 6 of the Real Estate Settlement Procedures Act (RESPA). This law requires that lenders acknowledge the complaint within 20 business days and resolve the complaint within 60 business days by correcting the account or giving a statement of the reasons for its position.

Attention Customer Service:

Subject: [Your loan number]
[Names on loan documents]
[Property and/or mailing address]

This is a "qualified written request" under Section 6 of the Real Estate Settlement Procedures Act (RESPA).

I am writing because:
■Describe the issue or the question you have and/or what action you believe the lender should take.
■Attach copies of any related written materials.
■Describe any conversations with customer service regarding the issue and to whom you spoke.
■Describe any previous steps you have taken or attempts to resolve the issue.
■List a day time telephone number in case a customer service representative wishes to contact you.

I understand that under Section 6 of RESPA you are required to acknowledge my request within 20 business days and must try to resolve the issue within 60 business days.

Sincerely,

[Your name]

This letter SHOULD NOT be included with your mortgage payment, but should be sent separately to the customer service address. You SHOULD continue to make the required mortgage and escrow payment until the request is resolved. You may bring a private right of action under Section 6, if you suffer damages due to the lender's servicing of the loan.
I started having problems with green tree servicing after I made 2 lump sums to where my house was almost paid off and only had a balance of less than $1400. It started where I couldnt get them to reallocate my payment to my acct, TOOK 3 weeks (if they even posted it) I don't know because I am not able to see my balance online anymore because they turned me into collection and that part isn't visible anymore. I finally got my payoff amount from a customer service rep and sent it certified mail so they could not say they did not recieve it. They recieved it 9/3/2012, cashed it 9/4/2012 and I still have this jerk eric calling me saying I didn't pay it, I said yes I did, says oh yeah but you only paid and gives me a lower amount then the check I wrote. I told him you know i sent it Certified mail and I have copy of the canceled check and it was for the payoff amount that was quoted me. Blah, blah, blah. Anyways he is harrassing me even though I have made every mortgage payment on time and argues with me that I don't have grace period from the first of month, which I do. So I have been doing research and calling my senator and attorney general filing complaints because know I can't see my acct on line these snakes may be telling me it's taking care of and filing foreclosure papers on my property even though it's paid in full.

Where can I find these decent human beings that work at green tree? I've been hung up on several times just for asking a question after trying to speak to a supervisor, and I'm not even the rude one in the conversation. I too was a BOA customer and was sold to these jerks, and that's being kind. They pulled the same crappy paper work with me, plus a double payment that will show I'm always a month behind. They truly can run up your blood pressure.

I had the same transfer of a second mortgage from Country-Wide to BOA to Green Tree. I am in Minnesota. I absolutely agree with the bullying/harrassment per the phone calls. I have always taped my conversations and voice mails they have left me. They continue to call day after day even though I have spoke with someone and set up payments. Two of the girls that call me, Dawn and Kristen, must have some serious personal issues against me. Not that I care. Dawn had obtained my work number from linked in and my maiden name from facebook. She called my work on an extra line that is a different number than the main number and even called my parents house which is illegal as my parents are not on my mortgage. So that's 2 strikes. The third strike came on Friday Jan. 27, 2012 when Kristen called my work and at the same time she was calling my cell and leaving a message. So now I have no choice but to get a lawyer and sue both personally and sue Green Tree. I did not even work at my current job when I got my 1st and 2nd mortgage, so Dawn obtained my info per the internet. When I did my application on the Green Tree website, I did not list the company I worked for or a phone number. Only my cell. I told Dawn the first time she called my work to never call my work and make sure no other person there does. They claim they type all info per the calls into my account, but not true. So after Kristen called my work on Jan.27th 2012, I told her I could not talk and she said " we are open until 7 p.m." I said, sorry I have to go to my other job and I will call on Monday the 30th. She leaves me a message on the 28th and tells me I said I would call her back on the 27th and it is unacceptable that I did not and that I needed to get on the phone right now and call her back. What a bunch of lies. So I left her message on her voice mail and told her that I said I would call back on the 30th. And that I record all conversations and this voicemail and all dates this company has called my cell and all recorded conversations are being sent to my attorney and the attorney general. I also said that she should speak to people the way she wants to be spoken to, so I am just giving back what she gave to me. I let her know that I have rights also and harassment and bullying laws don't only apply to work and schools. I have had it with these people, they are so desperate and pathetic. I do need to include that I have talked to 2 people there that were very nice and not opinionated, nor did they speak to me in a demeaning manner.

(WE JUST RECEIVED OUR FIRST STATEMENT 03/21/2011 DATED 03/12/2011, IT STATES THAT GREEN TREE OR YOUR PRIOR SERVICER INCURRED AND PAID FOR EXPENSES FOR 30.00 THAT WE HAVE NOT YET PAID FOR, WE CALLED AND QUESTIONS THIS 30.00 AND THEY COULD NOT TELL US WHAT IT IS FOR, WE THEN PRINTED THE INFORMATION OFF GREEN TREES WEB PAGE SHOWING WE MADE MARCH PAYMENT ON THE 16TH, PLUS THE 12.00 FEE TO PAY ON-LINE THERE WERE NO LATE CHANGES OR ANY OTHER UNKOWN CHARGES, WITH THE NEXT PAYMENT SHOWING DUE ON 04/01. I HOPE THIS IS NOT GOING TO BE ON GOING---EXTRA FEE SHOWING UP---- THEY SAID I WOULD NEED TO "WRITE A LETTER" TO DISPUT THE 30.00 UNKNOWN CHARGE.

Ditech Financial / Green Tree Servicing Dragging feet on short sale & harassment

We submitted a short sale in Dec. 2010. In July 2009, a lost job forced my husband and I to live apart for 6 months (he lived in Utah, I stayed in Nevada), and no one would list the house because of the market. He finally got a job in Nevada, but his commute was 100 miles each way. We did this for a while, listing the house June 2010. We decided to move Aug 2010 to shorten the commute. We finally got a short sale offer and it was presented to Greentree in Dec. It is now sitting on some manager's desk waiting approval, but they are constantly calling and wanting payments, but saying nothing on their dragging on the short sale. The house sits empty. The bail outs help these big corporations and left the middle class to rot. I just want to get on with life.
