Foreclosure Agency / unauthorized charges

This is a letter I wrote to my credit card company

My name is xxxxx and I am writing to inform you that I am contesting charges that have been debited from my Capitol One debit card ending in xxxx. The company that charged my account is called The Foreclosure Agency [protected]).

The Foreclosure Agency was advertising on the radio, and they claimed to offer a free listing of foreclosed homes. I called the 1800 number to sign up and receive a one week free trial of listings. They took my contact information, as well as my credit card number, and informed me that I would receive the listing in the mail within 3 days. After the one week trial the customer representative, named Ashley at extension 1507, informed me that I could continue to work with their program for 9.95 per week, or I could cancel at anytime. The customer representative also informed me that I could access the information on their website immediately, and she provided me with a user name and password. Ashley then proceeded to ask me if I would like to sign up for other programs to receive gifts and coupons at a cost of 39.80 per month. At which time I declined the offer.

I never received a listing, nor was I able to access their website at anytime. I called the number the company provided to cancel my order, but I was never able to reach anyone. By that I mean, the phone never rang, and then I was disconnected. On November 27 at 230am my account was debited in the amount of 39.80 transaction number xxxxxx. It appears they charge me for the free gifts and coupons program, the program in which I declined.

In short, I did not authorize the company to debit my account for the weekly charge of 9.95; I was only interested in a free trial. Nor did I authorize a payment of 39.80 for any extra programs. I only authorized a charge in the amount of 1.95 for shipping of the foreclosed listing they promised, which, of course, I never received. Thank you for your kind and immediate attention to this matter. And HAPPY HOLIDAYS!

Warm Regards,

I answered a radio ad for a 'free' listing of foreclosed homes in my area. The agent said it cost $9.95 for shipping, I had 10 days to cancel or I'd be charged an additional $29.95. I thought he was repeating himself, but now realize he was telling me I was being charged for two different entities - Foreclosure Agency and Foreclosure Finance. Very deceptive script.

I received a small packet in the mail about 9 days later, and after looking at it, decided it was a ripoff and tried to call on the 10th day, a Saturday, and they were not open. When I finally got through to them on Monday, I was told I could cancel but they already charged me the monthly fees and I could not get a refund because I needed to call 'way before the 10 days is up'.

I went online to my credit card statement and found out they charged two $9.95 fees and there were two pending $29.95 charges. My credit card company said there was nothing they could do because I agreed to the terms, but I could file a dispute of charges.

Beware of these scam artists. Total charges for a so called 'free list - $79.80. Now I see that they are part of a larger network of fraudulent entities: Bargain Network, Easy Saver, American Bargain Network, American Leisure, EMI encore Marketing International.

These crooks just rip people off, and change their name and location when things get hot. They never seem to get prosecuted, just a slap on the wrist at the most.

Next time check it out first - Just because they are advertised, does not mean they are legitimate or there are not other reasons not to do business with them.

At this time there is no requirement to validate a business buying advertising time. Anyone who wants to spend the money are allowed to advertise.

YOU HAVE TO BE RESPONSIBLE FOR DOING THE RESEARCH TO AVOID BEING RIPPED OFF.

You can file complaints with the Federal Trade Commission on the service provider. The fact that they took 9 days to send you the Free information packet barely allowing you time to read it and cancel + closed on the 10th day - that sounds fishy to me.

As for your credit card, YES YOU CAN DISPUTE IT, and YES the Credit Card companies must work with you to resolve the issue.

If they refuse - file complaints against the credit card company with the Federal Trade Commission and Office of Thrift Supervision.

I was told the same thing. They took 39.95 for Repo finance and 1.95 for Foreclosure Agency. I was told that I would n't be charged until after my ten days. I called and canceled my memebership today, 01/26/2009. Then I checked my account and saw where they had charged me anyway. They told me that since I cancel before the ten days were up, that no further charges would be made. I have sent an complaint against them with Better Business Bureau. So I hope to hear something from them. Also I am filing an dispute with the credit card company against foreclosure Agency.

I agree I was a customer, well a sucker to this agency as well. I also heard about the information over the radio and when I called the 1800 number I talked to someone and they asked for my information, and after 30 days I could use the service for free.I called and cancelled my services a couple of days before the thrity days and when I started to read my bank statements, they had been taking money out of my account for the pass 41/2 months after I cancelled my service, so when I called in to check on this a rep told me that I never cancelled my account in Dec. I explained to her I did and to cancel my account now, so I had to go through the trouble of calling bank and sending them information about this. After doing that I called the agency back to get my cancellation number I had two of them one coming from Dec. after I was told I did not call and cancel. This agency is a scan and they need to closed down and a lawsuit needs to be filed for all the people thats has had problems and lies told to them and there accounts being charged without there approval.

THE FUNNY THING THAT BOTH YOUR CLAIMS FAIL TO MENTION IS THAT YOU WERE INFORMED THAT THERE WOULD BE A $1.95 CHARGE TO HAVE THE LISTINGS SENT TO YOU AND AFTER THE 10DAY FREE TRIAL YOU WOULD HAVE A MONTHLY CHARGE OF $29.80. IN THIS WORLD NOTHING IS FREE, HOWEVER AS A CONSUMER IF YOU WOULD ACTUALLY PAY ATTENTION AS YOU ARE GIVING OUT YOUR BILLING INFORMATION YOU WOULD HAVE UNDERSTOOD THE CORRECT CHARGES. SECONDLY, ANYTIME YOU CALL INTO AN AGENCY LIKE THIS ALL CALLS ARE RECORDED AND MONITORED. ALSO YOU FAILED TO MENTION THE FACT THAT DURING YOUR CONVERSATION WITH THE AGENT THEY NOT ONLY READ FROM A SCRIPT BUT THEY HAVE YOU REAUTHORIZE ANY CHARGES SEVERAL TIMES BY REPEATING THE LAST 4 DIGITS. I AM ACTUALLY A CUSTOMER MYSELF OF THIS PROGRAM AND HAVE USED IT W/ PLEASURE. I WAS ABLE TO FIND DISCOUNTED PROPERTIES THAT I WOULD NEVER HAVE FOUND W/OUT THE SERVICE. THEY ALSO HELPED ME FIND FINANCING FOR THE PROPERTY THAT W/ MY CREDIT WULD NOT HAVE BEEN POSSIBLE WITHOUT THEIR HELP. THE REAL PROBLEM IS FOLKS LIKE YOURSELF CALL A TOLL FREE NUMBER, DON'T LISTEN TO A WORD THAT IS SAID TO YOU THEN EXPECT KEYS TO A NEW HOME IN THE MAIL. SHAME ON YOU!!! IN THIS WORLD IT IS NOT THE JOB OF ANYONE PRIVATE OR GOVERNMENT TO PROTECT LAZY CONSUMERS FROM THEMSELVES. IF YOU ACTUALLY PUT THE BALL IN MOTION YOU WOULD HAVE SUCCEEDED OR CANCELLED OUT IN A TIMELY FASHION SO YOU WOULDN'T RECEIVE MORE CHARGES. SIMILAR TO HAVING A GYM MEMBERSHIP IF YOU'RE TO LAZY AND FAT TO GO IS IT THE RESPONSIBILITY OF THE GYM TO REFUND YOU? OF COURSE NOT...IN THE FUTURE IF YOU ARENT MATURE AND RESPONSIBLE ENOUGH TO PAY ATTENTION AND USE A PROGRAM THEN MAYBE YOU SHOULDNT CALL IN AND GIVE YOUR PAYMENT INFO...I DONT KNOW ABOUT YOU FOLKS BUT I WOULD NEVER GIVE OUT MY CREDIT CARD NUMBER UNLESS I WAS FULLY INFORMED AND UNDERSTOOD I WAS GOING TO BE CHARGED. FOR EXAMPLE IF SOMEONE ASK TO BORROW YOUR CAR KEYSTHEY'RE PROBABLY GONNA BORROW YOUR CAR RIGHT!?!?!? SO IF SOMEONE DISCLOSE TO YOU FEES UPFRONT AND THE CONVERSATION IS RECORDED THEN THATS EXACTLY WHATS GONNA HAPPEN. IF I WAS THE AGENCY I WOULD PROCEED WITH LEGAL ACTIONS AGAINST BOTH OF YOU FOR SLANDER AND DEFEMATION, AGAIN SHAME ON YOU!

The ForeclosureAgency is actually legit. My oldest sister bought a house from there over 6 years of paying 538$ a month for her beautiful 5 bedroom house in Honeyoe NY (sp?). I, myself, am trusting the service with my bank card information to find me a cheap home, unlike the ones advertised in the local papers considered "fixer uppers" that they're selling for literally a dollar a piece. I'd give them a dollar just to burn them down, but they're only worth the practice for the fire department. The homes the ForclosureAgency are selling are real life, real cheap homes that most of the time are in excellent shape.Just because you didn't utilize the services and find yourself a house, or were too stupid to cancel after the first ten days, well, that was your own fault, so don't try to ruin a business' reputation because you were dumb. It's rude and unethical.

i have complaints also, in west virginia we also went for foreclosed homes info., was totally screwed. they took my bank info. asked if we wanted all the special and free ammentities they could offer. not knowing they would clear my bank account, which includes over limit fees out the ###, i stupidly fell for one of the most smartest scams i have ever encountered. they talk to you like you have known them for years and finally smoothly ### you in the ### with your pants tightly fascined around your waist, michael jackson couldn't even get into. although i didnt agree to any of the special ammentities i did give info for the free trial list. did cancel before trial was over but they stated i didnt. when i finally got through to the company. although, i was i guess, one of the lucky ones. they did pay back the initial fees they took, they didnt pay back 5 $32 over draft fees. im a poor white ### trying to feed a family of 4 by my self on min. wage income and these people had the nerve to take food from my childrens mouths. let me find one of these people who like to give hope to families like mine. i think we should be able to take action towards them and recieve compensation for the mental anguish, depression and all the ###ed up thoughts you get in your head when under that kind of stress.I GUESS THATS WHAT WE GET FOR DREAMING, HOPING & TRUSTING PEOPLE.

I have to add my 2 cents...I'm a realtor and just received a text from "Foreclosure Agency" to please contact them as they could get me in a foreclosed home on a rent to own deal for $176.00 a month and for a small fee I could get a list of all the foreclosed homes in my area...WOW...I coudn't contain myself, I had to call...some kid probably just out of high school read the script...of course I let him read...what they are offering is a leaseback, which is NEVER a good deal...rent for a few years and have your rent put towards the purchase...what these institutions are hoping is that you default after a couple of years and move out...they keep your money and the house...Anyone interested in buying a bankowned home, see a Realtor, they'll "GIVE" you a list...but have the courtesy to use their services. The buyer doesn't pay the Realtor's commision, the seller does...

Foreclosure Agency has debited my account $179.25 AFTER I had canceled subscription per their instructions; i.e., they stole from me.
May11, Sandra, emp #2303, gave me 2 week extension on my free trial period to June 2, telling me the service would cost $29.99 per year, "no monthly", and would auto cancel June 9, 2010. She gave me confirmation #fb766334.
June 1, per their instructions, I sent an email canceling service.
June 2, I left on 2 months summer road trip.
June 9, with Issac, #1122, he was to email me cancellation notice: did not.
Imagine my surprise to find, upon my return, that Foreclosure Agency and their Loan company affiliate, had debited my account for three months, for $179.25, once each month, not for one year as told me by Sandra, May 11th, (above).
August 13, I phoned, got Martha, #2768, who did cancel my subscription with confirmation numbers, but could not refund the money already debited. Asked to speak with a supervisor who did have the authority and was put on hold. Never got one.
Aug. 14, phoned, got recording, waited 28 minutes, no agent, no answer.
Aug. 26, phoned, got agent, asked for supervisor, got none, place on hold, then cut off.
Aug. 26, made second call, waited 25 min., never got through.
Total time on phone trying to resolve this issue: 66 minutes.
Issue still unresolved.
Have searched Foreclosure flier and emails I have, as well as their public web site, and have found no address to which I can mail complaint.
Company is not recommended, impossible to get through to and is dishonest.
I will continue to try, and pursue legal channels if necessary.

I don't think many people pay attention when they call in. There is a fee for a trial and unless you cancel before it is over, there is a monthly fee.

I'm pretty web adept, but the website was a little confusing for me. I called in to the member services where it was explained that the website has been having a lot of work done. I was given listings and now I'm in a rent to own property myself. The website needs some work, definitely, but they really made this whole process a lot easier by explaining how all of these things happen.

You can get the SAME info from homepath.com or trulia.com and NOT PAY A DIME!

They come across as helpful but take the time yourself and get the same info for FREE!

I had the same problem, I signed up for a trial period, looked at what they purported to offer and saw that the service was bogus no value in anything they offered. I called to cancel the next day but noone answered the phone, I called all day and then again the next day; finally spoke with someone, canceled, got a cancelation number BUT THEY CONTINUED TO CHARGE MY CREDIT CARD. As a note I had to call them over and over again because they would not answer the phone; finally after several calls and being on hold for 20 plus minutes I spoke to an agent told them of my problem and they put me on hold for another 20 minutes then finally another person answered and told me that they would take care of the problem and credit my account. NO explanation as to why they were continuing to charge my credit card account w/o my authorization. I asked for the address of the company and was given 1800 #A Brazos St. Ste 396, Austin, Tx 78701. The funny thing is, the company is listed as a PA company. This is just another scam, that ### like these people run on those is need. DO NOT GIVE THESE THIEVES ANY INFORMATION AT ALL!.. Until they are shut down and they all go to jail it will continue!

They spammed my cell phone, cost me a nickel to read it. Now when I get board I call them back. So far I have logged over 76 hours of their payroll.
