first national merchant solutions contract termination nightmare

I contracted with First National Merchant Solutions in October 2017 and was locked into a 3 year contract. I had to close my business in August 2017 and after speaking to a representative from their company, I was told that my contract would be over in October and that I would be charged an early termination fee if I canceled before that but I could return my machine which would eliminate my rental fee leaving me a monthly charge of $12.95 a month till my contract was up. So I did. I returned my machine in and closed my business in August. When December came around and I noticed I was still being charged I called them and was told that because I didn't give them a written 30-day notice, they renewed my contract automatically. This despite I haven't made any transactions since August and they have the machine.
After a very frustrating call and obviously them not willing to work with me, I hung up. This month I noticed they charged me $250.00 for an early termination fee. Now, how could they not close my account when my contract was up without my written notice but they can close my account without written notice for an early termination fee. I guess they'll do whatever they can to get as much money from you as they can. I phoned them yesterday to tell them that I didn't authorize this transaction. I was told that they would try to reverse it but if they did, I would be locked into a contract again for a year at $12.95 a year but instead of it being retroactive from October when my contract should have been up, I'm locked into a contract beginning this month, January.
These guys are scammers not willing to work with anyone. A valued customer for a year with no problems and they wouldn't close my contract in October when it needed to be closed and not even a couple months following that when I inquired in December. I mean, common sense on their part seeing as how they have the machine back and there haven't been any transactions since August. Apparently, I'm not the only customer to complain about this company.
I wouldn't use this company and would never recommend this company. What has happened to customer service in our country?

I was with FNMS for more than 4 yrs - though not always happy with additional fees and the poor customer service, I hung in there - and when I sold my business I was then informed of the $250 cancellation fee. First of all I didn't know there was an automatic renewal after my initial 3 yr contract (and my rep NEVER helped me after she got me signed up), secondly, I'm leaving because I sold the business and they wouldn't let me roll the account from myself to the new owner (not just because I decided to leave) and thirdly, even if I had known of the first two issues, I couldn't have controled the timing of my selling the business within the 30 day window that they said I had to close the account without the fee. This totally pisses me off because of all of the BS I put up with them over the past 4 yrs. They were a ### company to work with, and now they are trying to rip me off in the end. A small business who struggled to keep my head above water and am again being taken advantage of by big business. They seem to be able to change their contract (ie add new fees) anytime they want, but you can't have any flexibility in yours. I find it ironic the word "solutions" is in the name since there never seemed to be any solution, just another fee. I STRONGLY ADVISE AVOIDING THIS COMPANY based on not only their bad track record on a monthly basis but their continuing to basically take advantage and steal from the small business owner to their very last cent.

When i signed up with First National Merchant Solutions I was led to believe that my the jjpercent I would have to pay was around 2.6%. In fact it has been over 3% at times and their are lots of unecessary fees. I was also told it was a month to month program. The samll print However cost $399.00.

First National Merchant Solutions is now TSYS Merchant Solutions. This company is a rip off ! Unlike many of the unfortunate posts on here I was able to beat them with their scam of trying to get the $250 cancelation fee. In my case I had been with them for over 6 years and wanted to switch to a company with better rates. They gave me the same old tired bs that they tell anyone who wants to cancel their crappy service. Things like you owe $250 because you agreed to it (which I did not) and you arent cancelling in that 1 month per year blah blah. I asked them not to charge my card any more but in the meantime I went to my bank and put a stop payment for the $250 and also revoked any future rights that they had to my bank account. They for sure tried to draft the $250 but my bank blocked them. I then wrote their con artist president who gave me a bunch of jibberish reasons hiding behind codes and contractese that I did not find in my paperwork. I told them I wanted proof of me agreeing to the $250 and in the mean time I contacted the BBB (Better Business Bureau) in Omaha. BTW their contact info is: BBB Headquarters

They told me that they had over 300 complaints about First National Merchant Solutions (Now called TSYS Merchant Solutions). They sent my complaint to the Comptroller of the Currency (part of the federal government). The CotC did not open up an investigation. In the mean time the First National Merchant con artists sent me a copy of a contract with my signature and the $250 on it but the date on the contract was 2017. I signed up with them in 2017! They stuffed the envelope with bogus information mixed with my signature trying to get me to pay. They also started harassing my snail mail saying that they were going to turn me into collections. I sent the false contract to the BBB and they again submitted it to the CotC. This time the CotC opened an investigation and the threat mails stopped. This was 6 months ago. I had also told the CotC of the number of complaints against this 'company'. They do not realize how bad they make themselves look and the money that they actually miss out on as more and more people hear of their dishonest and corrupt tactics. Stay away from TSYS Merchant Solutions! Hope this helps someone out there.

first national merchant solutions Illegal charges, overcharges, awful customer service

I signed up for their fnms credit card processing services in February 2010. When i talked to Jason, my apparent account manager, i told him my website was already PCI compliant, for which he asked what was that. I had to explain Jason  that was about to start  processing my credit card transactions what pci compliance was, for which i got the response they weren't dealing with that and that it was great i already had it. 

Today I'm reviewing my bank account statement and found a charge for $150.58. When I called fnms demanding an explanation, I was told the charges were for their new PCI Compliance services, wow! they finally got compliant a year later than my business. When I explained to them I wanted the charges reversed because I was already pci compliant, that I already had a company monitoring my website and charging me for it, they denied to reimburse me. They said in order for fnms to refund me I would have to prove I was already compliant (not a problem) and that I would have to sign up for their monitoring, which is $30 a year plus $20 per month. They denied me of my refund after I explained to them many times I wasn't going to pay twice for a service that I already had, and threaten with closing my account. They said they we're going to charge me an early termination fee of $250 if I closed my merchant account with thrum. You kidding me?! I signed up a year and a half ago, and no, my contract says nothing about early termination fee.

So not only they have done bait and switch, after checking today i discovered i was overcharged more than $40 in transaction fees and they are trying to coax me into give me my money back if I sign up for a service that not only I don't need  I don't want, and without giving me the option of opting out in any way.

Shady, shady company.

I have already filed a complaint with the bbb and FTC, and I'll make sure fnms refund me every penny they have taken from me.

And by the way their customer service is the worse! I'll never do business with first national merchant services or Omaha first national bank ever again.

PCI compliancy is a once a year charge. Although I've seen the prices all over the board ($100-300), we pass it through at cost. There is no monthly fee for it, although I do see those. Most of the time it's for not filling out the form and sending it in. Our company stays on top of you till you get it done, so you don't get hit with the monthly cost. It's a matter of caring for your merchants, or not.

first national merchant solutions Consumer Fraud

Here is another update. I got a letter from them saying I now owe 369.00 after they sent me a letter saying the matter was closed. I tried to file a complaint online with the BBB in Omaha, Nebraska, but the form won't take my complaint because I don't have a Nebraska zip code.
I sent another fax to them. They will only let you contact them this way. :

If a company does business in a state it must have a registered agent. You should be able to find out who that registered agent is fairly easily. Then file a complaint with the Secretary of State's office where you live sending copies of your letter to the president of FNMS. In your letter to the FNMS CEO be very polite, suggesting how he probably is not aware of how her or his subordinates are representing the company. This will give the CEO a little wiggling room. I hope this helps.

I totally agree with your complaint regarding their unprofessinalism. I called to cancel two of my merchant accounts in California, after finding out that they have been ripping me off with double charging me for certain transactions according to my new merchant account vendor. I made the mistake of telling them I have switched to another vendor, the rep immediately forgot I had been a long term customer and started treating me with a different tone of voice and determination. She asked why did not give them another chance before switching. She also tried to intimidate me with charging me lots of moneys for breaching the terms and conditions. I requested to speak with a manager, the manager treated me even worse, her name is Cathy E. I asked to speak with some else, she stated she was the highest manager below their so called president. She said I was not going to be able to speak with another person above her. She said my conplaint ended there with her. Frustrated enough, I opted for letting it go, as if that was not enough, she closed the accounts before i settled the machines for the last time and did not send me a return lable, I had to called back to get one. Cathy go to HELL!

first national merchant solutions customer service/equipment problems

Pay a minimum of $50.00 a month for processing, even if I dont use my machine. The machine never works. I have had it replaced at least 4 times and have been treated extremely rude by customer service. They said I can upgrade for $40 more a month. This has got to be the most expensive processing company ever. $250 to get out of the contract. THIS COMPANY SUCKS! STAY AWAY!

One last thing to merntion. If you're not set up with the Interchange Plus pricing structure, most likely you're paying more than you have to. Not sure how this site feels about links, so go to the BBB's website and look for "Controlling Credit Card Processing Costs" . It's great advice, and tells you what to look for when signing with a new processor.

The ONLY way to avoid it is to have an amendment signed PRIOR to entering into a contract with the processor that gets you out of an Auto renewal and out of an early termination fee. But good luck finding a processor that will go along with that.

Not entirely true. We don't have a contract, therefore no cancellation fee, so not possible for auto renewel. There are a few out there that do not make you sign a contract, and I'd advise anyone to search them out. They have just as competitive rates, if not even more so, since there's no contract. A service company with no contract has to wkr harder to keep your business.

Sadly at one time we were happy with this company but then they were not competitive anymore with there rates. So we left. Now they keep taking fees out of our account without permission. We sent back there machine 6 months ago and just today they charged us for there machine not being returned. They also charged for an early termination fee that was not in the contract. We have contacted them repeatedly and have not gotten far with customer service in resolving this situation. I am planning on suing the company if the monthly fees that have been wrongly debited are not returned in a timely fashion, even if it costs me more money just to do that. Crooks are Crooks and should be treated as such.

My local rep was great, but the overall company charged us so many fees and hassles that we had to dump them and go with another company. FNBO made too many mistakes in wrongful charges that really made us angry. That was our experience. I'm sure there are good ones as well, we just weren't happy.

They make sure you don't read the contract. The lady told me "don't print it it will time out you only have 50 seconds to agree"

Fees aren't the issue this is what happen to me. my account got closed and i have to wait 180 days to get 10K
I only had them a week. and the reason why they closed my account was "I don't like the way you spoke to me on the phone." I just got that call today.
they closed me 2 weeks ago. I didn't even know they closed the account. This is most likely going to end my business.
They don't even have a reason

A lot of these complaints are stemming from the new PCI DSS (Payment Card Industry-Data Security Standard) that First National Merchant Solutions is having thier merchants adhere to. This has been driven mainly by some very highly publicized breaches of data security that took place at other processing companies. The card associations are making the payment processors have thier merchants adhere to this new minimum standard. So, even though it seems like FNMS is just trying to make money...which I'm sure they are...a lot of it stems from that as well. As for the early termination fees...those are standard in the payment processing industry. You complaing to a BBB would be like complaining to a BBB about a cell phone carrier's early termination fee. It's just a common charge in the industry. The ONLY way to avoid it is to have an amendment signed PRIOR to entering into a contract with the processor that gets you out of an Auto renewal and out of an early termination fee. But good luck finding a processor that will go along with that.
