Families Bring Lawsuit Against Agencies: BETHANY & FAMILIES FIRST review: child neglect & adoption agency incompetence 5

My name is Kelly Pooler Miller. I am reaching out to anyone that I think can help me..My grandson Zaiden Francis was born on June 19, 2013 ..His mom Cacey Miller was 16 years old when she gave birth. I obtained full legal and physical custody when Zaiden was born only because my daughter was a minor. My daughter is an excellent mother. She went back to school and works the weekends to help support her son. On may 14, 2015 I gave my daughter custody of her son due to she became an adult. The last two years we have been in and out of custody court with the father. Let me get to the main issue at hand. My grandson was diagnosed with Cephalhematoma when he was around 7 months old. So if he falls and bumps his head on a pillow the wrong way we rush him into the ER..because of the Cephalhematoma ..we are overprotective of him...While Zaiden was with his father...Pernell Francis .He was rushed to the ER..Dr. and social worker said that his story did not match Zaidens injuries ..This happen on 6/7/15..Hospital ER Dr. advised us not to let father see him...On 6/8/15 DHS case worker came to our home..Ms. Holmes...also instructed us not to let father see him. Till they talked to father. On 6/11/15 I was taking my daughter Cacey Miller up to modify the custody. When Ms. Holmes called her and said she was coming down to our home. My grandson was in the care of my oldest daughter Kellyann D'Armi while we were up at the court. A DHS caseworker supervisor called my daughter and asked her if we could come into the office Cacey Miller told her that we were on our way to modify the custody order and that she was meeting with Ms. Holmes later on that day. I forget the supervisor's name. So now we got worried and ask her if we should go home right away...she said yes we could modify the order the next day...that it was important that we meet. So we immediately went home. When we got home we found out my oldest daughter went down AC for the day to see my Aunt Rainey and Uncle Mickey...Who live there. We are very active people. We keep Zaiden very active with us. We are very outdoors people. We had just came back from Jamaica on 6/2/15..Zaiden loves the water and beach. When Ms. Holmes and another caseworker came out to the house...I never caught his name...They brought two police officers with them. I found that odd..Ms Holmes then instructed us to turn over Zaiden to DHS care..Well you can image the shock to myself, Cacey Miller, and my oldest daughter’s boyfriend Louis Schillero..I had ask on what grounds...And she stated that we take him to the hospital to much. What I found odd was that she had all Zaiden's information from the hospital except for the discharge papers from CHOP that the baby has Cephalhematoma. So Louis Schillero started crying along with Cacey Miller...I went to my folder of information that I keep about Zaiden for court and pulled out the discharge papers from CHOP along with the MRI report when he was diagnosed with Cephalhematoma..She did not even want to look at it..Now the man DHS caseworker has me call my daughter KellyAnn ...I leave her a message that when she gets off the beach please call me immediately. And to see if she was coming home that night or if they made plans to stay at my Aunt and Uncles over night..Ms Holmes did not have a court order for us to give them Zaiden..Ms. Holmes and the other man DHS worker started to bicker between each other the man DHS caseworker call his supervisor from my front porch myself and my neighbors heard him tell her you can not do this...you can not go to a home to remove a child. Without a court order and without notifying the family. That he wanted nothing to do with this. The police officers that were there agree totally and left my home..When Kellyann D'Armi came home from the shore with Zaiden...Cacey Miller Zaiden's mom called DHS caseworker. I am unsure of which one. To inform them that the baby was home. They scared Cacey Miller into begging them if a family member could take Zaiden which they agreed upon. Zaiden is now with Mary Piscitelli..Louis Schilleros sister..They stated he would have to stay there for 60 days while they start their investigation. I have now found out that in DHS case report it mentions nothing of Zaiden having Cephalhematoma...It states father is perpetrator and that I might have bugs and fleas...which I don't..i just had terminix come out to my home and father's home...cause Zaiden was covered in bed bug bites in May...Terminix inform us that he was out to Pernell Francis house a year ago and they were infested with bed bugs and have not done anything about it...A friend of mine told me that DHS would pay for an exterminator to get rid of there bed bugs if other children lived in his home...which they do...so I called DHS and made a report...told them who I was...cause I did not want my grandson getting big beds while under Pernell Francis care. Nor did I want the other babies in his home to have to live with bed bugs..Terminix inspected my home also...And I am bug free. I am having a hard time with all of this. Because I have been inform that DHS has broken protocol in which they must abide by in removing a child. And how they conduct investigation. Zaiden Francis is a very loved little boy. There is no abuse going on in my home. The only crime we are quilt of. Is being overprotective of him..Because of the Cephalhematoma..That's why we rush him to the ER if he falls.Zaidens pediatrician told us if there is anything she can do to help us in this matter to just ask. Please help Zaiden and look into this matter. Now DHS changed up their story and said we fled with Zaiden...This is a bunch of bull crap.excuse my language. My daughter Kellyann D'Armi came right home as soon as we got in touch with her..May God Bless you for all the abuse children you help. Please help Zaiden. On 6/18/2015 Myself and my daughter had a meeting a DHS..We were never notified of the meeting..Thank God..The woman Ashley who oversees Zaiden while in Mary’s care .called Mary to remind us that we had the meeting..I was enraged that no one notified us of this meeting..We have another Safety conference on 7/17/15..I am so angry and heart broken..My grandson should not have to go thru any of this..He is a well loved little boy..Happy, Healthy, Well cared for. and LOVED little boy ...And last but not least safe in my HOME. We went to the safety conference on 7/17/15 with an attorney ..when we got to the DHS building we were notified that the meeting had been changed to another place..not even in the DHS building..The meeting was at 22nd and McKean..We were never notified of any change..My attorney wanted to know what was gone on..by the time we got to the new location when we went in we were told that we were late and that we only had five minutes left to discuss a new safety plan..Thats when i told them i was instructed not to say anything into my attoneyt was present and he was looking for a parking spot..After that safety conference..DHS signed off...we recieved a letter that no neglect was found in our home...It was unfounded...of course it was unfounded..Zaiden got hurt while he was with his father..The only thing that we are quilty of is being over protected of zaiden and taking him to the ER to often due to he was born with Cepehematoma..Which know one even talks about..My daughter completed everything that Bethany Social Services asked her to do..She graduated parenting classes..The new supervisor said she has to go back to parenting classes cause they wanted her in there after the baby was placed in Marys care..Well low and behold when she got her parenting certificate she was still in the classes when Zaiden was placed with Mary..Now they changed up the rules again and said that is not good enough..She has to retake the parenting classes again...For what..She already completed it has a cerificate in it..This is absoulety crazy..Bethany is making up the rules as the go along..This is illeagal...This is a child that is well cared for..well loved..and living in a happy home...please please please I need help...My attorney turned out to be slimmy and never followed thru on climing the ladder of command...I need help...I am begging anyone that can help us bring Zaiden home..

i had the same thing but it was my son and he's 2. my ex-gf got arrested for drugs and she had my son in the car with her. they told me since i didnt have my own job and house that i couldnt take care of him so they took him. they said i could get him back when i got a job and a place to live and di some parenting classes. it took me awhile, but i got a job. but when i got my job they said that i was missing too much visits. then they said that i failed a drug test at work, though i didnt, it was a prescription and they told my employer to fire me and then they started making me take drug tests. i had my meds in my system for a few weeks so i failed drug tests. so they stopped letting me see my kid until i got drug treatment. after i finished a program for 8 weeks they said that my son was having too hard of a time seeing me, and that now it was 12 months and they had to change my case plan. now next month they are going to have the termnation trail. i dont even know what to do.

Bethany Christian Services in Iowa are no better. A young man I am close to had a child in November of 2009 but he was not notified by Bethany that he even had a child until two months later when he was served papers saying he was terminated for abandonment. Isn't it hard to abandon a child when you didn't even know they existed? The father then retained an attorney to stop the adoption. Bethany backed out but placed the child with the adoptive parents. They refused to produce to the father the birth certificate even though they had it all along. This poor baby essentially didn't exist for months because of the lack of cooperation on the part of Bethany's staff and attorney. Even though Bethany had the father's information three months prior to the birth of the child they chose to not notify him in a timely manner. I would never recommend this agency to anyone! They lack communication skills, professionalism and morals. Because of their actions they put this father through mental and emotional stress. This father missed out on special bonding time and a lot of "first" with his child. Anyone should really think twice and do their research before considering this adoption agency. The potential adoptive parents also suffered considerably due to Bethany Christian Services of Iowa.
