Electrosmart Waste of valuable money

Hi All,

My boyfriend entered into an agreement with Electrosmart in January 2011, the sales consultant was professional and stated in her pitch that there was a 90 day money back guarantee, funny enough after signing the contract - which was late at night due to the fact that the sales consultants harass people at late parts of the night - after signing the contract, it was noted that nowhere in the agreement was there anything mentioned about the 90 day money back guarantee. After seeing that his account had not changed and the bill was the same, he contacted Electrosmart and informed them that the product does not work, the lady he spoke to told him that his settings were wrong and they would change it, he then waited for the next electricity bill and honestly NO SURPRISE, the bill remained high still, so now he had to pay Electrosmart for a product that did not work as well as pay the electricity bill! Outrageous! Once more he contacted them, stating that he would like to cancel, they told him that if he wanted to cancel he would need to pay 35% of the whole amount before that could happen, he then sent them a letter stating that under the Consumer Protection Act, they mislead him into signing the agreement by stating that there was a 90 day money back guarantee, also they could not charge him 35% (which is in the agreement) due to the fact that under the Consumer Protection Act, he is only entitled to pay 10% of the amount and provide them with a 20 business day cancellation, which he did! The woman then called him and told him that they do not fall under the Consumer Protection Act! This is an endless nightmare, they deduct money from him account, and yet the product does not work, there are also numerous complaints about these people! I dont know about anybody else, but to me the company is fraudulent and they need to be dealt with accordingly.

If you signed the contract after April 2011 then the Consumer Protection Act applies to the contract - I suggest that you contact a legal company and get legal advice on what you can do, or even Google the CPA yourself.

I have tried cancelling this contracting but this company is very forceful - They refuse to let my boyfriend cancel. Something really needs to be done.

Hi,

I am glad that you did not get pulled into their fraud, the company has conned so many people. I have a list of complaints that I have seen on different websites. I am hoping now that someone does something about this. More and more people are complaining and yet the company, Electrosmart, still stands by their product, refusing to let anybody cancel if they do not pay 35% of the total amount. Furthermore, according to the Consumer Protection Act, a consumer is liable for only 10% of the amount and they are allowed to cancel giving a 20 business day notice, yet if you phone that company, they will tell you stories about the unit being a fixture. Honestly, something has to be done soon! I do hope that someone will be more willing to assist you as I am close to giving up.

Can anyone tell me how to stop the Electro smart product. My brother got caught by them 2and a half months ago. The product does not work- on freezing cold days he has no hot water. I phoned them and they say if he cancels the debit order they will blacklist him. This is rediculous? Anyone that knows how to legally cancel this contract and get them to take their "box" back. Needless to say the lady that sold it to him, did not have a business card and her number doesn't exist anymore. Phoning the company is a nightmare as they refuse point blank to take the product back- any advise?

Thanks for this info. I had one of these idiots knock on my door at 10.00 o'clock last night... also with the sales pitch, trying to sell an electronic TIMER SWITCH that probably costs no more than R50 to make, and they want R11, 000 for it! YES, ELEVEN THOUSAND! He was PERSISTENT and wouldn't leave before 11pm.. on a Wednesday night! They imply that they have something to do with Eskom and the high electricity costs. I refused to sign anything at that time of night and asked him to leave me his card. He had no cards. I asked him for a website address and the one he gave me is bogus. Doesn't exist. I will be reporting this to the local police and the local authorities as well as all the local newspapers and the Sunday papers. THEY ARE FRAUDS. Sorry your boyfriend got caught in a scam.

Electrosmart Money back

I purchased an electrosmart provided that I can give it back in 3 months. It didn't save but they don't want to give back my money. Anybody interested in group legal action?

I would be interested. I am not the one who purchased the appliance but my boyfriend is going through hell trying to cancel with these people. Marion is assisting him but she refuses to let him cancel.

YES! I would definitely be interested in group legal action. It is obvious that there are numerous people that are unhappy with the device as well as the inability of electrosmart and CT International to deal with complaints. Give me an e-mail address so that I can forward my story to you.

Electrosmart Refusal to cancel contract although I am unable to use the product

I have purchased the electrosmart device which supposedly saves electricity by switching the geyser on and off on preprogrammed times.
When the electrician arrived to have the unit installed, I was told that the wiring in my house is not done correctly, and I would need to redo the wiring before the device can be installed. He then left the unit with me and said that we could contact him to install once we have sorted out the wiring problem
I have meanwhile received a quotation for the rewiring to be done, which amounts to R8000. I am unable to do this at the moment, which means I am unable to use the electrosmart device.
I have also received a money back guarantee from electrosmart that I could cancel the agreement should I not receive the full benefit of the product.
Electrosmart is now refusing to cancel my contract, wanting me to pay a cancellation fee of R4000 before they will consider the cancellation. This is ROBBERY.

I agree. The Electo Smart actfually put my usage up by +-R400. I complained via email but have been ignored. I didn't make a payment so that they would contact me but instead got called by CT International who threatened to blacklist me. I am back to putting my geysers on and off as I used to and it works better. Is there a way for people who have been deceived to stop them from stealing from other people?Kenny Williams, Pretoria (Karken66@gmail.com).

so it seems that i will have the same problem as my ELECTROSMART GIZMO will be installed tommorow, if I look at all the negative comments then my little timer that costs R65.00 does a better job than the R8000.00 gizmo. I will give it 2 months though to see if it does save me money, if not I will take further action.

This sounds as if I am reading my own story! The empty promise of a money back guarentee, the loan from a third party, etc etc... I never requested a loan from a third party, and was under the impression that I am having a down-payment-agreement with electrosmart. When you phone the numbers you have, you get to CT International, they cannot handle your complaint, but you never get to speak from somebody at electrosmart. Their promises of managers calling you back also never realise. At first Riana from CTI denied getting my letters (three of them) that was both e-mailed and faxed - the first sent by registered mail as per the contract. After enquiring at the post office, I phoned CTI to state that a D. Cloete (aparently a manager) picked up the registered letter and gave the date and time. Then all of a sudden, they did not deny getting the letters. After discussing the problem with legal advisers, I was told to leave them to make their threats, as it is believed not much would come from this either. Oh, and the funny part of the blacklisting: I received a letter that stated that I was blacklisted, but on enquiring about this at CTI, Riana told me that they did not blacklist me. What they say telephonically and what they put in writing are two different stories. If you ask to speak to somebody else, they put you through from the one person to the other, and you just end up with the first person again - nothing reached! Back to square one! I also phoned the SABS and requested them to check if electrosmart is registered under the number given on their documents. According to the SABS electrosmart is not registered with them. They are also investigating this matter.

I also have a problem with Electrosmart. They sold me the unit and gave me a 3 month money back guarantee. This thing has never saved me any money...least not the amount that was promised...in fact my bills have almost remained the same. After the second month I called the support number where I was told that I should leave it for a few more months. I explained that my 3 month guarantee would be up by then and the reply that I got was that they are a financial institution that basically gave me a private loan and that they are not responsible for the unit. In fact they are a third party that only loans money and has nothing to do with the sales of the unit. I have called and faxed the guarantee (which has their phone number on it) and my accounts to them and requested that some sort of manager contact me, but to no avail. I have since then gone into the bank and cancelled the stop order to get a reaction from them. well I got my reaction...this morning I got a call from a them and was told that if i do not pay I would be blacklisted and that they are not interested in my 3 month guarantee...
To anybody out there who is thinking of purchasing an Electrosmart...DONT it does not work and they will not honour their promises... except for the part about taking your money
