DutyFreeDepot.com / cigarrette order never arrived?

I placed an order more than 6 weeks ago and have not received NOTHING!! ABSOULUTLY.. NOTHING...
I sent an e-mail, no response and called their 24/7 support line but only a message asking for name and number to call back, so i've been worried that
the site is a SCAM.
wondering what i'm going to do, should i take legal action?
Please help give me an advice.
