Deltec Manufacturing Unsolicited Toner Cartridges Scam

I have witnessed the Deltec Manufacturing scam as well. I cannot understand why a purchasing officer would agree to purchase toner cartridges at a 250% premium to prices listed on most other sites. I suspect that Deltec offers a kickback to purchasing officers in order to secure the sale. I can’t see any other obvious reason why so many companies have fallen victim to this scam. Furthermore, I cannot understand how Deltec repeatedly gets away with systematically sending unordered, overpriced printer cartridges to firms – NSW police should investigate Deltec Manufacturing. I am certain that it is illegal to send unordered goods accompanied by an invoice when the delivery is actually a solicitation for the order of the goods (see http://www.accc.gov.au/content/index.phtml/itemId/11515). Doing so is called fraud, and Deltec Manufacturing is committing exactly this type of fraud. The police and trade commission should not let the Deltec scam continue to defraud innocent small businesses. You can report the scam at http://www.fairtrading.nsw.gov.au/Consumers/Scams/Report_a_scam.html.
I found some information through ASIC that may help others deal with Deltec Manufacturing. The director of the company is Ian Michael Cooper (93 Lennox St, Newtown NSW 2042). Deltec’s current principal place of business is LEVEL 7, 350 KENT STREET, SYDNEY NSW 2000 and their registered office is AUSTRALIAN BUSINESS NOMINEES PTY LIMITED, 'MLC CENTRE' SUITE 5307 LEVEL 53, 19-29 MARTIN PLACE, SYDNEY NSW 2000. Hopefully someone can use this information to protect themselves from the villains at Deltec Manufacturing.
For those of you who have received unordered goods from Deltec, here is what NSW Fair Trading states as your rights (from http://www.fairtrading.nsw.gov.au/Consumers/Scams/Types_of_scams/Unsolicited_goods.html):
“Under NSW consumer protection laws there are two things people can do if they receive unwanted, unordered goods.
1. They can advise the seller in writing of their name and address, that the goods are unsolicited and unwanted and where they can be collected. If the seller fails to collect them within one month, the goods then become the property of the householder. Householders should keep a copy of the letter. If the letter is sent by registered mail, proof can be obtained of the date when the sender of the goods received the letter, or
2. They can choose to do nothing. If the seller does not collect the product after three months, ownership reverts to the householder.
In both cases, during the intervening period consumers have a responsibility not to use the goods and to keep them safe and secure.”
Power to the people – don’t let Deltec Manufacturing win!

Deltec Manufacturing Harrassment of Staff, Dodgy Products

Deltec Cold Call businesses harassing junior staff into buying products unseen. They use tactics like we have a recorded conversation. Sent us 5ink cartridges with a bill of over $370, to suit a printer that cost $79. Still hounding us even thought the cartridges were returned - actual true cost of the ink is less than $80, go figure. Pushy nasty people. Thet also ring from "unknown' numbers and have no real email address

Deltec Manufacturing Dodgey product- Woeful customer service

This company is bad to the bone. Harrassed our trainee administration officer into purchasing toners. Relentlessly pursued her until she ordered. We received 4 toners that we needed to exchange. Deltec Manufacturing claims to have received only one return and it has taken over 3 months of continuous calling of the head office and still no resolve. Staff continue to tell us someone will call back They never do! Customer service staff get aggressive when I call to find out what is happening. I have taken my complaint to the Department of Fair Trading and would encourage anyone else having these type of issue to do likewise.

Deltec Manufacturing Unauthorised orders

They keep ringing saying that we are committed to another shipment of cartridges when we are not. Every order is "the last order" and then they ring back 3 months later saying the last order is ready to go. I have requested a copy of our agreement but they won't send it. I have got the last 3 invoices signed by the sales person stating that this is the last order but they won't acknowledge it. My advise is stay away.

I have to agree with some of these comments. Deltec Manufacturing will send orders to you under the pretense of agreed verbal contracts for their overpriced products (toner cartridges in our case), and they will attempt to continue the sales thereafter. Deltec just did this to a newly installed manager in our organisation claiming it was part of a verbal contract they had with the previous manager, pressuring the new manager to agree to a shipment of cartridges. They have refused to take them back, and we refuse to pay for products sent to us due to their devious principles of sales.

I have had the same problem and am dealing with an invoice for over $4000 for cartridges sent to the office (before I started) that we do not use. They will not accept return. We have a whole room ($17, 000) of cartridges that they had sent us that could not be used - and we have paid for. I am going to be taking them to the ACCC! We are a not for profit charity organisation.

Deltec rang me on 15/6/11 saying our shipment of more toner cartridges were ready to be sent, but I'd never requested any! I'd last spoken to them back in October 2010 and said we had never ordered the cartridges they intended to send then and again today they want to send more - this is unsolicited and stealth selling of their goods

Deltec Manufacturing Dodgy sales practices

These people rang our business and claimed they had been supplying printer cartridges for us in the past. They got a new person who believed them, and she asked for another 12 of our usual cartridges.

When the invoice arrived we discovered that:
- we had never dealt with these people before;
- instead of our usual $27 per cartridge, they were demanding $79 for exactly the same item;
- when questioned about the price, they claim their product was a special high yield product which would last longer. It was not, it's just a standard canon cartridge;
- their receipts were hand written with no ABN or reference to GST;
- they refused to take back the product when we asked for them to be returned.

I have instructed the employees to never deal with Deltec again

TOTALLY AGREE - BEWARE OF THIS COMPANY, THEIR PRODUCTS ARE DODGY, THEY DO NOT DO WHAT THEY ARE SAID TO DO, THE COMPANY REFUSES TO ACCEPT RESPONSIBILITY OF RETURNING THE PRODUCT AT THEIR COST, WHEN I SENT IT BACK THEY SAID THEY NEVER RECEIVED IT, HOW CONVENIENT OF THEM. THEY HARASS FOR PAYMENT, CHARGE LATE PAYMENT FEES, LIE, USE SARCASIM AND THREATS. I HAVE TAKEN THE ISSUE TO A CURRENT AFFAIR SO THAT ALL AUSTRALIANS ARE AWARE OF THIS SHODY COMPANY

Deltec Manufacturing Dodgey sales people

Rang up offering 2 printer cartridges cheap. Have sent a total of 35 cartridges which they claim I ordered. Every time they send more they assure me that this is the last part of my order (which I supposedly signed for) but they keep sending more.

They might be cheaper initially but you will spend alot more in the long run in my opinion.

Called when new person at reception (me). Told me that they supplied our cartridges and were sending through a form for our next order at a "special" price. Despite many orders being the "last order" - I am still receiving calls and more cartridges, which they will not take back.

Same problem different company! We kept receiving cartridges until one day my boss let them have it and the cartridges stopped. The account however was over $6000. Each month now 'Todd' rings saying he needs payment so the boss gives him a pull through and we send them a couple of hundred each month. They finally decided they had had enough so they told us to send back a certain amount of cartridges and that would cover the bill. But guess what, they say they didn't receive them! But don't worry I sent them registered post and we have proof they were delivered. Australia Poat is now doing an enquiry and the ### will get found out!

I too was contacted by this company again today, stating that the balance of my order from January was to be sent in the next couple of weeks. (They apparently separated they order to save us freight as we are a small company according to them.). So 11 months on, the balance was to be shipped. I remember taking part in a survey last year. 2 months after the survey they rang to say they would send the Eco friendly cartridges with a gift voucher, that I apparently agreed to, in the survey, as they were a new Australian company I thought I would give them a go.The first shipment arrived twice the price of the company we had been dealing with. Somehow the bill of $793 got paid twice. When we rang to tell them, they apparently had no records of receiving it twice, so we were never reimbursed. Six months later, which was about five months ago, they rang to say the next shipment was being sent. I said don't bother, the last lot broke in the fax machine and made a hell of a mess, "We don't want anymore cartridges and don't call again."
I think what they do is wait for a period of time, when they think you have forgotten or have replaced staff who would be none the wiser to previous dealings.
Anyway the fax to sign and return, was sent by them today, to which my Office admin called them back to state we didn't want them. The girl stated she had a voice recording of me ordering them. When my Admin asked to listen to the recording, their staff member hung up. My office Admin called the company back and asked to speak to the Manager. The Manager stated that "No she didn't hang up she had finished the call." My Admin demanded to hear the voice recording and was told "We only keep those for 3 months" He told her he would cancel the order.
They have been reported today, to The Department of Fair Trading. I expect we will hear from them again, in about 11 months time.

I was called by Deltec some 24 months ago regarding an order of 6 cartridges (to which l agreed and signed) Some 6 months later l was being pestered by them that my "next shipment of cartridges was about to be sent out" to which l asked if l could have copy of the document stating that l had agreed to more cartridges other than the 6 l had already received - they were unable to provide it. I then asked if they could provide me with a digital recording of me agreeing to more cartridges - which they were unable to. After some 18 months of harassment l reached the end of my tether and took the following steps which stopped them.
1. I contacted the ACCC and they directed me to their website and they strongly urged me to write to Deltec stating clearly that l am cancelling all orders with them
2. I contacted the Office of Fair Trade NSW and they like the ACCC advised the same line of action
3. I then sent the letter that l was sending to Deltec to the ACCC, Office of Fair Trading NSW and my solicitor
4. I sent a letter to Deltec (ensure it is Registered Post that way they can't say to you they never received it) advising them that ACCC, Office of Fair Trade NSW and my solicitor have been contacted and that l will take further action if harassed in future.
I have not heard from them since.
If you didn't agree to more than what you originally agreed then don't do it! Don't get sucked into their lies - to put it siply don't do it if you didn't agree to it!

Wow! I have had the same kind of problems as most of the ones I have been reading about. I have sent the information and told them never to contact me again. I have kept copies of the faxes and the dates so that I can prove when I sent the information. I am sending the last one by email. I will follow what scamstopperr has suggested and will also put in a complaint to Fair Trading. Thanks Miss Calypte - I have had the same experience but was also ignored by the staff when I told them I didn't want to have anymore cartridges sent to me.

"In light of all the responses i am reading now, one thing always puzzles me about companies out there, when someone calls you and offers you something, make sure you pay attention to what the sales person is saying on the other end or just hang up, dont think because a company is offering something that may or may not save you money that its a scam, sometimes people who say yes to something just cant be bothered to hang up and say YES, everyone who has some complaint about this company needs to realise that YOU a consumer makes the decision about whether or not you accept the offer. Noone has forced you to buy anything, noone has put a gun to your head and said you HAVE to buy this so step back and think for a moment. 2 put it simply, SAY NO and hang up.".
