Deep Sea Fishing Charter / failure to refund money

In July of 2007 My husband & I and some other family members had reservations for a private fishing charter, we had to pay $300 deposit and then the day of the trip another $1,595. The day of the trip the weather was bad but the captian said there was no need to cancel that all would be good. The further out we got the worst it was & they started asking if we wanted to cancel, I told them no I would rather not unless it was unsafe for us to be out. After a few min. of talking about it they told me it was unsafe so I said ok lets head back. After getting back to the dock we were given our 1,595 back but not the 300 deposit. The captian said we would have to get it back from the owner. Well after the owner telling us it was our fault the trip was canceled because the woman on the boat was too scared to keep going (not true) We told him what happened & that it was his captain who told us it would not be safe , he said he would refund the money. Several weeks went by & still no money ( he was supposed to credit it back to a credit card) My husband called the owner who then said he would be keeping the money for the gas that was used, my husband argued ubtil the owner (Mr.Jim Holmes) said he would return half of the money. Tierd of argueing we thought it best to cut our losses & just take half. After waiting another 2 months, still no money. I E-mailed Mr. Holmes to ask why he had not credited it yet, as of now 7 months later I still have not had a reply from him or a refund! These people are dishonest! If you are thinking about a great fishing charter this company is not for you.
