I would like to publicly APOLOGISE for filing a complaint on this board YESTERDAY 4/15/09, against Attorney Daniel Fox, Nadia Jose, Mitigationllc, MortgageModToday etal.

I have contacted the Webmaster of this site and asked to have my ORIGINAL Complaint REMOVED IMMEDIATELY.

Miraculously, this morning, I was contacted By Nadia Jose of Attorney Fox's office, and they were ABLE to do what I retained them to do, and that is negotiate a Modification with my lender!

While there are details still to be worked out, I am confident in Mr. Fox's abilities and efforts on my behalf, and while this may have come at literally the 11th hour, as far as I am concerned, he HAS done, FINALLY, what I have been trying to do for months now. (My complaint posted yesterday was done so out of sheer fustration for not having had any communication at all over the last few stressful weeks).

So again, I Publically apologise to Mr. Fox and Nadia Jose, I THANK THEM, and I HAVE already requested that my Complainted posted yesterday be IMMEDIATELY removed from this Board.

I filed my complaints via the internet; google Florida State Bar, they have the ACAP Program (Attorney Consumer Assistance Program), you can download the form directly from thier website/just follow thier directions. Also go to "Florida Attorney General's" website...you can file your complaint directly online.

Importnat note: If you were telephone solicited originally, like I was from a guy in Long Island, New York, then in your complaint to the Florida Attorney General you can LEGALLY state: "Mr. Fox etal is in DIRECT VIOLATION of Florida Statute 501.1377 - Charging Fee's for Loan Modification/Foreclosure Relief, not utilizing Mandatory Contract Format". Additionally, you can state: "Mr. Fox etal participated in/perpetrated UNFAIR and DECEPTIVE Trade Practices, and you were a VICTIM of UNETHICAL LAWYER REFERRALS in Violation of Florida Bar Rules" unquote.

If you were originally "solicited" by a SHEISTER from New York by the name of Ryan Lewis (or some other snake oil salesman from there), then you can file this with the New York Attorney General as well. (I am). Apparently the NY Attorney General only needs 2 more of "us victims" to come forward in order to proceed with action against them.

Lastly, use EVERY public resource available to you. There is another consumer website called [redacted].com which is getting a lot of media play here on the West Coast. (I know none of us want to become poster children for how we got "DUPED" here), but without bringing this SCAM out in the open, these CROOKS are going to continue to perpetrate FRAUD on desperate people who are also in our shoes. Go to your local TV Station Consumer Helpline, they love to expose this kind of stuff.

If anyone has any other tips on how to make these "people" squirm...I'm all ears!

P.S. If you do a SEARCH ON HERE for Daniel H. Fox, Nadia Jose, Mitigationllc... you will find a whole other GROUP of people with Complaints!

To Whom It May Concern:

My name is Sharon Rowe and have been desperately trying to contact your office with no success. Mr. Fox and Mr. Clarin I spoke with you both several times before providing you with a cashier check in the amount of $1700. I am sadden that you or the other mitigation attorney's have not contacted my frantic cry for help or in this case closure. Although I guess the closure is that you have the money and therefore there is no need to contact me. Know that if you practice law the way you return phone calls you will end up in the same position I'm in. Anyone with a “PULSE or CONSCIOUS” please contact me.

P.S. Nadia Jose I honestly believe you when you promised to stay in touch with me regarding my application.

i was charged $1, 600 for a loan modification and not only did they keep the money they never try to do anything about the loan.I tried asking for my money back but that still has not happened.

I paid Daniel Fox $1500 to have my mortgage modified over a year ago as of today I have had no satisfaction on this. I tried calling his office today & his phone is out of service.

First I had tried contacting my lender ASC (aka: Wells Fargo), but they "couldn't do anything for me". So I was forced to do a Loan Mod. I originally filed with The Loan Modification Group out of Melville, NY. They deal with Dan Fox/Mitigation LLC as the representing attorney. I started the Loan Mod process back in Oct of '08. The Sales Rep I dealt with, John F. Lamb suggested that I miss payments to "show hardship". So I missed two payments, which helped me get my bills in order. I find out later from Zammy Gonzales at Mitigation LLC that this is a No No. I should stay current with payments. OK, so getting back on track.

It's been now 10mos since I started the program. I paid something like $1895.00 for the services. It was a $1295 installment, then another $695. I had two mortgages because I'm self employed and could not qualify for a Jumbo Loan. I told them I would not send another dime until the one mortgage was finalized.

Well, as of today 7/24/09, I finally received the modification papers. I am pissed to say the least. I have read about people having rates in the 10% knocking down to 4% - 6%. My original mortgage was 7.625% variable. It had jumped to 8.25% and then dropped to 7.25%. The new papers state that the NEW rate would be 7.49% Fixed. I was like What The F@#$%?! That's pathetic to say the least.

I have reason to complain as well. You can't tell me that a whole .2% is a MODIFICATION! I've tried calling Dan Fox at Mitigation LLC and I keep hearing the same message over and over with no prompts to leave a message. I did call the Loan Modification Group in Melville and left a message. We shall see who contacts me first.

My next step will be to file a complaint with the Florida Bar Assoc as stated above as well as the NY State Atty General and file a complaint against The Loan Modification Group.

You should have signed up with ALMG (American Loan Modification Group) They helped me get my money backk from that scam artist D. Fox and gave me a forensic loan audit which i paid for and a free loan modification. They never once told me anything that was not true and told me to never miss a payment if i could not help it. Great people to work with. [protected] ask for jake

I am all for making these horrible people squirm! I was contacted back in 10/08 & the same thing has happened to me. First and foremost contact your Mortgage Co. yourself, there is no need to hire someone to do something you can do yourself (for free) I did and even though we haven't worked out the details yet, it looks favorable. Then contact your Attorney General's office in your state, they usually have a complaint form that you can fill out online. I filed one with AR., FL., & NY., then I contacted my congressman's office, I kept everything from these people, every email, every paper, everything. Copy it and send it to your Attorney General's office, your congressman's, the BBB, your local TV station, also your local newspaper. In my case the Attorney General's office contacted my mortgage company, so did my congressman's office. There are people out there that can help you, all you have to do is ask! To me I have more respect for a common thief, with them its nothing personal, but with this SOB its very personal. He knows how we are all struggling to keep our heads above water, he knows the blood, sweat, & tears that we have shed trying to save our homes. The worst is that he steals our hope, the one thing that everyone wants, is to provide a home for our loved ones, and he endangers that even more with his actions. My advice to any of you is don't depend on this man to help you, help yourself and your family by contacting your mortgage company and trying to work something out with them. If worst comes to worst you can always contact a lawyer and file a chapter 13, its not something that I would ever want to do, but in most cases that can save your home. All of us who are victims of Daniel Fox, Franklin First Financial/FHA All Day, Adam Jenson, The Loan Modification Group, or whatever they are calling themselves this week, we will have our justice. One way or another we will unite our voices and be heard, because these people are stealing our dreams and they cannot be allowed to continue.

I have been trying since 12/08 to have my loan modification completed. I also have been calling and leaving messages a few times a day every day for the last month. No one ever returns my calls and I never know who is working on my file. I asked to speak with Daniel Fox directly and he is never available, either out of the office or in meetings. i did receive a call from someone from another attorney's office which was contracted out from Daniel Fox, two days later I was told that he canceled the contract and asked for all files to be returned. Now when you call the office you are unable to leave a message and are told they will send out update letters within 14 days, this is because the loan companies are overwhelmed. I would just like to know if I wasted my money and need to chalk it up to a lesson learned. Never send any money out until you really research the people who say they are able to help you. I am now further behind in my mortgage payments than before I sent my $2000.00 into the loan modification group back in December, 2008. I believe now my next is to file a complaint against Daniel Fox and The Loan Modification Group. Anyone who can help as to how to file a complaint it would be greatly appreciated.

A little update... Daniel Fox and his partner Daniel Clarin squeaked by with the Mass Attorney General. The got off with a small fee. Apparently there was a loop hole because Mr. Fox's company did not take the funds up front the brokers who hire his firm did. So, he could not be held accountable. Google Daniel Fox AG there was a press release I believe dated April 28.

Also, I'd like to offer a little advise to those of you at risk of losing your home. Please contact your lender directly, do not avoid them! Most banks are willing to work with you and don't be afraid to push a little. A lot of lenders are offering different programs aside from modifications.

We purchased our loan modifications through Christian Penner of National City in West Palm Beach who sold us our home loans.We were given a 1 week evaluation and a money back guarantee.The 1 week guarantee got longer and longer and now 7 months later and our lenders have informed us that no modifications have been filed.The money was paid to Ashton Group Ltd and the applications shipped down to Dan Fox's office in Aventura.Dan Fox's office would not return our calls.Two weeks ago Ashton Group informed us that they agreed that there had been many complaints regarding Dan Fox's office and our case was shipped to an office in Vero Beach. Within a few days that office informed us that Dan Fox had requested our files back.And we have been promised day after day that Dan Fox would call us bit nothing.Christian Penner nor Ashton Group will answer our basic questions or concerns.I challenge Christian Penner, Ashton Group Ltd or Dan Fox's office to dispute these statements. We have complaints with the BBB and the Florida AG.

Does anyone have any information on what charges/complaints have been filed regarding Ashton Group and Dan Fox attorneys. I understand that the attorney generals office in Mass. is filing charges and are we allowed to join that litigation? Dan Fox attorneys office is a scam or they would return calls and work with you. Our lenders have told us there have been no applications filed on our behalf.

I have been waiting since 10/08 and I cannot get any assistance from Dan Fox and his office in Aventura.
We filed through the Ashton Group and they made a lot of promises and made a lot of assurances but they cannot get in touch with Dan Fox either. Do not pay this company as they will take your money and give you money back guarantees but will not follow through.

Speaking as a victim of Daniel H. Fox, Franklin First Financial/FHA All Day (in addition to the legal assitants, and Adam Jenson). Don't give up hope! But give up hope that anyone at that office is going to help you! First and foremost you need to contact your mortgage company. You need to explain everything that has happened, provide them with proof if you have it, see if you qualify for a repayment program, or if you qualify for a loan modification. Contact the HOPE hotline and speak with a foreclosure specialist (its a non-profit organization), they can help you, in addition to making a recommendation to your mortgage company. You need to see if you can refinance your home, in my case I live in a mobile home and it is almost impossible to refinance. President Obama also has instituted a foreclosure bailout, you need to see if you qualify for any of these. Go online and type in Foreclosure refinance, Foreclosure help, Save my home from foreclosure. Whatever it takes! Do whatever you have too to keep your home, but you need to contact your mortgage company and see if they will work with you. Do another online search to see if there are any local organizations that can help you. Don't give up hope, the fat lady hasn't sung yet, but she is starting to hum! Then you need to contact your attorney generals office for your state, they should have an online complaint form that you can fill out. In addition contact your local congressman, explain the situation to them. That you were a victim of a loan modification scam, detail everything in writing and send it to them. They cannot help you until you contact your mortgage company, sometimes they can make suggestions and recommendations to your mortgage co. Contact your bank and let them know that you were a victim of fraud and see about getting your money back. I don't see how these people sleep at night. In my case I am disabled and care for a disabled mother, in addition to have 2 young children. I was always late on my mortgage, but I always paid it until they told me to not make the payments and that to refer all communications to Mr. Fox's office. Now I am $8150.00 in back payments, interest, & late fees! My foreclosure is due June 23., but I am gonna go down fighting! Just do everything in your power to work this out with your mortgage co., let them know that you want to keep your home. They don't want your home the already have more foreclosures then they know what to do. Be willing to work with them!, BUT DON'T I REPEAT DON'T RELY ON DANIEL FOX OR ANYONE FROM HIS OFFICE TO HELP YOU!

I have been waiting since 11/08 and I have been waiting and now my property is in foreclosure and due to be sold on 6/2009 . I call every day and now no one is answering there phone. Mr. Fox use to call me back and email me if I had a question now nothing. I feel so depressed, I cannot sleep and have anxiety attachs. I have 2 little girls and a wife and acted in good faith trying to work with the banks and my attorney in getting my loan modified and do not know why someone would mess with someones family and home just to gain a buck. How is someone able to keep doing business and sleep good at night treating people this way. I felt that Mr. Fox was doing a great service in helping people to keep there homes. And I am still praying and hoping that my home will be saved. Mr. Fox and Jackie Sommers if you are reading this please help us out here, we are not trying to hurt anyone just trying to keep a roof over our families heads . If anyone hears or knows anything in extra to help us out here please advise. God bless you all and I hope it works out for the best for all of us. I still am holding out for hope that someone over at his office cares about human beings.

I have been waiting to get my loan modified since 11/08 and I am still waiting, I do not know what to do . I have given these people my money and trust and now no one answers the phone when I call or email them. Is there anything else we can do to save our homes and get in touch with these people. My house is due to be foreclosed in june and i am having sleepless nights and hyperventilation. No one calls. Mr. Fox will not even answer his phone if anyone knows anything could you please post any information I believe we are all getting desperate and just want to know if we have truly been scamed or what .

Well, in my case it's been 5 months. And still no answer from my attorney (Daniel H. Fox). All I'm hearing is: we're working on your case (but it always a different person in charge of my file) They tell me they'll get back to me with news in a couple of weeks... (and that's after 10 of my calls a day) but no one ever calls back. Meantime I just found out that my foreclosure process was completed and I lost my house...Bank said, they never received my updated paperwork that I've sent to my "lawyer". And still no call? I called his office 16 times today and left couple of messages and still nothing. My credit is ruined, I'm losing my house and I paid money for it. (Shame on me)

Dear Mr. Fox, have you heard saying: "what goes around comes around"?

I know Florida can be slow at times, but at least Boston Attorney General is doing something to protect people from scammers like Daniel H. Fox. (See link bellow)

I have been trying to get a loan modification since 11/08, these people have my money, and now I cannot get ahold of anyone. I called the numbers for Franklin First Financial/FHA All Day and nothing, I learned from the branch in New York that the Boca Raton branch has been shut down, no one seems to be able to help me. I am not a well woman, in addition to caring for a disabled mother, I didn't have $1500 to spare and now my mortgage co. is saying that I owe them over $8, 000 in back payments and interest. CAN SOMEONE PLEASE HELP ME! I don't know what to do, I can't loose my house! I tried to contact Mr. Fox's office but was told there was no one there that could help me!

This is great to hear. Coming from someone that can not get though to these people as my house is about to be taken from me. I have been waiting for a return call after leaving a few messages for my case worker and have heard nothing yet. I can only pray that they pull through for me in the next few days as well. I am super nervous right now.
