The complaint has been investigated and resolved to the customer’s satisfaction.

We receive several calls per week from this company. There's never a person on the other end - just a recording stating "Please call [protected] about a personal business matter. Operators are available until 9pm Eastern time to assist you." I'm sure that they are looking for someone else, maybe someone that used to have our phone number, or just someone that just randomly made up a number that just happened to be ours (Jeff and Gwendolyn, I'm talking to you!) We've received calls from banks, etc. before, and as soon as we could talk to a real person and explain who we are and how long we've had this number, they've stopped calling. I've called the 800 number for CMS - the only options they give is to leave a voicemail, which I did. I spelled out my name and number and the fact that I do not have an account with them and I have not received any letter and that I'm NOT who they're looking for. But, they keep calling.

[protected] This number is CONTINUOUSLY calling my 14 year old son's brand new cell phone NONSTOP looking for someone that clearly is NOT at the number they are calling.

I have since started answering my son's cell phone when they call, and the last few calls came in at the MIDDLE of the NIGHT at 1 AM, 3 AM and 5AM. Each and every time, they keep asking for someone we do NOT know. There is NO one named "Glen" at this number. That's NOT my name, it's NOT my son's name, it's NOT my younger son's name and it's NOT my wife's name.

Note directly to Capital Management:

* We do NOT owe you anything.
* We are NOT who you are looking for.
* My son JUST got this new cell number a few months ago.
* Continuously calling his number is considered harassment.
* Calling at the hours you are calling violates a Federal Law.

It also seems that you've already been sued in the past.
Case in point: CASE NUMBER: 3:09−CV−03465−MLC−DEA
If you continue to harass my MINOR child, I WILL sue you as well.

I have already told them over 8 times now, as well as taking my personal time to contact them directly by calling THEIR number and leaving a message informing them that they have the WRONG NUMBER and if they continue to call, I WILL be contacting the BBB, the FCC, Sprint/Nextel and our local Police Department, as well as the District Attorney's Office both here and in New York.

Well, they are STILL calling. Guess it's time to step up the legal actions against them.

I know that some of these are old post but if anybody reads this I just want you to know a few things. I am a professional that has worked in the finance field for quite awhile. What this company is doing is illegal on several accounts. And the regulations they are violating are federal offenses. You should not have to hire your own attorney; just call the Federal Trade Commision (FTC) and file and formal complaint. The company and the individual caller and be prosecuted as well as they should be. The specific act they are violating is called the Fair Debt Collection Practices Act (FDCPA). No one should be treated without respect and the company I work for would fire an employee immediately for any of these offenses.

We have researched the company mentioned by Desertech, Inc. in their posting regarding [protected]. The information they posted is for the wrong company. They clearly did not perform their research correctly or thoroughly and have potentially exposed themselves to legal action. The correct company for this number is Credit Management Services, headquartered in Rohnert Park, CA with numerous offices around the country. Perhaps we should all start returning harassing calls back to them? Perhaps they will get the idea. They have been asked not to call our business and they won't stop.
