About September 17, 2013 I phoned a roofer to get a quote and got his answering machine, so I left a message. He called me on September 21, 2013 and arranged to come by that afternoon.
This was the third contractor I had called and received a quote from. Based on what he said and what his price was, I believed I had found the right contractor and agreed that he could go ahead with re-roofing my house. (Of the three quotes I received, this guy came in second highest).
We agreed that he would do the re-shingling the following week or the week thereafter latest. We shook hands and I left it at that.
During the week of September 22, 2013; it rained a couple of days, so I assumed that he would be delayed a bit.
On October 4, 2013; the shingles were delivered and placed on the roof of my house. I thought, oh great, he’ll be here next week to do the job.
By October 13, 2013; he had still not showed up, so on October 16, 2013 I called him to see when he would do the roof. No response from him.
I phoned again on October 24, 2013; leaving a message. Again no response from him.
I phoned a third time on October 30, 2013 and left a message. Once more no response from him.
Today is November 3, 2013; it has now snowed and the bundles of shingles are sitting on my roof. My concern is that the bundles of shingles are sitting around the vents and will act as a snow fence trapping snow which could result in excess weight on the roof and the blockage of the vents.
I will try calling him again on November 4, 2013.
In my opinion, it is too late in the season to do the shingles and I would like to see them removed from my roof. Additionally, I no longer feel any confidence in this roofer and would like him to remove the shingles and go away. I don’t care to do business with this fellow because he did not fulfill his contractual obligations as agreed to by him and me.
I am of the opinion now; that he knew that he would not be able to get the job done this year (deceived me) and by having the shingles delivered, had me on the hook (captive) to do the job next year (which is not what I wanted).
I would like to get these shingles removed and for him to go away.
I have not paid him anything as the agreement was payment in full after the job was done.
What are my rights? How can I get him to remove the shingles and end this contract? Do I have any rights? Can I be held liable for anything if I tell him to take his shingles and to go away? Any other advice?
