Computer battery / Faulty merchandise

I purchased a battery for my Compact Presario Laptop in Sept. 2008. It would not charge at all.
I contacted the company they instructed me to return the battery at my expense and they sent a second one on September 22nd.
On about 20th December I contacted the company again and after repeated phone calls and email was informed that the 3 month warranty period had expired and TOUGH LUCK! I would just have to purchase a new battery!!!
Is this fair or even legal?

Impact Computers, as resellers, offers resolutions for consumers by offering their own 90 day warranty to the customer and making the policies know and very clear on the website and on the invoice.
The initial battery was faulty and Impact Computers abided by their policies by sending out the appropriate battery. If the 90 day warranty is up, then the customer can contact the manufacturer to see if they offer an additional warranty or purchase a new battery.
